This article considers whether, in the context of armed conflicts, certain non-refoulement obligations of non-belligerent States can be derived from the 1949 Geneva Conventions. According to Common Article 1 (CA1) thereof, all High Contracting Parties (HCPs) undertake to ‘respect and to ensure respect’ for the four conventions ‘in all circumstances’. It is contended that CA1 applies both in international armed conflicts (IACs) and in non-international armed conflicts (NIACs). In turn, it is suggested that Common Article 3 (CA3) which regulates conduct in NIACs serves as a ‘minimum yardstick’ also applicable in IACs. It is widely (though not uniformly) acknowledged that the undertaking to ‘ensure respect’ in a given armed conflict extends to HCPs that are not parties to it; nevertheless, the precise scope of this undertaking is subject to scholarly debate. This article concerns situations where, in the course of an (international or non-international) armed conflict, persons ’taking no active part in hostilities’ flee from States where violations of CA3 are (likely to be) occurring to a non-belligerent State. Based on the undertaking in CA1, the central claim of this article is that, as long as risk of exposure to these violations persists, persons should not be refouled notwithstanding possible assessment of whether they qualify as refugees based on the 1951 Refugee Convention definition, or could be eligible for complementary or subsidiary forms of protection that are regulated in regional arrangements. The analysis does not affect the explicit protection from refoulement that the Fourth Geneva Convention accords to ‘protected persons’ (as defined in Article 4 thereof). It is submitted that CA1 should be read in tandem with other obligations of non-belligerent States under the 1949 Geneva Conventions. Most pertinently, all HCPs are required to take specific measures to repress ‘grave breaches’ and to take measures necessary for the suppression of all acts contrary to the 1949 Geneva Conventions other than the grave breaches. A HCP that is capable of protecting displaced persons from exposure to risks of violations of CA3 and nonetheless refoules them to face such risks is arguably failing to take lawful measures at its disposal in order to suppress acts contrary to the conventions and, consequently, fails to ‘ensure respect’ for the conventions. Purpose This paper examines how multinational enterprises (MNEs) and local partners, including suppliers, customers, and competitors in China, improve their innovation capabilities through collaboration. We analyse this collaboration as a three-way interaction between the ownership-specific (O) advantages or firm-specific assets (FSAs) of the MNE subsidiary, the FSAs of the local partner, and the location-specific assets of the host location. Design/methodology/approach Our propositions are examined through a survey of 320 firms, supplemented with 30 in-depth case studies, based in mainland China. Findings We find that the recombination of asset-type (Oa) FSAs and transaction-type (Ot) FSAs from both partners leads to new innovation-related ownership advantages, or ‘recombinant advantages’. Ot FSAs, in the form of access to local suppliers, customers or government networks are particularly important for reducing the liability of foreignness for MNEs. Originality/value The study reveals important patterns of reciprocal transfer, sharing, and integration for different asset categories (tacit, codified) and different forms of FSA and explicitly links these to different innovation performance outcomes. The paper reports on these findings, making an empirical contribution in an important context (China-based partnerships). We also contribute to conceptual developments, connecting various kinds of FSA, tacit and codifiable assets and ‘recombinant advantages’. Limited conceptual, methodological, and empirical contributions are made in linking asset integration with (measurable) innovation performance outcomes in international partnerships.

We examine the internal equity financing of the multinational subsidiary which retains and reinvests its own earnings. Internal equity financing is a type of firm-specific advantage (FSA) along with other traditional FSAs in innovation, research and development, brands and management skills. It also reflects subsidiary-level financial management decision-making. Here we test the contributions of internal equity financing and subsidiary-level financial management decision-making to subsidiary performance, using original survey data from British multinational subsidiaries in six emerging countries in the South East Asia region. Our first finding is that internal equity financing acts as an FSA to improve subsidiary performance. Our second finding is that over 90% of financing sources (including capital investment by the parent firms) in the British subsidiaries come from internal funding. Our third finding is that subsidiary-level financial management decision-making has a statistically significant positive impact on subsidiary performance. Our findings advance the theoretical, empirical and managerial analysis of subsidiary performance in emerging economies.

Purpose – The purpose of this paper is to demonstrate how strategy is developed and implemented within a subsidiary of a global organization, the relationship between subsidiary and headquarters and the need for continuous change and adaption to remain relevant. Furthermore, this case study describes a successful process of invention and adoption. Design/methodology/approach – The paper draws on documentary evidence and a semistructured interview with Jill McDonald CEO and President of McDonald’s Northern Europe Division with responsibility for the UK, Sweden, Finland, Denmark, Norway and the Republic of Ireland. Management research rarely captures the views of the top executive, yet the top executives have a broad picture and are key strategic decision makers. Findings – The case study and interview offers a unique insight into factors contributing to McDonald’s unprecedented success (it has paid an increased dividend for the past 37 years). It also sheds light on its successful internationalization strategy. Originality/value – The case study draws on published material and augments this with an in-depth interview with the Chief Executive. Very few case studies offer insight into the thinking of a Chief Executive managing a subsidiary of a global organization. Its value lies in the lessons that managers and students of management can draw on the approach adopted by a highly successful global organization.

This article explores the precarious status of Eritrean and Sudanese nationals in Israel. Having crossed the Israeli-Egyptian border without authorisation and not through an official border crossing, Israeli law defines such individuals as ‘infiltrators’, a charged term which dates back to border-crossings into Israel by Palestinian Fedayeen in the 1950s. Eritreans and Sudanese nationals constitute over 90 percent of ‘infiltrators’ in Israel. Their livelihood is curtailed through hostility, sanctions, and detention, while (at the time of writing) Israel refrains from deporting them to their respective countries of origin, recognising that such forced removal could expose them to risks to their lives and/or freedom. Israel was the 10th state to ratify the 1951 Refugee Convention, and has acceded to its 1967 Protocol which removed the 1951 Convention’s temporal and geographic restrictions, yet it has not incorporated these treaties into its domestic law not has it enacted primary legislation that sets eligibility criteria for ‘refugee’ status and regulates the treatment of asylum-seekers. Israeli law also fails to accord subsidiary protection status to persons that the state considers to be non-removable, whether or not they satisfy the definition of a ‘refugee’ under the 1951 Convention. Absent legal recognition of ‘refugee’, ‘asylum-seeker’, and ‘beneficiary of subsidiary protection’ statuses, Eritreans and Sudanese nationals are left in legal limbo for an indefinite period qua irregular non-removable persons. This article takes stock of their legal predicament.

Purpose – The purpose of this paper is to examine the determinants of home-region strategy of the multinational subsidiary and the impact of such a strategy on its performance. The author draws upon new internalization theory to develop a theory-driven model and empirically tests the simultaneous relationships between home-region strategy and performance of the subsidiary. Design/methodology/approach – The author tests the model using a simultaneous equation statistical technique on an original, new data set of publicly listed multinational subsidiaries operating in the ASEAN region, with parent firms’ headquarters across the broad triad. Findings – There are three significant findings. The first finding is that subsidiary-level downstream knowledge (marketing advantages), and the geographic location of the subsidiary in the same home region as of the parent firm are key antecedents of a subsidiary’s home-region strategy. The second finding is that a subsidiary’s profitability reduces home-region orientation; however, home-region strategy has an insignificant effect on performance. The third finding is that these subsidiaries generate on average 92 per cent of their total sales in the home region (the Asia Pacific). Originality/value – The author advances the existing literature on the regional nature of parent-level multinational enterprises by demonstrating that their quasi-autonomous subsidiaries also operate mainly on a home-region basis.

Large-scale planetary waves are diagnosed from an analysis of profiles retrieved from the Thermal Emission Spectrometer aboard the Mars Global Surveyor spacecraft during its scientific mapping phase. The analysis is conducted by assimilating thermal profiles and total dust opacity retrievals into a Mars global circulation model. Transient waves are largest throughout the northern hemisphere autumn, winter and spring period and almost absent during the summer. The southern hemisphere exhibits generally weaker transient wave behaviour. A striking feature of the low-altitude transient waves in the analysis is that they show a broad subsidiary minimum in amplitude centred on the winter solstice, a period when the thermal contrast between the summer hemisphere and the winter pole is strongest and baroclinic wave activity might be expected to be strong. This behaviour, here called the ‘solsticial pause,’ is present in every year of the analysis. This strong pause is under-represented in many independent model experiments, which tend to produce relatively uniform baroclinic wave activity throughout the winter. This paper documents and diagnoses the transient wave solsticial pause found in the analysis; a companion paper investigates the origin of the phenomenon in a series of model experiments.

This paper explores the concept of a reverse diffusion of knowledge, that is, the transfer flowing from a company’s subsidiary to its home plant. The article presents the empirical evidence gathered in General Motors UK and Poland, where the reverse diffusion of a concept of the built-in quality took place. Lastly, the implications of our findings for future research are discussed.

The search for innovation has become an important motivation for the internationalization of companies in emerging countries. In that context, this study tests the impact that a nation’s development has on whether subsidiaries transfer innovation of products or that of processes. Survey data collected from 73 subsidiaries of Brazilian companies indicate that companies located in developed markets tend to transfer more product-oriented innovations than do those based in emerging countries. Furthermore, the size and age of a subsidiary has an impact on the transfer process. The larger and younger the subsidiary, the more likely a company is to favor the flow of product innovation into its headquarters. The level of national development was not identified as an influence on the flow of process innovation.

Our aim was to compare the osteogenic potential of mononuclear cells harvested from the iliac crest combined with bovine bone mineral (BBM) (experimental group) with that of autogenous cancellous bone alone (control group). We studied bilateral augmentations of the sinus floor in 6 adult sheep. BBM and mononuclear cells (MNC) were mixed and placed into one side and autogenous bone in the other side. Animals were killed after 8 and 16 weeks. Sites of augmentation were analysed radiographically and histologically. The mean (SD) augmentation volume was 3.0 (1.0) cm(3) and 2.7 (0.3) cm(3) after 8 and 16 weeks in the test group, and 2.8 (0.3) cm(3) (8 weeks) and 2.8 (1.2) cm(3) (16 weeks) in the control group, respectively. After 8 weeks, histomorphometric analysis showed 24 (3)% BBM, and 19 (11)% of newly formed bone in the test group. The control group had 20 (13%) of newly formed bone. Specimens after 16 weeks showed 29 (12%) of newly formed bone and 19 (3%) BBM in the test group. The amount of newly formed bone in the control group was 16 (6%). The results show that mononuclear cells, including mesenchymal stem cells, in combination with BBM as the biomaterial, have the potential to form bone. Phytase (myo-inositol hexaphosphate phosphohydrolase) and phytic acid (myo-inositol hexaphosphate) play an important environmental role, in addition to being a health issue in food industry. Phytic acid is antinutritional due to its ability to chelate metal ions and may also react with proteins decreasing their bioavailability. In this work, we produced biosensors with phytase immobilized in Layer-by-Layer (LbL) films, which could detect phytic acid with a detection limit of 0.19 mmol L-1, which is sufficient to detect phytic acid in seeds of grains and vegetables. The biosensosrs consisted of LbL films containing up to eight bilayers of phytase alternated with poly(allylamine) hydrochloride (PAH) deposited onto an indium-tin oxide (ITO) substrate modified with Prussian Blue. Amperometric detection was conducted in an acetate buffer solution (at pH 5.5) at room temperature, with the biosensor response attributed to the formation of phosphate ions. In subsidiary experiments with the currents measured at 0.0 V (vs. SCE), we demonstrated the absence of effects from some interferents, pointing to a good selectivity of the biosensor. As técnicas que formam o campo da Descoberta de Conhecimento em Bases de Dados (DCBD) surgiram devido à necessidade de se tratar grandes volumes de dados. O processo completo de DCBD envolve um elevado grau de subjetividade e de trabalho não totalmente automatizado. Podemos dizer que a fase mais automatizada é a de Mineração de Dados (MD). Uma importante técnica para extração de conhecimentosa partir de dados é a Programação Lógica Indutiva (PLI), que se aplica a tarefas de classificação, induzindo conhecimento na forma da lógica de primeira ordem. A PLI tem demonstrado as vantagens de seu aparato de aprendizado em relação a outras abordagens, como por exemplo, aquelas baseadas em aprendizado proposicional Os seus algorítmos de aprendizado apresentam alta expressividade, porém sofrem com a grande complexidade de seus processos, principalmente o teste de corbertura das variáveis. Por outro lado, as Redes Neurais Artificiais (RNs) introduzem um ótimo desempenho devido à sua natureza paralela. às RNs é que geralmente são "caixas pretas", o que torna difícil a obtenção de um interpretação razoável da estrutura geral da rede na forma de construções lógicas de fácil compreensão Várias abordagens híbridas simbólico-conexionistas (por exemplo, o MNC MAC 890 , KBANN SHA 94 , TOW 94 e o sistema INSS OSO 98 têm sido apresentadas para lidar com este problema, permitindo o aprendizado de conhecimento simbólico através d euma RN. Entretanto, estas abordagens ainda lidam com representações atributo-valor. Neste trabalho é apresentado um modelo que combina a expressividade obtida pela PLI com o desempenho de uma rede neural: A FOLONET (First Order Neural Network).

Esta tese apresenta contribuições ao processo de Descoberta de Conhecimento em Bases de Dados (DCBD). DCBD pode ser entendido como um conjunto de técnicas automatizadas – ou semi-automatizadas – otimizadas para extrair conhecimento a partir de grandes bases de dados. Assim, o já, de longa data, praticado processo de descoberta de conhecimento passa a contar com aprimoramentos que o tornam mais fácil de ser realizado. A partir dessa visão, bem conhecidos algoritmos de Estatística e de Aprendizado de Máquina passam a funcionar com desempenho aceitável sobre bases de dados cada vez maiores. Da mesma forma, tarefas como coleta, limpeza e transformação de dados e seleção de atributos, parâmetros e modelos recebem um suporte que facilita cada vez mais a sua execução. A contribuição principal desta tese consiste na aplicação dessa visão para a otimização da descoberta de conhecimento a partir de dados não-classificados. Adicionalmente, são apresentadas algumas contribuições sobre o Modelo Neural Combinatório (MNC), um sistema híbrido neurossimbólico para classificação que elegemos como foco de trabalho. Quanto à principal contribuição, percebeu-se que a descoberta de conhecimento a partir de dados não-classificados, em geral, é dividida em dois subprocessos: identificação de agrupamentos (aprendizado não-supervisionado) seguida de classificação (aprendizado supervisionado). Esses subprocessos correspondem às tarefas de rotulagem dos itens de dados e obtenção das correlações entre os atributos da entrada e os rótulos. Não encontramos outra razão para que haja essa separação que as limitações inerentes aos algoritmos específicos. Uma dessas limitações, por exemplo, é a necessidade de iteração de muitos deles buscando a convergência para um determinado modelo. Isto obriga a que o algoritmo realize várias leituras da base de dados, o que, para Mineração de Dados, é proibitivo. A partir dos avanços em DCBD, particularmente com o desenvolvimento de algoritmos de aprendizado que realizam sua tarefa em apenas uma leitura dos dados, fica evidente a possibilidade de se reduzir o número de acessos na realização do processo completo. Nossa contribuição, nesse caso, se materializa na proposta de uma estrutura de trabalho para integração dos dois paradigmas e a implementação de um protótipo dessa estrutura utilizando-se os algoritmos de aprendizado ART1, para identificação de agrupamentos, e MNC, para a tarefa de classificação. É também apresentada uma aplicação no mapeamento de áreas homogêneas de plantio de trigo no Brasil, de 1975 a 1999. Com relação às contribuições sobre o MNC são apresentados: (a) uma variante do algoritmo de treinamento que permite uma redução significativa do tamanho do modelo após o aprendizado; (b) um estudo sobre a redução da complexidade do modelo com o uso de máquinas de comitê; (c) uma técnica, usando o método do envoltório, para poda controlada do modelo final e (d) uma abordagem para tratamento de inconsistências e perda de conhecimento que podem ocorrer na construção do modelo.

Is the capital structure choice of a foreign subsidiary different from the choice of a comparable company controlled by nationals? If so, what are the differences? In this paper we shed some light on these questions by looking at a sample of foreign subsidiaries in Brazil over the period 1985 to 1994. We find that the foreign subsidiaries in our sample are more levered than their Brazilian counterparts. This difference, however, has declined over time. The evidence is consistent with the hypothesis that foreign subsidiaries increase leverage as a hedge against an expropriation of assets in a nationalization process.

O presente trabalho tem por objetivo conhecer as práticas socio-ambientais no setor de mineração do Peru. Setor que esta dominada pela presença de empresas transnacionais que se encontram com duas realidades de regulamentação de meio ambientais muito discordantes, a primeira, as normas corporativas onde se encontra a matriz e, a segunda, a regulamentação do país onde esta a subsidiaria, neste caso o Peru. Com a internacionalização do tema socio-ambiental, se dá a devida importância ao tema da Responsabilidade Social Corporativa, já que as empresas transnacionais estão pressionadas a manter uma boa imagem internacional, que pode ser vulnerável a criticas negativas em relação à heterogeneidade, já que suas praticas socio-ambientais têm que ser as mesmas em qualquer parte do mundo. Na presente dissertação se enfatiza as praticas socio-ambientais das empresas com relação às comunidades circundantes, sendo um tema pouco difundido na mineração peruana. As desconformidades das comunidades frente aos projetos de mineração constituem o maior problema social atual, gerando a paralisação das atividades nesse setor. O Peru não tem Ministério do Meio Ambiente, embora exista um Conselho Nacional do Meio Ambiente (CONAM) que é um organismo público descentralizado e, esta aderido ao âmbito da Presidência do Conselho de Ministros. Nesta investigação se analisa a função do Ministério de Energia e Minas do Peru, já que ele é um ente que incentiva a promoção de investimento privada no setor de energia e minas e, por outro lado, mediante a Direção Geral de Assuntos Ambientais do Ministério de Energia e Minas aplica a guia de gestão ambiental emitidas pelo CONAM. Finalmente, no estudo de caso, são analisadas duas empresas transnacionais maiores do setor de mineração peruano, aplicando entrevistas e um questionário com perguntas abertas para poder conhecer suas praticas socio-ambientais. Desenvolve-se uma análise dos resultados obtidos no estudo de caso, utilizando o referencial teórico para situar a realidade peruana, numa realidade internacional. Pelos dados obtidos, podemos interpretar que as empresas estudadas não se encaixam totalmente nos parâmetros internacionais do auto-regulamentação. Observamos a falta de políticas públicas sócio-ambiental, é por esse motivo, a conclusão desta investigação propõe a criação e aplicação de políticas públicas a dois problemas socio-ambientais, o primeiro, a geração de emprego indireto e a segunda, a recuperação dos passivos ambientais.
