El artículo describe y compara las estrategias de seguridad nacional de Estados Unidos de las administraciones de Bill Clinton y George Bush. Trata de clarificar la forma en que se concibe el espacio nacional estadounidense, mundial y global dentro de estas estrategias.

El artículo estudia el impacto que la aplicación del Plan Colombia tendrá sobre el Ecuador. Se lo define como el riesgo a la seguridad más importante que tiene el país en el presente y se llama la atención respecto a la necesidad de forjar una posición nacional común que involucre a todos los sectores del país. Esta posición debería colaborar para contener un derrame del conflicto militar al resto de la subregión, garantizar los derechos fundamentales y el bienestar de las poblaciones de frontera, controlar el impacto ecológico del Plan Colombia, y lograr una revisión del Acuerdo de Manta con EE. UU. de modo que se evite la utilización de territorio ecuatoriano para operaciones militares directas en la guerra que se libra en Colombia.

El presente artículo aborda el impacto de la transformación tecnológica y los nuevos instrumentos de la teleinformática en los medios de comunicación masiva. La forma como se han estructurado las transnacionales mediáticas a partir del uso de instrumentos como la web, el software o el podcasting y los riesgos que su exceso conlleva respecto de la democracia al imponer sus intereses económicos y culturales por encima del interés del individuo, el interés público, la intimidad y el honor. Todo lo cual plantea nuevos desafíos al derecho y la protección de los derechos del individuo.

O presente trabalho sopesa a justiciabilidade dos direitos sociais no Sistema Interamericano. Para que tal análise pudesse ser realizada, em primeiro lugar, foi necessária a compreensão do que sejam direitos sociais (principalmente direito à saúde) e como derivam dos direitos fundamentais. Essa foi a melhor maneira de introduzir o tema para que houvesse real compreensão do motivo pelo qual seria complicada a existência de decisões que se referissem à violação de direitos sociais. O trabalho se desenvolve de forma a apresentar o Sistema Interamericano, suas formas de buscar proteger os direitos sociais e também de garantir sua manutenção. Por fim, o trabalho ainda apresenta conceitos como reserva do possível, soberania nacional e teoria do custo dos direitos como sendo obstáculos para a existência de decisões que privilegiam os direitos sociais. A conclusão da presente pesquisa, ainda não que fechada por conta de seu dinamismo, constatou que os obstáculos apresentados pela maioria da doutrina, em verdade, não serviriam de motivo para a não observância dos direitos sociais nas fundamentações das decisões do Sistema Interamericano, restando somente a possibilidade de um não desejo de intromissão em política pública interna.

O enfoque do presente Trabalho de Conclusão de Curso repousa sobre tendência de flexibilização da Imunidade de Jurisdição Estatal em casos de graves violações a Direitos Humanos, tendo em vista o teor das decisões de cortes nacionais e internacionais. A problemática reside no fato de que, em algumas situações, a Imunidade de Jurisdição Estatal, norma utilizada para preservação da soberania estatal, contrapõe-se a direitos fundamentais do cidadão, sujeito de Direito Internacional Público. Nesse sentido, o presente trabalho traz à baila a discussão sobre a tendência de flexibilização dessas normas consoante a observância de normas imperativas relativas à proteção de graves violações de Direitos Humanos. A hipótese do presente trabalho consiste em averiguar a tendência de flexibilização da Imunidade de Jurisdição Estatal quando contraposta a graves violações de Direitos Humanos. Observar-se-á, para tanto, o comportamento das cortes nacionais e internacionais, amparados pelos ensinamentos jurídico-doutrinários a respeito da normatização dos direitos em conflito. O intuito dessa explanação consiste não só em um (i) argumento de hierarquia, o qual enseja o questionamento da supremacia jurídica das normas de jus cogens sobre as demais, não se limitando ao Direito dos Tratados, mas também a (ii) no argumento de que a própria imunidade de jurisdição que nasceu de um costume internacional, i.e., prática reiterada uniforme e constante, pode estar-se diante de nova tendência de flexibilização da norma porquanto o surgimento de novo costume internacional, qual seja, a proteção legítima de graves violações de Direitos Humanos.

Some protected special spaces on behalf of fundamental rights to the environment and the housing at the city of Natal are fragile by facing actions and attempts to suppress and changing (or omission in the implementation) of standards in furtherance of those rights at the local level, which seems to reflect a situation that goes beyond the context of the city. Based on integrated approach of the housing rights and the environment and its protection of special spaces on the field of fundamental rights, the thesis seeks to understand the weaknesses that affect the legal state duty under the realization/implementation of fundamental rights to the environment and housing in cities, focusing on the issues of flexibility of the founding legislation of special spaces to the detriment of the attributes they protected and the lack of implementation of the legal system that allows their effectiveness. So, it looks initially to understand the environment and housing rights and their special protected areas in the brazilian legal system, looking forward the evolution of its legal protection, as well as the weaknesses that emerge in the field of their effectiveness. Analyzing the trajectory of the environment and housing rights and their special protected areas in Natal, considering its standards, attributes, protection indicators, weaknesses and negative evidence within its legal protections and their enforcement by state entity, this thesis proposes to verify the existence of forms to confronting the weaknesses founded in the maintenance of legal protection and its implementation. At this point it discusses the legal basis and safeguard instruments of protection, especially within the juridical field, as part of a (re)discussion about issues of legislative and administrative discretion in the face of objective legal state duty to realization/implementation of fundamental rights in the urban space. With all these issues together the thesis does not ignore the scenario where the dividing line between public and private (economic) are becoming ever more tenuous in the field of state action and where the city stands as a special commodity to the reproduction of real estate, according to the interests of capitalist logic

This work presents a reflection on possibilities and boundaries of consolidation and expansion of human settlements characterized as traditional communities that are located within protected areas, using as study reference the State Sustainable Development Reserve Ponta do Tubarão, at Rio Grande do Norte state. The main topics highlight the conflict between the right to housing and the prevalence of fundamental rights of traditional populations, opposed to the diffuse right to environment, according to the regulatory framework of the Brazilian Urban and Environmental Policies. At the same time that these settlements, historically built, are substantiated by the principles of recognition of rights to traditional populations, they are in a condition of complexity to the resolution of conflicts in its urban dimension and lead to an impairment of natural sites. This work questions how the instruments of land use and occupation are defined and relate to environmental planning, especially considering that the settlements are located in Permanent Preservation Areas (APP). It aims to further the discussion of the urban dimension in settlements, characterizing its formation and growth process, to identify the gaps and convergences between the Urban and Environmental Policy, under the foundations of a socio-environmental approach. The results spotlights the conflicts between occupation and natural areas, inferring that the definition of Urban Policies instruments and its integration with Environmental Policies instruments account for essential and priority actions to the achievement to the rights to a sustainable city, as determined in the Cities Statute and environmental protection goals, defined for the Conservation Units

The state s evolution, after its liberal and the social stages, arrives at the post-social state, also regarded as regulatory state, which, in order to accomplish the state s aims, employs indirect interventions in the economy. The new model of administration adapts principles and concepts form the private sector such as the quest for efficience and tangible results, also striving for the decentralization of state s power to improve effectiveness before the new paradigm of handling of affairs of public interest. Present state derives its legitimacy from the efficiency principle, the legitimacy of the public administration cannot be limited to an analysis of legality, but the fulfillment of the ends envisaged by the public authority on its policies. These public policies have the objective of satisfying fundamental rights of the citizens. The access to public policies set by states as a way of enjoyment of the aforementioned rights constitute a legal and demandable path of development. The creation of public policies and the access to them must abide to the efficiency principle. This access must be taken unther the principles of legal and material equality, inasmuch as the liberty and real liberty. The access must also be observed as a matter of limited resources to grant, in reality, the access and enjoyment of these rights. The demandable nature of the access to public policies binds the public authority into broadening the range of these policies to every one who needs them. Thus, in this spectrum, the role of the Regulatory State, as the legal instruments for access of public policies as a legal path to development, is analyzed in the present work

This dissertation aims to address the limits and possibilities of realizing the fundamental right to reasonable time of the Brazilian legal system process. From this perspective, we analyze a reasonable time concept for the process, consistent with the civil homeland process; the relationship between efficiency, effectiveness, legal security and reasonable time of adjudication; a formal recognition of the fundamental right to reasonable time of the procedure in the Constitution of 1988; and the immediate applicability of this fundamental right. As indicated, the crisis of the Judiciary and procedural delay are problems directly related to the limits and possibilities of realization of the fundamental right under study. Moreover, we also present some mechanisms that can be used to overcome these problems. The subject was developed based on constitutional interpretation of fundamental rights, an approach that will always have this concern to be based on a methodology which includes the normative and empirical-dogmatic fields, realizing the fundamental right to reasonable time of the process. We adopted as methodological approach the study of this issue in judicial aspect, more specifically in the field of civil procedure. Finally, we weave through a critical and analytical view, our conclusions, which demonstrate the possibilities of overcoming the limits imposed to immediate implementation of the fundamental right to reasonable time of the process in our legal system

This work aims to study the additive decisions, a type of juridical interpretation developed in foreign legal systems and which are known in Italy as adittive sentences. Thefore, this dissertation is based on theorical studies developed around the subject in Italy and Brazil. Considering the fact that the fundamental rights face a problem of implementation, being decreased its normative force when there are legislative partial omissions lacking constitutional justification creating privileges to certain individuals or social/economical groups over others, the method of additive interpretation according to the Constitution can be used in order to realize the principle of equality. In tax matters the subject is even more relevant in the way that it represents an important role in the economy. Partial legislative omissions can generate inequalities, favoring certain taxpayers in relation to others in similar legal situation. In these cases the privilege may have a negative impact on economic order restricting values related to the basis of market competition. On those occasions, Brazilian Judges and Courts must exercise their constitutional jurisdiction in order to expand the effects of the legislative omissions, based on the principle of equality by extending the standard to equal tax situations in order to maintain neutrality in taxation

The administrative model of the Brazilian State, based on regulation, strives, with the application of the efficiency principle and assessment of economical costs, to give a greater effectiveness to fundamental rights by implementing public policies.The objective of this work is to analyze the role of Oil royalties in the context of the Brazilian State, considering that, being an income gap, they might work as a device that promotes intra/intergenerational justice. By means of a correct and efficient distribution and application in the national region, the royalties constitute financial resources available for implementing public policies that intend to guarantee the fundamental rights; above all, with the discovery of the Pre-salt basin and the indisputable rise in the tax revenues arising from Oil exploration. In the making of this work, the theoretical-descriptive methodology is observed, grounded in a critical-reflexive analysis about Constitutional Law and Oil Law. This work analyzes the administrative model of the Brazilian State, the theory of costs of fundamental rights and the theoretical aspects about royalties, such as: the ethical and economical fundamentals, the distribution and destination of revenues, considering the oil exploration scenario before and after the discovery of the pre-salt basin. it is verified, with the present work, the importance of the creation of a new regulatory framework, and consequently the creation of a sovereign wealth fund, which arises to re-evaluate the application of the current norms of Oil revenue distribution. Still, it is imperative that the mechanisms for controlling the application of royalties are defined in detail, so that those can fully admit the objectives of intra/intergenerational justice. Furthermore, it is emphasized that this process should develop from the efficiency principle viewpoint, as well as the principle of reducing social and regional differences, given that the Oil revenues might be used to ensure fundamental social rights, by implementing public policies that are aligned with the development recommended by the Federal Constitution

The Federal Constitution of 1988 is recognized for its enlargement in the face of large amount of provisions that make it up, among which many are fundamental rights. The fundamental rules set up the foundation of a democratic state, however, are the necessary legal mechanisms to be effective, its exercise is not enough merely to state them, but to offer ways for them to stop being just written standard on paper, and come to be viewed and exercised day-to-day. In this sense, access to justice presents itself in our times, as a cornerstone for a just society dictates. In this light, access to justice can be seen as the most fundamental of rights, which translates as instruments able to safeguard the fundamental rights not only against the action/omission violating the state but also the very particular. Furthermore, access to justice within the legal country, is not right for everyone, despite the willingness of the Citizen Charter in its article 5, paragraph LXXIV, ensuring that the State shall provide full and free legal assistance to those in need. More than half of the population lives in poverty and can´t afford to pay legal fees or court costs as well as a bump in their own ignorance of their rights. The judiciary, in their primary function, is in charge of trying to correct the violation of the rights, intending to effect a true distributive justice, serving as a paradigm for the promotion of substantive equality of human beings, however, is difficult and tortuous access Justice for those without financial resources. In this vein, we present the Public Defender, as keeper of the masses in its institutional role, defending a disadvantage, in the words, as a mechanism for effective access to justice, ensuring therefore fundamental rights. Public Defenders arise at the time or much discussion highlights the priority of actual access to justice, custody, therefore, intimate bond with the pursuit of fundamental rights, in which, that advance the broad range of rights, without whom could defend them or guardianship them
