The major task of policy makers and practitioners when confronted with a resource management problem is to decide on the potential solution(s) to adopt from a range of available options. However, this process is unlikely to be successful and cost effective without access to an independently verified and comprehensive available list of options. There is currently burgeoning interest in ecosystem services and quantitative assessments of their importance and value. Recognition of the value of ecosystem services to human well-being represents an increasingly important argument for protecting and restoring the natural environment, alongside the moral and ethical justifications for conservation. As well as understanding the benefits of ecosystem services, it is also important to synthesize the practical interventions that are capable of maintaining and/or enhancing these services. Apart from pest regulation, pollination, and global climate regulation, this type of exercise has attracted relatively little attention. Through a systematic consultation exercise, we identify a candidate list of 296 possible interventions across the main regulating services of air quality regulation, climate regulation, water flow regulation, erosion regulation, water purification and waste treatment, disease regulation, pest regulation, pollination and natural hazard regulation. The range of interventions differs greatly between habitats and services depending upon the ease of manipulation and the level of research intensity. Some interventions have the potential to deliver benefits across a range of regulating services, especially those that reduce soil loss and maintain forest cover. Synthesis and applications: Solution scanning is important for questioning existing knowledge and identifying the range of options available to researchers and practitioners, as well as serving as the necessary basis for assessing cost effectiveness and guiding implementation strategies. We recommend that it become a routine part of decision making in all environmental policy areas.

The dominance of ''ecosystem services'' as a guiding concept for environmental management - where it appears as a neutral, obvious, taken-for-granted concept - hides the fact that there are choices implicit in its framing and in its application. In other words, it is a highly political concept, and its utility depends on the arena in which it is used and what it is used for. Following a political ecology framework, and based on a literature review, bibliometric analyses, and brief examples from two tropical rainforest countries, this review investigates four moments in the construction and application of the ecosystem services idea: socio-historical (the emergence of the discourse), ontological (what knowledge does the concept allow?), scientific (difficulties in its practical application), and political (who wins, who loses?). We show how the concept is a boundary object with widespread appeal, trace the discursive and institutional context within which it gained traction, and argue that choices of scale, definition, and method in measuring ecosystem services frustrate its straightforward application. As a result, it is used in diverse ways by dif- ferent interests to justify different kinds of interventions that at times might be totally opposed. In Madagascar, the ecosystem services idea is mainly used to justify forest conservation in ways open to cri- tique for its neoliberalization of nature or disempowerment of communities. In contrast, in the Brazilian Amazon, the discourse of ecosystem services has served the agendas of traditional populations and family farm lobbies. Ecosystem services, as an idea and tool, are mobilized by diverse actors in real-life situa- tions that lead to complex, regionally particular and fundamentally political outcomes.

Background: Reductions in breast cancer (BC) mortality in Western countries have been attributed to the use of screening mammography and adjuvant treatments. The goal of this work was to analyze the contributions of both interventions to the decrease in BC mortality between 1975 and 2008 in Catalonia. Methodology/Principal Findings: A stochastic model was used to quantify the contribution of each intervention. Age standardized BC mortality rates for calendar years 1975-2008 were estimated in four hypothetical scenarios: 1) Only screening, 2) Only adjuvant treatment, 3) Both interventions, and 4) No intervention. For the 30-69 age group, observed Catalan BC mortality rates per 100,000 women-year rose from 29.4 in 1975 to 38.3 in 1993, and afterwards continuously decreased to 23.2 in 2008. If neither of the two interventions had been used, in 2008 the estimated BC mortality would have been 43.5, which, compared to the observed BC mortality rate, indicates a 46.7% reduction. In 2008 the reduction attributable to screening was 20.4%, to adjuvant treatments was 15.8% and to both interventions 34.1%. Conclusions/Significance: Screening and adjuvant treatments similarly contributed to reducing BC mortality in Catalonia. Mathematical models have been useful to assess the impact of interventions addressed to reduce BC mortality that occurred over nearly the same periods.

Evidences collected from smartphones users show a growing desire of personalization offered by services for mobile devices. However, the need to accurately identify users' contexts has important implications for user's privacy and it increases the amount of trust, which users are requested to have in the service providers. In this paper, we introduce a model that describes the role of personalization and control in users' assessment of cost and benefits associated to the disclosure of private information. We present an instantiation of such model, a context-aware application for smartphones based on the Android operating system, in which users' private information are protected. Focus group interviews were conducted to examine users' privacy concerns before and after having used our application. Obtained results confirm the utility of our artifact and provide support to our theoretical model, which extends previous literature on privacy calculus and user's acceptance of context-aware technology.

Background: As a result of the growing number of interventions that are now performed in the context of maternity care, health authorities have begun to examine the possible repercussions for service provision and for maternal and neonatal health. In Spain the Strategy Paper on Normal Childbirth was published in 2008, and since then the authorities in Catalonia have sought to implement its recommendations. This paper reviews the current provision of maternity care in Catalonia. Methods: This was a descriptive study. Hospitals were grouped according to their source of funding (public or private) and were stratified (across four strata) on the basis of the annual number of births recorded within their respective maternity service. Data regarding the distribution of obstetric professionals were taken from an official government survey of hospitals published in 2010. The data on obstetric interventions (caesarean, use of forceps, vacuum or non-specified instruments) performed in 2007, 2010 and 2012 were obtained by consulting discharge records of 44 public and 20 private hospitals, which together provide care in 98% of all births in Catalonia. Proportions and confidence intervals were calculated for each intervention performed in all full-term (3742 weeks) singleton births. Results: Analysis of staff profiles according to the stratification of hospitals showed that almost all the hospitals had more obstetricians than midwives among their maternity care staff. Public hospitals performed fewer caesareans [range between 19.20% (CI 18.84-19.55) and 28.14% (CI 27.73-28.54)] than did private hospitals [range between 32.21% (CI 31.78-32.63) and 39.43% (CI 38.98-39.87)]. The use of forceps has decreased in public hospitals. The use of a vacuum extractor has increased and is more common in private hospitals. Conclusions: Caesarean section is the most common obstetric intervention performed during full-term singleton births in Catalonia. The observed trend is stable in the group of public hospitals, but shows signs of a rise among private institutions. The number of caesareans performed in accredited public hospitals covers a limited range with a stable trend. Among public hospitals the highest rate of caesareans is found in non-accredited hospitals with a lower annual number of births.

In the last decade, dialogue between science and society has found a forum in an increasing number of publications on topics such as public engagement with science and public trust in science. Concerning the latter, issues that include cases of research misconduct, accountability in research, and conflicts of interest (COIs) have shaped global discussions on the communication of science. In the publication setting, the perception that hiding COIs and/or not managing them well may affect public trust in the research record has grown among editors. We conducted a search for editorials addressing COIs between 1989 and 2011, using four major databases: Medline/PubMed, Embase, Scopus, and Web of Knowledge. We explored the content of these editorials and the relationship they established between COIs and the public trust in science. Our results demonstrate that the relationship between disclosure of COIs and public trust in science has become a major concern among editors. We, thus, argue that COIs should be discussed more openly and frequently in graduate courses in the sciences, around the globe, not only in biomedical but also in non-biomedical areas. This is a critical issue in contemporary science, as graduate students are the future voices and decision-makers of the research community. Therefore, COIs, especially in the broader context of science and society, merit closer attention from policymakers, researchers, and educators. At times of great expectations for public engagement with science, mishandling of COIs may have undesirable consequences for public engagement with science and confidence in the scientific endeavor.

Throughout their schooling experiences, students with learning disabilities (LD) face numerous academic and socioemotional challenges. Some of these individuals rise above these obstacles to obtain a postsecondary education and become professionals. Recently, there have been a number of individuals with learning disabilities who have chosen a career in teaching. There is a lack of research that documents the experiences of teachers with learning disabilities. The purpose of this qualitative study is to gain an understanding of the challenges that the teachers with learning disabilities strive to overcome and the supports that they receive ^^^ch facilitate their inception into teaching. Four teachers with learning disabilities were the participants in this collective case study research. Data were collected through semistructured interviews. These data were coded, collapsed into themes, and the results were presented in a narrative form. The resultant 9 themes are: (a) Perspectives on School Experiences, (b) Identification and Effective Accommodations, (c) Isolation, Frustration, and Support, (d) Awareness of Learning Disability at Age 18, (e) Disclosure of Learning Disability, (f) Negative Impact of the Learning Disability Label, (g) Desire, Drive, and Obstacles, (h) Empathy, Compassion, and Self-Concept, and (i) Critical Views of Colleagues. The themes reflect the common experiences among participants. The discussion brings forth new information that is not found in other research. The impHcations of this research will interest teacher federations, parents of students with LD, teachers, and educational researchers.

Introduction Man can be described as the being who shows himself in speech, and from birth to death is continually speaking. Communication is so close to us, so woven into our very being, that we have little understanding of the way it is constituted; for it is as hard to obtain distance from communication as it is to obtain distance from ourselves. All communication is not alike. There are two basic modesl of communication, the inauthentic and the authentic, between which there occurs a constant tension. It is in the inauthentic mode, points out Heidegger, that we find ourselves "proximately and for the most part"; 1. Being and Time, pg. 68 Dasein decides as to the way it will comport itself in taking up its task of having being as an issue for it. " •.• it~, in its very being 'choose' itself and win itself; it can also lose itself and never win itself or only "seem" to do so. But only in so far as it is essentially something which can be authentic--that is, something of its own--can it have lost itself and not yet won itself." 2. therefore Heidegger also terms it "everydayness".2 Caught up in the world of everydayness, our speaking covers over and conceals3 our rootedness in being, leaving us in the darkness of untruth. Our first task will be to explore the nature of communication in general and then to explore each of the modes manifested in turn. The structure of the inauthentic mode of communication can be explored by asking the following questions: What is this speaking about? Who is it that is speaking and who is spoken to? Does this speaking show man in his speech? The authentic mode is distinguished by the rarity with which we encounter it; as the inauthentic conceals, so the authentic reveals our rootedness in being. Yet this rarity makes it difficult to delineate its elusive structure clearly. Its constituent elements can be brought into focus by asking the same questions of this mode that we previously asked of the inauthentic mode. Our initial response to the disclosure of the authentic mode is to attempt to abandon the inauthentic mode and leave the darkness behind dwelling only in the "lighted place". All through the ages, some men pushing this to extreme, have, upon uncovering their relatedness to being, experienced a deep longing to dwell in such a "place" of pure truth and oft times denigrated or attempted to exclude the everyday world. Such 4. flight is twice mistaken: first it atbempts to fix truth as unchanging and static and secondly, it opposes this to untruth which it seeks to abolish. This is both the wrong view of truth and the wrong view of untruth as Heidegger points out in The Origin of The-Work of Art: The Way-to-be of truth, i.e., of discoveredness, is under the sway of refusal. But this refusal is no lack or privation, as if truth could be simply discoveredness rid of all covers. If it could be that, it would no longer be itself . ••• Truth in its way-to-be is untruth.5 Pure light is not the nature of Being nor is pure unconcealedness possible for man. Failure to remember this is the failure to realize that communication destroys itself in such flight because it no longer maintains the contingency of its task, i.e., the dis-closedness of being. We are reminded of the strong attraction this flight from darkness held for Plato. Light, truth and Being are all beyond the darkness and have nothing to do with it. In Book VII of the R~public, Socrates' explanation of the Allegory of the Cave to Glaucon points to a decided preference men have for the "lighted place". 5. The Origin Of The Work Of Art, pg. 42 5. Come then, I said, and join me in this further thought, and do not be surprised that those who attained to this height are not willing to occupy themselves with the affairs of men, but their souls ever feel the upward urge and yearning for that sojourn above. For this, I take it, is likely if in this point too the likeliness of our image holds. 6 Despite the attraction to pure truth, human communication is more complex than putting down one mode of communication and picking up another. In Canada freedom of information must be viewed in the context of governing -- how do you deal with an abundance of information while balancing a diversity of competing interests? How can you ensure people are informed enough to participate in crucial decision-making, yet willing enough to let some administrative matters be dealt with in camera without their involvement in every detail. In an age when taxpayers' coalition groups are on the rise, and the government is encouraging the establishment of Parent Council groups for schools, the issues and challenges presented by access to information and protection of privacy legislation are real ones. The province of Ontario's decision to extend freedom of information legislation to local governments does not ensure, or equate to, full public disclosure of all facts or necessarily guarantee complete public comprehension of an issue. The mere fact that local governments, like school boards, decide to collect, assemble or record some information and not to collect other information implies that a prior decision was made by "someone" on what was important to record or keep. That in itself means that not all the facts are going to be disclosed, regardless of the presence of legislation. The resulting lack of information can lead to public mistrust and lack of confidence in those who govern. This is completely contrary to the spirit of the legislation which was to provide interested members of the community with facts so that values like political accountability and trust could be ensured and meaningful criticism and input obtained on matters affecting the whole community. This thesis first reviews the historical reasons for adopting freedom of information legislation, reasons which are rooted in our parliamentary system of government. However, the same reasoning for enacting such legislation cannot be applied carte blanche to the municipal level of government in Ontario, or - ii - more specifially to the programs, policies or operations of a school board. The purpose of this thesis is to examine whether the Municipal Freedom of Information and Protection of Privacy Act, 1989 (MFIPPA) was a neccessary step to ensure greater openness from school boards. Based on a review of the Orders made by the Office of the Information and Privacy Commissioner/Ontario, it also assesses how successfully freedom of information legislation has been implemented at the municipal level of government. The Orders provide an opportunity to review what problems school boards have encountered, and what guidance the Commissioner has offered. Reference is made to a value framework as an administrative tool in critically analyzing the suitability of MFIPPA to school boards. The conclusion is drawn that MFIPPA appears to have inhibited rather than facilitated openness in local government. This may be attributed to several factors inclusive of the general uncertainty, confusion and discretion in interpreting various provisions and exemptions in the Act. Some of the uncertainty is due to the fact that an insufficient number of school board staff are familiar with the Act. The complexity of the Act and its legalistic procedures have over-formalized the processes of exchanging information. In addition there appears to be a concern among municipal officials that granting any access to information may be violating personal privacy rights of others. These concerns translate into indecision and extreme caution in responding to inquiries. The result is delay in responding to information requests and lack of uniformity in the responses given. However, the mandatory review of the legislation does afford an opportunity to address some of these problems and to make this complex Act more suitable for application to school boards. In order for the Act to function more efficiently and effectively legislative changes must be made to MFIPPA. It is important that the recommendations for improving the Act be adopted before the government extends this legislation to any other public entities.

Bien que les règles de droits et des directives administratives dictent leur conduite, les policiers jouissent d’une latitude considérable dans la manière d’appliquer la loi et de dispenser des services. Puisque l’exercice efficient de toute forme d’autorité nécessite la reconnaissance de sa légitimité (Tyler, 2004), plus l’application de leurs pouvoirs discrétionnaires est jugée arbitraire ou excessive, plus les citoyens risquent d’utiliser des mécanismes normaux d’opposition ou de riposte. Dans cette optique, la présente étude cherche à départager les causes des 15 023 épisodes de voie de fait, menace, harcèlement, entrave et intimidation, qualifiés de défiance, dont les policiers du Service de police de la ville de Montréal (SPVM) ont été la cible entre 1998-2008 selon leur registre des événements (Module d’information policière – MIP). Elle présume qu’à interactions constantes entre la police et les citoyens, les comportements de défiance policière seront fonction du niveau de désordre du quartier et des caractéristiques des personnes impliquées. Plus les policiers interceptent de jeunes, de minorités ethniques et d’individus associés aux gangs de rue, plus ils risquent d’être défiés. Elle suppose également que la probabilité qu’une intervention soit défiée dépend de l’excessivité des activités policières menées dans le quartier. Plus un quartier est sur-contrôlé par rapport à son volume de crimes (overpoliced), plus le climat local est tendu, plus les policiers sont perçus comme étant illégitimes et plus ils risquent d’être défiés lorsqu’ils procèdent à une intervention. Enfin, les comportements de défiance sont peut-être simplement fonction du niveau d’interactions entre les policiers et les citoyens, à conditions sociales et criminogènes des quartiers tenues constantes. Une série d’analyses de corrélation tend à confirmer que les comportements de défiance varient en fonction de l’âge, de l’ethnicité et de l’appartenance à un gang de rue de l’auteur. Par contre, les conditions sociales et criminogènes des quartiers paraissent être des causes antécédentes à la défiance puisqu’elles encouragent un volume plus élevé d’interventions dans les quartiers désorganisés, lequel influe sur le nombre d’incidents de défiance. Contrairement à notre hypothèse, les résultats tendent à démontrer que les policiers risquent davantage d’être défiés dans les quartiers sous-contrôlés (underpoliced). Quant à elles, les analyses multiniveaux suggèrent que le nombre d’incidents de défiance augmente à chaque fois qu’une intervention policière est effectuée, mais que cette augmentation est influencée par les quartiers propices aux activités criminelles des gangs de rue. En ce sens, il est probable que l’approche policière dans les quartiers d’activités « gangs de rue » soit différente, par souci de protection ou par anticipation de problèmes, résultant plus fréquemment en des actes de défiance à l’égard des policiers.

Problématique : Les femmes travailleuses du sexe (TS) constituent la population le plus à risque d’infection au VIH dans différents pays d’Afrique subsaharienne. Plusieurs interventions y ont ainsi été menées pour réduire le risque d’infection en influant sur les facteurs de risque. Parmi ces interventions, on peut citer la promotion de l’utilisation du préservatif de même que le dépistage et le traitement des infections sexuellement transmissibles (IST). Cependant, certaines composantes sont peu représentées dans ce panel d’interventions offertes aux femmes TS. Le conseil dépistage volontaire pourrait s’avérer une intervention utile de prévention primaire et secondaire pour cette population mais son acceptabilité est mal connue. Par ailleurs, en termes de surveillance de l’épidémie, l’évaluation de la validité de l’auto-rapport d’utilisation du préservatif, indicateur fréquemment utilisé lors d’enquêtes populationnelles serait souhaitable. Enfin, pour ce qui est de la prévention de l’infection dans cette population, l’effet du désir d’enfant sur l’utilisation non systématique du condom avec le principal partenaire régulier non payant est peu connu. Il en est de même pour la prévalence de certaines IST comme le VPH-16 et l’effet combiné de facteurs sociodémographiques, comportementaux et préventifs sur la présence de ces IST. Objectifs : Les objectifs de cette thèse sont 1) de mesurer l’acceptabilité et les conséquences du conseil dépistage volontaire du VIH chez les femmes TS de Conakry en Guinée; 2) d’évaluer la validité de l’auto-rapport de l’utilisation du préservatif dans cette population grâce à un indicateur biologique de présence de sperme, l’antigène spécifique de la prostate (PSA); 3) d’estimer la fréquence d’utilisation systématique du préservatif avec les partenaires clients et non-clients des femmes TS et d’étudier l’importance du désir d’enfant dans l’utilisation non systématique du préservatif avec le principal partenaire régulier non-client et 4) de mesurer la prévalence des IST et du VIH et d’étudier les facteurs sociodémographiques, comportementaux et préventifs qui y sont associés. Méthodologie : Nous avons mené une étude longitudinale dans la ville de Conakry en Guinée auprès de 421 femmes TS recrutées dans trois services de santé adaptés pour elles. Un devis mixte répété un an plus tard a permis de collecter des données quantitatives et qualitatives. Des analyses biologiques de dépistage des IST et du VIH ont été effectuées. Résultats : Le premier article de résultats présenté dans cette thèse montre que l’acceptabilité du conseil dépistage volontaire est élevée chez les femmes TS. En effet, les taux d’acceptation du test, de retour pour la prise de résultats et de notification du statut sérologique avoisinaient les 100%. Cette acceptabilité semblait être le fait d’une perception de risque d’infection élevé, mais aussi d’une pression sociale du milieu prostitutionnel pour effectuer le dépistage et révéler le statut sérologique. Les conséquences négatives au dépistage étaient rares. Le deuxième article montre que l’auto-rapport de l’usage récent du préservatif a une très faible sensibilité lorsque comparé à l’étalon d’or que constitue la PSA. Ainsi, la plupart des personnes chez qui la PSA était retrouvée ne rapportaient aucun rapport non protégé récent. La discordance entre l’auto-rapport d’utilisation récente du préservatif et la présence de PSA était associée à une perception de risque d’infection au VIH élevé. Enfin, la troisième section montre que si l’utilisation systématique du préservatif était très fréquente avec les clients, elle l’est beaucoup moins avec le principal partenaire régulier non-client. Le désir d’enfant de la femme TS contribue de manière significative à l’utilisation non systématique du condom avec ce type de partenaire. Des facteurs sociodémographiques, comportementaux et la coinfection par d’autres IST sont associés à la présence d’IST/VIH, ces dernières étant fréquentes dans la population des femmes TS malgré les nombreuses interventions qui y sont menées. Conclusion : En conclusion, l’on peut dire que la prévention du VIH chez les femmes TS constitue un défi nécessitant des interventions intégrées tenant compte du contexte commercial dans lequel ces interventions sont implantées et des aspirations des femmes TS en matière de reproduction.

Introduction : L’ostéoporose constitue un problème de santé publique important vu les conséquences graves des fractures ostéoporotiques. Toutefois, le dépistage et le traitement de l’ostéoporose sont grandement sous-optimaux. De nouvelles interventions visant à améliorer le dépistage et le traitement de l’ostéoporose sont donc nécessaires. Objectifs : L’objectif global de ce programme de recherche était d’évaluer quelles avenues devraient être privilégiées pour le développement de futures interventions visant à améliorer le dépistage et le traitement de l’ostéoporose en soins de première ligne. Pour ce faire, trois projets ont été réalisés, dont les objectifs étaient les suivants : 1) évaluer l’impact d’un atelier de formation offert à des médecins de famille sur les pratiques préventives associées à l’ostéoporose (premier projet de recherche); 2) évaluer l’efficacité globale des interventions dans le domaine de l’ostéoporose en soins de première ligne (deuxième projet de recherche); et 3) explorer les perceptions des pharmaciens communautaires, des directeurs d’agences de santé publique et du Ministère de la santé et des services sociaux du Québec (MSSSQ) concernant le rôle des pharmaciens dans la prévention des maladies et la promotion de la santé et spécifiquement dans le domaine de l’ostéoporose et de la prévention des chutes (troisième projet de recherche). Méthodologie : D’abord, une étude de cohorte a été réalisée avec les données administratives de la Régie de l’assurance maladie du Québec (premier projet de recherche). Ensuite, une revue systématique avec méta-analyse concernant l’efficacité des interventions visant à améliorer le dépistage et le traitement de l’ostéoporose en soins de première ligne a été effectuée (deuxième projet de recherche). Finalement, une étude transversale avec volet qualitatif a été réalisée chez des pharmaciens communautaires, des directeurs d’agences de santé publique et la directrice de la prévention des maladies chroniques du MSSSQ (troisième projet de recherche). Résultats : Dans le premier projet de recherche, bien que la participation des médecins de famille à l’atelier entraînait une amélioration des pratiques préventives liées à l’ostéoporose, celles-ci sont demeurées grandement sous-optimales. Au niveau du deuxième projet de recherche, il a été observé que les interventions comprenant plusieurs composantes et ciblant les médecins de famille et leurs patients pouvaient améliorer les pratiques préventives de l’ostéoporose, mais ces améliorations étaient souvent modestes du point de vue clinique. Finalement, le troisième projet de recherche a démontré que les pharmaciens communautaires, les directeurs d’agences de santé publique et la direction de la prévention des maladies chroniques du MSSSQ considèrent que les pharmaciens devraient jouer un rôle significatif dans la prévention des maladies et la promotion de la santé et spécifiquement dans le domaine de l’ostéoporose et de la prévention des chutes. Néanmoins, à cause de nombreuses barrières organisationnelles, un large écart existe entre le niveau d’implication idéal et réel des pharmaciens dans l’offre de ces services. Conclusion : Les futures interventions à être développées devront être multidisciplinaires, comprendre plusieurs composantes et cibler les barrières à l’application des recommandations des guides de pratiques cliniques. L’implication plus intensive des pharmaciens communautaires et des infirmières cliniciennes constitue une avenue particulièrement intéressante pour le développement de futures interventions.

The article discusses the present status of weblogs and examines whether legal standards applicable to traditional press and media should be applied to that specific forum. The analysis is based on two key documents: the Draft Report on the concentration and pluralism in the media in European Union (2007/2253(INI)) of the European Parliament Committee on Culture and Education presented in March 2008 and a landmark decision of the Polish Supreme Court from July 26, 2007 (IV KK 174/07) in the light of present judicial tendency in other European countries. The first of the mentioned documents calls for the “clarification of the legal status of different categories of weblog authors and publishers as well as disclosure of interests and voluntary labelling of weblogs”. It emphasizes that the “undetermined and unindicated status of authors and publishers of weblogs causes uncertainties regarding impartiality, reliability, source protection, applicability of ethical codes and the assignment of liability in the event of lawsuits”. The position of the European Parliament, expressed in the document, raises serious questions on the limits of freedom of thought and speech on the Internet and on the degree of acceptable state control. A recent Polish Supreme Court decision, which caused quite a stir in the Polish Internet community, seems to head in the very direction recommended by the EP Culture Committee. In a case of two editors of a web journal (“czasopismo internetowe”) called “Szyciepoprzemysku”, available on-line, accused of publishing a journal without the proper registration, the Polish Supreme Court stated that “journals and periodicals do not lose the character of a press release due solely to the fact that they appear in the form of an  Internet transmission”, and that ‘’the publishing of press in an electronic form, available on the Internet, requires  registration”. The decision was most surprising, as prior lower courts decisions declined the possibility to register Internet periodicals. The accused were acquitted in the name of the constitutional principle of the rule of law (art. 7 of the Polish Constitution) and the ensuing obligation to protect the trust of a citizen to the state (a conviction in this case would break the collateral estoppel rule), however the decision quickly awoke media frenzy and raised the fear of a need to register all websites that were regularly updated. The spokesman of the Polish Supreme Court later explained that the sentence of the Court was not intended to cause a mass registration of all Internet “periodicals” and that neither weblogs nor Internet sites, that were regularly updated, needed registration. Such an interpretation of the Polish press law did not appear clear based only on the original text of the judgment and the decision as such still raises serious practical questions. The article aims to examine the status of Internet logs as press and seeks the compromise between the concerns expressed by European authorities and the freedom of thought and speech exercised on the Internet.
