L'objectiu de la tesi es centra en la definició, en l'àmbit de l'ordenament comunitari, de l'actual estatut jurídic dels treballadors extracomunitaris assalariats que formen part del mercat de treball regular d'un Estat membre. Els treballadors nacionals de tercers països que formen part del mercat de treball regular d'un Estat comunitari, així com els membres de les seves famílies, gaudeixen d'un estatut jurídic fragmentat: els seus drets són variables, depenen de la norma que els regula. En aquest sentit, la situació varia en funció de la llei interna de l'Estat d'acollida, l'existència o no d'acords bilaterals entre l'Estat d'acollida i l'Estat d'origen, i les normes de dret comunitari. Aquesta situació també és diferent atenent a l'existència i el contingut d'un acord extern celebrat per la Comunitat i els seus Estats membres i el país de la nacionalitat de l'immigrant, aquest aspecte centra el present estudi. Els acords que s'analitzen són aquells que juntament amb aspectes econòmics, contenen disposicions relatives als treballadors, i que s'han celebrat, prenent com a base jurídica l'actual article 310 TCE, amb països geogràficament fronterers amb la Unió Europea. D'entre ells, el model a seguir és l'Acord d'Associació amb Turquia, que preveu uns objectius més amplis, com ara la creació d'una unió duanera enfront a la zona de lliure comerç prevista en els altres acords i que s'ha desenvolupat mitjançant les decisions adoptades pel seu Consell d'Associació. Aquest acord ha estat objecte d'una àmplia jurisprudència per part del Tribunal europeu, relativa a l'aplicació i la interpretació de les seves disposicions. A fi de delimitar l'abast de les disposicions de l'Acord, i valorar si es tracta d'un estatut privilegiat respecte del dels altres treballadors extracomunitaris, es comparen les seves disposicions amb les corresponents a les dels acords celebrats amb els països del Magreb, entenent per aquests el Marroc, Tunísia i Algèria i amb els 10 països d' Europa Central i Oriental (els anomenats PECO's). A fi de clarificar l'estatut jurídic dels treballadors extracomunitaris, és necessari entrar a considerar altres aspectes directament relacionats amb aquest estatut, com són les condicions d'accés i de permanència en un Estat, matèries, que, fins a l'entrada en vigor del Tractat d'Amsterdam, eren competència exclusiva de cadascun dels Estats membres. De totes maneres, no es fa un estudi comparatiu de les diferents legislacions internes en matèria d'immigració, donat que l'àmbit d'anàlisi es limita a l'ordenament comunitari, i no a l'ordenament intern. La tesi s'estructura en dues parts diferenciades, correspon la primera als 2 Capítols inicials i la segona als altres 3. En els dos primers Capítols se segueix un criteri cronològic, començant amb el Tractat de Roma i culminant amb el Tractat de Niça. En aquests Capítols s'analitzen les possibles bases jurídiques del dret originari que podien haver-se utilitzat, així com la cooperació que varen fer els Estats membres, tant a dins com a fora, de la Unió Europea, en relació a les mesures adoptades destinades a la regulació de l'accés i de l'estatut jurídic dels treballadors immigrants. L'entrada en vigor, l'1 de maig de 1999 del Tractat d'Amsterdam ha suposat un important avenç per a l'atribució de competències a la Comunitat en matèria d'immigració, que queda vinculada al nou objectiu de la creació de l'espai de llibertat, seguretat i justícia. A partir d'aquest moment, s'assumeix la lliure circulació de persones com objectiu propi, que requereix la regulació del control a les fronteres externes, d'asil, de la immigració i de la cooperació dels Estats membres en la prevenció i la lluita contra la delinqüència. Això es concreta en la comunitarització d'una part del Tercer Pilar destinada a visats, asil i immigració, amb l'exclusió del Regne Unit, Irlanda i Dinamarca, i en la integració del cabal Schengen a l'estructura de la Unió Europea, tot i que permetent una exclusió per al Regne Unit i Irlanda. Es crea, doncs, una cooperació sui generis plena de solucions d'enginyeria jurídica, que si bé suposa un avenç, trenca la unitat i l'homogeneïtat del dret comunitari. Tot i aquestes complexitats tècniques que deriven de la reforma del Tractat d'Amsterdam, el nou article 63 en els seus apartats 3 i 4 permet abordar, a través de la coordinació o de l'harmonització, els temes d'interès comú vinculats al fenomen de la immigració. Entre ells, hi ha la possibilitat d'elaborar un estatut comú per als treballadors no comunitaris. Les iniciatives legislatives presentades des de l'entrada en vigor del Tractat d'Amsterdam demostren l'acceleració en l'elaboració i el desenvolupament d'una política comunitària d'immigració, integrada en uns objectius comuns, per primera vegada sembla realista pensar en l'adopció d'un estatut jurídic únic per l'extracomunitari que sigui resident de llarga durada. Tot i que aquest estatut pot quedar configurat com un estàndard mínim de protecció, considero que la seva adopció constituiria un pas de gran rellevància en la clarificació dels drets d'aquest col·lectiu de treballadors. Els altres tres Capítols conformen la segona part de la tesi, dedicada a analitzar l'actual estatut dels treballadors nacionals de tercers Estats. Aquest estatut es caracteritza pel seu caràcter fragmentat, que deriva de la diversitat de les disposicions contingudes en els acords externs. Mitjançant un estudi comparatiu, s'analitzen els objectius, l'estructura, els antecedents i el desenvolupament dels acords celebrats amb Turquia, amb els països del Magreb i amb els PECO's. El contingut dels objectius d'aquests acords constata que ens trobem davant 3 models diferents que reflecteixen una disminució del compromís comunitari. El Tribunal de Justícia, en la seva jurisprudència, ha manifestat que tant els acords externs celebrats per la Comunitat, com les decisions adoptades pels òrgans que els desenvolupen, formen part de l'ordenament jurídic comunitari. El Tribunal de Justícia és l'òrgan competent per interpretar-los, contribuint a clarificar el contingut d'aquests instruments jurídics. Aquesta perspectiva es completa amb l'anàlisi de les nocions que recullen els acords externs, a fi de dilucidar si un mateix terme té idèntic contingut, i si, tot i la diversitat dels instruments jurídics utilitzats, tenen una mateixa interpretació jurisprudencial. Per aquest motiu ha estat necessari, que el Tribunal de Justícia determinés l'abast dels diferents conceptes emprats, i clarifiqués si és el mateix que el relatiu als treballadors comunitaris o és diferent. La redacció dels acords estudiats reflecteix un estatut jurídic privilegiat per als treballadors turcs en relació als altres treballadors immigrants. Els treballadors originaris dels països d'Europa Central i Oriental o del Magreb, podran millorar la seva situació actual en la mesura en què les disposicions dels seus respectius acords siguin, en el futur, desenvolupades. De totes maneres, aquesta situació de privilegi que ha estat un fet fins el moment actual, ha canviat amb l'entrada en vigor de diferents lleis d'estrangeria estatals, i pot modificar-se, també, amb el desenvolupament del Tractat d'Amsterdam. Actualment, a un treballador turc li perjudica, més que no beneficia el sistema de terminis que per accedir a un lloc de treball preveu la Decisió 1/80. Els treballadors turcs que formen part del mercat regular de treball d'un Estat membre haurien de quedar protegits pel règim jurídic que els sigui més beneficiós, amb independència de que aquest sigui l'intern de l'Estat d'acollida, el comunitari previst a l'Acord d'Associació i el seu posterior desenvolupament, o el que derivi de les futures directives quan entrin en vigor. Si bé aquestes disposicions dels Acords d'Associació varen ser positives, actualment hauran de ser objecte de modificació, la qual cosa no implica la seva desaparició. El seu contingut haurà de tendir a ressaltar l'especificitat de les relacions que es volen establir amb un tercer Estat concret, establint en aquest sentit un tractament preferent als seus nacionals enfront als altres immigrants, i reconeixent el seu dret de residència com derivat del permís de treball. De tota manera, amb l'entrada en vigor de la directiva relativa a l'estatut dels residents de llarga durada, aquest règim privilegiat només afectarà als immigrants residents legals a l'Estat d'acollida durant els primers 5 anys, és a dir, abans de que se'ls concedeixi el citat estatut.

This paper focuses upon a comparatively overlooked issue with regard to the scope of self-defence in international law: whether the subjective ‘psychological’ positions of the states concerned in a dispute involving the use force have any impact upon the lawfulness of an action avowedly taken in self-defence. There exists a long standing conception that the motives of a state responding in self-defence are relevant to the lawfulness of that response. The purity (or impurity) of a state's motive forms the basis of a distinction for many writers between a lawful self-defence action and an unlawful armed reprisal. Similarly, in recent decisions of the ICJ, the implication has been that the subjective intention of the attacking state may be relevant to the question of whether the attack perpetrated by that state can trigger the right of self-defence. The conclusion is reached here that the lawfulness of an avowed self-defence action should be premised upon objective criteria alone. Moreover, this reflects the law as it is in fact applied in practice. It is argued that the subjective ‘psychological’ position of either the responding or attacking state has no place in the final analysis of whether an action in self-defence was lawful or unlawful.

Defensive behaviors, such as withdrawing your hand to avoid potentially harmful approaching objects, rely on rapid sensorimotor transformations between visual and motor coordinates. We examined the reference frame for coding visual information about objects approaching the hand during motor preparation. Subjects performed a simple visuomanual task while a task-irrelevant distractor ball rapidly approached a location either near to or far from their hand. After the distractor ball appearance, single pulses of transcranial magnetic stimulation were delivered over the subject's primary motor cortex, eliciting motor evoked potentials (MEPs) in their responding hand. MEP amplitude was reduced when the ball approached near the responding hand, both when the hand was on the left and the right of the midline. Strikingly, this suppression occurred very early, at 70-80ms after ball appearance, and was not modified by visual fixation location. Furthermore, it was selective for approaching balls, since static visual distractors did not modulate MEP amplitude. Together with additional behavioral measurements, we provide converging evidence for automatic hand-centered coding of visual space in the human brain.

Experiments assimilating the RAPID dataset of deep temperature and salinity profiles at 26.5°N on the western and eastern Atlantic boundaries into a 1° global NEMO ocean model have been performed. The meridional overturning circulation (MOC) is then assessed against the transports calculated directly from observations. The best initialization found for this short period was obtained by assimilating the EN3 upper-ocean hydrography database prior to 2004, after which different methods of assimilating 5-day average RAPID profiles at the western boundary were tested. The model MOC is strengthened by ∼ 2 Sv giving closer agreement with the RAPID array transports, when the western boundary profiles are assimilated only below 900 m (the approximate depth of the Florida Straits, which are not well resolved) and when the T,S observations are spread meridionally from 10 to 35°N along the deep western boundary. The use of boundary-focused covariances has the largest impact on the assimilation results, otherwise using more conventional Gaussian covariances has a very local impact on the MOC at 26°N with strong adverse impacts on the MOC stream function at higher and lower latitudes. Even using boundary-focused covariances only enables the MOC to be strengthened for ∼ 2 years, after which the increased transport of warm waters leads to a negative feedback on water formation in the subpolar gyre which then reduces the MOC. This negative feedback can be mitigated if EN3 hydrography data continue to be assimilated along with the RAPID array boundary data. The late eighties and early nineties in Germany were not only marked by the fall of the Wall and German unification, but also by the dramatization of the political issue of asylum, resulting in outbreaks of xenophobic violence. In the context of the asylum debate of the early nineties, a number of punk bands produced songs between 1991 and 1994 which criticise the xenophobic climate created by the asylum debate and undermine an exculpatory official discourse about the violent attacks. The lyrics of these songs will be analysed as instances of counter-discourse emerging from a subcultural sphere that nurtures a critical distance towards hegemonic public and political discourse, arguing that Critical Discourse Analysis should pay more attention to defiance of hegemonic discourse.

This article focuses on one particular factor that is of crucial importance to all self-defence actions. It is a factor that is almost always present in the application and appraisal of the right, but one that is not always explicitly engaged with: time. There are various ratione temporis elements underpinning the lawful exercise of the right of self-defence, and questions related to the timing of both an attack being responded to in self-defence and the response itself are notably controversial. The self-defence timeline is therefore charted, and the key legal debates encountered along its trajectory are identified. In particular, there is a focus on three temporal ‘stages’ of the right of self-defence: (i) the much-debated question of preventative forms of self-defence (the ‘before’); (ii) the timeliness of a state's defensive action, or what is sometimes called the need for the response to be ‘immediate’ (the ‘during’); and (iii) the duration of self-defence actions, including the crucial issue of when they must end (the ‘after’). The aim of this article is not to break new substantive ground with regard to these ‘stages’ as such, but is, rather, to draw together the temporal strands of self-defence in a more focused manner than is often the case in the literature.

We investigated the time course of anaphor resolution in children and whether this is modulated by individual differences in working memory and reading skill. The eye movements of 30 children (10-11 years) were monitored as they read short paragraphs in which (i) the semantic typicality of an antecedent and (ii) its distance in relation to an anaphor, were orthogonally manipulated. Children showed effects of distance and typicality on the anaphor itself, and also on the word to the right of the anaphor, suggesting that anaphoric processing begins immediately but continues after the eyes have left the anaphor. Furthermore, children showed no evidence of resolving anaphors in the most difficult condition (distant atypical antecedent), suggesting that anaphoric processing that is demanding may not occur online in children of this age. Finally, working memory capacity and reading comprehension skill affect the magnitude and time course of typicality and distance effects during anaphoric processing.

This article is concerned with the liability of search engines for algorithmically produced search suggestions, such as through Google’s ‘autocomplete’ function. Liability in this context may arise when automatically generated associations have an offensive or defamatory meaning, or may even induce infringement of intellectual property rights. The increasing number of cases that have been brought before courts all over the world puts forward questions on the conflict of fundamental freedoms of speech and access to information on the one hand, and personality rights of individuals— under a broader right of informational self-determination—on the other. In the light of the recent judgment of the Court of Justice of the European Union (EU) in Google Spain v AEPD, this article concludes that many requests for removal of suggestions including private individuals’ information will be successful on the basis of EU data protection law, even absent prejudice to the person concerned.

Introduction: The White Ribbon Alliance for safe motherhood believes respectful maternity care is the universal right of every childbearing woman. Methods: NHRC in 2012 approved an inquiry of respectful care at facility-based childbirth. Individual-, focus group interviews and content analysis was used for gathering and analysis of data. Findings: The participating women and the SBAs shared similar views, and this was that together the SBAs and relatives ensured the women remained within the comfort and safety zone when giving birth in a tertiary level maternity unit. Conclusion: The SBAs strategy of having relatives provides basic care alongside the provision of medical care by the SBAs is a strategy that Nepal could use to improve the quality of its maternity care without any additional costs. Clinical implication: Prenatal classes might contribute to preparing relatives. Further Research: Further research could evaluate such a strategy in order to determine its effectiveness in reduction of morbidity and mortality.

According to the latest available statistics, in 1997-98, of the total of seven million Australian households, two million were renting their dwelling from a State housing authority or private landlords.Therefore, the decision on the scope of landlords' liability to tenants, members of their households, and guests in the right of the tenant handed down by the High Court of Australia in November 2000 was not only of legal, but also of social and economic significance. This note will discuss the Jones v Bartlett case in the context of the traditional common law approach to landlords' liability and the ground-breaking, if flawed, case of Northern Sandblasting Pty Ltd v Harris.

Traditionally the right of privacy has not been recognised at common law. However, recently the High Court has indicated that it may be willing to develop a new tort of invasion of privacy. Several of the justices have stated that the new action would only relate to natural persons, not corporations. This is because the principles said to underpin the right to privacy, autonomy and dignity, are supposedly inapposite to corporations. This article argues that this reasoning is flawed. Neither the right to autonomy nor dignity is capable of underpinning the right to privacy. Hence, no sustainable basis has so far been advanced for restricting the availability of any future tort of invasion of privacy to individuals. This article also questions whether a separate tort is needed in view of the protection already provided to the privacy interests of individuals and corporations under the equitable doctrine of confidence.

The international medium of film poses many challenges for authors and copyright owners. So do the practices of the advertising industry. Each jurisdiction approaches these challenges differently. In a recent French decision three issues that are of interest in Australia were discussed – the copyright status of a literary or dramatic character, the use of such a persona in character merchandising, and the moral right of film directors to control the exploitation of the persona. This article examines the 2004 decision of the Paris Court of Appeal in the matter of the film “The Fifth Element”. It compares the protection offered to author and copyright owner under French law with the protection offered by Australian legislation and common law.

Despite recent advances in the area of humanitarian responses and the publication and dissemination of various guidelines with regard to nutritional interventions, there is, however a paucity of studies which have examined the human right to food in complex emergencies. 186 countries including those affected by both human made and natural disasters and countries who are donors of humanitarian relief aid adopted the Rome Declaration on Food Security and World Summit plan of Action reaffirming “ the right to adequate food and the fundamental right of everyone to be free from hunger”. The human right to adequate and nutritious food in refugee settings implies that every refugee has physical and economic access to sufficient food to provide the necessary nutrients for effective physical and physiological functions and achieve well being. There are many grounds for believing that the current humanitarian responses to disasters more often violate than respect the human right to adequate and nutritious food. Using elements of household food security as our working framework this paper focuses on the complex ethical and moral questions raised by the conventional humanitarian assistance framework and in particular the issue of human right to food and household food security in refugee settings.

It has been claimed that the arguments for and against euthanasia have not changed in the last 120 years. Throughout this period, two rights claims have been thought to be central to the debate. The right to autonomy is invoked by many euthanasists as the main argument in support of euthanasia. This is often countered by the claim that euthanasia violates the right to life. This article argues that the relevance of these rights claims to the euthanasia debate has been overstated. More generally, it is argued that the bluntness of the rights claims in the context of the euthanasia debate is illustrative of the fact that the concept of rights is an unsuitable device for resolving moral disputes which involve conflicting rights.

One of the classic debates in corporate law relates to whether the rules of corporate law are ar should be 'mandatory', in that companies must comply, or 'enabling' - meaning a set of default rules which companies have the choice of adopting or 'opting out' of through alternative contractual arrangements. The so-called 'mandatory/enabling' debate has been especially prominent in the United States fro numerous reasons, yet has also received some attention in Australia. That said, the extent to which companies can 'opt out' of corporate law has rarely been considered as a practical issue in Australia - particularly whether Australian companies can 'opt out' of provisions under the Corporations Act ("the Act"). However, just recently, two high-profile events in Australia have made 'opting out' of corporate law a relevant issue, especially the question of whether companies are free to 'opt out' of provisions of the Corporations Act  which provide express governance rights to shareholders. These events were Boral's constitutional amendment in 2003 to restrict the ability of shreholders to propose amendments to the company's constitution, and the contemplation and introduction of so-called 'pre-nuptial' agreements- designed to by-pass the right of shreholders to vote on removing directors in public companies. In the light of these two recent events, in this article the authors revisit the mandatory/enabling debate. However, rather than going over old ground as to whether a mandatory or enabling approach to corporate regulation is desirable, the authors approach the issue from a fresh perspective: that Australian Securitiesand Investments Commission's ("ASIC") existing relief powers under the Act should be extended to provide a means for companies to opt out of provisions containing shareholder governance rights.
