Due to the powerful nature of confession evidence, it is imperative that we investigate the factors that affect the likelihood of obtaining true and false confessions. Previous research has been conducted with a paradigm limited to the study of false confessions to an act of negligence, thereby limiting the generalizability of the findings. The first goal of the current study was to introduce a novel paradigm involving a more serious, intentional act that can be used in the study of both true and false confessions. The second goal was to explore the effects of two police interrogation tactics, minimization and an offer of leniency, on true and false confession rates. ^ Three hundred and thirty-four undergraduates at a large southeastern university were recruited to participate in a study on problem-solving and decision-making. During the course of the laboratory experiment, participants were induced to intentionally break or not break an experimental rule, an act that was characterized as “cheating.” All participants (i.e., both innocent and guilty) were later accused of the act and interrogated. For half of the participants, the interrogator used minimization tactics, which involved downplaying the seriousness of the offense, expressing sympathy, and providing face-saving excuses, in order to encourage the participant to confess. An offer of leniency was also manipulated in which half the participants were offered a “deal” that involved the option of confessing and accepting a known punishment or not confessing and facing the threat of harsher punishment. Results indicated that guilty persons were more likely to confess than innocent persons, and that the use of minimization and an explicit offer of leniency increased both the true and false confession rates. Furthermore, a cumulative effect of techniques was observed, such that the diagnosticity of the interrogation (the ratio of true confessions to false confessions) decreased as the number of techniques used increased. Taken together, the results suggest that caution should be used when implementing these techniques in the interrogation room. ^

La problématique liée au manque d’accès à la justice se pose dans toutes les régions du monde. Afin de résoudre celle-ci, l’Assemblée nationale du Québec a adopté, le 20 février 2014, le projet de loi 28, Loi instituant le nouveau Code de procédure civile, 1e sess, 40e lég. À cet égard, la disposition préliminaire indique que le nouveau Code de procédure civile (ci-après : « NCPC »), qui régit dorénavant la procédure applicable aux modes de prévention et de règlement des différends (ci-après : « modes de PRD »), vise à « assurer l’accessibilité, la qualité et la célérité de la justice civile […] ». Au-delà de ces mots, qui ont une grande valeur interprétative, ce mémoire analyse dans quelle mesure l’intégration des principes de la procédure applicables aux modes de PRD dans le NCPC est réellement susceptible d’améliorer l’accessibilité de la justice civile au Québec.

El establecimiento de los medios idóneos para asegurar la eficacia práctica de las decisiones judiciales es una exigencia del buen funcionamiento de la Administración de Justicia. En ello juega un rol esencial la tutela cautelar. Durante los últimos años, tanto la doctrina como varios de los ordenamientos jurídicos de Europa y Latinoamérica han avanzado en la construcción de amplios y sólidos regímenes cautelares en el proceso administrativo, superando la visión tradicional del contencioso que limitaba la tutela cautelar a una única medida posible: la suspensión de la ejecución de los actos administrativos. Sin embargo, ello no ocurre así en Cuba, cuyo derecho procesal continúa descansando en la técnica de suspensión del acto y en la exacerbación del privilegio de autotutela ejecutiva de la Administración. El presente trabajo se propone demostrar la necesidad de creación de un nuevo régimen de tutela cautelar en el contencioso administrativo cubano, que sea capaz de garantizar una justicia administrativa eficaz en su misión de proteger los derechos de los ciudadanos y del interés general frente a cualquier comportamiento de la Administración Pública que los vulnere.

Le financement des municipalités québécoises repose en majeure partie sur des revenus autonomes, dont la principale source découle de leur pouvoir de taxer la richesse foncière. Par conséquent, le législateur, voulant assurer la stabilité financière des municipalités, a strictement encadré le processus de confection et de révision des évaluations foncières par plusieurs lois et règlements. Ceci n’a tout de même pas empêché l’augmentation des demandes de contestations à chaque nouveau rôle. Débutant par une demande de révision administrative, à l’aide d’un simple formulaire, le litige entre la municipalité et le contribuable peut se poursuivre devant le Tribunal administratif du Québec et même la Cour du Québec, la Cour supérieure et la Cour d’appel, où la procédure devient de plus en plus exigeante. La transition du processus administratif à judiciaire crée parfois une certaine friction au sein de la jurisprudence, notamment au niveau de la déférence à accorder à l’instance spécialisée, ou encore à l’égard de la souplesse des règles de preuve applicables devant cette dernière. Par une étude positiviste du droit, nous analysons tout d’abord la procédure de confection du rôle foncier, en exposant les acteurs et leurs responsabilités, ainsi que les concepts fondamentaux dans l’établissement de la valeur réelle des immeubles. Ensuite, nous retraçons chacune des étapes de la contestation d’une inscription au rôle, en y recensant les diverses règles de compétence, de preuve et de procédure applicables à chaque instance. À l’aide de nombreux exemples jurisprudentiels, nous tentons de mettre en lumière les différentes interprétations que font les tribunaux de la Loi sur la fiscalité municipale et autres législations connexes.

This paper discusses the relationship between law and morality. Morality does not necessarily coincide with the law, but it contributes to it. An act may be legal but nevertheless considered to be immoral in a particular society. For example, the use of pornography may be considered by many to be immoral. Nevertheless, the sale and distribution of non-violent, non-child related, sexually explicit material is legal (or regulated) in many jurisdictions. Many laws are informed by, and even created by, morality. This paper examines the historical influence of morality on the law and on society in general. It aims to develop a theoretical framework for examining legal moralism and the social construction of morality and crime as well as the relationship between sex, desire and taboo. Here, we refer to the moral temporality of sex and taboo, which examines the way in which moral judgments about sex and what is considered taboo change over time, and the kinds of justifications that are employed in support of changing moralities. It unpacks the way in which abstract and highly tenuous concepts such as ‘‘desire’’, ‘‘art’’ and ‘‘entertainment’’ may be ‘‘out of time’’ with morality, and how morality shapes laws over time, fabricating justifications from within socially constructed communities of practice. This theoretical framework maps the way in which these concepts have become temporally dominated by heteronormative structures such as the family, marriage, reproduction, and longevity. It is argued that the logic of these structures is inexorably tied to the heterosexual life-path, charting individual lives and relationships through explicit phases of childhood, adolescence and adulthood that, in the twenty-first century, delimit the boundaries of taboo surrounding sex more than any other time in history.

Over the last two decades, particularly in Australia and the UK, the doctoral landscape has changed considerably with increasingly hybridised approaches to methodologies and research strategies as well as greater choice of examinable outputs. This paper provides an overview of doctoral practices that are emerging in the context of the creative industries, with a focus on practice-led approaches within the Doctor of Philosophy and recent developments in professional doctorates, from a predominantly Australian perspective. In interrogating what constitutes ‘doctorateness’ in this context, the paper examines some of the diverse theoretical principles which foreground the practitioner/researcher, methodological approaches that incorporate tacit knowledge and reflective practice together with qualitative strategies, blended learning delivery modes, and flexible doctoral outputs; and how these are shaping this shifting environment. The paper concludes with a study of the Doctor of Creative Industries at Queensland University of Technology as one model of an interdisciplinary professional research doctorate.

This chapter will discuss how environmental factors, specifically one’s backgrounds and where one lives, has an impact on teaching and learning. You have learned from previous chapters that inclusive education is underpinned by human rights and social justice issues. This chapter takes up that argument by identifying the diversity of students in city and suburban schools and how some are excluded, leading to disengagement with learning. We suggest possible pedagogy such as differentiated instruction and a ‘pedagogy of hope’ to counter student disengagement. Inclusive education, as anact of imagination’ engages students in creative ways with the curriculum, where they can find meaning and purpose in what they are doing. Such engagement allows student to make connections between their school work and their own life worlds.

Through its focus on perceptions of responsibility and the development of a theoretical framework for voluntary initiatives, the thesis offers key stakeholders and advocates a way to work towards the provision of inclusive housing as an instrument of distributive justice.

In recent years, restorative justice has become an immensely popular criminal justice option in contemporary western societies. Restorative practices have emerged in diverse parts of the world often in total isolation from one another – that is, they have emerged without knowledge of other, similar practices. This quandary prompts us to question how it is that restorative processes have come about, and what it is that has allowed restorative justice to become such a widely acceptable way of thinking about crime and criminal justice. The research project from which this pa-per stems takes this as its central problem, and aims to explore the many dis-courses which inform the field of restorative justice, or more specifically, the “conditions of emergence” of this field. This paper focuses on one of these discourses – the discourse of the therapeutic/recovery/self-help movement, famously championed by talk-show host Oprah Winfrey. It aims to investigate the ways in which the taken-for-granted nature of this discourse has permitted restorative justice to be-come an approved way of “doing justice”.

Royal commissions are approached not as exercises in legitimation and closure but as sites of struggle that are heavily traversed by power holders yet are open to the voices of alternative and unofficial social groups, social movements, and individuals. Three case studies are discussed that highlight the hegemony of the legal methodology and discourse that dominate many inquiries. The first case, involving a single-case miscarriage inquiry, involves a man who was accused, convicted, and served a prison sentence for the murder of his wife. Nineteen years following the murder another man confessed to the crime. The official inquiry found that nothing had gone wrong in the criminal justice process; it had operated as it should. Thus, in the face of evidence that the criminal justice process may be flawed, the discursive strategy became one of silence; no explanation was offered except for the declaration that nothing had gone wrong. The fallibility of the criminal justice system was thus hidden from public view. The second case study examines the Wood Royal Commission into corruption charges within the NSW Police Service. The royal commission revealed a bevy of police misconduct offenses including process corruption, improper associations, theft, and substance abuse, among others. The author discusses the ways in which the other criminal justice players, the judiciary and prosecuting attorneys, emerge only briefly as potential ethical agents in relation to police misconduct and corruption and then abruptly disappear again. Yet, these other players are absolved of any responsibility for police misconduct. The third case study involves a spin-off inquiry into the facts surrounding the Leigh Leigh rape and murder case. This case illustrates how official inquires can seek to exclude non-traditional viewpoints and methodologies; in this case, the views of a feminist criminologist. The third case also illustrates how the adversarial process within the legal system allows those with power to subjugate the viewpoints of others through the legitimate use of cross-examination. These three case studies reveal how official inquiries tend to speak from an “idealized conception of justiceand downplay any viewpoint that questions this idealized version of the truth.

Since the 1998 Rome Statute recognized widespread and systematic acts of sexual and gender-based violence (SGBV) as an act of genocide, a war crime and crime against humanity, the last decade has seen historic recognition that egregious acts of sexual violence merit international political and legal attention (UN General Assembly, 1998). Notably there are now no fewer than seven United Nations Security Council resolutions on the cross-cutting theme of Women, Peace and Security.

One of the causes of lower artesian pressure, water waste and aquifer contamination is the misuse and insufficient care of artesian wells. In 1953, Senate Bill No. 57, entitled "An Act to Protect and Control the Artesian Waters of the State" (see Appendix) became a law. This law was passed through the efforts exerted by leading members of the Senate and the House of Representatives, who understood the need for a wise and controlled expenditure of our most valuable natural resource. The State Geologist and his authorized representatives were designated by this law to enforce this conservation measure; however, no financial provision was included for the 1953-55 biennium. The proposed program of the Florida Geological Survey for this biennium did not include the funds nor provide any full-time personnel for the enforcement of this statute. As a result, little actual work was accomplished during these two years, although much time was given to planning and discussion of the problem. Realizing that this program could provide additional basic data needed in the analysis of the water-supply problem, the State Geologist sought and was granted by the 1955 Legislature adequate funds with which to activate the first phase of the enforcement of Florida Statute No. 370.051-054. Enumerated below is a summary of the progress made on this investigation as outlined previously: 1. Data have been collected on 967 wildly flowing wells in 22 counties. 2. Chloride determinations have been run on 850 of the 967 wells. 3. Of the 967 wells, 554 have chlorides in excess of the 250 ppm, the upper limit assigned by the State Board of Health for public consumption. 4. Water escapes at the rate of 37, 762 gallons per minute from these 967 wells. This amounts to 54, 377, 280 gallons per day. The investigation is incomplete at this time; therefore, no final conclusions can be reached. However, from data already collected, the following recommendations are proposed: 1. That the present inventory of wildly flowing wells be completed for the entire State. 2. That the current inventory of wildly flowing wells be expanded at the conclusion of the present inventory to include all flowing wells. 3. That a complete statewide inventory program be established and conducted in cooperation with the Ground Water Branchof the U.S. Geological Survey. 4. That the enforcement functions as set down in Sections 370.051/.054, Florida Statutes, be separated from the program to collect water-resource data and that these functions be given to the Water Resources Department, if such is created (to be recommended by the Water Resources Study Commission in a water policy law presented to the 1957 Legislature). 5. That the research phase (well inventory) of the program remain under the direction of the Florida Geological Survey. (PDF contains 204 pages.)

Trata-se de estudo dirigido à afirmação da natureza objetiva da responsabilidade objetiva da Administração Pública por atos omissivos. Defende-se a correta aplicação do artigo 37 parágrafo 6 da Constituição da República, em que se fora estabelecida a responsabilidade objetiva da Administração em todas as hipóteses em que esteja configurado nexo causal entre sua atuação, comissiva ou omissiva, e um dano injusto ocorrido. É novo o enfoque que norteia a reparação civil, não mais a atividade realizada pelo agente, mas as conseqüências sofridas pela vítima deste dano injusto. Exercitada na seara da responsabilidade civil do Estado, considerado em sentido lato, parece ainda mais lógica a mudança de enfoque mencionada, em razão do princípio norteador do seu dever de reparar, que é o da repartição eqüitativa dos encargos da Administração. De fato, sempre que a atividade administrativa estatal, exercida em benefício de toda a coletividade, gerar dano injusto a um particular específico, configurar-se-á sua responsabilidade de reparar este dano, já que, se é em nome da coletividade que se adotou a conduta geradora do dano, esta a idéia principal daquela diretriz enunciada. Daí por que a verificação da presença do elemento subjetivo culpa, em sede de responsabilidade do Poder Público, fora tornada inteiramente estranho ao exame. A correta leitura do artigo constitucional, com reconhecimento da responsabilidade objetiva do Estado nas hipóteses de ato comissivo e omissivo da Administração Pública, realiza, ainda, o princípio da solidariedade social, que implica preponderância do interesse da reparação da vítima lesada sobre o interesse do agente que realiza, comissiva ou omissivamente, o ato lesivo. Essa a legitimidade da teoria do risco administrativo adotada, a adoção de coerente verificação do nexo causal, com admissão da oposição de excludentes de responsabilidade. Ademais, entre a vítima e o autor do dano injusto, a primeira não obtém, em geral, beneficio algum com o fato ou a atividade de que se originou o dano. Se assim é, a configuração do dever de indenizar da Administração Pública dependerá, apenas, da comprovação, no caso concreto, de três pressupostos que se somam: a atuação do Estado, a configuração do dano injusto e o nexo de causalidade. Será referida a jurisprudência espanhola consagrada à regra de responsabilidade objetiva da Administração Pública por atos omissivos, com considerações acerca da resposta da Jurisprudência daquele país ao respectivo enunciado normativo. Buscou-se, desta forma, elencar-se os elementos básicos à compreensão do tema, e também os pressupostos essenciais à afirmação da natureza objetiva da responsabilidade da Administração Pública por atos omissivos, que são, primordialmente, a compreensão do fundamento da regra constitucional, a correta delimitação do conceito de omissão e de causalidade omissiva. Destacados os pressupostos necessários à correta compreensão do tema, conclui-se pela afirmação da natureza objetiva da responsabilidade da Administração Pública por dano injusto advindo de ato omissivo, desde que assim o seja, querendo-se significar, desta forma, que a responsabilidade mencionada não prescinde da configuração do nexo causal entre o comportamento omissivo ocorrido e o dano injusto que se quer reparar.
