Puts the case for reform of the law to allow for the administration of the estate of a missing person in the interim period between their disappearance and any later declaration of their presumed of death. Explains why reform is needed. Notes Parliamentary activities relating to the presumption of death and interim administration in the period 2008-12. Highlights Australian and Canadian legislation providing for such interim administration and the Irish Law Commission recommendations for a statutory scheme on administering a missing person's property.

The Brazilian juridical ordain has suffered several transformations on Family Law as of the 1988 Federal Constitution, which incorporated the changes in socio-cultural values and behaviors that appeared in the post-modern Brazilian society, with the repersonalization of the family, beginning with the principles of human dignity, affectivity and familiar solidarity; occurring an enlargement of the concept of family, increasing the relevance of socioaffectivity and eudaimonia. The general purpose of this dissertation is to analyze the constitutional interpretations of paradigmatic cases of the Brazilian Superior Courts checking the conditions and behaviors required to achieve the principles of affectivity and familiar solidarity. To do so, uses an exploratory and descriptive research trough books, scientific papers, jurisprudence, monographs and consult to specialized magazines to identify the reasons and specific purposes of the principles of affectivity and family solidarity within the constitutional norms, systematizing the primary meaning of these principles, then to observe the trial of patriotic courts, the criteria and standards of behavior used in their application. The analysis of recent decisions of the Supreme Federal Court and the Superior Court of Justice on the topic of the familiar relations, utilizing the new interpretative approach to the law that considers man as an ontological being of language, demonstrate that the affectivity and familiar solidarity are constitutional principles concretized in decisions, that don’t affect the principle of protection of the juridical security, that is, don’t cause uncertainty despite the incipient specification of criteria to its use

In Ireland, the Constitution guarantees very strong rights to parents and the family, and there has been a long and unfortunate history of failures to adequately protect children at risk. As a result, there has been much discussion in recent years about the need to improve legal mechanisms designed to protect the rights of children. By comparison, little attention has been given to establishing whether the theoretically strong rights of parents translate into strongly protected rights in practice. This paper presents new empirical evidence on the manner in which child care proceedings in Ireland balance the rights and interests of children and parents, including the rates at which orders are granted, the frequency of and conditions in which legal representation is provided, and the extent to which parents are able to actively participate in proceedings. A number of systemic issues are identified that restrict the capacity of the system to emphasise parental rights and hear the voice of parents to the extent that would be expected when looking at the legal provisions in isolation.

It is widely accepted that court proceedings concerning child protection are a particularly sensitive type of court proceedings that warrant a different approach to other types of proceedings. Consequently, the use of specialized family or children’s judges or courts is commonplace across Europe and in common law jurisdictions. By contrast, in Ireland, proceedings under the Child Care Act 1991 are heard in the general courts system by judges who mostly do not specialize in child or family law. In principle, the Act itself and the associated case law accept that the vulnerability of the parties and the sensitivity of the issues involved are such that they need to be singled out for a different approach to other court proceedings. However, it is questionable whether this aspiration has been realized in a system where child care proceedings are mostly heard in a general District Court, using the same judges and the same physical facilities used for proceedings such as minor crime and traffic offences. This article draws on the first major qualitative analysis of professional perspectives on child care proceedings in the Irish District Court. It examines evidence from judges, lawyers, social workers, and guardians ad litem and asks whether non-specialist courts are an appropriate venue for proceedings on an issue as complex and sensitive as child protection, or whether the establishment of specialist family courts with dedicated staff and facilities provides a better solution.

There has been a debate for years about what the role of the ombudsman is. This article examines a key component of the role, to promote trust in public services and government. To be able to do this, however, an ombudsman needs to be perceived as legitimate and be trusted by a range of stakeholders, including the user. This article argues that three key relationships in a person’s complaint journey can build trust in an institution, and must therefore be understood as a system. The restorative justice framework is adapted to conceptualize this trust model as a novel approach to understanding the institution from the perspective of its users. Taking two public sector ombudsmen as examples, the article finds that voice and trust need to be reinforced through the relationships in a consumer journey to manage individual expectations, prevent disengagement, and thereby promote trust in the institution, in public service providers, and in government.

La igualdad ante la ley es uno de los derechos fundamentales de las Constituciones modernas. Sin embargo, hay algo más. De hecho podría decirse que los modernos sistemas jurídicos se han ido formando alrededor de la idea de igualdad. El valor de la igualdad parece expresar una manera común de entender las relaciones humanas, especialmente en el caso de la igualdad de género, expresamente mencionado por el artículo de las Constituciones democráticas modernas que se refiere al principio de igualdad ante la ley. El presente estudio trata esa forma específica de igualdad que se caracteriza por la paradoja de querer tratar como igual lo que es diferente, o sea, de hacer distinciones sin discriminar. Con este fin nos referimos al enfoque jurídico y al enfoque político del tema como se encuentran en la reforma del derecho de familia. No es un problema de una específica legislación nacional, sino más bien una versión específica de un problema de nivel general. Se trata de la imposibilidad de construir como indistinguible lo que es diferente. El intento político de reformar el derecho de familia para implementar el principio constitucional de igualdad no consigue resolver el problema. Éste vuelve a aparecer por la imposibilidad que el derecho funcione sin crear diferencias. Al mismo tiempo, surgen problemas nuevos relacionado con formas nuevas de organizar la vida familiar.

This article argues that the concept of a public/private divide is inappropriate in the context of children's proceedings in Northern Ireland. It highlights the problem by examining policy proposals in respect of legal aid/services, which have been structured and validated by the concept. A spectral model for understanding children's proceedings is proffered by way of a proposed replacement.

The concept of non-territorial autonomy gives rise to at least two important questions: the range of functional areas over which autonomy extends, and the extent to which this autonomy is indeed non-territorial. A widely used early description significantly labelled this ‘national cultural autonomy’, implying that its focus is mainly on cultural matters, such as language, religion, education and family law. In many of the cases that are commonly cited, ‘autonomy’ may not even extend this far: its most visible expression is the existence of separate electoral registers or quotas for the various groups. Part of the dilemma lies in the difficulty of devolving substantial power on a non-territorial basis: to the extent that devolved institutions are state-like, they ideally require a defined territory. Ethnic groups, however, vary in the extent to which they are territorially concentrated, and therefore in the degree to which any autonomous arrangements for them are territorial or non-territorial. This article explores the dilemma generated by this tension between ethnic geography (pattern of ethnic settlement) and political autonomy (degree of selfrule), and introduces a set of case studies where the relationship between these two features is discussed further: the Ottoman empire and its successor states, the Habsburg monarchy, the Jewish minorities of Europe, interwar Estonia, contemporary Belgium, and two indigenous peoples, the Sa´mi in Norway and the Maori in New Zealand.

Tiivistelmä TURUN YLIOPISTO Oikeustieteellinen tiedekunta Perhe-oikeus VALJAKKA EEVA: Vain lakiko lasta suojelee? Väitöskirja, 219 s. Kesäkuu 2016 Tutkimuksessa tarkastellaan suomalaisen lastensuojelulainsäädännön pitkän ai- kavälin kehitystä 1800-luvun lopulta 2010-luvulle. Tavoitteena on selvittää, mil- lä tavoin lasten suojelun tarvetta on lastensuojelulakeja säädettäessä määritelty ja millaisin keinoin julkinen valta on suojellut lapsia. Tutkimuksessa luodaan myös yleisemmin kuvaa siitä, millaista keskustelua lastensuojelun yhteiskunnallisesta tehtävästä, yksityisen ja julkisen hyvinvointivastuun jakautumisesta sekä julkisen vallan perheen yksityisyyteen puuttuvien toimien tarpeellisuudesta ja oikeutukses- ta on eri aikoina käyty. Tutkimuksessa lastensuojelun käsitettä käytetään sekä laa- jemmassa (Child Welfare) että suppeammassa (Child Protection) merkityksessä. Tutkimus on lapsi- ja oikeuspoliittinen puheenvuoro, jossa lastensuojelun institutionaalisia kehityskulkuja tarkastellaan yhteiskunnassa sosioekonomisesti heikoimmassa asemassa olevan lapsiväestön ja lastensuojelun asiakkaiksi valikoi- tuvien lasten näkökulmasta. Tutkimusote on ongelmalähtöinen ja yhteyshakuinen siten, että tutkimuskysymyksiä tarkastellaan monitieteisesti hallinto- ja sosiaalioi- keudellisessa viitekehyksessä. Tutkimus osoittaa, että tarkasteltaessa lastensuojelua käsitteen suppeam- massa merkityksessä lastensuojeluinstituution rakenteet kuten lasten suojelutar- peen määrittely, suojelun keinot ja lastensuojelulain julkilausutut tavoitteet ovat pysyneet lähes samankaltaisina aina ensimmäisen lastensuojelulain (1936) säätä- misestä lukien. Tarkasteltaessa lastensuojelua käsitteen laajemmassa merkityksessä voidaan lastensuojelussa nähdä tapahtuneen muutoksia. Vähitellen hyvinvointivaltion laajentuessa lastensuojelua koskeva ymmärrys muuttui yhä moniulotteisemmak- si. Lastensuojelu merkitsi 1960-luvulle tultaessa laajaa lapsiväestön hyvinvointia turvaavaa yhteiskuntapoliittista ohjelmaa. Myös sosiaalipolitiikan suunnanmuutos 1990-luvulla ja sen myötä julkisen vallan vastuun kaventaminen merkitsivät muu- tosta lastensuojelussa. Monille yhteiskunnan eri osa-aluille ulottuvien perheiden ja lasten hyvinvointia tavoittelevien politiikkaohjelmien ja niiden toteuttamispyrki- mysten sijaan lastensuojelu kaventui niin käsitteenä kuin käytännön toimintanakin tarkoittamaan lähes yksinomaan sosiaalihuollon erityispalvelua eli lapsi- ja perhe- kohtaista lastensuojelua. El Código civil y la legislación especial intentan satisfacer la necesidad de vivienda. Además de la adquisición de la propiedad, existen figuras como el derecho de habitación (Derechos reales) o el arrendamiento urbano y sus modalidades de cesión y subarriendo, el préstamo gratuito (Derecho de contratos) o la atribución del uso de la vivienda familiar a uno de los progenitores y a los hijos (Derecho de Familia). Se examinan sus requisitos y efectos para aprovechar posibilidades y detectar abusos.
