Cuando en la expedición de un acto procesal hay un apartamiento de ciertas formas, o bien se omiten requisitos que la ley exige para su validez, se dice que es nulo. Estos errores determinan que la nulidad sea un vicio que afecta a las formas, no al contenido del acto, por ello, para declarar una nulidad procesal -diríase el remedio extremo-, el juzgador debe atenerse a ciertos principios, en especial, cuando el vicio afecta gravemente la garantía de defensa de los justiciables. El tratamiento que otorga la legislación procesal civil ecuatoriana a la materia no es sistemático, es de esperar que un nuevo cuerpo legal, siguiendo la corriente que en la materia ha impuesto el Código Procesal Civil Modelo para Iberoamérica, corrija la dispersión en el sistema e incorpore nuevos principios y figuras.

Recent analysis of the Arctic Oscillation (AO) in the stratosphere and troposphere has suggested that predictability of the state of the tropospheric AO may be obtained from the state of the stratospheric AO. However, much of this research has been of a purely qualitative nature. We present a more thorough statistical analysis of a long AO amplitude dataset which seeks to establish the magnitude of such a link. A relationship between the AO in the lower stratosphere and on the 1000 hPa surface on a 10-45 day time-scale is revealed. The relationship accounts for 5% of the variance of the 1000 hPa time series at its peak value and is significant at the 5% level. Over a similar time-scale the 1000 hPa time series accounts for 1% of itself and is not significant at the 5% level. Further investigation of the relationship reveals that it is only present during the winter season and in particular during February and March. It is also demonstrated that using stratospheric AO amplitude data as a predictor in a simple statistical model results in a gain of skill of 5% over a troposphere-only statistical model. This gain in skill is not repeated if an unrelated time series is included as a predictor in the model. Copyright © 2003 Royal Meteorological Society

The overall and the individual rate constants of the unimolecular thermal isomerization of methylenespiropentane (4) to 1,2- and 1,3-dimethylenecyclobutanes (7 and 8) have been determined to be lg (k(-4)/s(-1)) = (13.78 +/- 0.06) - (49.7 +/- 0.2) kcal mol(-1)/RT.ln 10, lg(k(7)/s(-1)) = (13.03 +/- 0.19) - (48.0 +/- 0.6) kcal mol(-1)/RT.ln 10 and lg(k(8)/s(-1)) = (14.15 +/- 0.19) - (52.4 +/- 0.5) kcal mol(-1)/RT.ln 10, respectively. Apolipoprotein E4 (apoE4) genotype is associated with an increased risk for Alzheimer's disease (AD). This is thought to be in part attributable to an impact of apoE genotype on the processing of the transmembrane amyloid precursor protein (APP) thereby contributing to amyloid beta peptide formation in apoE4 carriers, which is a primary patho-physiological feature of AD. As apoE and alphato-copherol (alpha-toc) have been shown to modulate membrane bilayer properties and hippocampal gene expression, we studied the effect of apoE genotype on APP metabolism and cell cycle regulation in response to dietary a-toc. ApoE3 and apoE4 transgenic mice were fed a diet low (VE) or high (+VE) in vitamin E (3 and 235 mg alpha-toe/kg diet, respectively) for 12 weeks. Cholesterol levels and membrane fluidity were not different in synaptosomal plasma membranes isolated from brains of apoE3 and apoE4 mice (-VE and +VE). Non-amyloidogenic alpha-secretase mRNA concentration and activity were significantly higher in brains of apoE3 relative to apoE4 mice irrespective of the dietary a-toe supply, while amyloidogenic beta-secretase and gamma-secretase remained unchanged. Relative mRNA concentration of cell cycle related proteins were modulated differentially by dietary a-toc supplementation in apoE3 and apoE4 mice, suggesting genotype-dependent signalling effects on cell cycle regulation.

Hydrophilic polymeric films based on blends of hydroxyethylcellulose and maleic acid-co-methyl vinyl ether were produced by casting from aqueous solutions. The physicochemical properties of the blends have been assessed using Fourier transform infrared spectroscopy, thermal gravimetric analysis, differential scanning calorimetry, dielectric spectroscopy, etc. The pristine films exhibit complete miscibility due to the formation of intermacromolecular hydrogen bonding. The thermal treatment of the blend films leads to cross-linking via intermacromolecular esterification and anhydride formation. The cross-linked materials are able to swell in water and their swelling degree can be easily controlled by temperature and thermal treatment time. The formation of the crosslinks is apparent in the dynamic properties of the blends as observed through the mechanical relaxation and dielectric relaxation spectra. The dielectric characteristics of the material are influenced by the effects of change in the local structure of the blend on the ionic conduction processes and the rate of dipolar relaxation. Separation of these processes is attempted using the dielectric modulus method. Significant deviations from a simple additive rule of mixing on the activation energy are observed consistent with hydrogen bonding and crosslinking of the matrix. This paper indicates a method for the creation of films with good mechanical and physical characteristics by exposing the blends to a relatively mild thermal treatment.

The Baja California Peninsula is home to 85 species of cacti, of which 54 are endemic, highlighting its importance as a cactus diverse region within Mexico. Many species are under threat due to collection pressure and habitat loss, but ensuring maximal protection of cacti species requires a better understanding of diversity patterns. We assessed species richness, endemism, and phylogenetic and morphological diversity using herbarium records and a molecular phylogeny for 82 species of cacti found in the peninsula. The four diversity measures were estimated for the existing nature reserve network and for 314 hexagrids of 726 km2. Using the hexagrid data, we surveyed our results for areas that best complement the current protected cacti diversity in the Baja California Peninsula. Currently, the natural reserve network in Baja shelters an important amount of the cacti diversity (74% of the species, 85.9% of the phylogenetic diversity, 76% of endemics and all the growth forms). While species richness produced several solutions to complement the diversity protected, by identifying priority species (endemic species with high contribution to overall PD) one best solution is reported. Three areas (San Matías, Magdalena and Margarita Islands and El Triunfo), selected using species richness, PD and endemism, best complement the diversity currently protected, increasing species richness to 89%, PD to 94% and endemism to 89%, and should be considered in future conservation plans. Two of these areas could be included within nature reserves already established.

The archaeology of Britain during the early Middle Pleistocene (MIS 19–12) is represented by a number of key sites across eastern and southern England. These sites include Pakefield, Happisburgh 1, High Lodge, Warren Hill, Waverley Wood, Boxgrove, Kent's Cavern, and Westbury-sub-Mendip, alongside a ‘background scatter’ lithic record associated with the principal river systems (Bytham, pre-diversion Thames, and Solent) and raised beaches (Westbourne–Arundel). Hominin behaviour can be characterised in terms of: preferences for temperate or cool temperate climates and open/woodland mosaic habitats (indicated by mammalian fauna, mollusca, insects, and sediments); a biface-dominated material culture characterised by technological diversity, although with accompanying evidence for distinctive core and flake (Pakefield) and flake tool (High Lodge) assemblages; probable direct hunting-based subsistence strategies (with a focus upon large mammal fauna); and generally locally-focused spatial and landscape behaviours (principally indicated by raw material sources data), although with some evidence of dynamic, mobile and structured technological systems. The British data continues to support a ‘modified short chronology’ to the north of the Alps and the Pyrenees, with highly sporadic evidence for a hominin presence prior to 500–600 ka, although the ages of key assemblages are subject to ongoing debates regarding the chronology of the Bytham river terraces and the early Middle Pleistocene glaciations of East Anglia.

In a previous work [M. Mandaji, et al., this issue] a sample stacking method was theoretically modeled and experimentally demonstrated for analytes with low dpK(a)/dT (analytes carrying carboxylic groups) and BGEs with high dpH/dT (high pH-temperature-coefficients). In that work, buffer pH was modulated with temperature, inducing electrophoretic mobility changes in the analytes. In the present work, the opposite conditions are studied and tested, i.e. analytes with high dpK(a)/dT and BGEs that exhibit low dpH/dT. It is well known that organic bases such as amines, imidazoles, and benzimidazoles exhibit high dpK(a)/dT. Temperature variations induce instantaneous changes on the basicity of these and other basic groups. Therefore, the electrophoretic velocity of some analytes changes abruptly when temperature variations are applied along the capillary. This is true only if BGE pH remains constant or if it changes in the opposite direction of pK(a) of the analyte. The presence of hot and cold sections along the capillary also affects local viscosity, conductivity, and electric field strength. The effect of these variables on electrophoretic velocity and band stacking efficacy was also taken into account in the theoretical model presented. Finally, this stacking method is demonstrated for lysine partially derivatized with naphthalene-2,3-dicarboxaldehyde. In this case, the amino group of the lateral chain was left underivatized and only the alpha amino group was derivatized. Therefore, the basicity of the lateral amino group, and consequently the electrophoretic mobility, was modulated with temperature while the pH of the buffer used remained unchanged.

Esta dissertação analisa potencialidades de uso da ferramenta de simulação computacional em atividades de um Armazém Geral. Para tanto, foi realizado um estudo de caso em um Armazém Geral onde se aplicou a ferramenta segundo o método de desenvolvimento de projetos de simulação computacional proposto por Barrônio (2000). O desenvolvimento do projeto de simulação foi, então, focado na atividade de apanha separação, integrante do sub-processo de separação de pedidos. O substrato teórico utilizado envolve uma abordagem sobre a logística e caracterização de armazém geral, bem como uma revisão dos conceitos principais da ferramenta de simulação computacional. No desenvolvimento da pesquisa, identificaram-se diversas aplicações da simulação tanto no armazém geral e terminais de cargas da empresa, quanto na análise da malha de rotas da empresa. A partir da análise dos resultados da simulação, em diversos cenários desenvolvidos e do entendimento sistêmico da situação em estudo, identificou-se como oportunidade de melhoria a definição de horários fixos de parada para descanso ao longo da jornada de trabalho na atividade de apanha separação O desenvolvimento do projeto de simulação computacional contribuiu como instrumento de aprendizagem e tomada de decisões sobre a realidade organizacional. Através de experimentação no modelo computacional o grupo de trabalho pôde testar e mudar seus pressupostos e sua compreensão do mundo real, aprimorando a aprendizagem. Identificou-se ainda, que os armazéns gerais dotados de sistema de gerenciamento automatizado apresentam um grande potencial para desenvolvimento de projetos de simulação, principalmente, devido à disponibilidade de dados característicos destas organizações.

Avaliaram-se os efeitos da inclusão de farelo de canola em dietas de juvenis de pacu (Piaractus mesopotamicus) sobre parâmetros de crescimento e composição corporal. Um total de 192 alevinos (9 a 15g) foram estocados em 24 tanques de cimento, de 100l de capacidade, durante 103 dias. O farelo de canola foi utilizado em quatro proporções: zero; 9,5%; 19% e 38% da dieta, com ou sem farinha de peixe (12%/dieta), totalizando oito tratamentos. A presença de farinha de peixe não afetou os parâmetros de crescimento avaliados. A inclusão de 38% de farelo de canola na dieta diminuiu o ganho de peso dos peixes, valores médios de 28,74g a 50,70g, e piorou a conversão alimentar aparente, de 1,66 para 2,85. A taxa de eficiência protéica também foi menor nos peixes alimentados com 38% de farelo de canola. As várias proporções de farelo de canola das dietas alteraram os teores de umidade, proteína bruta e lipídios dos peixes. A presença da farinha de peixe, nas dietas, somente influiu no teor de lipídios dos peixes alimentados com dietas contendo 9,5% de farelo de canola. Conclui-se que até 19% de farelo de canola pode ser adicionado às dietas de juvenis de pacu, sem que seu desenvolvimento seja prejudicado.
