Indenture of release regarding a loan of 12, 500 pounds which Samuel Zimmerman (deceased) is said to have lent and advanced to the Woodstock and Lake Erie Railway and Harbour Company. This is put forward by the executors who include: Joseph A. Woodruff, Richard Woodruff, John L. Ranney and Richard Miller. This document releases and exonerates the Railway Company from any debts to the executors. [The outside of the document says 1857, but the actual date is Feb. 10, 1858].

Indenture of release by executors between Richard Miller, John L. Ranney and Richard Woodruff, all of St. Catharines and Joseph A. Woodruff of Clifton, all executors of the will of Samuel Zimmerman of the first part and The Great Western Railway Company of the second part. Parties of the second part have exonerated parties of the first part to undertake and complete the Sarnia branch of the railway. Also, parties of the first part believe they are entitled to compensation as the death of Zimmerman was caused while travelling on one of the carriages belonging to said company. A sum of $150,000 was agreed upon to be paid to the executors by the Great Western Railway Company, September 7, 1858.

Statement signed by Hume Blake of Toronto (2 ½ pages) who has read the will of Joseph Clement dated May 14, 1810 and has also read the will of Mary M. Clement dated Sept. 10, 1842. He states that the devise to James D. Clement and Joseph Clement is void. “The executor therefore take the personal estate … and the lands devised to James and Joseph Clement descend unencumbered to the heir of the testator Joseph Clement.” This document is slightly burned on the edges but text is not affected. The outer page says “Mr. Hume Blake for Brock Woodruff, May 9, 1845.

Les « dispositions successorales spéciales » de la lex situs apportent une exception particulière au système unitaire de la loi applicable à la succession. Leur reconnaissance dans le récent Règlement du Parlement européen et du Conseil relatif à la compétence, la loi applicable, la reconnaissance et l'exécution des décisions, et l'acceptation et l'exécution des actes authentiques en matière de successions et à la création d'un certificat successoral européen du 4 juillet 2012 témoigne de l’importance et de l’actualité de cette prévision normative. L’exception trouve sa source dans l’article 15 de la Convention du 1er août 1989 sur la loi applicable aux successions à cause de mort, formule qui fut suivi par l’article 3099 al. 2 du Code civil du Québec. La conception originaire de la règle se situe à l’article 28 de la Loi d’introduction au Code civil allemand de 1896. Ces législations reconnaissent la nécessité de respecter certaines dérogations aux règles successorales ordinaires dont le contenu matériel justifie une rupture exceptionnelle de l’unité de la succession internationale. Ainsi, l’opposition traditionnelle entre le système scissionniste qui divise la loi applicable à la succession en fonction de la nature mobilière ou immobilière des biens et celui qui postule l’unité législative trouve dans le respect des « dispositions spéciales » de la lex rei sitae régissant certains biens de la succession un facteur conciliateur. Il s’agit de respecter un minimum normatif de la loi de l’État où sont situés certains biens de la succession malgré la compétence générale d’une lex successionis étrangère. Ce bloc normatif irréductible se présente comme un pont qui relie les deux solutions extrêmes dans une position intermédiaire où il n’y a plus de scission au sens classique du terme mais où l’unité est néanmoins brisée en raison de certaines considérations substantielles tirées de la destination des biens.

Perhaps the most characteristic feature of our timesis that economic development has become the goal and ambition of people. The needs which this desire creates are immense they are of course urgent everywhere and they cannot be postponded. Consequently there was a frantic search for formulae of rapid economic development. It was claimed that agrarian reform is the indispensable condition for the development of productive forces and industrialization of the state.A key element in the land reform policy is the provision for ownership of land .Measures taken include redistribution of large estates ,assistance to tenants or labourers to acquire holdings and settlement schemes to establish new farming units on reclaimed or developed lands.In this thesis an attempt is made to evaluate the impact of these reforms on the agrarian structure in general and the scheduled caste in particular.
