La tutela jurídica de los bienes arqueológicos en la Roma pontificia: Del "Sacco" de Roma al Dominio francés (1527-1795)

El presente artículo es síntesis de un trabajo doctoral dedicado al interés por los restos del pasado y su conocimiento así como a los comienzos de la tutela jurídica del patrimonio arqueológico en el Estado Pontificio. Se trata de una primera entrega que tendrá continuidad con otras posteriores. Se analiza en ésta la reacción del papado al Sacco de Roma y las mediadas de protección que se pusieron en marcha, destacando la creación del cargo de Commissario dell’antichità primera autoridad creada en Europa para el control de las excavaciones arqueológicas, hallazgos y exportaciones. Al mismo tiempo se analizan las Proibizioni y Editti promulgados para el control de los bienes arqueológicos desde 1527 hasta 1795.

Contenido y alcance del acto preparatorio punible de ordenar en el artículo (8) (2) (e) (viii) del Estatuto de Roma

“La Unidad de Víctimas de la Fiscalía de la CPI envió en agosto de 2015 a la Clínica Jurídica Internacional de la Universidad del Rosario la siguiente pregunta: “En cuanto al rechazo de la cámara de la solicitud de autorización para apelar presentada por la Defensa en el caso Ntaganda contra la “Solicitud de Defensa de autorización para apelar la decisión sobre la confirmación de los cargos de fecha 09 de junio 2014” de la Sala de cuestiones preliminares I, No ICC-01/04-02/06-322, 7 de Julio de 2014), el artículo 8(2)(e)(viii) del Estatuto de Roma requiere que la Fiscalía demuestre que una orden específica fue dada por el autor para ejecutar el desplazamiento ilegal de la población civil? ¿Y cuál es la relación (semejanzas y diferencias) entre el delito de desplazamiento ilegal en virtud del artículo 8 (2) (e) (viii) del Estatuto de Roma, y el crimen de persecución en virtud del artículo 7 (1) (h)? En términos más generales, ¿cuál es el ámbito de aplicación del crimen de guerra de desplazar a la población civil en virtud del artículo 8 (2) (e) (viii) del Estatuto de Roma? Founder p.Arg 446* mutation in the PDHX gene explains over half of cases with congenital lactic acidosis in Roma children

Investigation of 31 of Roma patients with congenital lactic acidosis (CLA) from Bulgaria identified homozygosity for the R446* mutation in the PDHX gene as the most common cause of the disorder in this ethnic group. It accounted for around 60% of patients in the study and over 25% of all CLA cases referred to the National Genetic Laboratory in Bulgaria. The detection of a homozygous patient from Hungary and carriers among population controls from Romania and Slovakia suggests a wide spread of the mutation in the European Roma population. The clinical phenotype of the twenty R446* homozygotes was relatively homogeneous, with lactic acidosis crisis in the first days or months of life as the most common initial presentation (15/20 patients) and delayed psychomotor development and/or seizures in infancy as the leading manifestations in a smaller group (5/20 patients). The subsequent clinical picture was dominated by impaired physical growth and a very consistent pattern of static cerebral palsy-like encephalopathy with spasticity and severe to profound mental retardation seen in over 80% of cases. Most patients had a positive family history. We propose testing for the R446* mutation in PDHX as a rapid first screening in Roma infants with metabolic acidosis. It will facilitate and accelerate diagnosis in a large proportion of cases, allow early rehabilitation to alleviate the chronic clinical course, and prevent further affected births in high-risk families.

Käsitteellisestä ruumiilliseen, sitaatiosta paikkaan - maalaustaide ja nykytaiteen historia

The dissertation "From Conceptual to Corporeal, from Quotation to Site: Painting and History of Contemporary Art" explores the state of painting in contemporary art and art theory since the 1960s. The purpose of the study is to re-consider the dominant "end of painting" -narrative in contemporary art history, which goes back to the modernist ideology of painting as a reductive, medium-specific form of art. Drawing on Michel Foucault´s concepts of discursive formation and archive, as well as Jean-Luc Nancy´s post-phenomenological philosophy on corporeality, I suggest that contemporary painting can be redefined as a discursive-sensuous practice. Instead of seeing painting as obsolete or over as an avantgarde art genre, I show that there have been alternative, neo-avantgardist ways of defining painting since the end of the 1960s, such as French artist Daniel Buren´s early writings on painting as "theoretical practice". Consequently, the tendency of the canonical Anglo-American contemporary art narratives to underestimate the historical and institutional codes of art can be questioned. This tendency can be seen, for example, in Rosalind Krauss´s influential theory on index. The study also reflects the relations between conceptual art and painting since the 1960s and maps recent theories of painting, which re-examine the genre´s possibilities after the modernist rhetoric. Concepts of "flatbed", "painting in the extended field", "as painting" and so on are compared critically with the idea of painting as discursive practice. It is also shown that the issues in painting arise from the contemporary critical art debate while the dematerialisation paradigm of conceptual art has dissolved. The study focuses on the corporeal-material-sensuous -cluster of meanings attached to painting and searches for its avantgardist possibilities as redefined by postfeminist and post-phenomenological discourse. The ideas of hierarchy of the senses and synesthesia are developed within the framework of Jean-Luc Nancy´s and Luce Irigaray´s thought. The parameters for the study have been Finnish painting from 1990 to 2002. On the Finnish art scene there has been no "end of painting" ideology, strictly speaking. The mythology and medium-specificity of modernism have been deconstructed since the mid-1980s, but "the archive" of painting, like themes of abstraction, formalism and synesthesia have been re-worked by the discursive practice of painting, for example, in the works of Nina Roos, Tarja Pitkänen-Walter and Jussi Niva.
