Esta dissertação apresenta um panorama acerca da responsabilização dos crimes de violência sexual contra crianças e adolescentes no Brasil de 1990 a 2011 - 21 (vinte e um) anos da promulgação do Estatuto da Criança e do Adolescente (ECA). Destaca os projetos, programas e políticas implementados, bem como as alterações no ECA e no Código Penal no período, oferecendo subsídios para uma análise crítica da concepção de política pública adotada na área. Também apresenta uma amostra dos casos sentenciados a partir de 120 (cento e vinte) denúncias realizadas ao Disque Denúncia Nacional (Disque 100) e de 18 (dezoito) casos atendidos por Centros de Defesa da Criança e do Adolescente filiados à Associação Nacional dos Centros de Defesa (ANCED). Ressalta a escassez de ações voltadas para os autores de violência sexual, a tendência ao recrudescimento de penas nessa área e a influência de agências e organismos internacionais em relação às políticas públicas para crianças e adolescentes no Brasil

A presente tese tem por objetivo central investigar a legitimidade da adoção do monitoramento eletrônico como sanção autônoma no sistema de justiça penal brasileiro. Para tanto, parte-se da perspectiva do controle social formal no contexto das sociedades tecnológicas e de riscos, no qual a prisão e o monitoramento estão inseridos, e traça-se um paralelo entre as sanções penais adotadas ao longo do desenvolvimento do Direito Penal e a evolução da sociedade. Enfocando o instituto do monitoramento eletrônico de presos, a tese aborda seu conceito, origens, espécies, evolução tecnológica, finalidades, modelos e aspectos constitucionais, tanto no Brasil, como em outros países. A partir de uma análise crítica de seu tratamento normativo, a nível federal e estadual, formulam-se proposições com o objetivo de preservar os direitos individuais dos monitorados, garantindo-se a idoneidade do sistema de monitoramento eletrônico como espécie de sanção penal, em harmonia com as finalidades preventiva e retributiva da pena, mas sem se descurar da sua potencialidade como instrumento de redução da superpopulação carcerária brasileira.

A complexidade na implantação de processos seguros para o manejo dos resíduos biológicos em diversas classes de riscos, conforme a Resolução RDC no. 306/2004 ANVISA, é um desafio para administrações públicas e Unidades de Serviços de Saúde (USS) do país. O objetivo deste trabalho é avaliar o atual manejo destes resíduos, em particular os da classe de risco A4. A pesquisa tem caráter exploratório e qualitativo consistindo de revisão bibliográfica do estado da arte sobre o tema e de levantamento de dados. A coleta das informações foi realizada em Unidades de Serviços de Saúde (USS); órgãos ambientais; nas visitas técnicas em empresas tratadoras de resíduos; em gerenciadores de aterros sanitários; e através de entrevistas com especialistas no assunto. A título de exemplo, dois casos sobre o manejo dos resíduos biológicos foram estudados: no Rio de Janeiro (RJ) e em Orlando (Flórida - USA). A relevância da pesquisa está na constatação das mudanças em andamento no setor de saneamento no país, como o passo importante que esta sendo dado com a aprovação da Política Nacional de Resíduos Sólidos (PNRS). Para se atingir melhores indicadores de saúde e meio ambiente, torna-se imprescindível o gerenciamento integrado dos resíduos com a incorporação de métodos, técnicas e abordagens atuais. Quanto aos resíduos biológicos, existe aqui uma tendência em se adotar o modelo americano, mais rígido, que considera vários resíduos, comuns para nós, como sendo infectantes, e não separa estes resíduos biológicos em classes, colocando-os todos no mesmo grau de risco. Para a realidade brasileira tal rigidez de conceitos aumenta o risco no manejo para todos os envolvidos na cadeia e o custo da operação como um todo, tornando-a impraticável na maior parte do país. No Brasil a gestão inadequada dos resíduos em muitas USS e a grande quantidade de lixões existentes, com a presença de catadores de materiais recicláveis, são processos inseguros e para melhorar este quadro, é fundamental a implementação da PNRS. Nossa legislação se mostra eficiente, mas necessitamos de maior monitoramento e avaliação, e uma consequente ação educativa. Em complemento deve haver maior determinação de responsabilidades, aplicação de punições e empreender reformas substanciais nas áreas de educação e saúde pública. Espera-se que este trabalho contribua com a construção de um modelo de manejo adequado dos resíduos biológicos, sobretudo os de classe A4, de forma mais sustentável e segura. Para estudos futuros, indica-se uma avaliação estratégica sobre a sustentabilidade técnica e econômica do modelo de gerenciamento destes resíduos a ser realizada em contexto mais amplo. Para tal, recomenda-se a extensão da pesquisa a outros estados da federação, assim como o acompanhamento das tendências mundiais para classificação dos riscos dos Resíduos de Serviços de Saúde e de sua destinação mais adequada, principalmente em países com realidades semelhantes à nossa.

Para que possa alcançar sua ratio essendi, isto é, promover a convivência pacífica, o Estado utiliza-se do Direito para realizar o controle social e, em última análise, acolher os cidadãos que vivem sob a sua regência. Neste sentido, o Direito Penal adquire especial importância, tendo em vista deter a incumbência de enunciar comportamentos especialmente ofensivos para a vida em sociedade, prevendo e fixando, para cada conduta criminosa, a aplicação de penas ou medidas de segurança. É certo, de igual forma, que este ramo é também a ultima ratio, ou seja, a última instância de proteção, razão pela qual só pode ser acionado a partir do fracasso ou ineficiência de todos os demais meios de resguardo judicial, eis que o poder punitivo investe, via de regra, contra o bem mais precioso do ser humano, quer seja, sua liberdade. Levando estes pressupostos em conta, assoma uma relevante inquietação: a honra, aspecto inerente à personalidade do homem, dadas as suas características dogmáticas, ainda merece a proteção do Direito Penal? Será que não existem outros meios aptos a trazer suficiente amparo legal? É a partir destas questões que se desenvolve a presente dissertação. Para tanto, buscar-se-á, em um primeiro momento, entender a maneira como os valores e interesses mais caros ao homem adentram na seara penal (teoria do bem jurídico). Após, empreender-se-á efetiva imersão no tema de pesquisa, buscando entender as bases que historicamente assentaram e determinaram a tutela jurídica da honra (bipartição metodológica), além de promover diagnóstico da guarida fornecida pelo Direito Civil e pelo Direito Penal, de modo a compreender se a honra civil difere da honra penal. Por fim, será feito uma análise crítica da honra enquanto bem jurídico penal, com o fito conclusivo de trazer apontamentos quanto aos horizontes futuros da tutela deste valor individual.

For more than 25 years all sea turtle products have been prohibited from international commerce by the 170-member nations of the Convention on International Trade in Endangered Species (CITES). Sea turtles continue to be threatened by direct take (including poaching) and illegal trade despite multi-national protection efforts. Although take may contribute significantly to sea turtle decline, illegal take is difficult to measure since there are few quantified records associated with legal fisheries and fewer still for illegal take (poaching). We can, however, quantify one portion of the illegal sea turtle trade by determining how many illegal products were seized at United States ports of entry over a recent 10-year period. The United States Fish and Wildlife Service (USFWS) oversees the import and export of wildlife and wildlife products, ensuring that wildlife trade complies with United States laws and international treaties. Additionally, the USFWS has legal authority to target suspected illegal wildlife activity through undercover and field investigations. In an effort to assess the scale of illegal sea turtle take and trade, we have conducted a 10-year (1994 – 2003) review of the law enforcement database maintained by the USFWS. This database tracks the number and type of wildlife cases, the quantity of seized products, and the penalties assessed against violators. These data are minimum estimates of the sea turtle products passing through the United States borders, as smuggled wildlife is oftentimes not detected.

A study of the relative performance of an integrated semiconductor optical amplifier (SOA)/distributed feedback laser wavelength converter that can operate with negative penalties at 10 Gb/s rates is conducted. It is found that reduction of more than 25 times in required input powers are achieved when compared with laser or SOA converters.

Baseline survey and Participatory Rural Appraisal (PRA) during January 2003 to December 2004 on the fishing community revealed that unregulated fishing, use of destructive fishing gears, poaching of fishes, difficulties encountered in enforcing fisheries regulation and the helplessness of fishers to find alternative sources of income during banned fishing period (June to October) were the major management problems. CBFM (Community Based Fisheries Management) system as an alternative management strategy has been introduced to ensure active participation of the target group-the poor fishers living around the beet who were previously deprived to get access to the beet. Establishing a leasing system for controlled access, ensuring greater user-group participation through equitable distribution of all resource benefits among members, attempting to enforce penalties for illegal fishing linked with surprise checks to enforce management regulations are some of the recent steps taken by the BMC (Beel Management Committee). Chapila fish intake by the community was 31.25 g/head/day before stocking the beel by carp fingerlings. After stocking, they consumed chapila as fish protein from 8.33 g to 20.8 g/head/day during the fishing season (November to May) indicating that due to introduction of carp fingerlings, chapila production has been decreased in 2003-2004. About 77.5% families around the beel were found to be dependent directly and/or indirectly on chapila and other indigenous fishes of the beel for their livelihood, through fishing, marketing and other activities like net and boat preparation and nets mending etc. Particularly fishers' families were found to face serious problem during non-fishing period like June to October for their livelihood. Analyzing the present research result it was also observed that other than declination in biodiversity, the fishing pressure on promising chapila of the beel was found high and that is why the production of chapila has also been decreased. To get sustainable chapila production from the heel, it is suggested to ensure successful spawning and recruitment as juveniles, and hence the chapila should be undisturbed during its breeding period from March to July, and fishing pressure on the same species needs to be reduced for obtaining sustainable fish production.

The fastest ever 11.25Gb/s real-time FPGA-based optical orthogonal frequency division multiplexing (OOFDM) transceivers utilizing 64-QAM encoding/decoding and significantly improved variable power loading are experimentally demonstrated, for the first time, incorporating advanced functionalities of on-line performance monitoring, live system parameter optimization and channel estimation. Real-time end-to-end transmission of an 11.25Gb/s 64-QAM-encoded OOFDM signal with a high electrical spectral efficiency of 5.625bit/s/Hz over 25km of standard and MetroCor single-mode fibres is successfully achieved with respective power penalties of 0.3dB and -0.2dB at a BER of 1.0 x 10(-3) in a directly modulated DFB laser-based intensity modulation and direct detection system without in-line optical amplification and chromatic dispersion compensation. The impacts of variable power loading as well as electrical and optical components on the transmission performance of the demonstrated transceivers are experimentally explored in detail. In addition, numerical simulations also show that variable power loading is an extremely effective means of escalating system performance to its maximum potential.

In this paper, a strategy for min-max Moving Horizon Estimation (MHE) of a class of uncertain hybrid systems is proposed. The class of hybrid systems being considered are Piecewise Affine systems (PWA) with both continuous valued and logic components. Furthermore, we consider the case when there is a (possibly structured) norm bounded uncertainty in each subsystem. Sufficient conditions on the time horizon and the penalties on the state at the beginning of the estimation horizon to guarantee convergence of the MHE scheme will be provided. The MHE scheme will be implemented as a mixed integer semidefinite optimisation for which an efficient algorithm was recently introduced.

Statistical dependencies among wavelet coefficients are commonly represented by graphical models such as hidden Markov trees (HMTs). However, in linear inverse problems such as deconvolution, tomography, and compressed sensing, the presence of a sensing or observation matrix produces a linear mixing of the simple Markovian dependency structure. This leads to reconstruction problems that are non-convex optimizations. Past work has dealt with this issue by resorting to greedy or suboptimal iterative reconstruction methods. In this paper, we propose new modeling approaches based on group-sparsity penalties that leads to convex optimizations that can be solved exactly and efficiently. We show that the methods we develop perform significantly better in de-convolution and compressed sensing applications, while being as computationally efficient as standard coefficient-wise approaches such as lasso. © 2011 IEEE.

This paper presents new methods for computing the step sizes of the subband-adaptive iterative shrinkage-thresholding algorithms proposed by Bayram & Selesnick and Vonesch & Unser. The method yields tighter wavelet-domain bounds of the system matrix, thus leading to improved convergence speeds. It is directly applicable to non-redundant wavelet bases, and we also adapt it for cases of redundant frames. It turns out that the simplest and most intuitive setting for the step sizes that ignores subband aliasing is often satisfactory in practice. We show that our methods can be used to advantage with reweighted least squares penalty functions as well as L1 penalties. We emphasize that the algorithms presented here are suitable for performing inverse filtering on very large datasets, including 3D data, since inversions are applied only to diagonal matrices and fast transforms are used to achieve all matrix-vector products.

Increasing pressure on lowering vehicle exhaust emissions to meet stringent California and Federal 1993/1994 TLEV emission standards of 0.125 gpm NMOG, 3.4 gpm CO and 0.4 gpm NOx and future ULEV emission standards of 0.04 gpm NMOG, 1.7 gpm CO and 0.2 gpm NOx has focused specific attention on the cold start characteristics of the vehicle's emission system, especially the catalytic converter. From test data it is evident that the major portion of the total HC and CO emissions occur within the first two minutes of the driving cycle while the catalyst is heating up to operating temperature. The use of an electrically heated catalyst (EHC) has been proposed to alleviate this problem but the cost and weight penalties are high and the durability has yet to be fully demonstrated (1)*. This paper describes a method of reducing the light-off time of the catalytic converter to less than 20 seconds by means of an afterburner. The system uses exhaust gases from the engine calibrated to run rich and additional air injected into the exhaust gas stream to form a combustible mixture. The key feature concerns the method of making this combustible mixture ignitable within 2 seconds from starting the engine when the exhaust gases arriving at the afterburner are cold and essentially non-reacting. © Copyright 1992 Society of Automotive Engineers, Inc.

We report the first experimental demonstration of a monolithically integrated hybrid dilated 2×2 modular optical switch using Mach-Zehnder modulators as low-loss 1×2 switching elements and short semiconductor optical amplifiers to provide additional extinction and gain. An excellent 40 dB cross-talk/extinction ratio is recorded with data-modulated signal-to-noise ratios of up to 44 dB in a 0.1 nm bandwidth. A switching time of 3 ns is demonstrated. Bit error rate studies show extremely low subsystem penalties of less than 0.1 dB, and studies indicate that, by using this hybrid switch building block, an 8×8 port switch could be achieved with 14 dB input power dynamic range for subsystem penalties of less than 0.5 dB.

The effect of streamwise slots on the interaction of a normal shock wave / turbulent boundary layer has been investigated experimentally at a Mach number of 1.3. The surface pressure distribution for the controlled interaction was found to be significantly smeared, featuring a distinct plateau. This was due to a change in shock structure from a typical unseparated normal shock wave boundary layer interaction to a large bifurcated Lambda type shock pattern. Boundary layer velocity measurements downstream of the slots revealed a strong spanwise variation of boundary layer properties whereas the modified shock structure was relatively twodimensional. Oil flow visualisation indicated that in the presence of slots the boundary layer surface flow was highly three dimensional and confirmed that the effect of slots was mainly due to suction and blowing similar to that for passive control with uniform surface ventilation. Three hole probe measurements confirmed that the boundary layer was three dimensional and that the slots introduced vortical motion into the flowfield. Results indicate that when applied to an aerofoil, the control device has the potential to reduce wave drag while incurring only small viscous penalties. The introduction of streamwise vorticity may also be beneficial to delay trailing edge separation and the device is thought to be capable of postponing buffet onset. © 2001 by A N Smith.
