This paper discusses the Court’s reasoning in interpreting the EU Charter, using recent case law on horizontal effect as a case study. It identifies two possible means of interpreting the provisions of the Charter: firstly, an approach based on common values (e.g. equality or solidarity) and, secondly, an approach based on access to the public sphere. It argues in favour of the latter. Whereas an approach based on common values is more consonant with the development of the case law so far, it is conceptually problematic: it involves subjective assessments of the importance and degree of ‘sharedness’ of the value in question, which can undermine the equal constitutional status of different Charter provisions. Furthermore, it marginalises the Charter’s overall politically constructional character, which distinguishes it from other sources of rights protection listed in Art 6 TEU. The paper argues that, as the Charter’s provisions concretise the notion of political status in the EU, they have a primarily constitutional, rather than ethical, basis. Interpreting the Charter based on the very commitment to a process of sharing, drawing on Hannah Arendt’s idea of the ‘right to have rights’ (a right to access a political community on equal terms), is therefore preferable. This approach retains the pluralistic, post-national fabric of the EU polity, as it accommodates multiple narratives about its underlying values, while also having an inclusionary impact on previously underrepresented groups (e.g. non-market-active citizens or the sans-papiers) by recognising their equal political disposition.

The postwar development of the Intelligence Services in Japan has been based on two contrasting models: the centralized model of the USA and the collegiality of UK, neither of which has been fully developed. This has led to clashes of institutional competencies and poor anticipation of threats towards national security. This problem of opposing models has been partially overcome through two dimensions: externally through the cooperation with the US Intelligence Service under the Treaty of Mutual Cooperation and Security; and internally though the pre-eminence in the national sphere of the Department of Public Safety. However, the emergence of a new global communicative dimension requires that a communicative-viewing remodeling of this dual model is necessary due to the increasing capacity of the individual actors to determine the dynamics of international events. This article examines these challenges for the Intelligence Services of Japan and proposes a reform based on this new global communicative dimension.

This analysis estimates several economic benefits derived from national implementation of the National Oceanic and Atmospheric Administration’s Physical Oceanographic Real-Time System (PORTS®) at the 175 largest ports in the United States. Significant benefits were observed owing to: (1) lower commercial marine accident rates and resultant reductions in morbidity, mortality and property damage; (2) reduced pollution remediation costs; and, (3) increased productivity associated with operation of more fully loaded commercial vessels. Evidence also suggested additional benefits from heightened commercial and recreational fish catch and diminished recreational boating accidents. Annual gross benefits from 58 current PORTS® locations exceeded $217 million with an addition $83 million possible if installed at the largest remaining 117 ports in the United States. Over the ten-year economic life of PORTS® instruments, the present value for installation at all 175 ports could approach $2.5 billion.

O presente Trabalho de Investigação Aplicada encontra-se subordinado ao tema “Fluxo de Informação Financeira entre o Território Nacional e os Teatros de Operações: Abordagem Sociocrítica em contexto de mudança.”. Tendo em conta o contexto económico que o país atravessa, e que indiretamente afeta as organizações do Estado, através das consequentes reduções orçamentais, torna-se imprescindível que exista um aproveitamento dos recursos muito mais eficiente e eficaz. Neste contexto e face à existência em Território Nacional do Sistema Integrado de Gestão nas Instituições do Ministério de Defesa Nacional, nomeadamente no Exército, revelou-se indispensável a implementação desta ferramenta de gestão nas Forças Nacionais Destacadas dos Teatros de Operações. Desta forma, o objetivo geral desta investigação é identificar as limitações e potencialidades que a recente implementação do Sistema Integrado de Gestão nos Teatros de Operações provocou no desempenho das funções dos Oficiais de Finanças. Neste trabalho procuramos ainda identificar o impacto da harmonização dos procedimentos contabilísticos na execução orçamental, as melhorias do processo de tomada de decisão, a harmonização na realização do relato financeiro, e consequentes alterações nos procedimentos de mudança de contingente, bem como as alterações na execução das diferentes fases do Registo Contabilístico do Fundo de Maneio. Para a elaboração desta investigação aplicou-se o método hipotético-dedutivo, sendo desenvolvida segundo objetivos descritivos e exploratórios com o intuito de identificar, explorar e descrever as limitações e potencialidades da implementação do Sistema Integrado de Gestão na Força Nacional Destacada do Kosovo, recorrendo ao estudo exploratório/descritivo, enquadrando-se ainda na categoria do Estudo de Caso. No sentido de atingir os objetivos propostos inicialmente foram elaborados e aplicados diferentes inquéritos por entrevista. Após a análise e discussão dos resultados foi possível concluir que a informação contabilística disponível em tempo real, de forma imediata e oportuna, permite aos Oficiais de Finanças serem mais eficazes e assertivos no aconselhamento ao Comandante, assim como origina uma melhor e mais célere tomada de decisão em Teatro de Operações e para toda cadeia de comando em Território Nacional. Outra grande mais-valia foi a possibilidade de reduzir significativamente o Fundo de Maneio. Alcançado o final desta investigação, foi possível concluir que não existem limitações do Sistema Integrado de Gestão nos Teatros de Operações que não existam em Território Nacional, sendo dessa forma possível constatar que as possíveis melhorias são a implementação da contabilidade analítica e a integração de todas as áreas desta ferramenta, permitindo tirar total partido da mesma.

It is widely contended that we live in a „world risk society‟, where risk plays a central and ubiquitous role in contemporary social life. A seminal contributor to this view is Ulrich Beck, who claims that our world is governed by dangers that cannot be calculated or insured against. For Beck, risk is an inherently unrestrained phenomenon, emerging from a core and pouring out from and under national borders, unaffected by state power. Beck‟s focus on risk's ubiquity and uncontrollability at an infra-global level means that there is a necessary evenness to the expanse of risk: a "universalization of hazards‟, which possess an inbuilt tendency towards globalisation. While sociological scholarship has examined the reach and impact of globalisation processes on the role and power of states, Beck‟s argument that economic risk is without territory and resistant to domestic policy has come under less appraisal. This is contestable: what are often described as global economic processes, on closer inspection, reveal degrees of territorial embeddedness. This not only suggests that "global‟ flows could sometimes be more appropriately explained as international, regional or even local processes, formed from and responsive to state strategies – but also demonstrates what can be missed if we overinflate the global. This paper briefly introduces two key principles of Beck's theory of risk society and positions them within a review of literature debating the novelty and degree of global economic integration and its impact on states pursuing domestic economic policies. In doing so, this paper highlights the value for future research to engage with questions such as "is economic risk really without territory‟ and "does risk produce convergence‟, not so much as a means of reducing Beck's thesis to a purely empirical analysis, but rather to avoid limiting our scope in understanding the complex relationship between risk and state.

The national resource privilege, which holds that states are allowed to control all the natural resources found in their territory, is a cornerstone of international politics. Supporters of the national resource privilege claim that without the privilege states would fail to be sovereign and self-determining entities which provide for the needs of their citizens. However, as this paper shows the case is not as simple as that. In fact, control over resources must be carefully unpacked. Doing so shows that states do not require full control over all resources found in their territory in order to be sovereign. Moreover, sovereignty and self-determination come with a set of responsibilities and duties attached. Based on these observations the paper will sketch the contours of an alternative resource governance scheme built around the idea of an International Court of the Environment.

Sex sells. A lot. But who exactly is on the market?

What kinds of bodies are calibrated for traffic and consumption, and how exactly do they get there? When it comes to “sex” trafficking—which comprises a minority percentage of human trafficking, yet dominates the moral imagination as an “especially heinous” crime—the rise in predominantly white, evangelical Christian American interest in the trafficked subject galvanizes an ethical outrage that rarely observes critiques of race, ethnicity, sexuality or class as conditions of possibility. Though a nuanced mandate to fight trafficking is all but cemented in the contemporary American political and moral conscience, Virgin Territory accounts for the ways Christian ideas of purity annex both gender and sexuality inside the legacies of racialized colonial encounter, and foreground the market expansion of the global sex trade as it exists today.

In Part I, I argue that the narratives of virginity tied to Mary’s body simultaneously foregrounded the gendered, sexed Other as sparked disdain for the religious Other, for the Jewish body and for Mary’s Jewish identity. Through this analysis I explore the connections of racial identity to the Christian theological elision of Jewish election. I demonstrate how the questions of sexual ethics materialized at the site of the Virgin Mary, and align the moral attachments of sex and purity in the production of whiteness. These machinations, tied to the emerging European identity of empire, irrupt horrifically into the narrative ontology of dark flesh in Africa, Asia, and the Americas.

In Part II, I highlight the function of these narratives inside of the moments of colonial encounter, demonstrating how the logics of purity and virginity were directly applied to manage dark female flesh. I map the visual iconography of the Black Madonna first through a Dutch painting entitled The Rape of the Negress. I read this image through the social theological imagination instantiating the idea of the reprobate body and white imperial gaze. This analysis foregrounds a theological reading of Sarah Baartman, the “Hottentot Venus,” as the center of a complex sex trafficking investigation, outlining the genealogy of race, as well as the ideologies of the racial, ethnic and national Other, as mitigating factors in the conditions of possibility of a global sex trade. By restoring these narratives and their theological undertones, I reiterate the ways Christian thought is imbricated in the global sex trade, and propose theological strategies for rethinking humanitarian responses to sex trafficking.
