La crise de la piraterie maritime qui a longuement sévi au large de la Somalie est en voie de résorption, mais les pirates n’ont pas cessé leurs ataques qui se produisent désormais dans les eaux de l’Afrique de l’ouest. Pour y faire face, et traduire les pirates en justice, la Communauté internationale s’est rapidement appuyée sur les tribunaux des États de la région, tout en exigeant d’eux le respect des standards du procès équitable ainsi que des droits de l’homme. Elle s’est engagée dans un fort soutien, à la fois technique, financier et juridique, à leur action. Les résultats n’ayant pas été immédiats, l’idée de créer une juridiction internationale, ou internationalisée, a été évoquée par le Conseil de sécurité des Nations Unies. Elle a finalement été rejetée, au profit d’un renforcement de l’action en faveur des processus judiciaires nationaux de lutte contre la piraterie.

We have extensively evaluated the response of cloud-base drizzle rate (Rcb; mm day–1) in warm clouds to liquid water path (LWP; g m–2) and to cloud condensation nuclei (CCN) number concentration (NCCN; cm–3), an aerosol proxy. This evaluation is based on a 19-month long dataset of Doppler radar, lidar, microwave radiometers and aerosol observing systems from the Atmospheric Radiation Measurement (ARM) Mobile Facility deployments at the Azores and in Germany. Assuming 0.55% supersaturation to calculate NCCN, we found a power law , indicating that Rcb decreases by a factor of 2–3 as NCCN increases from 200 to 1000 cm–3 for fixed LWP. Additionally, the precipitation susceptibility to NCCN ranges between 0.5 and 0.9, in agreement with values from simulations and aircraft measurements. Surprisingly, the susceptibility of the probability of precipitation from our analysis is much higher than that from CloudSat estimates, but agrees well with simulations from a multi-scale high-resolution aerosol-climate model. Although scale issues are not completely resolved in the intercomparisons, our results are encouraging, suggesting that it is possible for multi-scale models to accurately simulate the response of LWP to aerosol perturbations.

The first part of this paper will give a brief introduction to maritime missiology, the second section will trace the beginnings of the Boston Seaman’s Friend Society in the nineteenth century and the third will focus on the Vineyard Haven branch of that work well into the twentieth century. Using source material from the American Seamen’s Friend Society - there is a 5,000 document collection of the ASFS papers in the G.W. Blunt White Library at Mystic Seaport, the Boston Seaman’s Friend Society - whose papers are mostly in the Congregational House on Beacon Hill in Boston, and other secondary works from the nineteenth and twentieth century. I am especially indebted to George Wiseman’s book, They Kept the Lower Lights Burning, Wiseman was the pastor of Trinity Methodist Episcopal Church in Oak Bluff during WWII and the son-in-law of Austin Tower. This presentation will look at the many facets that made up religious work among seafarers.

From an examination of the instruments of the Common European Asylum System (CEAS) and related policy measures regarding border surveillance and migration management, two interrelated issues stand out as particularly sensitive: Access to asylum and responsibility for refugee protection. The prevailing view, supported by UNHCR and others, is that responsibility for the care of asylum seekers and the determination of their claims falls on the state within whose jurisdiction the claim is made. However, the possibility to shift that responsibility to another state through inter-state cooperation or unilateral mechanisms undertaken territorially as well as abroad has been a matter of great interest to EU Member States and institutions. Initiatives adopted so far challenge the prevailing view and have the potential to undermine compliance with international refugee and human rights law. This note reviews EU action in the field by reference to the relevant legal standards and best practices developed by UNHCR, focusing on the specific problems of climate refugees and access to international protection, evaluating the inconsistencies between the internal and external dimension of asylum policy. Some recommendations for the European Parliament are formulated at the end, including on action in relation to readmission agreements, Frontex engagement rules in maritime operations, Regional Protection Programmes, and resettlement.

This contribution presents migrant smuggling by sea as a multi-faceted phenomenon. It juxtaposes State rights and duties, State security interests and protection of fundamental rights. Similarly, various branches of law, sometime contradictory, regulate irregular maritime migration. In view of these considerations, the argument is made that any effort to control the situation must lie in a cooperative initiative among States which considers migrant smuggling by sea in a holistic manner.

This paper examines key developments in the field of European border surveillance in the Mediterranean. By asking, ‘Whose Mare?’, we focus on rule of law challenges stemming from these developments in a post-Lisbon EU. The developments examined are the Italian Navy-led Mare Nostrum operation, the debates over European ‘exit strategies’ for this operation and the ensuing launch of the Frontex Triton joint operation (JO). The recently adopted Regulation on Frontex sea border surveillance operations is also presented as a key development to understand the rule of law challenges. Moreover, the adoption of the European Union Maritime Security Strategy (MSS) and the development of several maritime surveillance systems in the EU highlight that a wide range of actors seeks authority over this field.
