The chemical industry has to face safety problems linked to the hazards of chemicals and the risks posed by the plants where they are handled. However, their transport may cause significant risk values too: it’s not totally possible to avoid the occurrence of accidents. This work is focused on the emergency response to railway accidents involving hazardous materials, that is what has to be done once they happen to limit their consequences. A first effort has been devoted to understand the role given to this theme within legislations: it has been found out that often it’s not even taken into account. Exceptionally a few countries adopt guidelines suggesting how to plan the response, who is appointed to intervene and which actions should be taken first. An investigation has been made to define the tools available for the responders, with attention on the availability of chemical-specific safety distances. It has emerged that the ERG book adopted by some American countries has suggestions and the Belgian legislation too establishes criteria to evaluate these distances. An analysis has been conducted then on the most recent accidents occurred worldwide, to understand how the response was performed and which safety distances were adopted. These values were compared with the numbers reported by the ERG book and the results of two devoted software tools for consequence analysis of accidental spills scenarios. This comparison has shown that there are differences between them and that a more standardized approach is necessary. This is why further developments of the topic should focus on promoting uniform procedures for emergency response planning and on a worldwide adoption of a guidebook with suggestions about actions to reduce consequences and about safety distances, determined following finer researches. For this aim, the development of a detailed database of hazardous materials transportation accidents could be useful.

A considerable portion of public lands in the United States is at risk of uncharacteristically severe wildfires due to a history of fire suppression. Wildfires already have detrimental impacts on the landscape and on communities in the wildland-urban interface (WUI) due to unnatural and overstocked forests. Strategies to mitigate wildfire risk include mechanical thinning and prescribed burning in areas with high wildfire risk. The material removed is often of little or no economic value. Woody biomass utilization (WBU) could offset the costs of hazardous fuel treatments if removed material could be used for wood products, heat, or electricity production. However, barriers due to transportation costs, removal costs, and physical constraints (such as steep slopes) hinder woody biomass utilization. Various federal and state policies attempt to overcome these barriers. WBU has the potential to aid in wildfire mitigation and meet growing state mandates for renewable energy. This research utilizes interview data from individuals involved with on-the-ground woody biomass removal and utilization to determine how federal and state policies influence woody biomass utilization. Results suggest that there is not one over-arching policy that hinders or promotes woody biomass utilization, but rather woody biomass utilization is hindered by organizational constraints related to time, cost, and quality of land management agencies’ actions. However, the use of stewardship contracting (a hybrid timber sale and service contract) shows promise for increased WBU, especially in states with favorable tax policies and renewable energy mandates. Policy recommendations to promote WBU include renewal of stewardship contracting legislations and a re-evaluation of land cover types suited for WBU. Potential future policies to consider include the indirect role of carbon dioxide emission reduction activities to promote wood energy and future impacts of air quality regulations.

When Creative Commons (CC) was founded in 2001, the core Creative Commons licenses were drafted according to United States Copyright Law. Since their first introduction in December 2002, Creative Commons licenses have been enthusiastically adopted by many creators, authors, and other content producers – not only in the United States, but in many other jurisdictions as well. Global interest in the CC licenses prompted a discussion about the need for national versions of the CC licenses. To best address this need, the international license porting project (“Creative Commons International” – formerly known as “International Commons”) was launched in 2003. Creative Commons International works to port the core Creative Commons licenses to different copyright legislations around the world. The porting process includes both linguistically translating the licenses and legally adapting the licenses to a particular jurisdiction such that they are comprehensible in the local jurisdiction and legally enforceable but concurrently retain the same key elements. Since its inception, Creative Commons International has found many supporters all over the world. With Finland, Brazil, and Japan as the first completed jurisdiction projects, experts around the globe have followed their lead and joined the international collaboration with Creative Commons to adapt the licenses to their local copyright. This article aims to present an overview of the international porting process, explain and clarify the international license architecture, its legal and promotional aspects, as well as its most recent challenges.

Due to widespread development of anthelmintic resistance in equine parasites, recommendations for their control are currently undergoing marked changes with a shift of emphasis toward more coprological surveillance and reduced treatment intensity. Denmark was the first nation to introduce prescription-only restrictions of anthelmintic drugs in 1999, but other European countries have implemented similar legislations over recent years. A questionnaire survey was performed in 2008 among Danish horse owners to provide a current status of practices and perceptions with relation to parasite control. Questions aimed at describing the current use of coprological surveillance and resulting anthelmintic treatment intensities, evaluating knowledge and perceptions about the importance of various attributes of parasite control, and assessing respondents' willingness to pay for advice and parasite surveillance services from their veterinarians. A total of 1060 respondents completed the questionnaire. A large majority of respondents (71.9%) were familiar with the concept of selective therapy. Results illustrated that the respondents' self-evaluation of their knowledge about parasites and their control associated significantly with their level of interest in the topic and their type of education (P<0.0001). The large majority of respondents either dewormed their horses twice a year and/or performed two fecal egg counts per horse per year. This approach was almost equally pronounced in foals, horses aged 1-3 years old, and adult horses. The respondents rated prevention of parasitic disease and prevention of drug resistance as the most important attributes, while cost and frequent fecal testing were rated least important. Respondents' actual spending on parasite control per horse in the previous year correlated significantly with the amount they declared themselves willing to spend (P<0.0001). However, 44.4% declared themselves willing to pay more than what they were spending. Altogether, results indicate that respondents were generally familiar with equine parasites and the concept of selective therapy, although there was some confusion over the terms small and large strongyles. They used a large degree of fecal surveillance in all age groups, with a majority of respondents sampling and/or treating around twice a year. Finally, respondents appeared willing to spend money on parasite control for their horses. It is of concern that the survey suggested that foals and young horses are treated in a manner very similar to adult horses, which is against current recommendations. Thus, the survey illustrates the importance of clear communication of guidelines for equine parasite control.

Debido al aumento de los estándares de calidad exigidos internacionalmente, así como por una mayor presión sobre la industria mediante legislaciones ambientales más rigurosas, el sector cafetalero está obligado a buscar, a través de la investigación, un sistema adecuado de tratamiento para las aguas residuales generadas en el beneficiado húmedo del café. En este trabajo se evaluó el funcionamiento de la digestión anaerobia para el tratamiento de las aguas residuales de despulpe. Para ello, se utilizaron dos sistemas anaerobios, uno en una etapa (UASB), y otro con separación de fases (2PUASB). Se investigó el efecto en la digestión anaerobia de tres cargas orgánicas volumétricas (OLR) y de las dos configuraciones de reactor usadas. Los valores de OLR de operación en el sistema UASB variaron en un intervalo de 3.6-4.1 kgCOD m-3 d-1, con una tasa de recirculación del efluente de 1.0. El sistema 2PUASB fue alimentado con OLR similares a las que se emplearon en el sistema en una etapa. El reactor de acidificación fue cargado a 11.0 kgCOD m-3 d-1, mientras que en el reactor metanogénico varió en el intervalo de 2.6-4.67 kgCOD m-3 d-1. El uso de reactores UASB en una etapa y en dos fases, bajo las mismas condiciones de operación ya descritas, propiciaron el logro de una eficiencia de degradación de COD total superior al 75% y al 85% para la COD soluble, respectivamente. Sin embargo, el sistema en dos fases mostró mejores resultados en el tratamiento de este tipo de agua residual, no solo en cuanto a eficiencia de eliminación de la carga orgánica contaminante así como una menor concentración de ácidos grasos volátiles (VFA) en el efluente. Obtenidas las mejores condiciones de trabajo, fue evaluada la separación de fases bajo el efecto de la recirculación. Los grupos de fermentaciones producidos fueron similares a los obtenidos en el experimento sin recirculación, indicando que está última no afectó la composición relativa de los VFA del reactor anaerobio, por lo que no cambió el patrón de degradación del residuo. Una tasa de recirculación de 1.0 del efluente del reactor metanogénico al reactor acidogénico mejoró significativamente el proceso, ya que se incrementó la conversión de los VFA (31%), la eliminación de la fracción total y soluble del residuo tratado (6.5%) y la reducción del consumo de alcalinizante (39%); manteniendo similares producciones de metano. El uso de la digestión anaerobia en dos fases demostró una mejora en la estabilidad del proceso y un incremento de la eficiencia de operación y de la producción de metano, respectivamente.Tesis Doctoral Yans Guardia Puebla Abstract ix ABSTRACT Due to the increase of quality standards internationally demanded, as well as for a greater pressure on the industry by means of more rigorous environmental legislations, the coffee sector is forced to search, through the research, an appropriated treatment system for coffee wet wastewaters generated. In this work the performance of the anaerobic digestion for the coffee wet wastewater treatment was evaluated. For it, two anaerobic systems, one in single-stage (UASB), and another with two-phase (2PUASB) were used. The effect in the anaerobic digestion of three organic loading rates (OLR) and of two reactor configurations used was investigated. OLR operation values in UASB system varied in an interval of 3.6-4.1 kgCOD m-3 d-1, with a recycle rate of the effluent of 1.0. 2PUASB system was fed with OLR similar to those that were used in the reactor in a stage. The acidification reactor was loaded to 11.0 kgCOD m-3 d-1, whereas in the methanogenic reactor varied in the interval of 2.6-4.67 kgCOD m-3 d-1. The use of single-stage and two-phase UASB reactors, under the same operation conditions already before described, a total COD removal efficiency of 75% and 85% for the soluble COD removal efficiency, respectively, was achieved. However, two-phase system showed better results in the treatment of this wastewater type, not only as for removal efficiency of loading organic polluting as well as a smaller volatile fatty acid (VFA) concentration in the effluent. Obtained the best work conditions, the two-phase system under the effect of the recycle was evaluated. Fermentations groups produced were similar to those obtained in the experiment without recycle, indicating that it last one do not affect the relative composition of VFA of the anaerobic reactor, for that reason the degradation pattern of the residue does not change. A recycle rate of 1.0 of the effluent of the methanogenic reactor to the acidogenic reactor improved the process significantly, since it was increased the VFA conversion (31%), the removal of total and soluble fraction of the residue treated (6.5%) and the decrease of the alkalinity consumption (39%); maintaining similar methane productions. The use of the two-phase anaerobic digestion demonstrated to an improvement in the stability of the process and an increase of the operation efficiency and methane production, respectively.

La presente tesi analizza il reato di traffico di esseri umani in Europa, con particolare attenzione al fenomeno dello sfruttamento sessuale. La ricerca è stata condotta in parte nell’ambito del progetto “FIDUCIA. New European crimes and trust-based policy” (www.fiduciaproject.eu). La tesi è composta da 5 capitoli. Il primo capitolo introduce il reato di tratta di esseri umani, a livello globale e, successivamente, nello specifico, in Europa. Vengono presentati i fattori determinanti e le origini del fenomeno. Inoltre, ne vengono fornite le definizioni e le principali caratteristiche, in linea con i più importanti documenti internazionali sul tema. Il capitolo si chiude con una panoramica statistica, che affronta anche le criticità della raccolta di dati relativi ai reati. Il secondo capitolo analizza l’approccio correntemente adottato a livello domestico ed europeo contro la tratta. Le misure vengono presentate prima dal punto di vista teorico; successivamente ne vengono forniti esempi concreti, ad esempio convenzioni internazionali, direttive, ma anche progetti di ricerca, collaborazioni internazionali tra autorità ed ONG. Il terzo capitolo si concentra sulla tratta a fini di sfruttamento sessuale. Vengono analizzati il potenziale legame con la prostituzione, e l’approccio europeo. Segue un approfondimento dei modelli legali implementati a livello europeo ed uno studio comparato di cinque paesi membri, rappresentativi dei vari modelli di regolamentazione della prostituzione (Italia, Belgio, Polonia, Germania e Svezia). Il quarto capitolo raccoglie le interviste condotte con diversi esperti che si occupano di contrasto alla tratta: ONG italiane e straniere, referenti nazionali anti-tratta di Italia, Belgio e Germania, FRONTEX, membri del Parlamento Europeo. Nelle conclusioni, vengono proposte prima una valutazione complessiva del quadro attuale, e poi alcune raccomandazioni ai governi nazionali e agli organismi sopranazionali. In particolare, visto l’obiettivo di un contrasto omogeneo e coordinato della tratta (per sfruttamento sessuale specificamente) a livello europeo, si ritiene che un modello regolamentare uniforme della prostituzione negli stati membri possa contribuire a migliorare uniformità ad efficacia dell’approccio europeo alla tratta.

A sistematização dos recursos administrativos na legislação federal consiste em um trabalho de elaboração de um modelo de identificação e organização das diversas normas processuais administrativas disciplinadoras das regras de cabimento, processamento e julgamento dos recursos administrativos no âmbito da administração pública federal. Trata-se de uma pesquisa acadêmica de revisão normativa das principais legislações infraconstitucionais administrativas federais desenvolvida a partir da perspectiva das normas gerais de processo administrativo estabelecidas pela Lei Federal n. 9.784/99 (Lei de processo administrativo federal). Inicialmente, são analisados os aspectos históricos e conceituais do processo administrativo brasileiro considerados mais relevantes para a compreensão do sistema recursal administrativo. Posteriormente à fixação desses pressupostos conceituais na primeira parte do trabalho, o estudo direciona-se ao estabelecimento da tipologia recursal administrativa, por meio do exame dos princípios, regras e demais orientações apresentados pela Lei Federal n. 9.784/99. Tendo sido estipulados as espécies recursais, suas características, bem como as regras de cabimento, processamento e julgamento dos recursos administrativos, empreende-se o diagnóstico das legislações infraconstitucionais federais escolhidas com fundamento nos elementos fixados na segunda parte do trabalho. A sistematização dos recursos administrativos na legislação federal tem como finalidade demonstrar que a previsibilidade dos resultados obtida por meio do conhecimento das regras do jogo em matéria recursal administrativa, é responsável por um incremento das garantias constitucionais do processo administrativo nos entes públicos federais.

Nas últimas décadas, a indústria automobilística mundial vem investindo no desenvolvimento tecnológico dos motores, com o objetivo de alcançar melhor eficiência energética e atender às legislações que limitam a quantidade de resíduos tóxicos nos gases de exaustão e menor consumo de combustível. Isso resultou na implantação dos sistemas de gerenciamento eletrônico do motor, que possibilitam funcionalidades para se controlar diversas variáveis do motor, aumentando consideravelmente o rendimento do motor. Este trabalho tem como objetivos explorar a dinâmica de um motor de combustão interna ciclo Otto, os sinais elétricos associados, e os componentes de seu gerenciamento eletrônico. A partir dessas informações, o trabalho apresenta o processo de analise dos sinais elétricos e as estratégias de controle utilizadas em um sistema de gerenciamento real. Assim, são desenvolvidos o hardware e o firmware de uma unidade microcontroladora para gerenciamento eletrônico do motor. O hardware foi elaborado com uma concepção centralizada, ou seja, foi usado apenas um microcontrolador de 32-bit para gerenciar todas as funções. O firmware de controle foi desenvolvido de forma modular baseado em modelos de malha fechada. O modelo matemático do motor foi identificado utilizando técnicas de controle em um veículo real, e a avalidação do modelo foi obtida através de testes em um dinamômetro inercial.

In this paper we discussed how the literature traces a growing involvement of the national parliaments in EU policy-making. Three phases can be distinguished: limited or no involvement was the trend until the 1980s; after the Single Act (SEA, 1987), national parliaments started to be interested in European affairs and to set up specialized committees; following the Maastricht Treaty (TUE, 1992), the involvement of national parliaments in EU affairs became a response to the question of "democratic deficit" in the EU (Norton, 1995). The growing number of policies dealt with at the EU level, the consequently increased influence of EU law in national legislations, the new powers of the Union: all of these worked together to push national legislators to seek a scrutiny role in the drafting of EU legislation. According to Laprat (1995: 1), once the TUE was formally approved, a more parliamentary climate prevailed. In more recent years, national parliaments have distinguished themselves for their increased role in the scrutiny of EU legislation (Raunio and Hix, 200I: !52); more specialized MPs sit in the committees on EU affairs; the amount of work for EU specialists has increased. Also, parliamentary scrutiny, initially only optional and ex post, is now increasingly ex ante and/or mandatory (Maurer and Wessels, 2001: 425-475).

The concept of mobility, related to technology in particular, has evolved dramatically over the last two decades including: (i) hardware ranging from walkmans to Ipods, laptops to netbooks, PDAs to 3G mobile phone; (ii) software supporting multiple audio and video formats driven by ubiquitous mobile wireless access, WiMax, automations such as radio frequency ID tracking and location aware services. Against the background of increasing budget deficit, along with the imperative for efficiency gains, leveraging ICT and mobility promises for work related tasks, in a public administration context, in emerging markets, point to multiple possible paths. M-government transition involve both technological changes and adoption to deliver government services differently (e.g. 24/7, error free, anywhere to the same standards) but also the design of digital strategies including possibly competing m-government models, the re-shaping of cultural practices, the creation of m-policies and legislations, the structuring of m-services architecture, and progress regarding m-governance. While many emerging countries are already offering e-government services and are gearing-up for further m-government activities, little is actually known about the resistance that is encountered, as a reflection of civil servants' current standing, before any further macro-strategies are deployed. Drawing on the resistance and mobility literature, this chapter investigates how civil servants' behaviors, in an emerging country technological environment, through their everyday practice, react and resist the influence of m-government transition. The findings points to four main type of resistance namely: i) functional resistance; ii) ideological resistance; iii) market driven resistance and iv) geographical resistance. In recent years, the European Union has come to view cyber security, and in particular, cyber crime as one of the most relevant challenges to the completion of its Area of Freedom, Security and Justice. Given European societies’ increased reliance on borderless and decentralized information technologies, this sector of activity has been identified as an easy target for actors such as organised criminals, hacktivists or terrorist networks. Such analysis has been accompanied by EU calls to step up the fight against unlawful online activities, namely through increased cooperation among law enforcement authorities (both national and extra- communitarian), the approximation of legislations, and public- private partnerships. Although EU initiatives in this field have, so far, been characterized by a lack of interconnection and an integrated strategy, there has been, since the mid- 2000s, an attempt to develop a more cohesive and coordinated policy. An important part of this policy is connected to the activities of Europol, which have come to assume a central role in the coordination of intelligence gathering and analysis of cyber crime. The European Cybercrime Center (EC3), which will become operational within Europol in January 2013, is regarded, in particular, as a focal point of the EU’s fight against this phenomenon. Bearing this background in mind, the present article wishes to understand the role of Europol in the development of a European policy to counter the illegal use of the internet. The article proposes to reach this objective by analyzing, through the theoretical lenses of experimental governance, the evolution of this agency’s activities in the area of cyber crime and cyber security, its positioning as an expert in the field, and the consequences for the way this policy is currently developing and is expected to develop in the near future.

This dissertation consists of three papers, which together examine whether policies meant to address inequality, succeed in mitigating the impact of traditional institutions such as caste and enable ethnic minorities to claim their rights. Using experimental and quasi-experimental methods with data from a variety of primary and secondary sources, this dissertation analyzes whether policies meant to empower vulnerable groups in India have succeeded in doing so. The findings suggest that while legislations in the form of mandated political representation or freedom of information laws are necessary in terms of increasing the accountability of government towards citizens, they may not be sufficient in ensuring adequate and uniform delivery of public services, especially to citizens belonging to marginalized groups. Further, empowering citizens – especially those belonging to groups that have faced historic discrimination – to actively participate in civic and political life may require more active and intensive policy and programmatic interventions.

Oil spills in marine environments often damage marine and coastal life if not remediated rapidly and efficiently. In spite of the strict enforcement of environmental legislations (i.e., Oil Pollution Act 1990) following the Exxon Valdez oil spill (June 1989; the second biggest oil spill in U.S. history), the Macondo well blowout disaster (April 2010) released 18 times more oil. Strikingly, the response methods used to contain and capture spilled oil after both accidents were nearly identical, note that more than two decades separate Exxon Valdez (1989) and Macondo well (2010) accidents.

The goal of this dissertation was to investigate new advanced materials (mechanically strong aerogel composite blankets-Cabot® Thermal Wrap™ (TW) and Aspen Aerogels® Spaceloft® (SL)), and their applications for oil capture and recovery to overcome the current material limitations in oil spill response methods. First, uptake of different solvents and oils were studied to answer the following question: do these blanket aerogel composites have competitive oil uptake compared to state-of-the-art oil sorbents (i.e., polyurethane foam-PUF)? In addition to their competitive mechanical strength (766, 380, 92 kPa for Spaceloft, Thermal Wrap, and PUF, respectively), our results showed that aerogel composites have three critical advantages over PUF: rapid (3-5 min.) and high (more than two times of PUF’s uptake) oil uptake, reusability (over 10 cycles), and oil recoverability (up to 60%) via mechanical extraction. Chemical-specific sorption experiments showed that the dominant uptake mechanism of aerogels is adsorption to the internal surface, with some contribution of absorption into the pore space.

Second, we investigated the potential environmental impacts (energy and chemical burdens) associated with manufacturing, use, and disposal of SL aerogel and PUF to remove the oil (i.e., 1 m3 oil) from a location (i.e., Macondo well). Different use (single and multiple use) and end of life (landfill, incinerator, and waste-to-energy) scenarios were assessed, and our results demonstrated that multiple use, and waste-to-energy choices minimize the energy and material use of SL aerogel. Nevertheless, using SL once and disposing via landfill still offers environmental and cost savings benefits relative to PUF, and so these benefits are preserved irrespective of the oil-spill-response operator choices.

To inform future aerogel manufacture, we investigated the different laboratory-scale aerogel fabrication technologies (rapid supercritical extraction (RSCE), CO2 supercritical extraction (CSCE), alcohol supercritical extraction (ASCE)). Our results from anticipatory LCA for laboratory-scaled aerogel fabrication demonstrated that RSCE method offers lower cumulative energy and ecotoxicity impacts compared to conventional aerogel fabrication methods (CSCE and ASCE).

The final objective of this study was to investigate different surface coating techniques to enhance oil recovery by modifying the existing aerogel surface chemistries to develop chemically responsive materials (switchable hydrophobicity in response to a CO2 stimulus). Our results showed that studied surface coating methods (drop casting, dip coating, and physical vapor deposition) were partially successful to modify surface with CO2 switchable chemical (tributylpentanamidine), likely because of the heterogeneous fiber structure of the aerogel blankets. A possible solution to these non-uniform coatings would be to include switchable chemical as a precursor during the gel preparation to chemically attach the switchable chemical to the pores of the aerogel.

Taken as a whole, the implications of this work are that mechanical deployment and recovery of aerogel composite blankets is a viable oil spill response strategy that can be deployed today. This will ultimately enable better oil uptake without the uptake of water, potential reuse of the collected oil, reduced material and energy burdens compared to competitive sorbents (e.g., PUF), and reduced occupational exposure to oiled sorbents. In addition, sorbent blankets and booms could be deployed in coastal and open-ocean settings, respectively, which was previously impossible.

This study reports the results of a content analysis of the comment letters sent to the UK Financial Reporting Council (FRC), in response to its consultation document on the 2012 revisions of the UK Corporate Governance Code, concerning the proposal for mandatory audit tendering. The results indicate a general support for the FRC’s proposals with a number of key concerns related to audit quality, auditor independence and audit cost. There is also clear conflict of interests among some stakeholder groups such as audit firms and companies on one side and institutional investors on the other side. There is evidence of conflict of interest between Big 4 and non-Big 4 audit firms. Implications for future consultations and legislations are also discussed.

Though controversial the question of applying data protection laws to biological materials has only gotten a little attention in data privacy discourse. This article aims to contribute to this dearth by arguing that despite absence of positive intention from the architects to apply the EU Data privacy law to biological materials, a range of developments in Molecular Biology and nano-technology—usually mediated by advances in ICT—may provide persuasive grounds to do so.
