O controlo do circuito, da tramitação, da recuperação dos documentos e a legislação nos arquivos municipais de Moçambique

Este estudo tem como objectivo conciliar aspectos da Arquivística à Boa Administração através da gestão dos documentos com efoque no controlo do circuito, da tramitação, da recuperação dos documentos e a legislação nos arquivos municipais em Moçambique no período 1933-2007. O estudo realizado em três universos: municípios de Maputo, da Beira e de Quelimane, em que se confirma que os instrumentos de controlo utilizados na circulação e recuperação dos documentos contribuem para uma boa governação, garantindo a transparência dos actos administrativos e a salvaguarda dos direitos dos cidadãos. Mostra-se que nunca se deve prescindir quer das actividades que delineiam os macro e micro processos nas instituições quer da definição prévia dos percursos documentais, da regulamentação dos procedimentos, da utilização de técnicas que permitam a recuperação dos documentos e da informação: Mostra-se a importância da formação e do conhecimento dos procedimentos pelos funcionários dos escalões autorizados a realizar, pareceres e despachos, da determinação das formas do controlo documental e da garantia no cumprimento dos prazos estabelecidos para cada percurso e, finalmente, a necessária observância prática da legislação criada para esse efeito. ABSTRACT; This case study has as a main objective the reconciliation of the filing aspects with a good Administration though the management of documents and its network, specially in the restoring of files and its legislation into the Municipal Archives of Mozambique during the period of 1933-2007. The study was based on three cities where municipal councils were created, namely: Maputo, Beira and Quelimane. Record's contrail tools used either for registering record transactions or for the access of information contained in them, ensure good governance, transparency and protection of citizen rights. We show the necessity of the activities which lead to macro and micro processes within the organization. This requires that records procedures on transactions must be established and so the guidelines for records' contrail, registration and tools for the information retrieval. We indicate procedures to be followed by authorized civil servants, the importance of their practical training and we define types of records' contrail to ensure their preservation and use in order to accomplish the national legislation.

Protecting Trade Secrets In Litigation The Impact of Article 9 of The EU Trade Secret Directive Especially on Finnish Law

In November 2013 the European Commission issued the “Proposal for a Directive on the European Parliament and of the Council on the protection of undisclosed know-how and business information (trade secrets) against their unlawful acquisition, use and disclosure” (referred to as “TSD”). The TSD offers minimum harmonisation and aims at promoting sharing of knowledge, and the exploitation of innovations on the Internal Market. The European Parliament adopted the TSD on April 14, 2016 and the EU Member States will have two years to implement it. The TSD includes a harmonised definition of a trade secret that builds on the definition provided in Article 39 of the TRIPS Agreement. Moreover, it also ensures the freedom of expression and information and the protection of whistle-blowers. Appropriate means of actions and remedies against unlawful acquisition, use and disclosure of trade secrets are also included, such as provisional and pecuniary measures, injunctions and corrective measures or allocation of damages. This study examines the protection of trade secrets in the course of litigation regulated in Article 9 of the TSD. Currently, the protection of trade secrets within the EU is fragmented especially in this regard, which makes companies reluctant to resort to litigation when a trade secret has unlawfully been misappropriated or it is suspected that a trade secret is being misused. The regulations in Article 9 expand only to the hearing in court. Such protection is welcomed and a step in the right direction. However, in my study I have found that in order for the protection to be sufficient there is a need to further establish measures to protect trade secrets during the entire process, from the filing of the claim to the end when the judgement is given. Consequently, I also discuss different measures that could be used to strengthen the protection of trade secrets before the hearing in court, as evidence are gathered.

Fachliche Publikationskulturen und Open Access. Fächerübergreifende Entwicklungstendenzen und Spezifika der Erziehungswissenschaft und Bildungsforschung

Open Access zu öffentlich geförderten wissenschaftlichen Publikationen ist unter dem Vorzeichen der „Openness“ Teil einer zunehmend bedeutsamen globalen Entwicklung mit strukturellen Folgen für Wissenschaft, Forschung und Bildung. Dabei bedingen die jeweiligen fachkulturellen Ausgangslagen und ökonomischen Interessenskonstellationen sehr stark, in welcher Weise, mit welcher Reichweite und Akzeptanz sich das Open-Access-Paradigma konkret materialisiert. Die vorliegende Arbeit geht dieser Frage am Beispiel des inter- bzw. pluridisziplinären Feldes der Erziehungswissenschaft/Bildungsforschung nach. Zum einen werden die fachlichen und soziokulturellen Konstellationen des Publizierens im disziplinären Feld, die verlagswirtschaftlichen Marktkonstellationen sowie die informationsinfrastrukturellen Bedingungen des Fachgebietes analysiert und ein differenziertes Gesamtbild erstellt. Gestützt auf eine Online-Befragung der Fachcommunity Erziehungswissenschaft/Bildungsforschung werden weitergehende Erkenntnisse über vorhandene Open-Access-Erfahrungen im Fachgebiet und Hemmnisse bzw. Anforderungen an das neue Publikationsmodell aus der Sicht der Wissenschaftler/innen selbst – sowie explorativ aus Sicht der Studierenden und der Bildungspraxis - ermittelt. Wesentliche Faktoren bei der Betrachtung der Potenziale und Effekte von Open Access im Fachgebiet bilden die Faktoren akademischer Status und Funktion, Interdisziplinarität und fachliche Provenienz sowie das Verhältnis von Bildungspraxis und akademischem Sektor. Este trabalho propõe uma metodologia de tradução para igualar o programa de controle de PLC no ambiente Matlab/Simulink. A lista traduz automaticamente o programa de controlo de PLC para a linguagem. de software Matlab/Simulink. O programa do PlC é traduzido para uma função bloco do Matlab, dentro do ambiente Matlab/Simulink, que irá controlar o modelo do processo industrial, desde que a simulação seja executada. As entradas e saídas da lista de tradução do PLC depende do tipo de autómato que é escolhido. A lista de tradução será compatível com um ficheiro Matlab/Simulink que corresponde tradução de programa de controle de PLC. ABSTRACT: This work proposes a translation methodology to equa1 the program of control of PLC in the environment Matlab/Simulink. The list translates automatically the program of control of PLC for the language of software Matlab/Simulink. The program of the PlC is translated for a function block of the Matlab, inside the environment Matlab/Simulink, which will be going to control the model of the industrial process, since the simulation is executed. The entries and exits of the translation list of the PLC it depends on the type of automaton that is chosen. The translation list will be compatible with a filing cabinet Matlab/Simulink that corresponds translation of program of control of PLC.

Macroeconomic determinants of contingent protection:the case of the European Union

Contingent Protection has grown to become an important trade restricting device. In the European Union, protection instruments like antidumping are used extensively. This paper analyses whether macroeconomic pressures may contribute to explain the variations in the intensity of antidumping protectionism in the EU. The empirical analysis uses count data models, applying various specification tests to derive the most appropriate specification. Our results suggest that the filing activity is inversely related to the macroeconomic conditions. Moreover, they confirm existing evidence for the US suggesting that domestic macroeconomic pressures are a more important determinant of contingent protection policy than external pressures.
