Propõe-se estudo teórico com o objetivo de examinar a extensão e os limites da proteção jurídica concedida aos nascituros no ordenamento jurídico brasileiro. Há décadas a doutrina nacional se debruça acerca da exegese mais adequada do art. 4 do Código Civil de 1916, que, atualmente, corresponde ao art. 2 do Código Civil, com pequenas modificações textuais, mas sem alterar substancialmente o dispositivo. O Código Civil aparentemente optou pela atribuição da personalidade civil somente após o nascimento com vida, assegurando, contudo, os direitos do nascituro desde a concepção. O próprio Código Civil prevê expressamente direitos ao nascituro, como o direito a se beneficiar de doação e herança, o direito ao reconhecimento de paternidade e o direito à curatela. Nas últimas décadas outras leis infraconstitucionais reforçaram a proteção do nascituro, para resguardar direitos próprios do nascituro, entre eles o direito à assistência pré-natal, o direito à saúde e à integridade física e o direito aos alimentos. Não obstante, é costumeira a consciência de que o reconhecimento desses direitos pressupõe a concessão da personalidade civil desde a concepção, visto que a titularidade deles dependeria do gozo pleno da personalidade. Embora, pelo perfil do interesse, não haja óbice ao reconhecimento de situações patrimoniais, existenciais e dúplices, que podem ser titularizadas pelo nascituro, a preocupação do legislador nacional sempre se centrou nos aspectos patrimoniais. Diante da existência de situações jurídicas subjetivas merecedoras de proteção por parte do ordenamento jurídico titularizáveis pelos nascituros, pretende-se identificar e revelar os direitos extrapatrimoniais do ente por nascer como merecedores de tutela no direito brasileiro. Mediante pesquisa bibliográfica, observada a metodologia do direito civil constitucional, serão examinados os conceitos de nascituro, bem como as teorias existentes sobre os direitos que lhe são assegurados, com vista à possibilidade de proteção de seus direitos existenciais

An experimental investigation has been undertaken in which vortex generators (VGs) have been employed to inhibit boundary-layer separation produced by the combined adversepressure- gradient of a terminal shock-wave and subsonic diffuser. This setup has been developed as part of a program to produce a more inlet relevant flow-field using a small-scale wind tunnel than previous studies. The resulting flow is dominated by large-scale separation, and as such, is thought to be a good test-bed for flow control. In this investigation, VGs have been added to determine their potential for shock-induced separation mitigation. In line with previous studies, it was observed that the application of VGs alone was not able to significantly alleviate separation overall, because enlarged corner separations was observed. Only when control of the corner separations using corner bleed was employed alongside centre-span control using VGs was a significant improvement in both wall pressure recovery (6% increase) and stagnation pressure recovery (2.4% increase) observed. A moving image work co-commissioned by the Science Museum (London), with extensive unprecedented access to the Oramics archive at Goldsmiths College and the Science Museum. Conceived of as an Artist's film in homage to Daphne Oram, the pioneer of British Electronic Music and co-founder of the BBC Radiophonic workshop in 1958, the film features a close-up encounter with her unique invention, the Oramics Machine, housed at the Science Museum in London. Oram used drawn sound principles to compose ‘handwrought' electronic music, and yet the visual nature of her work remains largely unseen and unsung. A moving image work based on research with neurologists and audiologists, collectors and archivists. The film gives voice to the idea that every surface, in particular parts of our anatomy, is potentially inscribed with an unheard sound or echoes of voices from the past. The soundtrack’s musical composition is interlaced with a voice-over which draws on Rainer Maria Rilke’s text 'Primal Sound', where he reflects on the possibility of playing the coronal suture of a skull with a phonograph needle. The film uses microscopic photography, scanning electron microscopy, and sounds of otoacoustic emissions to uncover haunting aural bonescapes. The voiceovers too are recorded using old sound technology as a filter - writing and over-writing of wax cylinder to create unexpected scratches, glitches, loops and echoes. A regulação é apresentada como instrumento de uma política pública, neste caso, de uma política pública de turismo (GONZÁLEZ, 2004; OLIVEIRA, 2009; MACHADO, 2010). A sujeição desta a um princípio geral como a sustentabilidade, conforme art. 4º parágrafo único da Lei da Política Nacional de Turismo do Brasil (LPNTB) dá o mote para a investigação. É objetivo do artigo fazer uma análise comparativa entre as regulações constantes das leis-quadro das políticas públicas de turismo no Brasil e em Portugal, à luz de princípios funcionais comuns e sistémicos e, em particular, do princípio da sustentabilidade. A regulação do princípio da sustentabilidade no turismo, actividade, também, marcada por fortes princípios de sustentabilidade (OMT, 1999; RYAN, 2002; VALLS, 2004) implica que o Direito se adeque, enquanto instrumento, método, processo, dir-se-ia, como sistema (BENI, 2004; OLIVEIRA, 2004) adequado às especificidades do turismo, cujas políticas públicas estão funcionalizadas para fortes exigências de desenvolvimento económico e social. Para melhor compreensão, enriquecimento e conhecimento da regulação, enquanto instrumento de sustentabilidade, o autor recorre ao método comparado, justapondo os desenvolvimentos do princípio da sustentabilidade constantes da LPNTB com o princípio da sustentabilidade constante da Lei das Políticas Públicas de Turismo em Portugal (LPPTP). Assim, permite-se um apuramento e refinamento do sentido do princípio da sustentabilidade, através da deteção de pontes, homologias, funcionalidades idênticas e diferenças entre o sistema jurídico brasileiro e o português quanto à regulação fundamental de políticas públicas de turismo, permitindo-se uma melhor compreensão da sua funcionalidade, que se pretende o mais universal possível (OMT, 1999).

A large part of power dissipation in a system is generated by I/O devices. Increasingly these devices provide power saving mechanisms, inter alia to enhance battery life. While I/O device scheduling has been studied in the past for realtime systems, the use of energy resources by these scheduling algorithms may be improved. These approaches are crafted considering a very large overhead of device transitions. Technology enhancements have allowed the hardware vendors to reduce the device transition overhead and energy consumption. We propose an intra-task device scheduling algorithm for real time systems that allows to shut-down devices while ensuring system schedulability. Our results show an energy gain of up to 90% when compared to the techniques proposed in the state-of-the-art.

The object of this dissertation is the analysis of the legal framework applicable to contracts for provision of electronic communications services, while trying to offer solutions to some of the issues regarding this matter. The main focus of this study will be the rules concerning service’s suspension, which have been recently amended. The technological development and the establishment of these services as information transmitters and work tools were noteworthy for its growing importance at the present time. These services include cable television, telephone (landline and mobile) and internet and they are regulated by Law nr 23/96, July 26th, along with other essential public services. Said law sets a group of principles and duties, such as good faith (article 3), continuity and quality of the service (article 7) and the duty to rightfully inform the user (article 4), in order to protect the users. For the analysis of legal framework applicable to these particular contracts it is also fundamental to mention Law nr 5/2004, February 10th, known as Electronic Communications Law. The provisions regarding the service’s suspension are currently prescribed in articles 52.º and 52.º-A of the law. Given the amendments introduced by Law nr 10/2013, January 28th, consumers are subjected to a regulation different from the one applicable to the other users, established in the new article 52.º-A. From our analysis, we have concluded that the main change from past provisions has to do with the automatic termination of the contract as consequence of the consumer’s failure to pay the price or to conclude a written payment arrangement after service’s suspension.
