Puget Sound shorelines have historically provided a diversity of habitats that support a variety of aquatic resources throughout the region. These valued natural resources are iconic to the region and remain central to both the economic vitality and community appreciation of Puget Sound. Deterioration of upland and nearshore shoreline habitats, have placed severe stress on many aquatic resources within the region (PSAT, 2007). Since a majority of Washington State shorelines are privately owned, regulatory authority to legislate restoration on private property is limited in scope and frequency. Washington States’ Shoreline Management Act (RCW 90.58) requires local jurisdictions to plan for appropriate future shoreline uses. Under the Act, future development can be regulated to protect existing ecological functions, but lost functions cannot be restored without purchase or compensation of restored areas. Therefore, questions remains as to the ecological resilience of the region when considering cumulative effect of existing/ongoing shoreline development constrained by limited shoreline restoration opportunities. In light of these questions, this analysis will explore opportunities to promote restoration on privately owned shorelines within Puget Sound. These efforts are intended to promote more efficient ecosystem management and improve ecosystem-wide ecological functions. From an economics perspective, results of past shoreline management can generally be characterized as both market and government failure in effectively protecting the publics’ interest in maintaining healthy shoreline resources. Therefore coastal development has proceeded in spite of negative externalities and market imbalances resulting in inefficient resource management driven by the individual ambitions of private shoreline property owners to develop their property to their highest and best use. Federally derived property rights will protect continuation of existing uses along privately owned shorelines; therefore, a fundamental challenge remains in sustainable management of existing shoreline resources while also restoring ecological functions lost to past mistakes in an effort to increase the ecologic resiliency within the region. A questão do Acre, entre 1899 e 1901, mobilizou a política externa brasileira da Primeira República. Pelo Tratado de Ayacucho, assinado em 1867, o território do Acre foi entregue à Bolívia. Apesar disso, desde o último quartel do século XIX, a área foi gradativamente colonizada por Brasileiros. Com o Boom da borracha, os bolivianos desejaram utilizar os seus direitos para explorar a região. O governo brasileiro, firmado no Tratado de 1867, consentiu. Em 1899 a legação boliviana chegou ao Acre para estabelecer a soberania da república vizinha. A população acreana, esmagadoramente brasileira, não aceitou a presença boliviana. Fez diversos levantes entre 1899 e 1902, atrapalhando os planos do governo da Bolívia. Diante disso, o governo boliviano considerou a possibilidade de uma exploração indireta, por meio do arrendamento da região. Durante parte desse período, Rui Barbosa atuou através do jornal A Imprensa (1899-1901), em favor dos direitos do Brasil sobre o Acre. Defendeu que da insistência do governo de Campos Sales em afirmar a ascendência boliviana naquela região, decorria a ameaça à soberania e a integridade territorial brasileira, em função do estabelecimento de forças imperialista na fronteira amazônica. Rui formulou, a partir da ambigüidade da redação do Tratado de Ayacucho, a tese da fronteira angular, de acordo com a qual território do Acre era incorporado ao Brasileiro. Em sua reflexão e ação, Rui Barbosa expressou uma expectativa, existente na sociedade brasileira, a respeito de como deveria se processar a política externa do país: resguardando o interesse nacional, que englobava, prioritariamente, a salvaguarda da soberania e do elemento gerador de maior identidade no nacionalismo brasileiro, o caráter monumental de seu território. À solução dada por Rio Branco á questão do Acre, em 1903, através do Tratado de Petrópolis, portanto, antecedeu um amplo debate público sobre um tema de política externa, a questão do Acre, que o Barão teve que considerar no processo de decisão política.

The development of near-resonant holographic interferometry techniques for use on flows seeded with atomic species is described. A theoretical model for the refractivity that is due to the seed species is outlined, and an approximation to this model is also described that is shown to be valid for practical regimes of interest and allows the number density of the species to be determined without knowledge of line-broadening effects. The details of quantitative number density experiments performed on an air-acetylene flame are given, and a comparison with an alternative absorption-based experiment is made. A tanulmány a Public-Private Partnership (PPP) immanens logikai kihívásai közül két kiemelt kérdést elemez: az állami fél közszolgálati-közigazgatási beágyazottságából eredő dilemmákat, valamint az állami és a magánfél eltérő kulturális hátteréből eredő feszültségek jellemzőit. A PPP projektek gyakorlati megvalósítása szempontjából e két kardinális kérdés kifinomult elméleti hátterébe nyújt bepillantást. A közszolgáltatási dilemmák közül azonosítja és tárgyalja a jogszerűség vs. eredményesség, a hatékonyság vs. eredményesség, a centralizáció vs. decentralizáció, a közérdek vs. egyéni szabadságjogok védelme, valamint a kormányzat kicsinyítése vs. jogbiztonság védelme, és a vállalkozói szemlélet vs. közszolgálatiság közti egyensúlyozás kihívásait. Az állami és az üzleti fél kulturális különbözőségének központi motívumaként a döntéshozatalbeli különbséget ragadja meg, és a bizalom szerepét hangsúlyozza a működőképes modell megtalálásának lehetőségeként. = This study analyses two cardinal issues of Public-Private Partnership (PPP) projects’ immanent challenges: the management dilemmas of public services/governance, and the tensions between the private and public parties due to their different cultural imbeddedness. It provides theoretical insights into these two issues of practical relevance. As public service management dilemmas, it identifies the trade-offs between rights vs. effectiveness, efficiency vs. effectiveness, centralization vs. decentralization, protecting the public interest vs. individual freedom, minimizing government vs. protecting human rights, the entrepreneurial approach vs. public service ethos. The study captures the cultural difference between the public and the private parties in their different approaches to decision making, while it concludes that the role of trust is key in finding feasible solutions for PPP models.

A tanulmány a Public-Private Partnership (PPP) egyik nagy kérdésének megközelítéseit vizsgálja: miként védhető a közérdek e projektekben. Piaci és nem piaci megoldásokat tesz az elemzés mérlegre, valamint kitér arra, hogy miért különleges a PPP projektek esetében a közérdek védelmének kérdése. A szabályozott verseny körülményeinek kialakítása több megközelítésben is perdöntő kérdés a PPP értéknövelésének előmozdításához, bár a létező megoldások nem mentesek anomáliáktól. A képviseleti demokrácia intézményi működésének támogatására pedig a társadalmi részvétel megoldásait javasolja az irodalom. E megközelítés is több formájában, többféle céllal és szintén kihívásokkal segítheti az értéknövelő PPP projekteket. A tanulmány az elvi lehetőségek értékelő elemzését követően a megvalósítás realitásait is mérlegre teszi. = This study focuses on a key issue in Public-Private Partnership (PPP) projects: how may public interest be protected. It assesses market based and non market based approaches, and also explains why PPP projects are peculiar when addressing the protection of public interest. Setting up the conditions for simulated competition is of paramount importance for different reasons in order to enable value creating PPP projects. Existing solutions however are not without anomalies. To promote the institutions of democracy, participatory solutions are recommended in the literature. That approach may help value creating PPP projects in various forms, with a range of objectives and challenges. The study concludes the analytical assessment of options by highlighting the realistic conditions of implementation.

Section 126 of the Land Title Act 1994 (Qld) regulates whether, and if so, when a caveat will lapse. While certain caveats will not lapse due to the operation of s 126(1), if a caveator does not wish a caveat to which the section applies to lapse, the caveator must start a proceeding in a court of competent jurisdiction to establish the interest claimed under the caveat within the time limits specified in, and otherwise comply with the obligations imposed by, s 126(4). The requirement, in s 126(4), to “start a proceeding” was the subject of judicial examination by the Court of Appeal (McMurdo P, Holmes JA and MacKenzie J) in Cousins Securities Pty Ltd v CEC Group Ltd [2007] QCA 192.

Property in an elusive concept. In many respects it has been regarded as a source of authority to use, develop and make decisions about whatever is the subject matter of this right of ownership. This is true whether the holder of this right of ownership is a private entity or a public entity. Increasingly a right of ownership of this kind has been recognised not only as a source of authority but also as a mechanism for restricting or limiting and perhaps even prohibiting existing or proposed activities that impact upon the environment. It is increasingly therefore an instrument of regulation as much as an instrument of authorisation. The protection and conservation of the environment are ultimately a matter of the public interest. This is not to suggest that the individual holders of rights of ownership are not interested in protecting the environment. It is open to them to do so in the exercise of a right of ownership as a source of authorisation. However a right of ownership – whether private or public – has become increasingly the mechanism according to which the environment is protected and conserved through the use of rights of ownership as a means of regulation. This paper addressed these issues from a doctrinal as well as a practical perspective in how the environment is managed.

BACKGROUND: Disclosure of authors' financial interests has been proposed as a strategy for protecting the integrity of the biomedical literature. We examined whether authors' financial interests were disclosed consistently in articles on coronary stents published in 2006. METHODOLOGY/PRINCIPAL FINDINGS: We searched PubMed for English-language articles published in 2006 that provided evidence or guidance regarding the use of coronary artery stents. We recorded article characteristics, including information about authors' financial disclosures. The main outcome measures were the prevalence, nature, and consistency of financial disclosures. There were 746 articles, 2985 authors, and 135 journals in the database. Eighty-three percent of the articles did not contain disclosure statements for any author (including declarations of no interests). Only 6% of authors had an article with a disclosure statement. In comparisons between articles by the same author, the types of disagreement were as follows: no disclosure statements vs declarations of no interests (64%); specific disclosures vs no disclosure statements (34%); and specific disclosures vs declarations of no interests (2%). Among the 75 authors who disclosed at least 1 relationship with an organization, there were 2 cases (3%) in which the organization was disclosed in every article the author wrote. CONCLUSIONS/SIGNIFICANCE: In the rare instances when financial interests were disclosed, they were not disclosed consistently, suggesting that there are problems with transparency in an area of the literature that has important implications for patient care. Our findings suggest that the inconsistencies we observed are due to both the policies of journals and the behavior of some authors.

This article seeks to outline and explore some of the conditions necessary for International Organizations (IOs) to perform in a public interest fashion through a case study of the Principles of corporate governance formulated by the OECD. Rather than the more commonly documented pathological and dysfunctional behavioural forms of IOs, the case of the Principles, both in their formulation by the OECD, and in their assessment by the World Bank through the ROSC process, represent an episode of IO agency protecting and promoting a wider public interest. In exercising their agency, IO staff, have made the Principles more agreeable to a wider range of interested parties, giving them a general interest orientation, in accordance with a proceduralist definition of public interest. This case should therefore encourage IPE scholars to consider carefully and systematically the sets of circumstances and conditions, which might be required for IO agency to take more socially useful forms. In the final section, three indicators are identified which might be evaluated in future research into the positive public interest agency of IOs across a range of cases.

Background: Acute respiratory infections are usual in children under three years old occurring in upper respiratory tract, having an impact on child and caregiver’s quality of life predisposing to otitis media or bronchiolitis. There are few valid and reliable measures to determine the child’s respiratory condition and to guide the physiotherapy intervention. Aim: To assess the intra and inter rater reliability of nasal auscultation, to analyze the relation between sounds’ classification and middle ear’s pressure and compliance as well as with the Clinical Severity Score. Methods: A cross-sectional observational study was composed by 125 nursery children aged up to three years old. Tympanometry, pulmonary and nasal auscultation and application of Clinical Severity Score were performed to each child. Nasal auscultation sounds’ were recorded and sent to 3 blinded experts, that classified, as “obstructed” and “unobstructed”, with a 48 hours interval, in order to analyze inter and intra rater reliability. Results: Nasal auscultation revealed a substantial inter and intra rater reliability (=0,749 and evaluator A - K= 0,691; evaluator B - K= 0,605 and evaluator C - K= 0,724, respectively). Both ears’ pressure was significantly lower in children with an "unobstructed" nasal sound when compared with an “obstructed” nasal sound (t=-3,599, p<0,001 in left ear; t=-2,258, p=0,026 in right ear). Compliance in both ears was significantly lower in children with an "obstructed" nasal sound when compared with “unobstructed” nasal sound (t=-2,728, p=0,007 in left ear; t=-3,830, p<0,001 in right ear). There was a statistically significant association between sounds’ classification and tympanograms types in both ear’s (=11,437, p=0,003 in left ear; =13,535, p=0,001 in right ear). There was a trend to children with an "unobstructed" nasal sound that had a lower clinical severity score when compared with “obstructed” children. Conclusion: It was observed a good intra and substantial inter reliability for nasal auscultation. Nasal auscultation sounds’ classification was related to middle ears’ pressure and compliance.

This Account provides an overview of strategies that have been reported from our laboratories for the synthesis of targets of therapeutic interest, namely carbohydrates, and prodrugs for the treatment of melanoma. These programmes have involved the development of new synthetic methodologies including the regio- and stereoselective synthesis of specific carbohydrate isomers, and new protecting group methodologies. This review provides an insight into the progress of these research themes, and suggests some applications for the targets that are currently being explored.
