We try to shed some light oil the question of wily technology-intensive businesses often fail in less-developed countries and under what circumstances they are likely to be a Success from the perspective of both domestic and export markets. The answers were drawn from a set of empirical evidences from Brazilian firms applying photonics technologies. Sonic of the issues faced by them are related to the question of state versus private initiative, entering traditional versus niche market, and technology transfer versus product development management. In overall, we concluded that weakness of the institutions and inadequacy of social and organizational demography play a key role in explaining to a large extent wily countries differ in technological development and diffusion. In this context, we point out obstacles, which must be removed in order to make public policies and firm`s achievements more efficient. (C) 2008 Elsevier Ltd. All rights reserved.

En Colombia, la construcción, operación y administración de los puertos exige el otorgamiento, por parte del Estado, de un contrato de concesión a sociedades portuarias, el cual se otorga previo agotamiento de un trámite administrativo especial de iniciativa privada, mediante el ejercicio del derecho de petición en interés particular o por medio de una oferta oficiosa impulsada por el Estado. Los trámites enunciados están previstos en la Ley 1ª de 1991, reglamentada actualmente por el Decreto 4735 de 2009. Si bien el régimen legal prevé mecanismos que permiten la comparecencia de terceros dentro del trámite, no contempla la manera como debe tramitarse la solicitud de concesión portuaria, radicada por fuera del término previsto en el artículo 10 de la Ley 1ª de 1991, cuando ésta no es una oposición o propuesta alternativa a una solicitud, sobre una misma área en estudio de petición de concesión.

The mineral sector has an extreme strategic relevance for the social and economic development of any country. Therefore, proper management of existing mineral resources in a given area is closely linked to the full exercise of sovereignty. Thus, in pretending to guarantee efficient control of resources, the majority of the countries classify mineral resources as state property; however, because of the high cost and the risk involved, the economic exploitation of these resources is more efficient when driven by private initiative. Hence, the basic resource exploitation model is a modern legal concept in which the control over resources belongs to the State, but the direct economic exploitation of this heritage belongs to some individuals according to law and by offering the necessary social and economic counterparts.

Este trabalho pretende demonstrar como a realidade que alcança os imigrantes vindos daSuíça e de outros países, a geografia, as belezas naturais, os remanescentes traçosculturais e os fatores climáticos, são os pontos que diferenciam positivamente NovaFriburgo da maioria dos municípios do estado do Rio de Janeiro, conferindo-lhe um papelprivilegiado no cenário turístico. Também defende a importância da adoção de análises deambiente como atividades permanentes do planejamento turístico, e, por meio deresultados obtidos em levantamentos e pesquisas realizados, sugere a definição deestratégias que poderão gerar aumentos significativos nos resultados obtidos pelo setor deturismo, facilitando a realização de investimentos, o envolvimento da população, e a açãoconjunta entre o poder público, a iniciativa privada e o terceiro setor, influenciandopositivamente o desenvolvimento sustentável de uma cidade potencialmente turística.

O Direito à Saúde é consagrado em fontes normativas de Direito, sejam elas internas, sejam internacionais. A partir da promulgação da Constituição da República de 1988 é, ademais, tido como Direito Fundamental. Contudo, no bojo de um Estado Democrático de Direito no qual há, de um lado, um Estado centralizado e ineficiente e, de outro, a iniciativa privada voltada exclusivamente para o lucro, r. direito torna-se letra fria, manifestamente inefetivo no Brasil. Desse modo, o Terceiro Setor, por meio de suas diversas entidades, tais como Associações, Fundações e entidades filantrópicas e sem fins econômicos, torna-se uma alternativa à efetivação do Direito à Saúde. No caso, embasado pelos mecanismos legais previstos, tais como sua preferência a repasses de recursos e de competência pelo poder público, bem como pelo contexto social, no qual a sociedade civil exerce maior controle social e anseia empoderamento. Ressalta-se, por sim, que o Terceiro Setor é integrante da iniciativa privada, embora focado no interesse público, razão pela qual pode ser a chave para que o Direito constitucional e fundamental à saúde seja finalmente praticado no Brasil.

O Governo brasileiro criou a partir de 2007 o PAC – Programa de Aceleração do Crescimento, um conjunto de projetos de infraestrutura no qual o DNIT ocupa posição de destaque com volume de recursos superior a R$ 58 bilhões. Desde o início do Programa o principal obstáculo é a insuficiência de projetos de qualidade. Projetos de engenharia são etapa crucial para o lançamento de licitações para obras de infraestrutura. Este gargalo de projeto, associado ao processo licitatório, é chamado de “fator projeto”. Em 2011 foi instituído o RDC – Regime Diferenciado de Contratações com o objetivo de remover estes entraves. Este trabalho surge da necessidade da Secretaria do Programa de Aceleração do Crescimento, vinculada ao Ministério do Planejamento, e do Departamento Nacional de Infraestrutura de Transportes, vinculado ao Ministério dos Transportes, de entender os desafios impostos pelo “fator projeto” na execução dos projetos relacionados às obras rodoviárias no âmbito do PAC. Para tanto, foram analisados os aspectos de contratação pela Administração Pública, enfatizando as mudanças ocorridas no processo licitatório corridas depois da vigência do Regime Diferenciado de Contratação (RDC) e as formas contemporâneas de relacionamentos pré-contratuais, abordando as parcerias publico-privadas (PPP), as manifestações de interesse da iniciativa privada (PMI) e os diálogos concorrenciais. Após uma apresentação do DNIT e do processo de institucionalização do RDC no âmbito da autarquia concluiu-se que três aspectos tem contribuído para minimizar os efeitos do “fator projeto”: O primeiro, de natureza procedimental, está diretamente relacionado com o efeito da implementação do novo regime licitatório. Em projetos complexos, como os da área de infraestrutura, o desenvolvimento de relações pré-contratuais trazem ganhos consideráveis, tanto para Administração Pública quanto para o ente privado, por promover a redução das assimetrias de informação e a lapidação do objeto a ser contratado. O segundo aspecto está relacionado com a natureza do DNIT. Trata-se de uma Autarquia com acúmulo de conhecimentos na área de engenharia e gestão de projetos. Ao adotar intensamente o RDC, mostrou capacidade instalada e avançou nos parâmetros de monitoramento e gestão de risco e gerou um conjunto normativo atual e adequado para enfrentar os desafios do novo regime de contrações. O terceiro aspecto também está relacionado com o aspecto institucional do DNIT. Trata-se de sua estrutura organizacional, que influencia a governança dos processos licitatórios e que agrega dois predicados: segurança na responsabilização entre os diretores-membros quando partilham uma decisão e salvaguarda do corpo técnico para uma postura mais republicana. Estes tres aspectos levaram a uma maior eficácia e efetividade da Autarquia, minimizaram o "fator projeto". O Relatório de Gestão do DNIT de 2012 cita que no RDC há a redução de até 50% no tempo do processo licitatório em relação às modalidades concorrência e Tomada de Preços. A implementação do RDC Eletrônico, que possibilita a participação de empresas de todo o país, aumentou a competitividade e ajudou a executar R$ 10,2 bilhões em obras e serviços em infraestrutura de transportes.

To implement policies and plans at the tourist sector involve disposition to the establishment of parceries among government and private initiative, space to the action of studious, researchers and professionals of several areas of knowledge and formation, able of to give new courses no only at the tourism, but to the economy how a every, seen which the tourism had a effect multiplicator, reaching 52 sectors of the economy. At this sense, the Brazil came pruning for a new phase of politic actuation at the touristy activity. Until the year 2002, the tourism politic in the Brazil no had detail, because herself treated of isolated actions and many without continuity. However, at to start 2003, several actions were developed in order to contribute for the national touristy planning. The principal was the creation of Ministério do Turismo, accompanied of the formulation and implementation of the Plano Nacional do Turismo (2003/2007). This work pretend to understand the implementation at the Rio Grande do Norte of the model of participative administration extolled by Plano Nacional do Turismo. The your centre detail the action of the Conselho Estadual de Turismo do Rio Grande do Norte (CONETUR), to promote the participation at the tourism public policies. The bibliographical research contemplated diverse sources in order to compile knowledge of credential authors in the quarrel of inherent subjects to the participation and to the tourism public policies, especially at the Brazil. A qualitative perspective the case study was adapted as research method and for attainment of the data interviews with the members of the Conselho had been carried through beyond consultation the referring documents the dynamics of functioning of the Conselho. The principal actuations of the CONETUR, the directives tourism public policies already made and directed to implementation, the type of participation at made decision, the principal difficulties of the implementation of the participative administration model of the Plano Nacional do Turismo and the degree of participation of the members of the Conselho at the reunions had been identified. The results had shown that exist some difficulties at the implementation of the participation at the Conselho Estadual de Turismo do Rio Grande do Norte, knowledge of the Conselheiros of CONETUR function, the presence of bodies which doesn t directly connected at the touristy activity; the absence of time of the Conselheiros to be presents at reunions; the discontinuity of the presidency of the Conselho; among others. So, the CONETUR show himself how a Conselho with participative characteristics, but with some adapted needs.

It treats tourism as part of the places urban development dynamics and the touristic urbanization process as a strategy of cities international competitiveness strengthen, detaching institucional agents role as promoters of this process. It aims to understand how happens the interinstitucional cooperation existing between the agents (Estate, private initiative and third sector) that composes the Development Council of Pólo Costa das Dunas/RN, littoral potiguar region, where are invested the resources deriving from the Program of Development of Tourism in the northeast of Brazil (PRODETUR/NE). Making use of economy referencials, urban sociology and urban geography, as a possibility of a more consistent theoretical construction, capable to accomplish the sustainable development and sustainable tourism concepts amplitude, this work brings out an experience of interinstitucional cooperation, where it glimpses itself the possibility of implementation of a alternative development model, based on the sustainability principles

The Oil industry in Brazil has gone through several stages during the economical, political and social historical process. However, the significative changes have happened in the last fifteen years, due to market opening arising from the relaxation of the state monopoly over the Oil deposits and its derivatives. The edition of the Constitutional Amendment #9, changing the first paragraph of the 177th item of the Federal Constitution, marked the end of a stiffness about the monopoly that the Brazilian state kept in relation to the exploration and research of Oil and Gas. The economical order was fundamental to actualize the idea contained in the #9 Amendment, since its contents has the power to set up measures to be adopted by public power in order to organize the economical relations from a social viewpoint. The new brazilian Oil scenery, called pre-salt, presents itself in a way to amaze the economical markets, in addition to creating a new perspective to the social sector. This work will identify, in this new scenario, the need for change in the legal system. Nevertheless, this subject must not be treated in a thoughtless way: being an exhaustible good, we shall not forget that the future generations also must benefit from the exploration of natural resources recently discovered. The settlement of a new regulatory mark, including the change in the concession contract model to production and sharing is one of the suggested solutions as a bill in the National Congress, in an attempt to ensure the sovereignty of the nation. The constitutionality of a new regulatory mark is questioned, starting from an analysis of the state monopoly, grounding the comprehnsions in the brazilian constitutions, the relevance of the creation of Petrobras for self-assertion of the state about the monopoly of Oil and derivatives, and its posture after the Constitutional Amendment nº 9 (1995), when a company stops having control of the state monopoly, beginning to compete in a fairly way with other companies. The market opening and private initiative are emphasized from the viewpoint of the Constitutional Principles of the Economical and Social Order. The relaxation of the monopoly regarding the exploratory activity in the Federal Constitution doesn't deprive from the Union the ownerships of underground goods, enabling to this federal entity to contract, directly or by concession of exploration of goods, to state-owned or private companies. The existing oil in the pre-salt layer transforms the scenario from very high risk to low risk, which gives the Union the possibility of defining another way of exploring this resources in the best interests of the Public Administration

Analysis of the elements of the Constitutional Order of the letter 1988 politics, with emphasis in the principles of this, a study on the intervention of the State in the private initiative by means of the Law of Recovery of Companies and Bankruptcies (law 11.101/05). New enterprise vision is admitted, over all in the interdependence between economic and social factors. Study on the globalization and the interdependence of economic and legal sciences in the construction of a legal optics in the search for the economic and social development, with the recognition of the interference of the Economy in the Right and its uneven importance. Still, we delineate the state intervention in the economic scope, of company and in the judicial recovery, as well as the consequences of such intervention in the involved credits in the judicial recovery and patrimony of the debtor in recovery. For such task, the elements of the Judicial Recovery, its principles and adequacy of these to the related ones in the chapter had been analyzed that turns on the national economic Order, describing the formal procedure for concession of the benefit of the Judicial Recovery and the principles in existing them. The forms of intervention of the State in the private economy were not disrespected, relating its direct and indirect performance as half of preservation of interests writings in the constitutional scope as public interest and preservation of the National economic Order. The regulating agencies as of direct state intervention were half not disrespected of the study for the relevance of the subject. It is revised national bibliography with incursions in French, Portuguese and North American comparative jurisprudence. The civil liability of the distribution and retail fuel stems from the fact business activity developed to be high risk and can be said as risk inherent or latent danger that has predictability and normality characterized by placing the consumer in a position of vulnerability, such as the environment, both public policies defined and constitutional protection. Consumer protection as a fundamental right and the environment as the primacy of social order aims the welfare and social justice, as inserted right to the third dimension, are guarded by the State when it creates operational standards through public policies and indirectly intervenes in the economic order. This intervention is due to consumer protection and the environment are economic order principles, founded on free initiative and free competition, ensuring everyone a dignified existence which underlies the irradiation of fundamental rights in private initiative, before the commercial evaluation, mass consumption, the emergence of new technologies that link consumers to the environment before the protection of life, health and safety and ensuring a better quality of life for present and future generations. To repair this damage and the right to information are provided as fundamental rights that put the person at the epicenter of the relations and collective interest stands out against individual interests that to be done need public-private partnership. In such a way that the used methodology was an analysis of documents correlating them with bibliographic sources whose goals are to recognize the civil responsibility as limit to subjective right, having to develop a social function where guilt and risk grow distant and the damage is configured as a consequence of inherent risk, requiring the State interventional postures in fulfilling its public policy; prevailing in these risky activities the solidarity of those involved in the chain of production and socialization of damage forward those are provided directly of products of hazardous nature that put in a position of vulnerability the environment and the consumer
