In the face of what looks like a real impasse of the the line of European constitutionalism, partly due to an orientation of the Court of Justice which tends to favor the protection of economic freedoms over the protection of social rights, two opposing trends occurr. The first amounts to a new "constitutional patriotism"; the second entrusts the protection of fundamental social rights no longer to a single Chart or to a single court but to a multi-level system of protection. A dialogue between the European courts that truly valorizes fundamental rights, however, might be hindered by what someone has seen as a resurgence of the dualist theories, evident in an ECJ’s decision as Kadi.

This paper explores the limits and potentials of European citizenship as a transnational form of social integration, taking as comparison Marshall's classical analysis of the historical development of social rights in the context of the national Welfare State. It is submitted that this potential is currently frustrated by the prevailing negative-integration dimension in which the interplay between Union citizenship and national systems of Welfare State takes place. This negative dimension pervades the entire case law of the Court of Justice on Union citizenship, even becoming dominant – after the famous Viking and Laval judgements – in the ways in which the judges in Luxembourg have built, and limited, what in Marshall’s terms might be called the European collective dimension of “industrial citizenship”. The new architecture of the economic and monetary governance of the Union, based as it is on an unprecedented effort towards a creeping constitutionalisation of a neo-liberal politics of austerity and welfare retrenchment, is destined to strengthen the de-structuring pressures on the industrial-relation and social protection systems of the member States. The conclusions sum-up the main critical arguments and make some suggestions for an alternative path for re-politicising the social question in Europe.

In the Viking and Laval judgments and more recently in the Comm. v. Germany ruling, the Court of Justice applied the proportionality test to collective rights, setting a series of restrictions to the exercise of the right to strike and the right to collective bargaining. The way the ECJ balances the economic freedoms and the social rights is indeed very different from that of the Italian Constitutional Court. Unlike the European Union Treaties, the Italian Constitution recognizes an important role to the right to take collective action which has to be connected with article 3, paragraph 2, consequently the right of strike is more protected than the exercise of economic freedoms.

The immolation of street vendor Mohamed Bouazizi and the demonstrations that followed in December 2010 triggered the Tunisian revolution. But there were more deep-seated issues at stake: unemployment, poverty and exclusion, coupled with a deep sense of injustice, humiliation and helplessness of the peripheries to influence the political centre. Five years after the revolution, the social and economic problems are still persistent and arguably worse. Many people believe Tunisians are facing a distorted revolution; political progress has not coincided with reforms leading to welfare.

The consequences that arose from the ‘global economy’ have been significant in Portuguese children’s lives and we believe it is fundamental to reflect on the ongoing structuring of childhood through this global culture/ideology and the concrete implications that they have. It is also important to understand how childhood is constructed and experienced, as well as to consider the impacts of political economic conditions on children’s lives and in childhood in general, taking into account the effects brought on by public policies. The aim of this paper is to reflect on the ways through which the economic crisis affecting the general Portuguese population has impacted children in particular and promoted discrimination and a lack of opportunities in childhood. We will focus on two dimensions: first, on general data about the ongoing policies that have been reducing social rights, increasing poverty rates and threatening basic rights such as educational and health rights, to show their impact on children´s lives. Second, we will discuss some data collected with children throughout different research projects in order to characterize the meanings and impacts of the crisis in their lives from their points of view

En este artículo, se plantea el problema de si puede considerarse a la educación como un derechofundamental. Se analizan las implicaciones que ha tenido su no inclusión como tal derechoen la Constitución en el capítulo de los derechos fundamentales. Se estudian dos grandes tradicionessobre los derechos fundamentales: el neoliberalismo afirma que los derechos fundamentalesson únicamente los derechos liberales civiles y políticos. Y el liberalismo social concibe quelos derechos fundamentales son, además de los derechos liberales civiles y políticos, los económicosy sociales. En la parte final, se hace una reconstrucción del desarrollo del derechoa la educación en la jurisprudencia de la Corte Constitucional; termina con unas críticas alproyecto de reforma de la educación superior y unas sugerencias con miras a proponer a laeducación como un derecho fundamental.

El objetivo de este escrito es proponer elementos conceptuales para el debate sobre la implementación de políticas sociales bajo la actual administración del presidente Hugo Chávez Frías en Venezuela. A través del uso de conceptos propios de la Ciencia Política y de la Sociología del Derecho, junto a la definición de los paradigmas como categoría analítica, se abordan las actuales políticas sociales como el resultado de una crisis institucional que necesariamente precisa la implementación de un nuevo paradigma, con las consecuencias que este proceso trae consigo para la institucionalidad del país. A partir de la forma en la que están concebidos los derechos sociales dentro de la Constitución de 1999, se exponen algunos de los dilemas que será necesario afrontar para el pleno establecimiento de una política social institucional.-----The aim of this paper is to propose conceptual elements for discussion about the implementation of social policies under the current administration of the President Hugo Chávez Frías in Venezuela. Through the use of concepts from political science and sociology of law, together with the definition of paradigms as an analytical category, it addresses the current social policies as the result of an institutional crisis, which necessarily requires the implementation of a new paradigm, with the consequences that this process entails for the country’s institutions. Since the reform which social rights are conceived in the 1999 Constitution sets out some of the dilemmas that will be needed to meet the full establishment of an institutional social policy.
