The Inter-American system for the protection of human rights provides that disputesbetween States and victims of human rights violations or their representatives can beresolved through a friendly settlement. In this arrangement, conducted before the regionalorgans of protection of human rights, the State accepts its international responsibility,commits itself to investigate and judge the responsible and makes commitmentson compensation to the offended, the victims, on his part, renounce to take the caseto the Inter-American Court of Human Rights, and the Inter-American Commissionmonitors the legal consistency of the agreement and holds the role of independentobserver. What are these agreements, what possibilities and limitations provide to theopposing parties and, above all, what kind of reparation offer to victims of humanrights violations are issues to resolve in this article.

Los sujetos pasivos que impugnen ante la vía judicial un acto administrativo mediante el cual se pretenda determinar o recaudar tributos, deben rendir una caución equivalente al 10% de la cuantía de su demanda, de no presentársela en el término de quince días, el acto impugnado queda ejecutoriado y los jueces deben ordenar el archivo del proceso. Nuestra Corte Constitucional para el Período de Transición considera que no se vulnera derecho alguno en ese caso, siempre y cuando se exija rendir la caución después de calificada la demanda. Estudiaremos los fundamentos que tuvo la Corte Constitucional para llegar a esa conclusión. Pretenderemos analizarlos y cuestionarlos objetivamente, para así demostrar por qué su falta de coherencia y de sustento permite concluir que su análisis pecó por falto de imparcialidad, y por qué es razonable suponer que sus móviles no fueron jurídicos en lo absoluto, sin perjuicio de que, a la par, demos nuestro parecer al respecto. Independientemente de la trascendencia jurídica que puedan o no tener en nuestro ordenamiento, esperamos se entienda por qué creemos que estos precedentes deben ser considerados como un capítulo funesto en la historia de la jurisprudencia constitucional ecuatoriana.

Il presente lavoro verte sul ruolo svolto dal diritto romano e – più in generale – dalla “tradizione romanistica” all'interno del sistema giuridico nazionale posteriore alla codificazione civile del 1865. L'attenzione è rivolta principalmente all'art. 3 delle Disposizioni preliminari del Codice del 1865 con il suo riferimento ai 'principi generali del diritto' e, dunque, all'analogia iuris. La prima parte dello studio si concentra sull'analisi di alcune voci della scienza giuridica italiana tra Otto e Novecento, nei loro diversi approcci – laddove riscontrabili – rispetto allo studio e al recupero (in chiave moderna) del diritto romano. La seconda parte è invece dedicata all'esame della prassi giudiziaria e, più specificamente, delle Corti di Cassazione. In questa fase si persegue un duplice obiettivo: da un lato, verificare se, ed eventualmente in che misura, il diritto romano possa ancora svolgere un ruolo nella (moderna) giurisprudenza di legittimità; dall'altro, valutare la concreta possibilità, prospettata da una parte della scienza giuridica, di ricorrere in Cassazione per impugnare una sentenza asseritamente contraria ai principi generali del diritto sanciti dall'art. 3 co. 2 delle Preleggi. L'analisi prende dunque le mosse dal contenuto delle singole decisioni della Cassazione, per poi passare all'esegesi dei frammenti di volta in volta richiamati; infine, si concluderà con un'operazione di sintesi volta a valutare, per ciascun caso, la coerenza (giuridica) del ragionamento analogico.

The purpose of this qualitative research was to study the learning preferences and styles of management lawyers who work in Ontario's legal aid clinics. Data were gathered from two sources and analyzed using the constant comparison method. A preand postconference survey provided the principal data on clinic lawyers' learning preferences. Follow-up interviews were then conducted with 3 purposefully selected survey participants to explore their personal learning styles. Kolb's experiential learning theory provided the theoretical framework for discussing personal learning styles. The findings showed a general consistency among the lawyers to learn by listening to lectures and experts. This preference may suggest a lingering influence from law school training. The lawyers' more informal learning associated with daily practice, however, appeared to be guided by various learning styles. The learning style discussions provided some support for Kolb's model but also confirmed some shortcomings noted by other authors. Educators who design continuing education programs for lawyers may benefit from some insights gained from this exploratory research. This study adds to a limited but growing body of work on the learning preferences and styles of lawyers and suggests new questions for future research.

O objetivo deste trabalho foi estimar parâmetros genéticos (herdabilidades e correlações), efeitos não genéticos, tendência genética e resposta à seleção para as características de crescimento (pesos padronizados aos 120, 210 e 450 dias) e características reprodutivas (idade ao primeiro parto e perímetro escrotal aos 450 dias) de machos e fêmeas, da raça Nelore criados na Amazônia Legal. O arquivo de dados analisado consistia em 211.744 registros de animais da raça Nelore, participantes do Programa de Melhoramento Genético da Raça Nelore (PMGRN- Nelore Brasil), nascidos no período de 1995 e 2008, distribuídos em rebanhos localizados nos estados do AC, MA, MT, PA, RO e TO. A consistência dos dados, as análises descritivas, de variância e de escolha do modelo para cada uma das características foram realizadas utilizando-se o software Statistical Analysis System. As estimativas de média e desvio padrão foram de 122,919,0; 179,628,1; 262,445,5; 227,229,2; 37,14,7, respectivamente para as características de P120, P210, P450, PE450 e IPP. As herdabilidades para P120 foram de 0,24; 0,21 e 0,36, para h²d, h²m e h²t, respectivamente; para P210 foram de 0,29; 0,16 e 0,45, para h²d, h²m e h²t, respectivamente e para P450, PE450 e IPP, foram de 0,48; 0,49 e 0,22, respectivamente. As correlações genéticas entre os pesos variaram de 0,51 a 0,78, entre os pesos e PE450 variaram de 0,26 a 0,46, entre os pesos e a IPP foram baixas e negativas e entre PE450 e IPP foi nula. Em todas as características estudadas, os progressos genéticos foram superiores aos fenotípicos, com exceção à IPP. Os resultados de resposta à seleção variaram de 0,27 a 0,11 kg/ano; 0,49 a 0,20 kg/ano; 1,32 a 0,53 kg/ano; 0,08 a 0,03 cm/ano e 0,06 a 0,02 dias/ano para P120, P210, P450, PE450 e IPP, respectivamente. Portanto, todas as características estudadas podem ser utilizadas como critério de seleção, objetivando melhorar a produtividade.

Comparing the treatment of Islamic veils and Christian crucifixes by the European Court of Human Rights, this paper re-examines the charge of “double standards” on the part of this guardian of the European legal order, which is seen as disadvantaging Islam and favoring Christianity. While this is proved partially correct, the paper calls for a more differentiated treatment of the issue. For one, there is a modicum of consistency in the European Court’s decisions, because they are all meant to further “pluralism”. Only, Islam and Christianity fare differently in this respect, as “threat” to and “affirmation” of pluralism, respectively. This distinction hinges on Islam’s compatibility with the liberal-secular order, on which the jury is out. A possible way out of the “pluralism v. pluralism” dilemma, I argue, is signaled in the European Court’s recent decision in Lautsi v. Italy (2011), which pairs a preference for “culturalized” Christianity with robust minority pluralism.

From the Preface. Pursuant to Article 13(3) of Council Decision 2010/427/EU of 26 July 2010 establishing the organisation and functioning of the European External Action Service, the High Representative is held to provide a review of the organisation and functioning of the EEAS by mid-­‐2013. This review will cover, inter alia, the implementation of Article 6(6), (8) and (11), so as to ensure an adequate geographical and gender balance and a meaningful presence of nationals from all member states in the EEAS. If necessary, the review will be accompanied by appropriate proposals for the revision of the 2010 Council Decision (e.g., suggestions for additional specific measures to correct possible imbalances of staffing). In that case, the Council will, in accordance with Article 27(3) TEU, revise the Decision in light of the review by the beginning of 2014. This short and user-­‐friendly legal commentary on the 2010 Council Decision is the first of its kind and is intended to inform those involved in the review process and to serve as a reference document for practitioners and analysts dealing with the EEAS. This commentary is not an elaborate doctrinal piece, but rather a textual and contextual analysis of each article, that takes account of i) other relevant legal provisions (primary, secondary, international), ii) the process leading to the adoption of the 2010 Council Decision (i.e. travauxpréparatoires), iii) the preamble of the Council Decision, and iv) insofar as it is possible at this stage, early implementation. This study examined the effect of schemas on consistency and accuracy of memory across interviews, providing theoretical hypotheses explaining why inconsistencies may occur. The design manipulated schema-typicality of items (schema-typical and atypical), question format (free-recall, cued-recall and recognition) and retention interval (immediate/2 week and 2 week/4 week). Consistency, accuracy and experiential quality of memory were measured. ^ All independent variables affected accuracy and experiential quality of memory while question format was the only variable affecting consistency. These results challenge the commonly held notion in the legal arena that consistency is a proxy for accuracy. The study also demonstrates that other variables, such as item-typicality and retention interval have different effects on consistency and accuracy in memory. ^

This thesis argues that the legal framework in Ireland for specialist palliative care is inadequate and consequently a more appropriate legal framework must be identified. This research is guided by three central research questions. The first central research question examines the legitimacy of the distinction between specialist palliative care and euthanasia. The second central research question asks what legal framework currently exists in Ireland for specialist palliative care. The third central research question examines an alternative legal framework for specialist palliative. This thesis is composed of seven chapters. The first Chapter is an introduction to the thesis and defines the terminology and the central research questions. Chapter Two explores the development and practice of palliative care in Ireland. Chapter Three examines the distinction in criminal law between specialist palliative care practices and euthanasia. Chapter Four examines the human rights framework for specialist palliative care. Chapter Five critiques the regulatory framework in Ireland for specialist palliative care. Having gained a thorough understanding of palliative care and the related legal framework, this thesis then engages in comparative analysis of the Netherlands which is used as a source of ideas for reform in Ireland. Chapter Seven is the concluding chapter and, in it, the main findings of this thesis are summarised. The main findings being that: the distinction between specialist palliative care and euthanasia is not sufficiently supported by justifications such as a double effect or the acts and omissions distinction, there is no clear decision-making framework in Ireland for specialist palliative care, and the current legal framework lacks clarity and does not promote consistency between providers of specialist palliative care. This Chapter also proposes that detailed professional standards and guidelines are likely to be the most appropriate way to effect individual and institutional change in the provision of specialist palliative care.

Monte Carlo track structures (MCTS) simulations have been recognized as useful tools for radiobiological modeling. However, the authors noticed several issues regarding the consistency of reported data. Therefore, in this work, they analyze the impact of various user defined parameters on simulated direct DNA damage yields. In addition, they draw attention to discrepancies in published literature in DNA strand break (SB) yields and selected methodologies. The MCTS code Geant4-DNA was used to compare radial dose profiles in a nanometer-scale region of interest (ROI) for photon sources of varying sizes and energies. Then, electron tracks of 0.28 keV-220 keV were superimposed on a geometric DNA model composed of 2.7 × 10(6) nucleosomes, and SBs were simulated according to four definitions based on energy deposits or energy transfers in DNA strand targets compared to a threshold energy ETH. The SB frequencies and complexities in nucleosomes as a function of incident electron energies were obtained. SBs were classified into higher order clusters such as single and double strand breaks (SSBs and DSBs) based on inter-SB distances and on the number of affected strands. Comparisons of different nonuniform dose distributions lacking charged particle equilibrium may lead to erroneous conclusions regarding the effect of energy on relative biological effectiveness. The energy transfer-based SB definitions give similar SB yields as the one based on energy deposit when ETH ≈ 10.79 eV, but deviate significantly for higher ETH values. Between 30 and 40 nucleosomes/Gy show at least one SB in the ROI. The number of nucleosomes that present a complex damage pattern of more than 2 SBs and the degree of complexity of the damage in these nucleosomes diminish as the incident electron energy increases. DNA damage classification into SSB and DSB is highly dependent on the definitions of these higher order structures and their implementations. The authors' show that, for the four studied models, different yields are expected by up to 54% for SSBs and by up to 32% for DSBs, as a function of the incident electrons energy and of the models being compared. MCTS simulations allow to compare direct DNA damage types and complexities induced by ionizing radiation. However, simulation results depend to a large degree on user-defined parameters, definitions, and algorithms such as: DNA model, dose distribution, SB definition, and the DNA damage clustering algorithm. These interdependencies should be well controlled during the simulations and explicitly reported when comparing results to experiments or calculations.

Este artigo de revisão sistemática tem por objetivo citar os métodos de identificação humana por meio da radiologia, utilizados em odontologia legal. Para isso, realizou-se revisão de literatura com 19 trabalhos selecionados dentre 45 encontrados, após aplicação de critérios de inclusão. Há diversas técnicas radiológicas que podem ser utilizadas para auxiliar na identificação humana, tanto individual como geral, incluindo a determinação do gênero, do grupo étnico e, principalmente, da idade. A análise de radiografias e tomografias ante-mortem e post-mortem tornou-se uma ferramenta fundamental nos processos de identificação em odontologia legal, principalmente com o refinamento das técnicas adquiridas com o avanço da própria radio-logia e com a incorporação da informática. Conclui-se que a partir do conhecimento adequado dos métodos disponíveis, o profissional em odontologia legal pode optar pelo método que melhor preencha as características necessárias para o sucesso da identificação, tendo cuidado na aplicação correta da técnica e na interpretação precisa das informações obtidas.

Background: The Brazilian Amazon has suffered impacts from non-sustainable economic development, especially owing to the expansion of agricultural commodities into forest areas. The Tangara da Serra region, located in the southern of the Legal Amazon, is characterized by non-mechanized sugar cane production. In addition, it lies on the dispersion path of the pollution plume generated by biomass burning. The aim of this study was to assess the genotoxic potential of the atmosphere in the Tangara da Serra region, using Tradescantia pallida as in situ bioindicator. Methods: The study was conducted during the dry and rainy seasons, where the plants were exposed to two types of exposure, active and passive. Results: The results showed that in all the sampling seasons, irrespective of exposure type, there was an increase in micronucleus frequency, compared to control and that it was statistically significant in the dry season. A strong and significant relationship was also observed between the increase in micronucleus incidence and the rise in fine particulate matter, and hospital morbidity from respiratory diseases in children. Conclusions: Based on the results, we demonstrated that pollutants generated by biomass burning in the Brazilian Amazon can induce genetic damage in test plants that was more prominent during dry season, and correlated with the level of particulates and elevated respiratory morbidity.

Quantum field theory with an external background can be considered as a consistent model only if backreaction is relatively small with respect to the background. To find the corresponding consistency restrictions on an external electric field and its duration in QED and QCD, we analyze the mean-energy density of quantized fields for an arbitrary constant electric field E, acting during a large but finite time T. Using the corresponding asymptotics with respect to the dimensionless parameter eET(2), one can see that the leading contributions to the energy are due to the creation of particles by the electric field. Assuming that these contributions are small in comparison with the energy density of the electric background, we establish the above-mentioned restrictions, which determine, in fact, the time scales from above of depletion of an electric field due to the backreaction.
