The principal objective of this paper is to identify the relationship between the re­sults of the Canadian policies implemented to protect female workers against the impact of globalization on the garment industry and the institutional setting in which this labour market is immersed in Winnipeg. This research paper begins with a brief summary of the institutional theory appro­ach that sheds light on the analysis of the effects of institutions on the policy options to protect female workers of the Winnipeg garment industry. Next, this paper identi­fies the set of beliefs, formal procedures, routines, norms and conventions that cha­racterize the institutional environment of the female workers of Winnipeg’s garment industry. Subsequently, this paper descri­bes the impact of free trade policies on the garment industry of Winnipeg. Afterward, this paper presents an analysis of the ba­rriers that the institutional features of the garment sector in Winnipeg can set to the successful achievement of policy options addressed to protect the female workforce of this sector. Three policy options are considered: ethical purchasing; training/retraining programs and social engage­ment support for garment workers; and protection of migrated workers through promoting and facilitating bonds between Canada’s trade unions and trade unions of the labour sending countries. Finally, this paper concludes that the formation of isolated cultural groups inside of factories; the belief that there is gender and race discrimination on the part of the garment industry management against workers; the powerless social conditions of immi­grant women; the economic rationality of garment factories’ managers; and the lack of political will on the part of Canada and the labour sending countries to set effective bilateral agreements to protect migrate wor­kers, are the principal barriers that divide the actors involved in the garment industry in Winnipeg. This division among the prin­cipal actors of Winnipeg’s garment industry impedes the change toward more efficient institutions and, hence, the successful achievement of policy options addressed to protect women workers.

This article analyzes the characteristics of four different social enterprise schools of though (social economy, earned-income school in developed countries, earned-income in emerging countries, and social innovation) and the influence of the contextual elements (cultural, political, economic and social) on their configuration. This article draws on the qualitative discussions of social enterprise in different regions of the world. This paper is intended to contribute to the field of social enterprise by broadening the understanding of the influence of environment and institutions on the emergence of social enterprise.

We analyse the determinants of high growth expectations entrepreneurial entry (HGE) using individual data drawn on working age population, based on the Global Entrepreneurship Monitor (GEM) surveys for the 1998-2004 period. Individual level explanatory variables are combined with country-level factors. Our results suggest that availability of venture capital and intellectual proper rights protection are strong predictors of HGE. In addition, we also find that innovative start-ups are associated with highest growth expectations in countries with extensive supply of venture capital and strongest intellectual property rights. Once we introduce venture capital, we detect no significant effects of other elements of financial systems on high-powered entry.

Within the last few decades of operations and supply chain management, the field has seen the rise of so called best practices, methods that will help supply chains obtain their business goals and gain a competitive edge. These methods were thought to be universal. This however is not always the case, as the surrounding business environment could have a significant impact on what will be effective in gaining competitive edge. Contingency theory states that the success of a supply chain is determined by both internal capabilities, as well as external context aligning. This creates a strategic fit, which is a major determinant of success. In order for supply chains to reach this strategic fit, they must adapt. As China has seen rapid growth and over the last few decades become one of the major economies of the world, Western companies have tried to establish themselves there, only to find that the Chinese market is extremely difficult to operate in. The aim of this thesis was to investigate from contingency theory perspective, what are the institutional factors that affect supply chain management of Finnish companies operating in China, and how do Finnish companies adapt their supply chains to better fit the Chinese institutional environment. A theoretical model was created for this thesis, in which supply chains possess resources, which can be combined in a meaningful manner to create capabilities. Both resources and capabilities are affected by the surrounding institutional environment, which forces supply chains to adapt in order to find a better strategic fit. A total of six Finnish managers from three large and three small companies operating in China were interviewed. The results indicated that the Chinese business environment is significantly different, than that of Finland or Western countries in general. Three institutional factors were identified: Confucian though, fast-paced business environment, and managing labor force. These three institutional factors made the relationship and delivery capabilities particularly important, as well as human resources, reputation, physical resources and technological resources. In conclusion, it was discovered that the Chinese institutional environment is heavily affected by Confucian thought, as well as the rapid market growth. These are the two most important institutional factors that shape the Chinese market. If supply chains wish to be successful in China, adaptation regarding these two institutional factors should yield good results.

O objetivo desta tese é investigar a atuação do órgão de controle judicial no Poder Judiciário, focando na dimensão “Desempenho Administrativo Judicial”. Esta tese visa complementar o modelo de Taylor (2008) adicionando o CNJ como um elemento da melhoria do desempenho dos tribunais, por meio da implantação de ferramentas gerenciais e ocasionando impactos políticos e institucionais. O estudo se apoia no contexto político e organizacional do Judiciário para apresentar um complemento ao entendimento vigente sobre os mecanismos de mensuração de desempenho. Os impactos do CNJ foram analisados a partir de sete aspectos do processo de Reforma do Judiciário: 1. Padronização das estruturas; 2. Sistemas de gerenciamento centralizados; 3. Padronização de procedimentos internos; 4. Centralização orçamentária; 5. Financiamento de unidades judiciais; 6. Procedimentos disciplinar contra irregularidades e más condutas de magistrados; 7. Critérios meritocráticos e promoção de magistrados. Os dados foram coletados por meio de entrevistas estruturadas com ex-conselheiros e conselheiros atuais do CNJ e considerou os dez anos de existência do CNJ (2004-2013), fornecendo uma perspectiva longitudinal. A análise temática ou categorial foi escolhida como a principal da técnica de análise de conteúdo. Os dados foram segmentados por questões, por categorias prévias e por categorias estabelecidas posteriormente. Foi evidenciado que o CNJ apresenta um efeito direto de atuação no “Desempenho Administrativo Judicial”: i) usando ferramentas de gestão que permitem os tribunais aprimorar a organização interna e elevar o nível de maturidade de governança; ii) moralizando e fiscalizando os Tribunais por meio de inspeções frequentes realizadas pela Corregedoria Nacional de Justiça que objetiva a resolução das irregularidades e o afastamento dos magistrados com más condutas no exercício do cargo. As evidências identificaram também impactos indiretos: i) o CNJ como um coordenador de ações do Judiciário, articulando melhor as relações com os representantes do Executivo e do Legislativo na obtenção de mais recursos orçamentários e financeiros para os tribunais; ii) o CNJ aumenta a autonomia do Judiciário reconhecendo os esforços de gestão dos tribunais e compartilhando as melhores práticas com os outros tribunais, com impactos na melhoria de infraestrutura e no desempenho. O aumento de controle promovido pelo CNJ reforçou a governança e a eficiência dos tribunais, mas com perca de autonomia num primeiro momento. Por outro lado, num segundo momento, possibilitou uma mudança de perfil nas indicações de seus conselheiros numa tentativa de enfraquecer o controle e aumentar autonomia dos tribunais.

A pesquisa tem como finalidade a análise do Poder Judiciário em um contexto de ampliação de sua dimensão política, o que traz como conseqüência um tipo inédito e peculiar de espaço público de participação democrática. Essa alteração no quadro político institucional possibilitou uma maior inserção do Poder Judiciário em questões essencialmente políticas, o que se convencionou denominar de judicialização da política - expressa na ampliação da importância e da participação do Poder Judiciário na vida social, política e econômica. Tal fenômeno, característico de democracias consolidadas, decorreu de condicionantes e peculiaridades vivenciadas na ordem política, econômica e social e gerou efeitos visíveis na democracia brasileira. As conseqüências desse processo de judicialização da política sobre o espaço democrático variam de acordo com o enfoque analítico estabelecido como referencial teórico: o substancialista, defensor de um Judiciário mais participativo; e o procedimentalista, eixo que enfatiza os processos majoritários de formação da vontade política em detrimento das vias judiciais. A presente pesquisa situa-se no marco conceitual procedimentalista que defende a primazia do procedimento que torne possível o diálogo democrático, ressaltando, assim, a dificuldade contra-majoritária da judicialização da política, os perigos da crescente tendência de valorização do ativismo político exercido pelo Poder Judiciário e a conseqüente necessidade de se estabelecer limites institucionais à atuação dos tribunais em demandas políticas.

The thesis is a country-level study on the institutional and human capital determinants of growth-aspiration entrepreneurial activity. By using country-level panel-data analysis, the study is to our knowledge the first to test to what extent country-level human capital accumulation is associated with the prevalence of growth-aspiration entrepreneurship. Overall findings of the study suggest that there are different effects of the institutional determinants on the prevalence of growth-aspiration entrepreneurship in developing countries and developed countries. The study also found that country-level human capital moderates the effects of the institutional environment.

The social economy as a regional development actor is gaining greater attention given its purported ability to address social and environmental problems. This growth in interest is occurring within a global environment that is calling for a more holistic understanding of development compared to traditionally economic-centric conceptions. While regional development policies and practices have long considered for-profit businesses as agents for regional growth, there is a relatively limited understanding of the role of the social economy as a development actor. The institutional environment is a large determinant of all kinds of entrepreneurial activity, and therefore understanding the relationships between the social economy and broader regional development processes is warranted. This paper moves beyond suggestions of an economic-centric focus of regional development by utilising institutional logics as a theoretical framework for understanding the role of social enterprise in regional development. A multiple case study of ten social enterprises in two regional locations in Australia suggests that social enterprise can represent competing logics to economic-centric institutional values and systems. The paper argues that dominant institutional logics can constrain or promote the inter-play between the social and the economic aspects of development, in the context of social enterprise.

A presente tese pretende estudar dois modelos de função judicial o perfeccionismo (perfectionism) e o minimalismo (minimalism) judicial delineados por Cass Sunstein, destacando os seus fundamentos filosóficos, suas principais teses hermenêuticas, suas limitações decisórias e suas contribuições para o desenho institucional das relações entre os Poderes de Estado. O presente trabalho desenvolverá, neste sentido, duas perspectivas fundamentais, que são complementares, para o estudo das relações entre o constitucionalismo e a democracia nos sistemas político-jurídicos contemporâneos: em primeiro lugar, uma perspectiva hermenêutica, cuja preocupação reside, sobretudo, na sistematização das principais teses de cada um dos dois modelos no tocante à interpretação do texto constitucional. Em segundo lugar, será realizada uma abordagem institucionalista sobre as possíveis alternativas ao protagonismo do Supremo Tribunal Federal em termos de sua atuação como última instância na definição do significado dos dispositivos constitucionais. Para tanto, serão analisados, com apoio em um estudo comparativo, propostas de diálogo institucional que podem ser fomentadas a partir de uma visão minimalista de moderação judicial que contrasta, por sua vez, com a defesa hegemônica de uma atuação institucional ativista das cortes constitucionais na atualidade. Por último, com apoio nos modelos de função judicial delineados, será elaborada uma análise crítica da atividade jurisdicional dos ministros do Supremo Tribunal Federal com fundamento no exame da argumentação empreendida em seus votos em casos constitucionais difíceis de grande repercussão política, moral e social.
