A presente dissertação analisa a possibilidade da prática da eutanásia ativa e voluntária em pacientes com doenças incuráveis à luz da bioética e do direito. O trabalho é de natureza teórica e foi realizado através de pesquisa bibliográfica, que levantou publicações, nacionais e internacionais, inclusive na imprensa, sobre os temas tratados na dissertação, a saber: eutanásia, morte, vida, dignidade, autonomia, princípios bioéticos, liberdade. O levantamento bibliográfico compreendeu, preferencialmente, obras sobre filosofia, ética, bioética, medicina e direito, que permitiram a análise das questões teóricas envolvidas diretamente no estudo. Aborda-se o conceito de morte e suas transformações ao longo dos anos e as distinções necessárias entre os conceitos do fim da vida, que apesar de muito próximos tem suas especificidades. Apresenta-se os princípios bioéticos da não maleficência e da beneficência, com a finalidade de discutir os limites da intervenção médica sobre o paciente, bem como o princípio da autonomia na visão da bioética e do direito, com o intuito de demonstrar que o doente incurável é um ser autônomo, com vontades e desejos que devem ser respeitados. Examinam-se os direitos à vida e a liberdade para fins de ponderação em face do princípio da dignidade da pessoa humana. Diferenciam-se os princípios da sacralidade da vida e da qualidade da vida, na busca de uma integração entre eles e faz-se uma análise do Código de Ética Médica e da Resolução CFM n 1.805 de 2006, que autoriza a ortotanásia, para confrontar os limites da prática médica e da autonomia do paciente. Pontua-se o estado atual da criminalização da eutanásia no ordenamento jurídico brasileiro apontando-se o quão perversa pode se tornar essa criminalização para aquele que sofre e, que através da compaixão laica e da solidariedade deve-se buscar meios hábeis para se permitir a eutanásia, sem deixar de proteger os vulnerados de eventuais abusos. Utilizam-se os casos de Ramón Sampedro e Vincent Humbert, pessoas que por causa de um acidente ficaram tetraplégicas e solicitaram na justiça uma morte digna, para exemplificar os diversos conceitos utilizados nesse trabalho. Por fim, apresentam-se os requisitos pessoais e formais mínimos para que a declaração de vontade de um paciente incurável, que pede uma morte digna, seja respeitada, quando essa vontade é expressa de forma inequívoca por ele, tendo como exemplo, a legislação da Bélgica e da Holanda, onde a eutanásia é permitida observando-se determinados requisitos.

Execution of programmed cell death (PCD) in nonmetazoan organisms is morphologically different from apoptotic PCD in animals and lacks a number of key molecular components of apoptotic machinery, including caspases. Yet protozoan, fungal, and plant cells exhibit caspase-like proteolytic activities, which increase in a PCD-dependent manner. This poses a question whether nonmetazoan organisms contain structurally dissimilar proteases that functionally substitute for caspases. Putative ancestors of caspases, metacaspases, are candidates for this role; however, their distinct substrate specificity raises doubts. The identification of a common biological target of caspases and metacaspases and previously unknown functions unrelated to cell death of metacaspases provide new food for thought.

La mortalité aux jeunes âges devenant de plus en plus faible, l’augmentation de l’espérance de vie est de plus en plus dépendante des progrès en mortalité aux âges avancés. L’espérance de vie à 65 ans et à 85 ans n’a cependant pas connu un rythme de progression continu depuis les trois dernières décennies. Ces changements dans l’évolution de l’espérance de vie proviennent de changements dans les tendances de certaines causes de décès et de leurs interactions. Ce mémoire analyse la contribution des causes de décès aux changements qu’a connus l’espérance de vie, mais aussi l’évolution spécifique des taux de mortalité liés aux principales causes de décès au Canada entre 1979 et 2007. Finalement, une analyse de l’implication de ces changements dans un contexte de transition épidémiologique sera réalisée, par un questionnement sur le fait que l’on assiste ou non au passage de certaines pathologies dominantes à d’autres. La réponse à ce questionnement se trouve dans l’étude de l’évolution par âge et dans le temps des causes de décès. Les résultats montrent que les progrès en espérance de vie à 65 ans et à 85 ans sont encore majoritairement dus à la diminution de la mortalité par maladies cardiovasculaires. Toutefois, ces dernières causes de décès ne sont pas les seules à contribuer aux progrès en espérance de vie, puisque les taux de mortalité dus aux dix principales causes de décès au Canada ont connu une diminution, bien qu’elles n’aient pas toutes évolué de la même manière depuis 1979. On ne semble ainsi pas passer d’un type de pathologies dominantes à un autre, mais à une diminution générale de la mortalité par maladies chroniques et à une diversification plus importante des causes de décès à des âges de plus en plus avancés, notamment par la diminution des «grandes» causes de décès.

This study - Biologist s formative speech about death. Nuances and metaphors from knowing that the subject of do not want to know - shows a marginal cognitive construction in scientific education from biologist - death. It considered as obvious that death is a theme that covers both the scientific education from biologist and the division of the subject, and concerns the splitting of the double life-death and the principles of inclusion and exclusion of the subject. Part of sensitive question: What is the epistemological weave who supports biologist's speech about death? It is constituted an object of study of the biologist s speech on death. It is advocated the thesis that: Death is an epistemological obstacle announcing for something always aims to escape from the perspective of knowledge, especially of scientific knowledge because, since it is understood as cognitive learning about the disruption of biological phenomenon life which is involved on weave of imaginary and symbolic constructions about the finiteness of life; it has constituted a metaphorical knowing - encouraged by the noisy silence - which does not allow to know in full, mobilizing hence subject in searching for transitional truths that reduce the ontological being-mortal anguish centered in subjective dimension involved in the act of knowing. From this movement of search that the object mental life after death wins a symbolic value that requires a real-looking multi-referential for the study of biology - life - and its implications: the finiteness of life, especially by moving the omnipotence of scientific objectivity expressed by signs and symbols that seek say the completeness of scientific knowledge-, signaling thus the existence of the dynamics of incompleteness implicit in subjectivity that supports knowledge relating to the double, life and death, and to the temporality of the existence of Homo sapiens sapiens, with the axis guiding the desire of the subject, do not want to know about death, implicit in the mechanisms objective-subjective founded by non-said of death is the epistemology of the existence of objective-subjective subject, whose core is the negation of death. 153 Nachkommen einer Kreuzung aus der pilzresistenten Rebsorte ‘Regent‘ und ‘Lemberger‘ als klassischer pilzsensitiver Sorte zeigen quantitative Merkmalsvariation bezüglich der Resistenz gegen Plasmopara viticola und Uncinula necator sowie für weitere Eigenschaften, die z.B. das Eintreten der Beerenreife betreffen. Auf dem Weg über die genetische Kartierung mit molekularen Markern und der Lokalisierung von QTL-Effekten konnten Hinweise auf weinbaulich relevante Genomregionen gewonnen werden; dies liefert z.B. die Basis für markergestützte Selektion bei Zuchtvorhaben mit dem Resistenzträger ‘Regent’ (vgl. auch FISCHER et al., 2004). Ein Major-QTL für die Resistenz gegen den Echten Mehltau Uncinula necator sowie zwei Major QTL für die Resistenz gegen den Erreger des Falschen Mehltau, Plasmopara viticola, traten mit hoher Signifikanz auf drei verschiedenen Kopplungsgruppen von ‘Regent‘ auf. Auch Regionen mit Relevanz für das Eintreten der Beerenreife wurden beschrieben. Über die Isolierung, Sequenzierung und anschließende Analyse einzelner Markerfragmente mit Methoden der Bioinformatik ist es gelungen, ein putatives T10P12.4-Ortholog der Weinrebe (ein thioredoxinähnliches Protein) in enger Kopplung zu einem Major-QTL-Maximum für Plasmopara viticola-Resistenz zu identifizieren, das als Kandidat für die Beteiligung an der Pathogenantwort in Frage kommt. Es konnte exemplarisch gezeigt werden, dass die eingesetzten Methoden der Kartierung und QTL-Analyse unter Verwendung PCR-basierter Markertypen wie SSR und AFLP und einer beschleunigten Analyse über computergestützte Kapillargelelektrophorese in vertretbarem Zeitrahmen bis zur Isolation potentieller Schlüsselgene führen können. Die grundsätzliche Eignung der QTL-Analyse als effizientes Werkzeug gezielter Züchtungsplanung für den Weinbau bestätigte sich. Ihre Anwendung im Rahmen der vorliegenden Dissertation hat die Basis für die Nutzung von QTL-Information bei dem Vergleich etablierter und der Entwicklung neuer Sorten gelegt und zum Verständnis von Prozessen beigetragen, die den betrachteten Eigenschaften wie der Pilzresistenz möglicherweise zu Grunde liegen. Ein großer Teil der gewonnenen Daten bringt auch die Untersuchungen anderer Kultivare voran und ist intervarietal übertragbar. Darüber hinaus haben sich Chancen für vergleichende Studien zwischen der Weinrebe einerseits und der Modellpflanze Arabidopsis thaliana sowie weiteren Kulturpflanzen andererseits abgezeichnet. Die Hinweise auf die zentrale Rolle und universelle Natur des Redox-Signalling haben interessante Perspektiven zum Verständnis organismenübergreifender physiologischer Zusammenhänge eröffnet. Dies betrifft z.B. auch die Reaktion auf Verwundung oder die Pathogenantwort.

This paper seeks to identify what antecedents of power make it more or less likely for people to survive in a life-threatening situation.In particular, we look at the Titanic disaster as the life or death situation. Maritime disasters can be interpreted as quasi-natural experiments because every person is affected by the shock. True human nature becomes apparent in such a dangerous situation. Five antecedents of power are distinguished: physical strength, economic resources, nationality, social and moral factors. This empirical analysis supports the notion that power is a key determinant in extreme situations of life or death.

This paper explores what determines the survival of people in a life–and-death situation. The sinking of the Titanic allows us to inquire whether pro-social behavior matters in such extreme situations. This event can be considered a quasi-natural experiment. The empirical results suggest that social norms such as ‘women and children first’ are persevered during such an event. Women of reproductive age and crew members had a higher probability of survival. Passenger class, fitness, group size, and cultural background also mattered.

The paper discusses the view of Franklin Miller and Robert Truog that withdrawing life-sustaining treatment causes death and so is a form of killing. I reject that view. I argue that even if we think there is no morally relevant difference between allowing a patient to die and killing her (itself a controversial view), it does not follow that allowing to die is a form of killing. I then argue that withdrawing life-sustaining treatment is properly classified as allowing the patient to die rather than as killing her. Once this is accepted, the law cannot be criticised for inconsistency by holding, as it does, that it is lawful to withdraw life-sustaining treatment but unlawful to give patients a lethal injection.

This dissertation analyzes the interrelationship between death, the conditions of (wo)man s social being, and the notion of value as it emerges in the fiction of the American novelist Thomas Pynchon (1937 ). Pynchon s present work includes six novels V. (1963), The Crying of Lot 49 (1966), Gravity s Rainbow (1973), Vineland (1990), Mason & Dixon (1997), Against the Day (2006) and several short stories. Death constitues a central thematic in Pynchon s work, and it emerges through recurrent questions of mortality, suicide, mass destruction, sacrifice, afterlife, entropy, the relationship between the animate and the inanimate, and the limits of representation. In Pynchon, death is never a mere biological given (or event); it is always determined within a certain historical, cultural, and ideological context. Throughout his work, Pynchon questions the strict ontological separation of life and death by showing the relationship between this separation and social power. Conceptual divisions also reflect the relationship between society and its others, and death becomes that through which lines of social demarcation are articulated. Determined as a conceptual and social "other side", death in Pynchon forms a challenge to modern culture, and makes an unexpected return: the dead return to haunt the living, the inanimate and the animate fuse, and technoscientific attempts at overcoming and controlling death result in its re-emergence in mass destruction and ecological damage. The questioning of the ontological line also affects the structuration of Pynchon's prose, where the recurrent narrated and narrative desire to reach the limits of representation is openly associated with death. Textualized, death appears in Pynchon's writing as a sudden rupture within the textual functioning, when the "other side", that is, the bare materiality of the signifier is foregrounded. In this study, Pynchon s cultural criticism and his poetics come together, and I analyze the subversive role of death in his fiction through Jean Baudrillard s genealogy of the modern notion of death from L échange symbolique et la mort (1976). Baudrillard sees an intrinsic bond between the social repression of death in modernity and the emergence of modern political economy, and in his analysis economy and language appear as parallel systems for generating value (exchange value/ sign-value). For Baudrillard, the modern notion of death as negativity in relation to the positivity of life, and the fact that death cannot be given a proper meaning, betray an antagonistic relation between death and the notion of value. As a mode of negativity (that is, non-value), death becomes a moment of rupture in relation to value-based thinking in short, rationalism. Through this rupture emerges a form of thinking Baudrillard labels the symbolic, characterized by ambivalence and the subversion of conceptual opposites.
