Les interrogatives partielles peuvent être marquées par un mot en QU en position initiale de la phrase. J Bus Res 2009;62(7):698–705.] claim support for hypothesized relationships between constructs that, due to insufficient discriminant validity regarding certain constructs, may be inaccurate. This research comment discusses what discriminant validity represents, procedures for establishing discriminant validity, and presents an example of inaccurate discriminant validity assessment based upon the work of Bove et al. [Bove, LL, Pervan, SJ, Beatty, SE, Shiu, E. Service worker role in encouraging customer organizational citizenship behaviors. J Bus Res 2009;62(7):698–705.]. Solutions to discriminant validity problems and a five-step procedure for assessing discriminant validity then conclude the paper. This comment hopes to motivate a review of discriminant validity issues and offers assistance to future researchers conducting latent variable analysis.

Research with in-built replications:comment and further suggestions for replication research

This brief commentary on the paper Designing Research with In-built Differentiated Replication expands on concerns about a lack of replication research by focusing on three key questions of continuous importance: Why should researchers conduct more replication research? Why do so few researchers conduct replication studies? What can researchers do to add more studies? This paper identifies barriers preventing replication related to the scientific system, the replication researcher, and the initial research. Suggestions include publishing all papers electronically along with reviews; authors taking steps to encourage replications of their work; and editors inviting replications of important papers. The scientific community should establish a replication index as a measure of output quality. © 2012 Elsevier Inc.

Case Comment : Challenging the validity of leasehold guarantees:undue influence, non-est factum and formality issues

Case: Beardsley Theobalds Retirement Benefit Scheme Trustees v Yardley [2011] EWHC 1380 (QB) (QBD). The recent case of Beardsley Theobalds Retirement Benefit Scheme Trustees v Yardley, nicely illustrates, inter alia, the impact of the contractual defences of undue influence and the plea of non est factum in the context of avoiding liability under leasehold guarantees, within the setting of the landlord and tenant relationship. Additionally, the case also gives us an insight into the possible application of other technical defences relating to the law of formalities for leases. Judgment in this case was handed down on September 30, 2011.

Case Comment : Jones v Kernott:which road to Rome?

Jones v Kernott [2011] UKSC 53 (SC) Stack v Dowden [2007] UKHL 17; [2007] 2 A.C. 432 (HL). Casenote explores the implications of the ruling in Jones v Kernott by the Supreme Court and assesses its implications for English Property Law. Building on the commonwealth experience the casenote calls for the intorduction of a statutory scheme so as to allow courts to reallocate property rights to unmarried cohabitants in the event of relationship breakdown.

We feel that the main claim made in the abstract of the preceding Comment is wrong. Using results obtained in our paper, we prove that rogue waves with amplitudes much larger than the average level can be observed during a short period of time in purely linear propagation regimes in optical fiber systems. © 2011 American Physical Society.
