Coastal sand dunes represent a richness first of all in terms of defense from the sea storms waves and the saltwater ingression; moreover these morphological elements constitute an unique ecosystem of transition between the sea and the land environment. The research about dune system is a strong part of the coastal sciences, since the last century. Nowadays this branch have assumed even more importance for two reasons: on one side the born of brand new technologies, especially related to the Remote Sensing, have increased the researcher possibilities; on the other side the intense urbanization of these days have strongly limited the dune possibilities of development and fragmented what was remaining from the last century. This is particularly true in the Ravenna area, where the industrialization united to the touristic economy and an intense subsidence, have left only few dune ridges residual still active. In this work three different foredune ridges, along the Ravenna coast, have been studied with Laser Scanner technology. This research didn’t limit to analyze volume or spatial difference, but try also to find new ways and new features to monitor this environment. Moreover the author planned a series of test to validate data from Terrestrial Laser Scanner (TLS), with the additional aim of finalize a methodology to test 3D survey accuracy. Data acquired by TLS were then applied on one hand to test some brand new applications, such as Digital Shore Line Analysis System (DSAS) and Computational Fluid Dynamics (CFD), to prove their efficacy in this field; on the other hand the author used TLS data to find any correlation with meteorological indexes (Forcing Factors), linked to sea and wind (Fryberger's method) applying statistical tools, such as the Principal Component Analysis (PCA).

The thesis in Urban and Regional Geography titled “URBAN AND TERRITORIAL COMPETITIVENESS IN SUSTAINABILITY. EMILIA-ROMAGNA, REGION OF EUROPE” is divided into two sections. Section one is additionally composed by two chapters (chap. 1 and 2) and deals with theoretical and gnosiological issues. Section two, of two more chapters (chap. 3 and 4), provides practical contributions: these issues give explanatory patterns to interpret the performances of emiliano-romagnoli urban systems. Chapter one is an introductory chapter. It analyzes globalization that involves a larger and larger number of cities, rich or poor. It also considers the so called “digital divide” either as one of the major phenomena of this unhomogeneous development or as an interesting gnosiological and practical challenge of geography. Globalization is now involving all the cities, large or small, but the small ones have higher risks of exclusion: it depends on their more fragile socio-economic, cultural, and environmental urban structure. That’s why European Union (chapter two) promotes policies and endows politics to sustain cities, because urban systems are the basis for the territorial development. So, European, national and local Institutions are firmly interested in promoting urban and local interventions and projects. Section two deals with economic-geography methods, which consists on collecting indicators and the benchmarking methodology. It also specifically analyzes the urban systems of Emilia-Romagna. Consequences of the globalization on the cities are interpreted with a study of their local resources, intended as potentials for their development. The STeMA approach, proposed by Professor Maria Prezioso (University of Roma, “Tor Vergata”) and used by the ESPON (European Spatial Program Observation Network) project, describes the main “determinants” of the territorial and urban development. These are easily comparable to one another (similar or better performing). This approach achieves two goals. On one hand, it is possible to analyze every urban system in its all main characteristics and to preserve its historical and cultural factors. On another hand, each city is “knowable” and “understandable” by all scholars, as it is objectively comparable. So, urban planners can propose specific “multi-level” and “multi-varied” programs of governance. These will face globalization by exalting local empowerment.

La tematica dell’abuso del diritto in campo fiscale ha conosciuto, negli ultimi anni, una diffusione particolarmente rilevante. Questo lavoro, dopo una necessaria premessa introduttiva alla problematica, affronta l’abuso del diritto in campo tributario tramite l’analisi degli strumenti classici dell’ermenutica, constatando come si arrivi ad un intreccio tra lo strumento della clausola generale anti-abuso e il principio di divieto d’abuso del diritto sviluppatosi a livello europeo, concretizzazione del più ampio principio dell’effettività del diritto dell’Unione Europea. L’analisi prende a modello, da un lato, la clausola generale anti-abuso tedesca, adottata già nel primo dopoguerra, e le sue diverse modifiche legislative occorse negli anni, e dall’altro, il principio europeo di divieto d’abuso del diritto. L’esame congiunto rivela un cortocircuito interpretativo, posto che il principio europeo espone gli stessi concetti della clausola nazionale tedesca pre riforma, la quale, in seguito, alle sentenze Halifax e Cadbury Schweppes, ha subito un’importante modifica, cosicchè la clausola generale abbisogna ora del princìpio europeo per essere interpretata. La tesi evidenzia, inoltre, come tale circuito sia aggravato anche da tensioni interne alle stesse Istituzioni europee, posto che, nonostante l’esistenza di un principio di elaborazione giurisprudenziale, gli Stati Membri sono stati invitati ad introdurre una clausola generale anti-abuso, la cui formulazione rimanda al principio di divieto d’abuso del diritto elaborato dalla Corte di Giustizia.
