The thesis deals with the heterogenous category of the “unaccompanied minors”, concentrating the scientific work on those who migrate from Romania to the Italian city of Bologna. Between different migratory routes that include Romanian minors, I chose to explore the ones linked with the underground and illegal contexts. In order to analyse the reasons and the morphology of their migratory career, I used the multisituated field research which allowed me to consider the social policies in both the Romanian and the Italian environment. The main debate on the situation of the “unaccompanied children” refers to the extent to which these minors leave their country of origin “accompanied” by different adult figures and it also involves the role played by these adults. The first chapter is dedicated to a brief theoretical and methodological introduction to the main arguments of the thesis such as Romanian migration to Italy, trafficking in human beings, transnationality of migrant’s migration and decentered cooperation as a means of contrasting illegal migration and trafficking. Each field of research is characterized by a specific methodological approach, but they are all linked by the anthropological perspective I adopted throughout the entire work. The Romanian context, analized from a diachronic and a synchronic perspective represents the object of the second chapter. Some aspects of the Regime policies and other characteristics of the Romanian poscomunist period of “transition” are useful frameworks that become a background of the migration flows outside the country. The third chapter focuses on the Romanian patterns of migration. The reconstruction of some past attitudes that Romanians adopted towards migration are relevant in order to reveal the continuity with the present migratory practices. A consistent part is dedicated to a concrete example based on a field research in Bologna on a group of Romanian roma migrating from the south of Romania. The contact with these persons opened a debate on the limits between legal and illegal migration practices among the Romanians. The conclusion is that minors’ migration to Italy follows the adult patterns and flows. The nucleus of the field researches is included in the fourth and the fifth chapter. Before presenting the settings and the itineraries of the field researches, some deconstructive reflections are made on the representations that common sense and social sciences create on concepts as “child”, “minor” and “childhood”. A first perspective on the Romanian migrant minors emerges from a research concentrated on a group of roma teenagers engaged in Bologna in activities like windscreen washing, pocket-picking, begging and street prostitution. The aim of the research was to gain access to their daily life, to observe their relationship with the adults who “accompany” them and the strategies they activate in order to take some material profit out of their migratory experience. A parallel field research focuses on the Romanian minors who are part of the roma group coming from the south of Romania. Most of them are reunited with their family in Bologna, but according to the Italian law, they are all living as illegal migrants. Others are only temporary sheltered by these families and they meanwhile dedicate to illegal survviving practices. An interesting point of my participant observation was to reveal the motivations that these minors give when asked about the refusal to start a legal career inside the local Centres dedicated to the “non accompanied minors”. Their autoreflexivity brings some light on the controversy regarding the adequacy of the local and national care system and the migratory projects the minors have. In this respect, a small part of the research is dedicated to the phenomena of minors’ street prostitution in Bologna, as a useful contribution to the fragmented vision researchers have on the “unaccompanied” or “separated” children. The last chapter focuses on a decentered cooperation project that emerged as an alternative response the local administration from Bologna had chosen for facing the presence of numerous migrants coming from the south of Romania. The group of Romanian roma who was also the object of my field research became the starting point for the cooperation proposals between the city of Bologna and the city of Craiova. Although there are three projects involving the two administrations, throughout a period of stage in the Romanian city of Craiova I chose to analyse, only the one dedicated to the “urgent measures” requested in order to contrast the illegal migration and the trafficking in minors. This final part of the thesis highlightens the possible contribution that such a project might bring to the study of a complex and in some parts contradictory phenomena as that of the “unaccompanied” migrant minors.

Crowding is defined as the negative effect obtained by adding visual distractors around a central target which has to be identified. Some studies have suggested the presence of a marked crowding effect in developmental dyslexia (e.g. Atkinson, 1991; Spinelli et al., 2002). Inspired by Spinelli’s (2002) experimental design, we explored the hypothesis that the crowding effect may affect dyslexics’ response times (RTs) and accuracy in identification tasks dealing with words, pseudowords, illegal non-words and symbolstrings. Moreover, our study aimed to clarify the relationship between the crowding phenomenon and the word-reading process, in an inter-language comparison perspective. For this purpose we studied twenty-two French dyslexics and twenty-two Italian dyslexics (total forty-four dyslexics), compared to forty-four subjects matched for reading level (22 French and 22 Italians) and forty-four chronological age-matched subjects (22 French and 22 Italians). Children were all tested on reading and cognitive abilities. Results showed no differences between French and Italian participants suggesting that performances were homogenous. Dyslexic children were all significantly impaired in words and pseudowords reading compared to their normal reading controls. Regarding the identification task with which we assessed crowding effect, both accuracy and RTs showed a lexicality effect which meant that the recognition of words was more accurate and faster in words than pseudowords, non-words and symbolstrings. Moreover, compared to normal readers, dyslexics’ RTs and accuracy were impaired only for verbal materials but not for non-verbal material; these results are in line with the phonological hypothesis (Griffiths & Snowling, 2002; Snowling, 2000; 2006) . RTs revealed a general crowding effect (RTs in the crowding condition were slower than those recorded in the isolated condition) affecting all the subjects’ performances. This effect, however, emerged to be not specific for dyslexics. Data didn’t reveal a significant effect of language, allowing the generalization of the obtained results. We also analyzed the performance of two subgroups of dyslexics, categorized according to their reading abilities. The two subgroups produced different results regarding the crowding effect and type of material, suggesting that it is meaningful to take into account also the heterogeneity of the dyslexia disorder. Finally, we also analyzed the relationship of the identification task with both reading and cognitive abilities. In conclusion, this study points out the importance of comparing visual tasks performances of dyslexic participants with those of their reading level-matched controls. This approach may improve our comprehension of the potential causal link between crowding and reading (Goswami, 2003).

The doctorate’s theme of research - Abstract My doctorate’s theme of research is about the Investigation in the Italian criminal proceedings. The Italian Code of criminal procedure of 1988 is the fruit of a new ideology that marks a departure from Italy’s prior inquisitorial tradition. According to criminal procedure Code of 1988, an accusatorial system separates the investigation and trial stages and the judge’s decision is based only on evidence collected in oral form in his presence in a public trial containing adversarial dynamics. The Italian Code of 1988 created a separation between criminal investigations and trial. Investigations are conducted by Public Prosecutor: he conducts the investigation phase in order to deem whether to file a formal charge against the defendant or to dismiss the case and the investigative evidence collected should serve only for this purpose. According to so called “inutilizzabilità fisiologica”’s rule, the evidence collected during investigations by prosecutor is not usable during trial by the judge: the results of the investigative efforts displayed by the parties should be kept outside of court. If the proceedings go on to trial, the case shall be deemed with only evidence collected in front of the judge. To create the separation of the trial phase from the investigation stage, there is the double-dossier system. During the investigations, evidence are collected in an investigation dossier. The trial judge will never see the investigation dossier and the trial judge’s decision is based on a new dossier, the trial dossier, with the evidence collected during the trial. The issue of my research is about the investigation, the so called “inutilizzabilità fisiologica”’s rule and also the exclusionary rules that concern the investigative phase and the decisions pronounced during the investigations (for example, the decisions concerning pre-trial confinement). 2 In fact, the exclusionary rule system (so called “inutilizzabilità patologica”) provides that evidence cannot be used in Italian criminal proceedings if it was the result of illegal inquiry.

Satellite remote sensing has proved to be an effective support in timely detection and monitoring of marine oil pollution, mainly due to illegal ship discharges. In this context, we have developed a new methodology and technique for optical oil spill detection, which make use of MODIS L2 and MERIS L1B satellite top of atmosphere (TOA) reflectance imagery, for the first time in a highly automated way. The main idea was combining wide swaths and short revisit times of optical sensors with SAR observations, generally used in oil spill monitoring. This arises from the necessity to overcome the SAR reduced coverage and long revisit time of the monitoring area. This can be done now, given the MODIS and MERIS higher spatial resolution with respect to older sensors (250-300 m vs. 1 km), which consents the identification of smaller spills deriving from illicit discharge at sea. The procedure to obtain identifiable spills in optical reflectance images involves removal of oceanic and atmospheric natural variability, in order to enhance oil-water contrast; image clustering, which purpose is to segment the oil spill eventually presents in the image; finally, the application of a set of criteria for the elimination of those features which look like spills (look-alikes). The final result is a classification of oil spill candidate regions by means of a score based on the above criteria.

Lo studio è stato condotto seguendo una duplice prospettiva, che trae spunto da alcune assimilazioni operate dalla giurisprudenza italiana. Da un lato, si è cercato di capire come debbano essere interpretate norme create per la valutazione di realtà storicamente ben identificate, quali l’art. 416 bis c.p., nel momento in cui si applicano a realtà nuove, come le mafie straniere. Dall’altro lato, si è cercato di indagare i fondamenti dell’equiparazione dell’impresa che delinque al paradigma dell’associazione per delinquere, punita dall’art. 416 c.p., allorchè imprese formalmente lecite si trovano a operare per fini esclusivamente illeciti, facendo della organizzazione imprenditoriale una vera e propria organizzazione criminale. Gli obiettivi posti dalla ricerca si possono sintetizzare, dunque, nella verifica dell’adattabilità di tradizionali fattispecie criminose al nuovo contesto criminologico e nell’individuazione del confine tra l’azione occasionalmente illecita di una impresa lecita e la connotazione di una impresa come illecita tout court.

La tesi riprende un tema che è stato oggetto in passato di studi anche molto approfonditi; oggi sembra essere tornato alla ribalta grazie ad alcuni contributi che hanno nuovamente stimolato la dottrina a confrontarsi su aspetti così delicati anche alla luce della crisi economica. E'stato da sempre rilevato che la buona scrittura delle norme è un fattore fondamentale per il rilancio dell’economia del paese, per la semplificazione e per garantire ordine, coerenza e chiarezza all’ordinamento giuridico. La prima parte è incentrata su una ricostruzione storica e giuridica delle fonti che hanno disciplinato le “regole per la qualità delle regole”, oltre ad una panoramica della dottrina che si è occupata in passato del tema. Segue l’individuazione specifica di quali sono le regole formali e sostanziali di drafting. In particolare, una parte è dedicata alla giurisprudenza costituzionale per comprendere se esiste o meno un aggancio per la Corte Costituzionale da permetterle il sindacato sulle “regole oscure” e dichiararle illegittime. La seconda parte analizza le pressai, in particolare si è scelto di analizzare il rapporto tra Governo e Parlamento nelle problematiche principali che attengono al procedimento legislativo e alla cornice entro la quale viene esplicato in relazione alla decretazione d’urgenza, maxiemendamenti, questione di fiducia, istruttoria in commissione, gruppi di pressione. Ciò che è stato rilevato, è una scarsa aderenza ai principi e ai criteri di better regulation, peraltro difficilmente giustiziabili da parte della Corte costituzionale e sottratti al controllo di chi, al contrario, ha competenza in questo settore, ossia il Comitato per la legislazione e il DAGL. Le conclusioni, pertanto, prendono le mosse da una serie di criticità rilevate e tentano di tracciare una strada da percorrere che sia rispettosa dei canoni della “better regulation” anche alla luce delle riforme costituzionali e dei regolamenti parlamentari in corso di approvazione.

Market manipulation is an illegal practice that enables a person can profit from practices that artificially raise or lower the prices of an instrument in the financial markets. Its prohibition is based on the 2003 Market Abuse Directive in the EU. The current market manipulation regime was broadly considered as a big success except for enforcement and supervisory inconsistencies in the Member States at the initial. A review of the market manipulation regime began at the end of 2007, which became quickly incorporated into the wider EU crisis-era reform program. A number of weaknesses of current regime have been identified, which include regulatory gaps caused by the development of trading venues and financial products, regulatory gaps concerning cross-border and cross-markets manipulation (particular commodity markets), legal uncertainty as a result of various implementation, and inefficient supervision and enforcement. On 12 June 2014, a new regulatory package of market abuse, Market Abuse Regulation and Directive on criminal sanctions for market abuse, has been adopted. And several changes will be made concerning the EU market manipulation regime. A wider scope of the regime and a new prohibition of attempted market manipulation will ensure the prevention of market manipulation at large. The AMPs will be subject to strict scrutiny of ESMA to reduce divergences in implementation. In order to enhance efficiency of supervision and enforcement, powers of national competent authorities will be strengthened, ESMA is imposed more power to settle disagreement between national regulators, and the administrative and criminal sanctioning regimes are both further harmonized. In addition, the protection of fundamental rights is stressed by the new market manipulation regime, and some measures are provided to guarantee its realization. Further, the success EU market manipulation regime could be of significant reference to China, helping China to refine its immature regime.

Gli ultimi anni hanno visto importanti cambiamenti positivi nella cooperazione interstatale in Asia centrale. Crescenti minacce come il terrorismo internazionale, l'estremismo religioso e politico, il traffico di droga, ecc, causati dagli interessi geopolitici e geo-economici delle potenze mondiali, hanno contribuito alla formazione di una politica estera più coordinata e coerente degli Stati della regione. Questo processo si manifesta nella partecipazione attiva dell’istituzionalizzazione della Shanghai Organizzazione del Commonwealth (SOC), Conferenza sulle misure di costruzione d’interazione e fiducia in Asia (CICA) e Organizzazione del Trattato di Sicurezza Collettiva (CSTO). Problemi moderni di sicurezza in Asia centrale dovrebbero essere risolti in dei nuovi modi, non convenzionali. Le nuove minacce alla sicurezza richiedono modi non standard per risolvere il problema. Considerate le differenze fondamentali dell'Unione europea e degli Stati dell'Asia centrale nei valori e dal punto di vista in materia di sicurezza. I paesi dell'Asia centrale non sono pronti per l'integrazione politica. Nonostante questo, nell’Asia centrale sono state adottate misure per contrastare le minacce non convenzionali. L’esperienza europea di unire gli sforzi della regione per garantire la sicurezza interna, può essere utilizzata dai paesi dell'Asia centrale, soprattutto, in primo luogo sulla formazione del quadro istituzionale e giuridico per la cooperazione operativa delle forze dell'ordine per le seguenti aree: • prevenzione del traffico di droga attraverso gli Stati dell'Asia centrale; • lotta contro nuove forme di terrorismo ed estremismo; • limitare la dimensione della migrazione clandestina; • migliorare la protezione giuridica dei cittadini. Fino a poco tempo fa, questi temi hanno ricevuto poca attenzione, sia nella teoria sia nella pratica, poiché i problemi di sicurezza della società erano principalmente ridotti per evitare il pericolo di guerra.
