Reducing Legal Uncertainty: A Challenge for Subregional Integration in Latin America and the Caribbean

Despite the recovery in intraregional trade over the past three years, intra-group trade, that is trade within the Southern Common Market (MERCOSUR), the Andean Community (CAN) and the Central American Common Market (CACM), remains much weaker than that observed within similar groups in other regions of the world. This weakness is due essentially to the serious lack of complementarity in the process of eliminating tariff barriers (see chapter 3 of Latin America and the Caribbean in the World Economy 2004: Trends 2005, and the study on regional integration entitled: "América Latina y El Caribe: La integración regional en la hora de las definiciones", which is due to be published shortly and which updates basic information for the year 2005). The reasons include (a) weak institutional capacities; (b) the lack of macroeconomic coordination; (c) inadequate infrastructure and d) the lack of depth in integration-related trade disciplines.  This edition of the Bulletin reviews the mechanisms for dispute settlement within Mercosur, the Andean Community and CACM with a view to drawing conclusions on the extent to which they are used. In order to reform such mechanisms, consideration should be given to the creation of a single dispute settlement mechanism which would replicate the procedures and regulations of the World Trade Organization (WTO).

A periodization of Latin American development in the Robinsonian tradition

This paper analyzes Joan Robinson's growth model and then adapts it in order to provide an explanatory taxonomy of Growth Eras. The Growth Eras or Ages were for Robinson a way to provide logical connections between output growth, capital accumulation, the degree of thriftiness, the real wage and illustrate a catalogue of growth possibilities. This modified taxonomy follows the spirit of Robinson's work, but it takes different theoretical approaches. which imply that some of the classifications do not fit perfectly the ones here suggested. Latin America has moved from a Golden Age in the 1950s and 1960s to a Leaden Age in the 1980s, having two traverse periods, one of which the process of growth and industrialization accelerated in the late 1960s and early 1970s, which is referred to as a Galloping Platinum Age, an one in which a process of deindustrialization and reprimarization and maquilization of the productive structure took place, starting in the 1990s, which could be referred as the Creeping Platinum Age.

Autonomía y capacidad legal de las personas mayores: conceptos, mecanismos de protección y oportunidades de incidencia

En la base de la discriminación por edad se ubica la privación de la capacidad jurídica de las personas mayores y, por consiguiente, la limitación de su autonomía y de su poder para tomar decisiones. En este artículo se realiza un acercamiento al tema de la capacidad legal de este grupo social y los mecanismos necesarios para protegerla, y se analizan las oportunidades de incidencia a nivel internacional, regional y nacional para garantizar el igual reconocimiento de las personas mayores ante la ley.
