Analisam-se os fundamentos do processo de democratização da sociedade brasileira e seus impactos no campo da educação. Pressupõe-se que: a) democracia não é um conjunto dado de valores; b) as sociedades capitalistas são estruturalmente desiguais, incompatíveis com qualquer noção substantiva de igualdade; c) o Estado não é o lócus da realização do interesse geral; d) os conflitos de classes formam o terreno histórico no qual se objetivam as possibilidades democráticas. Com base nisso, afirma-se que tanto nas relações sociais em geral, como na educação, efetivou-se um processo de democratização no Brasil pósDitadura, fruto dos conflitos sociais que encaminharam a sociedade brasileira a conquistas favoráveis às classes trabalhadoras. Processo este que foi contraditório: de um lado, estavam as forças populares, para as quais democratização implicava conquista de direitos e participação nos processos decisórios; de outro lado, as forças que desejavam preservar a ordem vigente, ainda que tivessem de acatar mudanças na sua configuração (de Ditadura para um regime de direito). Nas conclusões argumentamos que, com a chamada redemocratização, houve certa abertura para uma democracia mais substantiva, capaz de dar vazão aos conflitos sociais. Abertura que logo se reverteu com o neoliberalismo, o que vem levando a um contexto de crescente ausência de alternativas.

Habermas entende os direitos humanos como produtos do mundo da vida; e é no interior do debate público, com a participação efetiva dos cidadãos, que deve ocorrer a produção deles como normas e princípios. A questão central abordada inicialmente no texto concerne ao status dessas normas e ao seu modo de instituição, dependente das relações de reciprocidade entre os sujeitos. Uma vez que, em sociedades complexas, apenas idealmente parece ser possível sustentar a participação de todos os sujeitos no processo de elaboração de normas, o texto procura analisar a viabilidade da concepção de Habermas. Ao considerar os elementos conceituais que orbitam essa questão, processa-se no curso do texto um deslocamento para outra, a saber, a relativa ao quanto o modo de sustentação da normatividade jurídica de um ordenamento social o determina como democrático ou não. Este é o ponto decisivo ao tratamento das normas relativas aos direitos humanos: a análise de Habermas é ideal, mas o pêndulo entre moral e empiria se mantém sempre, de modo que, pelo escopo conceitual, se não há como confirmar a identificação entre legitimidade dos direitos humanos e direitos humanos produzidos democraticamente, torna-se impossível querer negá-la.

Understanding the women’s political manifest at the present national scenario through analyzing the historicity and complexity of women’s movement and their contradictions regarding females / feminists actions in public and political areas. Thus, I give emphasis to the 30s and its “green blouses” and 60’s with “the marchadeiras” showing how those conservatives movements and their facist trend took on organized actions. And, also acting on the opposite way of democratic areas and the struggles for increasing the rights and advocating the maintenance of a status quo, keeping female traditional practices. Those women, who were living in the most visible female conjunctures and resistance to authoritarian governments, have taken positions that were holding back the progress in the game, contributing to reflux before the conquest of rights and gender equity.

This study aimed at analyzing the meanings of Children and Child Rights awarded by the kindergarten children and their educators, parents and teacher. Interest in the subject arose from the participation of the University Extension Project, conducted at the Department of Education, UNESP, Bauru, called The Rights of the Child: ECA in school. Since then, the question arose: to what extent we have visibility of meanings that educators and the child has on the Rights of the Child relating to the specifics of childhood? The research followed the tenets of qualitative research, methodological procedures and adopting the observation in a classroom from kindergarten (K II), semi-structured interview through leisure moments, with the class of aged five years and a questionnaire for family and teacher. The research adopted as reference material, studies of the area of Sociology of Childhood, History of Childhood, Public Policy, Legislation Related to the theme, and an overview of psychogenic to talk about the morality of children. The results showed that parents and caregivers understand childhood as a stage of child development, marked by jokes and fancies, in which the family and the school has an important role in this process. In what concerns the children's rights, there are contradictions in the legal aspects and the situation of children today. The results showed that children's childhood is characterized by recreational activities, and adults are responsible for caring for them. And it comes on the Rights of the Child noted that there is a confusion between rights and duties because they are in a phase of moral heteronomy. The findings indicate the need for wide dissemination on the Statute of Children and Adolescents, especially in preschools in line with families to practice it a new look at childhood, conceiving children as subjects... This study examined an example of community education of citizens that aimed to encourage their participation in democratic management of a non-governmental organization (NGO). The research problems were based on the NGO perspective and the ideas of community education and democratic management that guides the education of citizens to participate in the management of this organization. This issue has been studied under the perspective of educators and managers of NGO who performed the work focused on this study. We opted for a qualitative approach with a review of academic literature, questionnaires and individual and group interviews. The results indicated that the perspective of NGO adopted is used in Brazil. These organizations have low politicization and minimize conflicts between social groups. This approach seemed to contradict the prospect of democratic management that encouraged the struggle for rights and engagement in the management of the NGO and public spaces. The contradictions between the approaches of NFO and democratic management probably influenced the adoption of two conceptions of community education. One is dedicated to promoting self-help community to solve their social and economic problems and other inspired by Paulo Freire, which encourages popular mobilization for the questioning of capitalist social organization.

The article presents data from a qualitative study that aimed to investigate the presence of aspects that integrate knowledge, values and practice of the Human Rights Education (HRE) in the political-pedagogical projects (PPPs) of public schools in the state of São Paulo. 15 documents were analyzed from criteria based on reference documents for HRE in Brazil. The criteria were organized into seven areas: internal and external community; principles and concepts of education; goals; curriculum; democratic participation and school environment; teacher training and evaluation. We sought to identify whether the HRE related elements were missing, or if they were just mentioned or stood out through propositional planned actions in PPPs. The data demonstrate that the contents directly related to HRE are absent from PPPs, some issues related to this type of education are weakly mentioned and there are some planned actions that promote rights. However, the intentional, systematic and conscious planning of HRE is not yet reflected in this document type.
