A prominent characteristic of the modern legal profession is the need for lawyers to deal with challenging ethical dilemmas. It is an aspect of practice that has developed due to the increasing complexity of client arrangements, commercial realities and national and international responsibilities. This book is based on rulings of the Law Institute's Ethics Committee, which meets monthly to deliberate on requests for guidance from practising lawyers facing ethical dilemmas in their day-to-day working lives.

 Security questions are often based on personal information that is limited in variety, available in the public record and very difficult to change if compromised. A personalized folktale shared only by the communicating parties provides memorizable basis for individualized security questions that can be readily replaced in the event of a security breach. We utilize the Propp theory of narrative to provide a basis of abstraction for story generation systems. We develop a proof-of-concept system based on placeholder replacement to demonstrate the generation of repudiate and memorizable questions and answers suitable for online security questions. A 3-component protocol is presented that demonstrates the use of this process to derive a shared secret key through privacy amplification. This combination of story generation and communication security provides the basis for improvements in current security question practice.

The 1964 High Court decision in Woon v The Queen is commonly understood to permit the drawing of an inference of a ‘consciousness of guilt’ when a suspect selectively responds to police questions. It is the author’s contention that, in the light of the emphatic endorsement of the right to pre-trial silence by the High Court in 1993 in Petty v The Queen; Maiden v The Queen, Woon should now be regarded as bad law and should no longer be followed.

Communication is frequently characterized by a sequence of questions and answers. Little is known about how well students who are deaf or hard of hearing (deaf/HH) understand their hearing classmates in the context of an inclusive setting. This study explored the communication skills used by deaf/HH children when asking and answering questions in a “trivia” game with their hearing peers. Thirty-four children with normal hearing and 34 children with a hearing loss ranging from mild to profound (>90 dB HL) participated in this study. Each of the 34 dyads included 1 child with normal hearing and 1 child with hearing loss, matched by gender and grade level at school. Dyads were videotaped and analyzed. Pairs were compared in terms of their capacity to repeat the question, strategies used to seek information, and accuracy of responses. Results showed that the group of hearing children was able to repeat more questions verbatim compared to the deaf/HH children. The deaf/HH group required a significantly greater number of repetitions, sought a greater number of general clarifications, and correctly answered more questions compared with the group of hearing children. The implications of these findings are discussed in terms of peer communication and pragmatic skill development.

Knowing how species respond to fire regimes is essential for ecologically sustainable management. This axiom raises two important questions: (1) what knowledge is the most important to develop and (2) to what extent can current research methods deliver that knowledge? We identify three areas of required knowledge: (i) a mechanistic understanding of species’ responses to fire regimes; (ii) knowledge of how the spatial and temporal arrangement of fires influences the biota; and (iii) an understanding of interactions of fire regimes with other processes. We review the capacity of empirical research to address these knowledge gaps, and reveal many limitations. Manipulative experiments are limited by the number and scope of treatments that can be applied, natural experiments are limited by treatment availability and confounding factors, and longitudinal studies are difficult to maintain, particularly due to unplanned disturbance events. Simulation modelling is limited by the quality of the underlying empirical data and by uncertainty in how well model structure represents reality. Due to the constraints on large-scale, long-term research, the potential for management experiments to inform adaptive management is limited. Rather than simply recommending adaptive management, we define a research agenda to maximise the rate of learning in this difficult field. This includes measuring responses at a species level, building capacity to implement natural experiments, undertaking simulation modelling, and judicious application of experimental approaches. Developing ecologically sustainable fire management practices will require sustained research effort and a sophisticated research agenda based on carefully targeting appropriate methods to address critical management questions.

This article explicates on how the post-adjunct reading comprehension questions existing in the Iranian high school and pre-university English textbooks affect the comprehension of the related students. It further purports to see if there is a significant gender difference in the comprehension of reading texts by these student groups. To this end, 240 third-grade high school and pre-university students (equal number of male and female) participated in this investigation. The results demonstrated a significant superiority in the subjects’ reading comprehension when they answered the texts with the post-adjunct reading comprehension questions, designed by the researchers for this purpose. The results also showed non-significant gender disparities in the comprehension of given texts.

One highly regarded context for language learning is book reading, as teachers engage children in discussions around texts read. However, there is considerable variation in teachers’ patterns of talk that mediate this learning with preschool children’s oral language development dependent on the opportunities for engagement in language use provided by teachers. To explore the affordances of talk interactions within book reading a systematic analysis of teachers’ questions and children’s responses was undertaken. Results of this analysis show that the highest proportion of questions asked by this group of 18 preschool teachers were closed questions with a small proportion of open teaching questions asked. However, while open questions provided the most substantial opportunities for children’s extended talk, the range of questions asked provided opportunities for preschool teachers to extend children’s responses, support children’s understanding of the text, develop vocabulary and world knowledge, and to model more complex language structures.

The UNESCO declaration on cultural diversity in 2002 has raised more questions than answers. More recent events around the World have highlighted the immediate need for legislative actions to protect cultural built heritage in tensioned societies. This paper discusses the potential global risks that face cultural built Heritage. The paper argues that such risks are not only limited to regions where military operations are taking place but also to nations where questions of identity and cultural diversity are raised. The paper questioned the reasons and the impact of the rise of ethno nationalism on the protection of cultural built heritage. The different discourses of these groups that will lead to destruction of cultural artefacts are also explored. In order to properly legislate means for the protection of vulnerable cultural built heritage in conflict areas, the underline value system should be clarified and the values under threat identified. The paper concludes with a plea to move our understanding and definition of culture from the previous 'old' definition with relation to "people' to a 'new' one which is more relevant to context.

Chemiluminescence, the production of light from a chemical reaction, has found widespread use in analytical chemistry. Both tris (2, 2’-bipyridyl) ruthenium (II) and acidic potassium permanganate are chemiluminescence reagents that have been employed for the determination of a diverse range of analytes. This thesis encompasses some fundamental investigations into the chemistry and spectroscopy of these chemiluminescence reactions as well as extending the scope of their analytical applications. Specifically, a simple and robust capillary electrophoresis chemiluminescence detection system for the determination of codeine, O6-methylcodeine and thebaine is described, based upon the reaction of these analytes with chemically generated tris(2,2'-bipyridyl)ruthenium(III) prepared in sulfuric acid (0.05 M). The reagent solution was contained in a glass detection cell, which also held both the capillary and the cathode. The resultant chemiluminescence was monitored directly using a photomultiplier tube mounted flush against the base of the detection cell. The methodology, which incorporated a field amplification sample introduction procedure, realised detection limits (3a baseline noise) of 5 x 10~8 M for both codeine and O6-methylcodeine and 1 x 10~7 M for thebaine. The relative standard deviations of the migration times and the peak areas for the three analytes ranged from 2.2 % up to 2.5 % and 1.9 % up to 4.6 % respectively. Following minor instrumental modifications, morphine, oripavine and pseudomorphine were determined based upon their reaction with acidic potassium permanganate in the presence of sodium polyphosphate. To ensure no migration of the permanganate anion occurred, the anode was placed at the detector end whilst the electroosmotic flow was reversed by the addition of hexadimethrine bromide (0.001% m/v) to the electrolyte. The three analytes were separated counter to the electroosmotic flow via their interaction with a-cyclodextrin. The methodology realised detection limits (3 x S/N) of 2.5 x 10~7 M for both morphine and oripavine and 5 x 10~7 M for pseudomorphine. The relative standard deviations of the migration times and the peak heights for the three analytes ranged from 0.6 % up to 0.8 % and 1.5% up to 2.1 % respectively. Further improvements were made by incorporating a co-axial sheath flow detection cell. The methodology was validated by comparing the results realised using this technique with those obtained by high performance liquid chromatography (HPLC), for the determination of both morphine and oripavine in seven industrial process liquors. A complimentary capillary electrophoresis procedure with UV-absorption detection was also developed and applied to the determination of morphine, codeine, oripavine and thebaine in nine process liquors. The results were compared with those achieved using a standard HPLC method. Although over eighty papers have appeared in the literature on the analytical applications of acidic potassium permanganate chemiluminescence, little effort has been directed towards identifying the origin of the luminescence. It was found that chemiluminescence was generated during the manganese(III), manganese(IV) and manganese(VII) oxidations of sodium borohydride, sodium dithionite, sodium sulfite and hydrazine sulfate in acidic aqueous solution. From the corrected chemiluminescence spectra, the wavelengths of maximum emission were 689 ± 5 nm and 734 ± 5 nm when the reactions were performed in sodium hexametaphosphate and sodium dihydrogenorthophosphate or orthophosphoric acid environments respectively. The corrected phosphorescence spectrum of manganese(II) sulfate in a solution of sodium hexametaphosphate at 77 K, exhibited two peaks with maxima at 688 nm and 730 nm. The chemical and spectroscopic evidence presented strongly supported the postulation that the emission was an example of solution phase chemically induced phosphorescence of manganese(II). Thereby confirming earlier predictions that the chemiluminescence from acidic potassium permanganate reactions originated from an excited manganese(II) species. Additionally, these findings have had direct analytical application in that manganese(IV) was evaluated as a new reagent for chemiluminescence detection. The oxidations of twenty five organic and inorganic species, with solublised manganese(IV), were found to elicit analytically useful chemiluminescence with detection limits (3 x S/N) for Mn(II), Fe(II), morphine and codeine of 5 x 10-8 M, 2.5 x 10-7 M, 7.5 x 10-8 M and 5 x 10-8M, respectively. The corrected emission spectra from four different analytes gave wavelengths of maximum emission in the range from 733 nm up to 740 nm indicating that these chemiluminescence reactions also shared a common emitting species, excited manganese(II). Whilst several analytical problems were addressed in this thesis and answers to certain questions regarding the fundamentals of acidic potassium permanganate chemiluminescence were proposed, there are several areas that would benefit from further research. These are outlined in the final chapter of this thesis.
