Feminist challenges to the constraints of law : donning uncomfortable robes?

Legal judgment writing mobilises a process of story-telling, drawing on existing judicial discourses, precedents and practices to create a narrative relevant to the specific case that is articulated by the presiding judge. In the Feminist Judgments projects feminist scholars and activists have sought to challenge and reinterpret legal judgments that have disadvantaged, discriminated against or denied women’s experiences. This paper reflects on the process of writing as a feminist judge in the Australian Project, in an intimate homicide case, R v Middendorp. Drawing on the work of Judith Butler on intelligibility, iterability and the communality of violence and vulnerability, this article argues that feminist judgments necessarily require some uncomfortable compromises with unjust gendered institutions. While ‘donning the robes’ may be an uncomfortable process, a feminist re-articulation of the law’s carceral power serves to unsettle and challenge some aspects of gendered oppression, even though it cannot unsettle the operation of the institution. The article concludes that effective feminist interventions by members of the judiciary may require donning robes that are not entirely comfortable in order to persuade and advocate for change.

The theory and practice of coastal area planning: linking strategic planning to local communities

Integrated coastal management (ICM) has been slowly accepted over the last decade as a unifying approach for coastal planning and management throughout the world. Coastal planning aimed at achieving the objectives of ICM can be implemented by varying processes and faces many challenges. One major challenge for coastal planning is to adapt the well-developed theoretical principles of ICM to practical and understandable outcomes in local areas. Associated with this challenge is the need to balance coastal planning objectives for conservation and economic development of a nation or state/province with the objectives of the local community. This article describes a three-tiered approach to coastal planning in Victoria, Australia, which will be of value to other countries, particularly those with subnational coastal planning jurisdictions. This approach not only has the aim of balancing subnational (e.g., state government) and local objectives, but also of applying the theoretical concept of ICM in practice on the ground. In addition, the approach sets out to achieve a sense of ownership of the planning process by local communities by maximizing their involvement at all levels of planning and also by making the state strategy as easy to understand and follow as possible.

From Flysch to Molasse - sedimentary and tectonic evolution of late Caledonian - early Hercynian Foreland Basin in North Qilian Mountains

The Late Caledonian to Early Hercynian North Qilian orogenic belt in northwestern China is an elongate tectonic unit situated between the North China plate in the north and the Qaidam plate in the south. North Qilian started in the latest Proterozoic to Cambrian as a rift basin on the southern margin of North China, and evolved later to an archipelagic ocean and active continental margin during the Ordovician and a foreland basin from Silurian to the Early and Middle Devonian. The Early Silurian flysch and submarine alluvial fan, the Middle to Late Silurian shallow marine to tidal flat deposits and the Early and Middle Devonian terrestrial molasse are developed along the corridor Nanshan. The shallowing-upward succession from subabyssal flysch, shallow marine, tidal flat to terrestrial molasse and its gradually narrowed regional distribution demonstrate that the foreland basin experienced the transition from flysch stage to molasse stage during the Silurian and Devonian time.

Extensive, economical and elegant : the habitus of gentility in early nineteenth century Sydney

This paper challenges the modern expectation that mahogany furniture and silver cutlery were self-evident indicators of gentry status in colonial Sydney through close analysis of a bundle of middle class household inventories of the 1840s. They are considered as evidence of habitus--the structuring interaction of mentality with the material world--in order to demonstrate the active principle of consumption in the claim or assertion of bourgeois standing, which was particularly lively in the colony. A range of competences can he seen in the practice of gentility, which suggests that the possession of rosewood rather than mahogany, or imitation silver rather than sterling, was a variation shaped not merely by wealth but by cultural capital. This exposes strands of contingency, competition and compromise in middle class expression.

Anticipating policy and logics of practice : Australian institutional and academic responses to the globalising "quality research" agenda

Research assessment is now an international trend. This article mobilises a critical policy sociology informed by Bourdieu to unpack the differential effects of research policy shifts in Australia on universities, academics and the field of educational research. It argues in anticipating policy moves - from surveying the logics of practice that have emerged elsewhere from research assessment - that institutional, individual and field responses, while specific to the Australian policy context and mix, have assumed a logic of practice counter productive to "quality" research, education as a field, and equity.

Making sense of law and disorder

This article tells the story of a cross-cultural encounter on a beach at King George's Sound in the south west of Australia in 1826, when Major Edmund Lockyer arrived to establish a British military garrison. The account we have of those early encounters come from the pen of Lockyer, and by taking a close reading of his journal this article attempts to reveal the meanings and context of Aboriginal actions. It also analyses how the Aborigines and the British made sense and subsequently responded to the encounter. Whilst this story is not given iconic status in Australian historiography, it is valuable in opening up a porthole into this contact zone at the moment when precarious relationships were being formed.
