While comparative law has become a key discipline, its instrumentalist use has turned out to be a powerful weapon: it is the ‘pen’ by which the identity of and differences in law’s geopolitics are continually written and rewritten. Given its attractive functionalist essence, comparative law is gaining increasing international credit as a way of developing newer theories of sovereignty and governance in a framework in which law is conceived of less as a set of rules and more as a symbolic vestimentum of global soft power. The present contribution critically investigates the relationship between distortive views of comparative law’s geopolitics and the intimate essence of the doctrine aimed at creating the ‘aspatial’, unbounded, illimitable (and hence intangible) liberal global order whose governance appears to transcend the idea and form(s) of law through which the ‘politicization’ and ‘juridification’ of modernity have been achieved in the last century. In doing so, it also addresses why such an alliance has made it easier to ‘discover’ and ‘sell’ the smooth and rectilinear land of the figuratively unspoken and unwritten as the terra incognita that lies over what is created by the constructivist political intervention(s) of the modern nation-state

In 1933 and 1934 the visionary architect, designer, engineer and philosopher Robert Buckminster Fuller built three prototypes of a car he named the Dymaxion. Regarded as a ground breaking concept vehicle, the Dymaxion is arguably more relevant today than when it was conceived over eighty years ago. Although plans to manufacture were abandoned by Chrysler in 1933, the Dymaxion Car was considered the most fuel-efficient car of its time using less than half the amount of gasoline than any other car on the road. This was due to its meticulous design based on scientific first principles, power weight ratios and the laws of aerodynamics. The Dymaxion was spacious and easy to maneuver; it offered multi purpose use options with the passenger capacity of a modern people carrier and represented Buckminster Fuller's social responsibility mantra to create more with less. The brand narrative of the Dymaxion tells a story of sustainability and practicality that resonates with today's vehicle consumer market. The adage suggesting that there is reason why a car's windshield is bigger than its rear view mirror and implies that what lies ahead is much more important than anything behind you. Although this life metaphor acknowledges the importance of an occasional glace back this paper emphasises the strategic value of a precognitive, retrospective approach to design.

This paper discusses the power of performed research. Such power lies in assisting to research the whole human – thought, action, and emotion. The paper discusses the potential for research through the arts in the development of creativity and imagination, to facilitate social change, and to explore performance as a research process as well as an end result that presents findings. The experiences of Bagley and Cancienne (2001); (2002) guided the creation of the work, and assist to frame this paper. The dance work discussed in this paper is a recent addition to the performed research work ‘The First Time’. The dance work was crafted to bring together the comparable experiences of first year teacher participants, and similarities among the findings of research into their identity. The creation of ‘The First Time’ was employed as a tool to understand and analyse the data. The dance work was employed to highlight findings regarding beginning teachers’ transition to teaching. This paper explores the process of creating and presenting arts-based research to expand the avenues through which the results of research are made available to a relevant audience; of how this method might broaden and complement traditional ways of thinking about and doing educational research.

This review will discuss Hun Joon Kim’s important work on political dissent in the Republic of Korea, The Massacres at Mt. Halla: sixty years of truth-seeking in South Korea (Massacres at Mt. Halla). This book tells the story of the six-decade-long grassroots campaign to establish a truth commission into the events around Jeju 4.3: a series of counterinsurgency actions against armed uprisings that resulted in the large-scale massacre of civilians as well as other atrocities. Political activism looms large in South Korea’s modern political history, making a major contribution to the evolution of democracy in that country. For decades, the main game, and the focus of most academic scholarship, was the establishment of full participatory democracy in the country. Yet, behind the scenes and on the peripheries, many lower profile battles have been fought and the fate of these struggles is in some ways the real test of democracy in South Korea (Republic of Korea or ROK). Drawing together a broad range of primary documentary and interview material, Massacres at Mt. Halla makes a number of important contributions to audiences in Korean Studies, International Relations, and transitional justice. Kim brings to English speakers an unprecedented insight into the uprising, counterinsurgency operations, and activist efforts to bring this chapter of South Korean history to light. Careful archival research is supplemented with detailed personal interview data, the majority of which is in the Korean language and thus previously inaccessible to a wider audience. The value here lies with a detailed narrative that traces grassroots activism from the days of authoritarian government through the varied challenges of a newly democratic nation. In its telling, this story illuminates the ways in which local activism can be derailed or suppressed in a tight security environment. In this case, the backdrop was a political environment strictly managed by the state on the grounds of a fervent anti-communist policy. Anti-communism was in fact the only state-sanctioned ideology, one which had the backing of the ROK’s powerful US military ally. As Kim’s research demonstrates in a clear way, any activism that could be perceived to deviate from this ideology was harshly dealt with. The dawn of progressive government in South Korea in 1997 brought an end to explicit ‘red-baiting’,1 as it was known, but did not overturn altogether the rigid anti-communist structures that had accompanied the development of the modern South Korean state. In the following discussion, I first provide a brief introduction to Kim’s book before focusing my attention in on what Massacres at Mt. Halla tells us about this interaction between national security discourse and civil society activism.

Considering the way light is integral to photography I draw on its paradoxical nature at sub atomic levels that describe how, when observed it changes. Taking a biocentric approach ; ‘A radical new view of reality: Life creates time, space, and the cosmos itself The farther we peer into space, the more we realize that the nature of the universe cannot be understood fully by inspecting spiral galaxies or watching distant supernovas. It lies deeper. It involves our very selves.’ (Lanza, 2009), I aim to clarify how embodied photographic practice can be explored through improvisational and performative discourse.

If ontology concerns theories of being, and epistemology theories of knowing, how might we bring the two together to account for movements between being and knowing that constitute cultural production? something occurs or lies behind language and meaning that must be acknowledged if we are to arrive at an explanation. In this essay, I examine some key ideas that emerge from the work of Julia Kristeva, as well as those of Gilles Deleuze and Félix Guattari on sensation and affect, to demonstrate how ontology and epistemology are inextricably entwined in knowledge production.1 Kristeva’s perspective of creative practice not only aligns with the new materialist acknowledgement of the agency of matter, but, in contrast to Deleuze and Guattari, it also affirms the dimension of human or subjective agency that is implicated in cultural production.

The following forgotten text is flawed. It is a failure. It has many mistakes but few regrets. It was written 20 years ago and first appeared in the Melbourne Super 8 Group Newsletter Issue 135 in May 1998, 25 years after I solarized my first 25 feet of 16mm film of the Carlton Cemetery fence, just down the road from Goodtime Studios and did my first bit of sepia toning in a Russian processing tank that still lies with its warped plastic spiral in my garage in suburban Melbourne. As Pearls Before Swine sang in one of their songs, a faint memory now; 'The More things change, the more they stay the same'. They were not the first to say this. Technology continues to develop massively and the rubble of its passing slowly recedes to invisibility. I continue to live through this conundrum every day. It sings me to sleep. It wakes me up.

The publication of Melissa Lucashenko’s Mullumbimby in 2013 drew attention once more to the issue of how post-colonial scholars might best engage with English-language literary texts also containing a glossary of Indigenous words. This issue emerged first with the publication of Keri Hulme’s The Bone People in 1984. This article argues that, to date, scholars like Simon During and Eve Vincent have perpetuated a binary either/or approach to the interpretation of these glossaries. The result of this approach has been that either the pre-colonial Indigenous language or the colonial/post-colonizing English language has been privileged as the locus of linguistic power in the text. One problem with this approach is that it does not adequately represent the complex historical, cultural and political circumstances of post-colonial and multi-cultural nations like Australia (setting of Mullumbimby) and New Zealand (setting of The Bone People) as these link to matters of language. Another problem is that this binary approach restrains a close reading of the differences between different types of such glossaries, and of the nuanced relationship of a glossary to the text it accompanies. In place of this approach, this article proposes a new methodology that works with Elizabeth M. DeLoughrey’s notion of “tidalectics” as a way of reading island literatures. The neologism “glossary islands” allows another way into considering the function of glossaries in islandic literary texts like Lucashenko’s and Hulme’s. The post-colonial connection between islands and glossaries lies in the fact that they are each an intensified site of knowledge.

The author of the present study juxtaposes accounts by " postmemory" individuals with the fraudulent works of Binjamin Wilkomirski (Bruno Dössekker) and Jerzy Kosinski. Analyzing both phenomena as representative of the dynamics at work in memory of the Holocaust and of other "traumatic events," the author arrives at a formulation, via Giorgio Agamben, of the aporia (contradiction) that lies behind both the legitimized and illegitimated. © Oxford University Press 2010; all rights reserved.
