In order to strengthen the constitutional process of appointment of judges in Superior Courts, Bangladesh established a Supreme Judicial Commission in 2008 by promulgating an Ordinance. This Ordinance was neither promulgated in pursuance of any provisions of the Constitution nor by introducing any amendment to the provisions of the Constitution. The recommendations of the Commission were not given binding force on the executive. The power of the executive to accept or reject the candidates recommended by the Supreme Judicial Commission at his pleasure defeated the very objective of establishing the Commission for appointing the most competent and suitable persons as judges of the superior courts in Bangladesh. However, following the general elections held on 29 December 2008, the newly elected Government of Bangladesh Awami League dispensed with the Supreme Judicial Commission by not placing the Supreme Judicial Commission Ordinance before the parliament for its approval. This resulted in restoring the previous system of appointing judges on the satisfaction of the executive, which has resulted in patronage appointments. Thus, the establishment of an independent judicial commission in Bangladesh is an imperative necessity for strengthening the independence and impartiality of the judiciary.

This is a case study which criticises the way a water authority has been trying to introduce “biosolids” (stabilised sewage sludge) projects. Two proposed projects have been abandoned after outcry by communities neighbouring earmarked sites. At the time of writing a third project was going ahead. This local scale clash reflects contests which are cropping up globally as water authorities are restricted in their use of land or sea dumping and ordered to introduce environmentally sustainable practices. The case study ends with a discussion of a strand of cultural theory which might have given the water authority a better understanding of the public issues involved. The article concludes that understanding cultural theory might assist organisations achieve world best practice in public relations when they face some of the pressing environmental and safety concerns of the 21st century.

Mistletoes are hemiparasites that occur worldwide in many types of forest, woodland and shrubland ecosystems (Watson 2001). Some species are regarded as pests due to their detrimental effects on host species (Hawksworth 1983; Reid & Yan 2000). Heavy infestations can affect the growth, productivity and form of host trees, and may cause host death (Reid et al. 1994; Shaw et al.2004, 2008). In south-eastern Australia, mistletoes often are visibly obvious in trees along roadsides, in paddocks and on the margins of open forests; and concerns have been expressed about their potentially detrimental effects on host trees.Despite this, little quantitative information is available on the effects of mistletoes on tree health and mortality (Reid et al. 1994). Are detrimental effects widespread or localized? A first step is to assess whether trees parasitized by mistletoe are less healthy than those without such parasites. Here, we investigate the relationship between parasitism by Box Mistletoe (Amyema miquelii (Lehm. ex Miq.) Tiegh.), a common species in south-eastern Australia, and the health of trees of a widespread host species, Grey Box (Eucalyptus microcarpa (Maiden) Maiden), across a large geographic region.

Motor proficiency was investigated in a sample of children with Attention Deficit Hyperactivity Disorder-Combined type (ADHD-CT) without autism. Accounting for the influence of co-morbid autistic symptoms in ADHD motor studies is vital given that motor impairment has been linked to social–communication symptoms in children who have co-morbid ADHD and autistic-like symptoms. Two groups of children aged between 7–14 years were recruited; children with ADHD-CT (n = 16; mean age 10 years, 7 months [SD = 1 year, 10 months]) and a typically developing (n = 16; mean age 10 years, 6 months [SD = 2 years, 6 months]) group. Motor proficiency was measured using the Movement Assessment Battery for Children-2nd Edition, ADHD symptoms were measured using the Conner’s Parent Rating Scale. Children with ADHD-CT who had been screened for co-morbid autism did not display motor difficulties on the MABC-2. Higher levels of inattention, but not hyperactivity or impulsivity were associated with poorer motor performance. These findings provide indirect evidence that the motor problems that children with ADHD experience may be related to co-occurring social responsiveness impairments.

Research question: A major barrier to retaining existing customers is the difficulty in knowing who is most at risk of leaving (or ‘churning’). Given the strategic and financial importance of season ticket holders (STH) to professional sport teams, this paper examines the effectiveness of a range of variables in identifying the STH who are most likely to churn.
Research methods: A longitudinal field study was undertaken to reflect actual conditions. Survey data of a professional sport team STH were collected prior to the conclusion of the season. Actual renewal data were then tracked from team records the following season. This work was replicated across five professional sport teams from the Australian Football League, with renewal predictions made and tracked for over 10,000 STH.
Results and findings: The results suggest that the ‘Juster’ Scale – a simple, one-item purchase probability measure – is an effective identifier of those most at risk of churning, more than 3 months in advance. When combined with ticket utilization and tenure measures, predictive accuracy improves markedly, to the point where these three measures can be used to provide an effective early warning system for managers.
Implications: Whilst there is a tendency to view STH as highly loyal, these data reinforce the importance of actively managing all customers to reduce churn. Despite their commitment, STH do churn, but those most likely to can be predicted by examining their patterns of behaviour in the current season. Efforts to retain STH need to shift their focus from transactional value assessments.

Wildlife living in the suburbs faces the challenge of dealing with human presence and yard management (including the occurrence of pets) which vary at the scale of the house block. This study examined the influence of ecological factors (e.g. extent of grass and food availability) and anthropogenic factors (e.g. human activity and garden usage) on breeding site choice and reproductive success of the ground-nesting masked lapwing Vanellus miles on Phillip Island, Australia. Lapwings nested less frequently in residential properties (high levels of human usage) compared with vacant blocks and holiday houses. They were also more likely to breed on properties with high food availability and larger areas of grass. None of these variables influenced clutch size or the probability of eggs hatching, although larger clutches and higher hatching rates tended to be associated with more food. This study shows that, for an urban exploiting species, habitat quality is not homogenous at the scale of the house block, and that human activity is avoided by a species generally considered highly tolerant of people.
