The argument in favour of a widespread fixed penalty regime - adopting a primary rationale for punishment would facilitate a more coherent and exacting approach to sentencing - the central objections against fixed penalties are that they are too severe and lead to unfairness because they are unable to incorporate all the relevant sentencing variables - by adopting a utilitarian ethic as the primary rationale for punishment, these problems can be circumvented - no utilitarian justification for disproportionate punishment, and penalties should not exceed the seriousness of the offence - no foundation for most sentencing considerations - by disregarding irrelevant considerations, the remaining can be incorporated into a fixed penalty system - the way would then be open for a coherent sentencing law system in which criminal justice is governed by pre-determined rules and principles as opposed to the intuition of sentencers.

This article compares the operation of a dielectrophoretic (DEP) platform before and after pattering carbon nanotubes (CNTs) between its microelectrodes. The diverse performance of the DEP system is assessed by separating 1 and 5 μm polystyrene particles. In the absence of CNTs, both particles can only be trapped by operating the system at low medium conductivities, (<10-3 S/m) and frequencies (<75 kHz). Alternatively, applying CNTs to the system, some CNTs coat the surface of particles and increase their overall conductivity and permittivity, whereas the rest of them are patterned between the microelectrodes and induce strong DEP forces at their free ends, which can effectively trap the coated particles. The first development extends the range of medium conductivities and frequencies at which the trapping of both particles is achievable, whereas the second development facilitates the selective deposition of particles along the surface of curved microelectrodes. Setting the medium conductivity to 2×10-3 S/m and the frequency to 20 MHz, most of 5 μm particles are trapped at the entry region of the first microelectrode pair, whereas most of 1 μm particles are trapped at the tips, and this distinction facilitates their separation. The trapping of 1 μm particles can be improved by decreasing the frequency to 1.5 MHz. This study demonstrates how the integration of CNTs into microfluidic systems enables them to operate beyond their capabilities.

Purpose – The purpose of this paper is to add to the evidence of best practice in the implementation of the Health Promoting Schools (HPS) framework by examining the process of creating readiness for change in a large international school in South-East Asia. Using a settings-based approach and guided by readiness for change theory the data collected reflects which factors were most influential in the decision of the leadership team (LT) to adopt a comprehensive HPS model. It follows the process of creating readiness in the early stages of adopting a HPS approach and captures the critical factors effecting leader’s beliefs and support for the program. Design/methodology/approach – This research is a case study of a large pre-K-12 international school in South-East Asia with over 1,800 students. A mixed methods qualitative approach is used including semi-structured interviews and document analysis. The participants are the 12 members of the LT. Findings – Readiness for change was established in the LT who adopted a HPS approach. That is, they adopted a comprehensive model to address health-related priorities in the school and changed the school’s mission and accountability processes to specifically include health. Uncovering the reasons why the LT supported this change was the primary focus of this research. Building the motivation to change involved establishing a number of key beliefs three of which were influential in bringing about readiness for change in this case study. These included the belief that leadership support existed for the proposed change, a belief that there was a need for change with a clear discrepancy in the present and preferred operations in relation to addressing the health issues of the school and the belief that HPS was the appropriate solution to address this discrepancy. Research limitations/implications – Adopting a HPS approach is the first phase of implementation. Long-term research may show if the integrity of the chosen model is maintained as implementation continues. The belief construct of valence, that is, the belief that the change will benefit the change recipient, was not reliably assessed in this research. Further research needs to be conducted to understand how this construct is interpreted in the school setting. The belief construct of valence was not reliably assessed in this research. Practical implications – This paper provides a promising example of how health can be integrated into the school’s Mission and Strategic Learning Plan. The example presented here may provide strategies for others working in the field of HPS. Originality/value – Creating readiness is an often over-looked stage of building sustainable change. International schools cater to more than three million students are a rarely researched in regards to health education. It is predicted that the numbers of students in international schools will grow to more than six million in the next ten years.

The adoption, in mid-1995, of the revised food Standard A9, which permits the more liberal addition of nutrients to a range of food products, highlighted the need to obtain information on nutrient intake from supplements to complement the i 995 National Nutrition Survey data on nutrient intake from food. This paper describes the method used to obtain quantitative information on nutrient supplement intake and reports on the prevalence of supplement use in different subgroups of the Australian population. Information on supplement intake was obtained in two Australian Bureau of Statistics Population Survey Monitor surveys in August 1995 and February 1996 using the Therapeutic Goods Administration (TGA) registration numbers to identify individual products. Approximately 18% of men and 29% of women aged 18 years and over reported consuming a nutrient supplement on the day before the survey and these proportions increased to 25% and 35% respectively for consumption during the two weeks before the survey. The prevalence of supplement intake increased with age, education level, socioeconomic status, employment status and with fruit and vegetable intake. The substantial proportion of Australian adults who consume nutrient supplements, and the rapidly changing composition of the Australian food supply in response to changes in food regulation, indicate that there is a need for regular monitoring of nutrient intake from supplements. The use of TGA registration numbers to identify supplements provides a practical way to address this need.

This article examines how early childhood staff in diverse circumstances negotiate relationships with parents. It draws on interviews with staff in two rural and three urban communities in Australia, who were asked about their parent communication practices, their experiences of these practices, and their preferences within these practices. Their responses were analysed in the light of international research showing the importance of creating strong interpretive communities between staff and parents but consistent staff anxiety about their relationships with parents. The paper explores the extent to which staff's different approaches to communicating with parents can create sustainable interpretive communities between them, and it highlights some implications for staff training and development around parent involvement.

Since 1989 in New Zealand, the work of the primary school principal has been transformed in official policy texts from that of leading professional to chief executive officer. Surveys document the changing nature of the role and the workload and other pressures that have resulted, particularly for principals with teaching responsibilities in smaller schools. There is a generally accepted crisis of preparation, recruitment, development and retention. Below the surface, however, are deeper-seated, structural difficulties: women comprise the majority of teachers, yet are a minority of principals and their career advancement is largely limited to small schools and those in poorer socioeconomic areas. This article reviews the situation and examines the reasons why dominant images of the primary school principalship may be both partial and counterproductive.

This paper advances our understanding of the relationship between quality, value and satisfaction in the context of spectator sport services. This is achieved through an analysis and examination of relevant secondary data culminating in a conceptual model Although extensive research has been conducted in the three separate areas of quality, value and satisfaction, to date no work has been reported attempting to develop macro models that capture the concepts and their potential interrelationships. Such macro models could enhance the communication and stimulate further research for sport marketing scholars. This paper proposes a model apposite for further research and in the process leads to the potential confirmation, rejection or, indeed, adaptation of the conceplualization of sport services.

AFTER BALI, OCTOBER 12, 2002, A RANGE OF PUBLIC rituals took place in Australia to remember those who had been killed in the bombing. In Melbourne, the most visible, and collective ritual was the laying of flowers by members of the public on the steps of the State Parliament building, at the highly visible apex of Bourke St. This was a much-publicized event that took place over a period of two weeks. It was a riveting and moving sight/site for many people, who left notes expressing grief and regret, promises of remembrance, and of revenge. The choice of the site, and what would happen there, was prompted by talk-back listeners to Radio 3AW's Nell Mitchell, who called in with many different suggestions as to where and why the laying of flowers should take place. This essay seeks to understand the processes and purposes of the popular, public rituals after Bali, asking who made them, what was made, and how popular--that is, open to formation by those not primarily and directly connected with the mass media and party politics--were the constructions? Further, in calling such an event a "postmodern ritual," the essay will inaugurate an analysis, through cultural studies methodologies, of the attributes of public rituals in contemporary Western cultures.

Stroke is a major cause of chronic illness in Australia, where it is estimated that between 200,000 and 250,000 people live with disabilities due to stroke. Given stroke's effect on survivors and the accompanying burden on caregivers, attention should be given to addressing the needs of caregivers of stroke survivors because they are central to supporting survivors living in the community. Research has shown that the information needs of caregivers are not being met across healthcare settings. Thus, some attention must be given to the development of educational materials that address caregiver needs. In this study we interviewed caregivers to determine their perspectives on support and educational needs at two different stages in the recovery of the stroke survivor: the acute hospital and the community. Despite a high level of uncertainty among caregivers in the acute and community settings, limited information was provided to assist them in their new role. A multifaceted approach would involve the development and implementation of specifically designed educational materials for caregivers, the use of a tool such as a patient-held record to assist in and improve the continuity and communication of care, and the provision of ongoing support from a stroke nurse practitioner who would follow stroke survivors from the acute setting to the community. This approach should be evaluated so that the important issue of addressing caregiver needs is given its due attention.

Information literacy has become an important skill for undergraduate students due to societal changes that have seen information become a valuable commodity, the need for graduates to become lifelong learners, and the recognition that information literacy is an underpinning generic skill for effective learning in higher education. This paper describes a sequence of activities and technologies designed to help students learn and practice information literacy skills. These activities have been purposefully designed and integrated into a first-year engineering and technology study unit as a core syllabus element. A formal evaluation of aspects of these activities was planned and undertaken in semester one 2003.

To engage in the practice of photojournalism is to occupy a position of privilege, because the practice involves entering, albeit for a short while, the lives of others. But with this privilege comes the burden of representation. In this sense I believe that photojournalism is currently in crisis. This crisis concerns the decontextualization of the image in media outlets and the relegation of the photojournalist to the role of merely a hunter/gatherer rather than a storyteller. In other words, photojournalists have become alienated from the process of re-presentation of their own stories. To some extent it has always been thus.

The genetic composition of greenlip abalone (Haliotis laevigata) from Point Cook in Port Phillip Bay was examined prior to the aggregation of individuals from this site for ranching. The very thinly distributed natural population at Point Cook was believed to be of low genetic diversity, because the animals all originated from a single spawning event 5 y previously. Animals from Point Cook were compared with other H. laevigata from two sampling sites within Port Phillip Bay, and two sites outside the Bay in Bass Strait, to examine their genetic diversity and origin. Variation was assessed at five microsatellite loci. Deviations from Hardy-Weinberg equilibrium (HWE) were observed at some loci in various populations, but the Point Cook population was in HWE at all five loci. Mean heterozygosity and number of alleles was similar in all populations. Hierarchical analysis of molecular variance indicated significant genetic variation among populations, but did not differentiate Port Phillip Bay from Bass Strait populations. Pairwise comparisons of multilocus FSTand RST indicated significant genetic differences between Point Cook and some populations, as well as between other populations, but no consistent spatial pattern of differentiation was observed. There was no significant correlation between genetic and geographic distance. The level of genetic variation observed in the Point Cook individuals was similar to that in individuals from the other four sites, and sufficient to support a ranching program. However, this variation should be monitored to maximize genetic potential, and avoid commercially undesirable effects of inbreeding. Implications of this study in relation to the management of a ranching population in Port Phillip Bay are discussed.

Using a prospective design, this study examined falls risk factors and the nature of patient falls in oncology and palliative care settings. Two hundred and twenty seven patients admitted to the oncology and palliative care units at a private hospital participated in this study. Of these, 34 patients had a fall and 193 patients did not have a fall. Twenty-four nurses who attended to patients who fell were interviewed. Findings revealed that, when compared to patients who did not fall, fallers had a significantly higher mean age; were assessed as more physically dependent using the Eastern Cooperative Oncology Group scale; were less alert and more confused; were more likely to have responded incorrectly to orientation to person, time and place; were weaker pre-fall in arm muscle strength; and were more fatigued. These factors are worthy of further exploration to determine whether they are more sensitive than the currently used falls risk factors used in oncology and palliative care settings.

In November 2005, Susan Crennan was sworn in as the 45th justice of the High Court of Australia. This follows a brief two year period as a justice of the Federal Court of Australia. In this article, the author recounts the debate leading up to the latest appointment regarding what type of justice should be appointed to the Court, and reviews Crennan's Federal Court judgments in an attempt to provide some insight on the type of High Court justice Crennan will be. What is for certain is that Crennan is enchantingly mysterious.
