A sociological view of family law in Colombia. Radicalism-1945

This paper affirms that the economic and political failure of the Radical Period provided opportunities for those who proposed Regeneration as a means of defending authority. Family law became an important tool in that process. During the period studied by this article, the equality clause remained in Colombian constitutions without any practical affect for the majority of the people. Discrimination was imposed through family law over those who had born outside of a Catholic marriage and/or had not previously legitimized their union through a Catholic ceremony. By the middle of the 20th century, the dramatic situation of the nation’s children led to efforts to change the social prejudices through legislation, that is, in the same way the prejudices had been imposed.

Une approche comparée des principes de proportionnalité et de subsidiarité dans la jurisprudence de la CJUE et du TJCA: la coordination-harmonisation des pluralismes juridiques régionaux à l’épreuve de l’internationalisation du droit de l’intégration

Face à la complexité de la comparaison entre les droits de l’Union européenne et de la Communauté andine caractérisés par une internationalisation pluraliste croissante, l’idée de coordination du pluriel appelle l’émergence de «macro-principes» pour penser l’universalité juridique, tant dans sa diversité que dans son unité, dans le cadre d’un système juridique supranational. Sur ce point, un constat liminaire s’impose: on ne peut aujourd’hui définir les frontières d’un droit communautaire internationalisé car elles sont floues et ouvertes. Il convient dès lors de prendre comme point de départ une étude du noyau de cette internationalisation qui passe par une comparaison de principes à vocation universelle («macro principes»). En ce sens, la proportionnalité et la subsidiarité peuvent faire l’objet d’une analyse à travers une étude comparée de la jurisprudence de la CJUE et du TJCA. Le premier principe peut ainsi être vu comme un moyen de coordination de droits communautaire tandis que le second se révèle être un outil de coordination de compétences communautaires. 

General induction at companies - between an administrative process and a sociological phenomenon

From the example of the process of general induction into the organization and using certain sociological resources, shows paradox are specialists in human management: is to carefor the motivation and the welfare of workers to achieve its high performance, their fidelity and his tenure at the company; However, current mutations of the social architecture in general and of work in particular –as structure of organized action– force thinking that organizational loyalty tends to be increasingly unlikely and that, conversely, the current personnel administration processes appear made inappropriate notions and appear to contribute directly to the adversities of human beings in organizational settings.

Residential Mobility: a Sociological Concern

The aim of this paper is to present a theoretical-conceptual approach to residential mobility, in general, and residential trajectories, in particular. It seeks to understand how from the unequal distribution and appropriation of social resources —both material and symbolic— different trajectories are developed and how socio-territorial structures constrain, shape and enable interactions between families, their members and the various contexts of action towards meeting their housing needs. From sociological contributions of different traditions, we present a scheme that pays attention to articulating the relationship between structural factors, position in social structure and decisions elating to changes of residence. We conclude that mobility patterns are relational patterns that are defined in dialogue with the opportunities and limitations that are set up around the housing stock and new or vacant land, the land market dynamics and housing, the labor market, the provision of nfrastructure services and social facilities, etc.
