Analizar el fenómeno de la responsabilidad del Estado causada por los hechos del legislador ha sido un trabajo desarrollado tanto por la doctrina como por la jurisprudencia internacional a mediados del siglo xx. En Francia, por ejemplo, se presentó el primer antecedente jurisprudencial en el año de 1934. En España, su estudio empezó a gestionarse con la promulgación de la Constitución de 1978, dándose el primer fallo judicial en elaño de 1993. Para el caso colombiano, la Constitución de 1991 introdujo en su artículo 90 el fundamento constitucional de la responsabilidad patrimonial del Estado, sin que esto significase que la jurisprudencia del Consejo de Estado encontrase las bases de esta responsabilidad en diferentes disposiciones de la Constitución de 1886, tales como los artículos 2º, 16 y 30, que consagró el principio de legalidad del Estado para proteger la vida, honra y bienes de los ciudadanos, y garantizar la propiedad privada y los demás derechos adquiridos con el título de derecho. Sin embargo, los primeros fallos relacionados con este título de imputación en Colombia fueron emitidos por el máximo Tribunal de lo Contencioso Administrativo colombiano en el año de 1998 y por la Corte Constitucional a través de la Sentencia C-038 de 2006, providencia judicial que estableció algunas de las características que posee esta figura jurídica.

Law is often the source of social discriminations, but, at the same time, it can be thekey to delete these social discriminations. The authors try to give an example of thisphenomenon, by analyzing the impact of the Italian citizenship’s rules over the descendantsof the Italian citizens emigrated abroad and, especially, in South America.Indeed, according to the former Italian law, only fathers could transmit iure sanguinisthe citizenship to their children: moreover, women automatically lost theItalian citizenship if they get a foreign citizenship by concluding a marriage witha foreign husband.These rules hardly discriminate the Italian women emigrated abroad and, especially,their descendants who were prevented to get the Italian’s citizenship.These discriminatory rules were finally deleted by the Italian Constitutional Courtin the Seventies and in the Eighties: however, the effects of those rules still persisted,since the decision of the Constitutional Court could not overcome the temporal limit of the entry into force of the Constitution (01.01.1948) and, therefore, could not“cover” the discriminatory facts occurred before that date.Finally in 2009, the Italian Supreme Court, by extending the effects ratione temporisof the decisions of the Constitutional Court, “reopened the doors” of the Italiancitizenship to a huge number of Italian citizenship born from Italian women beforethe 01.01.1948.Therefore, the authors focus on the social impact of this decision for all the potentialItalian citizens living in South America and try to assess its juridical effects overthe Italian law.

A particular approach to the study of psycholinguistic processes is presented, which is based on a minimalist conception of language. A procedural model of language acquisition is sketched, which reconciles infants speech processing and the idea of innately guided learning with a minimalist view of the initial state of language acquisition in an account of the bootstrapping problem. Language acquisition is viewed as proceeding with the progressive specification of formal features of the functional categories of the lexicon. The possibility of a minimalist derivation to be incorporated in a sentence production and/or comprehension model is discussed. Possible sources of language impairment, as manifested in SLI (Specific Language Impairment) syndrome, are considered in the light of this integrative approach. Reference is made to experimental work carried out in Brazilian Portuguese, with some extension to European Portuguese and River-Plate Spanish.
