Actualmente nuestro país padece una de las expresiones más dramáticas de violencia como es el Desplazamiento Forzado, resultado del conflicto armado interno, las nuevas dinámicas del enfrentamiento y la disputa por un control territorial. Este fenómeno ha ahondado en la exclusión social: aumentando los niveles de pobreza, la informalidad laboral, la continua violación de los derechos fundamentales, la falta de garantía en los derechos prestacionales, entre otras manifestaciones.

El siguiente estudio busca contextualizar el fenómeno del desplazamiento en Colombia, entendiendo los orígenes del fenómeno en las variables claves del sistema, pasando por todos los cambios tanto de actores como de agentes que se han presentado a través de tiempo; y a partir de esto se tomará la información adecuada para aplicar las herramientas de prospectiva propuesta por Michael Godet; para así determinar los escenarios posibles del desplazamiento en Colombia, proponiendo finalmente en uno de éstos un planteamiento productivo para esta fuerza laboral. Después de entender históricamente los factores más relevantes de este sistema se realizó la aplicación de la herramienta MICMAC

The Colombian government thinks that accepting that there is an internal armed conflict in the country implies recognizing international personality o the groups in arms against the legitimate government. This article intends to demonstrate that this is not true and that, being terrorist groups, cannot be recognised as belligerents.

Este artículo examina la cuestión de los niños soldados en el Derecho Internacional. Después de haber hecho algunas observaciones preliminares sobre el enfoque del derecho internacional de los derechos humanos y del derecho humanitario sobre la protección de los derechos de los niños que se encuentren en un conflicto armado, el artículo revisa la prohibición del reclutamiento de los menores y la responsabilidad penal personal de los que los reclutan. También, será analizada la jurisprudencia sobre el reclutamiento de los niños. En la cuarta parte del artículo, se dará cuenta de la hipótesis de los menores autores de crímenes internacionales y se considerarán los enfoques de la justicia retributiva y de la justicia restaurativa

The armed conflict in Colombia, which has generated over three million internally displaced persons, has dramatic humanitarian consequences and raises serious issues regarding the protection of displaced peoples’ rights. The underlying reasons for the displacement often lie in the dynamics associated with territorial control and land seizures undertaken for strategic, military or purely economic purposes. Domestic and international legal provisions have established the victims’ right to the restitution of their homes and property as the “preferred remedy” in cases of displacement. However, policies dealing with displacement, both those of the Colombian government and of several international institutions, fail to take this sufficiently into account. A comprehensive reparation policy for victims must necessarily entail the reversion of lands, territories and goods seized in Colombia under the pretext of the internal armed conflict.

This article reviews the evidence collected by diverse national and international organizations regarding the relationship between sexual violence against women, forced displacement, and dispossession in the context of the Colombian armed conflict. To this end, it uses the concept of “sexual violence regimes” to highlight that the endspursued by sexual violence are not always exhausted by simple consummation (that is, the act of sexual violence itself), but depending on the context, can be connected with broader strategic goals of armed actors. At the same time, this document admits the difficulty of proving this relationship with respect to judicial procedures, and thus sets out the possibility of creating a rebuttable presumption, in the framework of “unconstitutional state of affairs” created by judgment T-025 of 2004, that alleviates the burden of proof of the victims, and serves as a catalyst to promote new genderbased mechanisms of reparations.

En el año 2011, después de cuatro años de cabildeo y forcejeo político, Colombia aprobó la Ley 1448, más conocida como la Ley de Víctimas. Los objetivos perseguidos por esta ley son bastante amplios, en la medida en que pretende ser una regulación comprensiva para enfrentar los efectos que el conflicto armado ha infligido en la población civil. En este sentido, la ley incluye las reformas legales que fueron consideradascomo necesarias para restablecer el estado de derecho a través de la proteccióny cumplimiento de los derechos de las víctimas. Actualmente, el gobierno, la sociedad civil y la academia se han enfocado en el análisis de los dilemas y grandes temas dela ley. Sin embargo, esta nueva regulación, con sus 208 artículos, es más amplia y compleja, razón por la cual es indispensable hacer un análisis más detenido de sus múltiples provisiones. Una de estas, que parece no haber llamado la atención y que, por lo tanto, no ha sido objeto de estudio pormenorizado es el artículo 46. A primera vista, este parece estar encaminado a reforzar la investigación y juzgamiento de las personas jurídicas relacionadas con violaciones de derechos humanos y derecho internacional humanitario en el contexto colombiano. Este texto examina específicamente los alcances reales y dilemas del artículo, y propone algunas soluciones para llenar la laguna que existe actualmente en el país en la materia.

This article offers a theoretical interpretation of the dispositions on land restitution contained in the famous “Victims’ Bill”, which was debated in the Colombian Congress during the year 2008. The bill included specific mechanisms aimed at guaranteeing the restitution of land to victims of the Colombian armed conflict. At the time, the bill was endorsed by all the main political actors in the country –notably the government and the elites that support it, on the one hand, and victims’ and human rights organizations and other opposition groups, on the other–. The fact that the restitution of land to victims of the Colombian armed conflict was being considered as a serious possibility by all political actors in the country seemed to indicate the existence of a consensus among actors whose positions are ordinarily opposed, on an issue that has traditionally led to high levels of polarization. This consensus is quite puzzling, because it seems to be at odds with the interests and/or the conceptions of justice advocated by these political actors, and because the restitution of land faces enormous difficulties both from a factual and a normative point of view, which indicates that it may not necessarily be the best alternative for dealing with the issue of land distribution in Colombia. This article offers an interpretation of said consensus, arguing that it is only an apparent consensus in which the actors are actually misrepresenting their interests and conceptions of justice, while at the same time adopting divergent strategies of implementation aimed at fulfilling their true interests. Nevertheless, the article concludes that the common adherence by all actors to the principle of restorative justice might bring about its actual realization, and thus produce an outcome that, in spite (and perhaps even because) of being unintended, might substantively contribute to solving the problem of unequal land distribution in Colombia. Even though the article focuses in some detail on the specificities of the 2008 Bill, it attempts to make a general argument about the state of the discussion on how to deal with the issue of land distribution in the country. Consequently, it may still be relevant today, especially considering that a new Bill on land restitution is currently being discussed in Congress, which includes the same restitution goals as the Victims’ Bill and many of its procedural and substantive details, and which therefore seems to reflect a similar consensus to the one analyzed in the article.

How do we justify the practice of corrective justice for losses suffered during armed conflicts? This article seeks to show the force and relevance of this question, and to argue that, in cases of massively destructive wars, social justice should gain priority over corrective justice. Starting from a liberal Rawlsian conception of the relationship between corrective and social justice, it is argued that, paradoxically, the more destructive a war is, the less normative force corrective rights have and the higher priority policies of social justice, which guarantee basic rights to all citizens, should have.

This article is an attempt to make an introduction, both empirical grounded and descriptive, of the dynamic that the collective action for peace shows in the Colombian society, with special emphasis in the geographical dimension. The article is developed in two main parts: firstly, the key characteristics of such social mobilization for peace are presented (an important and massive mobilization, which displays a varied repertoire of action forms and reaches a countrywide scale). Secondly, using the data of the Cinep’s collective action for peace database (Datapaz), the process of geographical expansion of those actions are showed. Tour periods of time are considered: the antecedents of the peace mobilization (1978-1985),the activation of the peace mobilization (1986-1992), the blossoming of the peace organizations and massive demonstrations (1993-1999), and, finally, the crisis of the massive demonstrations but a great dynamism at the local level (2000-2003). Summarizing, the article starts to elaborate which can be called a geography of peace; that is to say, it is an analysis that shows the geographical dynamic of the collective efforts for peace in the Colombian society. It aims to demonstrate that the Colombian reality is not only armed conflict, but also a growing confluence of initiatives and efforts towards finding alternatives to violence.

El propósito del presente estudio diagnóstico, es el de analizar el proceso de reconstrucción de la identidad del Pueblo Indígena Muisca de la Localidad de Bosa, en la ciudad de Bogotá D.C desde el año de 1999 hasta el 2013. Este diagnóstico tiene como punto de partida, el análisis de la pérdida del territorio ancestral por parte de esta comunidad de indígenas urbanos, debido a los proceso de expansión y de urbanización legales e ilegales que tienen lugar en el territorio. Con base en el análisis de los anteriores fenómenos, se estudian las características principales de las comunidades e individuos indígenas presentes en las ciudades, y los retos que enfrentan las instituciones oficiales en materia de desarrollar políticas de reconocimiento con base en modelos de planificación indígena.

The armed conflict in Chiapas began in 1994 after the armed uprising of the Zapatista Army of National Liberation (EZLN). Until now the Mexican government do not recognize the existence of an armed conflict there, for what they call inter-ethnic violence that happens in different municipalities in Chiapas. This study aims at demonstrating that, first, the Mexican state of Chiapas has an armed conflict since the mid-nineties, which has intensified and transformed over sixteen years. It is in this transformation that have emerged paramilitary groups seeking to destabilize the state, generating dynamics of appropriation and control of territory through different practices such as forced displacements, selective assassinations and terror spread within populations who are the targets of their attacks (mainly community support of the Zapatista Army of National Liberation). This work studied the "Peace and Justice" paramilitary group operating in different parts of the state of Chiapas, mainly in the Northern Zone. This case-study will look at the changes it has undergone Mexican democracy, which will be analyzed at two points: first, the failure of federal and Chiapas state to allow or endorse the creation of paramilitary groups and not to punish their actions; on the other, the consequences of the actions of such actors in democratic institutions, and democracy itself. Will seek to demonstrate that indeed both the permissiveness of the Mexican state and its complicity has weakened democracy in Mexico, since they are not able to manage conflict so that they do not degenerate into violence.

Globalization and liberalization of the economies have produced among others drastic effects on the human mobility, generating confusion, enhancing discrimination and a lack of respect to the rights of several migrant collectives. In this article we analyse several challenges for the study of these phenomena, based on the case of the neglected health rights of Colombian women, who have been forced to displace by the country's internal conflict, and are thus pushed to cross the border to Ecuador. The article identifies several knowledge gaps that could allow and advance a better understanding of these critical subjects. The paper - a think piece -is based upon a general review of documents and studies on the relation between migration and health. The supporting theory on the research comes from international organisations such as the WHO and IOM, NGOs, grass-roots organisations and academic research. This paper shows the need for focusing on the reality of supra states which globalization has generated, and t e urgency of securing the access to essential health preconditions to migrant populations. These issues can no longer be neglected and should be included on agendas at international level, widening the approach of programs to the displaced/immigrant population by taking into account the need to ensure the essential health preconditions (equity), prevention, and protection. Further, it is clear that women and children require a better protection with enhanced prevention and responding measures to sexual abuse, stigmatisation, violence and the respect of their rights.
