Thank you for inviting me again this year to talk with you about the condition of Iowa’s judicial branch. As your partner in government, we look forward to working with you on issues affecting the administration of justice. If I could capture the condition of our courts, indeed the condition of our state, in a few words, it would be: “We live in challenging times.” No one knows the true meaning of this phrase better than those Iowans hit by natural disasters. But my focus today is, of course, on the courts. Ensuring the delivery of equal, affordable and accessible justice is always challenging work, but it will be especially so this year and the next in light of the State’s budget problems. Given the magnitude of this challenge, it is even more imperative that we work together in the spirit of unity, candor and cooperation. And I address you today in this spirit. We are deeply concerned, as you are, about the present financial situation and its effect on individual Iowans. Naturally, we are particularly troubled about its impact on the delivery of justice to our citizens. Even in good economic times, the administration of justice is difficult to fulfill given the sheer volume and complexity of problems Iowans bring to their courthouses. Because of the effects of the nation’s economic downturn, people will need access to justice now more than ever. We already see this happening. The number of mortgage foreclosure cases in Iowa rose 14% in the past year. Debt collection cases increased 20% in the same time. An increase in these types of cases is predictable in tough economic times, but other types of problems may escalate as well. Some experts fear that a recession may also give rise to more crime, child abuse, domestic violence, and substance abuse. Naturally, for the sake of the people who may be harmed by these problems, we hope they do not occur. If they do, however, these matters will demand our immediate attention.

Much of the information in this handbook is also covered in the State’s collective bargaining agreements. Where there are differences between a collective bargaining agreement and this handbook, the collective bargaining agreement prevails for employees covered by the agreement. Where there are differences between this handbook and DAS-HRE rules and policies, DAS-HRE rules and policies prevail. Some of the employee benefit plans described in this handbook are subject to legal requirements concerning reporting and disclosure. This handbook contains highlights of those plans. For complete details about benefit plans, consult the benefit handbooks and the official plan documents. In case of any discrepancy, the official plan documents prevail. Of course, changes in laws may affect the benefit programs described in this handbook. The State of Iowa reserves the right to amend the contents of this handbook at any time without prior notice. The provisions of this handbook and other policies do not establish contractual rights or conditions of employment between the State and its employees.

This report highlights the landmark election legislation adopted in the past two years and statistical information on absentee ballots, provisional ballots, and Election Day Registration. In addition, the report outlines the responsibilities of our Business Services Division which handles hundreds of thousands of corporate filings annually. The Secretary of State’s proposals to the 83rd General Assembly for 2009 legislation are mostly technical in nature and are also set forth in this report. The presidential election on November 4, 2008, brought more voters to the polls in Iowa than ever before. Despite fears of election day problems due to new voting equipment, Election Day Registration, and challenged voter procedures, the election went very smoothly in Iowa. The Elections and Voter Registration Division of my office worked diligently to provide training materials for election administrators and fielded thousands of calls and emails from voters. The result was an efficiently-run election statewide. Though the Secretary of State’s Office, like all other state agencies, is operating under strict budgetary constraints, I assure you that my staff and I will continue to provide excellent service and develop innovative solutions to get through these rough economic times.

The Iowa Department of Education has joined the Office of the Governor to prepare a set of legislative proposals that will bring Iowa closer to its goal of providing a world-class education to all children, no mater where they live. This legislative brief serves as an overview of the legislation, which I encourage you to read and discuss in greater detail. the goals behind these policies are straightforward: Comprehensive and systematically raise and support the teaching profession while expanding efforts to customize instruction to every student's passion and talents. Iowa's children deserve the best education can provide so they leave our schools with the knowledge and skills necessary for successful and rewarding lives. Iowa has many good schools with hard-working, talented educators who deserves our respect and appreciation. While we honor the past work of generations of Iowans who built a strong foundation, it is our responsibility - and our turn - to make a focused, dedicated effort to improve Iowa's schools. We stand at a pivotal moment in Iowa storied education history, in which we have the opportunity and will as community to make the transition from being "good" to being "great".

Welcome to the initial edition of the Iowa Ag Insider, the newsletter of the Iowa Department of Agriculture and Land Stewardship. We see this newsletter as a way to keep people informed of the activities of the Department and also highlight some of the exciting things going on in Iowa agriculture in general. If you know of events or stories that should be included in future newsletters I hope that you will share them with us so they can be included in future editions. Also, if you know of people who would enjoy receiving this newsletter I hope you will pass it on as the information on how to subscribe is on the bottom of each issue. This is an exciting time of year in Iowa as farmers and everyone involved in agriculture gets ready to kickoff the growing season. We wish everyone a successful and safe 2013 as we get to the business of growing the crops that help power Iowa’s economy and feed the people of our state and trading partners around the world. Iowa is fortunate to have such a dynamic agriculture industry and each of you play a role in helping make Iowa agriculture so successful.

What are a supervisor’s responsibilities when it comes to interviewing, hiring, and retaining persons with disabilities? First and foremost, do not discriminate against persons with disabilities. What this means is that you are required to provide the same level of employment consideration and supervision for a disabled employee that you would for an able-bodied employee. No more – no less. State of Iowa management personnel must be proactive with regard to Title I of the Americans with Disabilities Act, and managers and supervisory personnel should have an operational knowledge of the significant aspects of The Americans with Disabilities Act. This manual is for Iowa management personnel to use.
