Individuals with disabilities have civil rights protection similar to that provided to individuals on the basis of race, sex, national origin, and religion. The advent of the Americans with Disabilities Act has improved these protections and brought this issue into the forefront. This book is not intended to be a legal translation of state or federal laws. Its purpose is to assist people with disabilities in understanding their rights. Please consult the Code of Iowa, the appropriate federal laws or an attorney if you need a legal interpretation.

Human trafficking has become a topic receiving much interest both in Iowa and nationally. However, estimates of human trafficking incidents and victims are difficult to derive given the underground nature of the offense. The purpose of this analysis is to gather data on human trafficking incidents in the state of Iowa.

Resident rights are guaranteed by the federal Nursing Home Reform Law of 1987, which requires nursing facilities to promote and protect the rights of each resident and places a strong emphasis on individual dignity and self-determination. Residents’ rights include, but are not limited to: • Being treated with respect and dignity • Being free from abuse and chemical and physical restraints • Participating in one’s own care and treatment • Being ensured information is being kept confidential • Managing one’s own finances • Being free to voice grievances, without fear of retaliation • Being able to associate and communicate privately with any person • Being able to send and receive personal mail • Making independent choices • Being able to apply for state and federal assistance without discrimination • Being informed of rights, services available and all charges prior to admission • Being given advance notice of a transfer or discharge

Resident rights are guaranteed by the Federal 1987 Nursing Home Reform Law and Iowa Code. It requires long-term care facilities to promote and protect the rights of residents and places a strong emphasis on individual dignity and self-determination. Staff shall provide privacy and maintain dignity and respect. Residents shall be free from abuse and restraints. Residents may participate in planning of care and medical treatment.
