The danger of neck compression without restriction of the arterial flow remains unresolved in forensic medicine. There is an ongoing debate concerning life endangerment due to the cardioinhibitory reflex. The aim of this study was to determine what forensic medical experts believe and how they deal with this reflex. An anonymous electronic questionnaire was sent to 1429 forensic medical experts all over the world. We asked them about their opinion on the cardioinhibitory reflex, its role in causing death, and what their diagnostic criteria were.A total of 182 questionnaires were returned. The experts who answered were from 32 different countries. Our survey showed that 80.2% of experts believe that the cardioinhibitory reflex can theoretically cause death. In the practical application opinions diverge though. Apparently, the practical application mainly depends on the habit of the individual expert. We observed no consensus on the diagnostic criteria to be used. Given the potentially frequent use of the concept of the cardioinhibitory reflex in forensic practice and its judicial impact it would be important to reach a consensus.

Background: Although smokers tend to have a lower body-mass index (BMI) than non-smokers, smoking may affect body fat (BF) distribution. Some studies have assessed the association between smoking, BMI and waist circumference (WC), but, to our knowledge, no population-based studies assessed the relation between smoking and BF composition. We assessed the association between amount of cigarette smoking, BMI, WC and BF composition. Method: Data was analysed from a cross-sectional population-based study including 6'187 Caucasians aged 32-76 and living in Switzerland. Height, weight and WC were measured. BF, expressed in percent of total body weight, was measured by electrical bioimpedance. Abdominal obesity was defined as a WC 0102 cm for men and 088 cm for women and normal WC as <94 cm for men and <80 cm for women. In men, excess BF was defined as %BF 028.1, 28.7, 30.6 and 32.6 for age groups 32-44, 45-54, 55-64 and 65-76, respectively; the corresponding values for women were 35.9, 36.5, 40.5 and 44.4. Cigarette smoking was assessed using a self-reported questionnaire. Results: 29.3% of men and 25.0% of women were smokers. Prevalence of obesity, abdominal obesity, and excess of BF was 16.9% and 26.6% and 14.2% in men and 15.0%, 33.0% and 27.5% in women, respectively. Smokers had lower age-adjusted mean WC and percent of BF compared to non-smokers. However, among smokers, mean age-adjusted WC and BF increased with the number of cigarettes smoked per day: among light (1-10 cig/day), moderate (11-20) and heavy smokers (>20), mean ± SE %BF was 22.4 ± 0.3, 23.1 ± 0.3 and 23.5 ± 0.4 for men, and 31.9 ± 0.3, 32.6 ± 0.3 and 32.9 ± 0.4 for women, respectively. Mean WC was 92.9 ± 0.6, 94.0 ± 0.5 and 96.0 ± 0.6 cm for men, and 80.2 ± 0.5, 81.3 ± 0.5 and 83.3 ± 0.7 for women, respectively. Compared with light smokers, the age-adjusted odds ratio (95% Confidence Interval) for excess of BF was 1.04 (0.58 to 1.85) for moderate smokers and 1.06 (0.57 to 1.99) for heavy smokers in men (p-trend = 0.9), and 1.35 (0.92 to 1.99) and 2.26 (1.38 to 3.72), respectively, in women (p-trend = 0.04). Odds ratio for abdominal obesity vs. normal WC was 1.32 (0.81 to 2.15) for moderate smokers and 1.95 (1.16 to 3.27) for heavy smokers in men (p-trend <0.01), and 1.15 (0.79 to 1.69) and 2.36 (1.41 to 3.93) in women (p-trend = 0.03). Conclusion: WC and BF were positively and dose-dependently associated with the number of cigarettes smoked per day in women, whereas only WC was dose dependently and significantly associated with the amount of cigarettes smoked per day in men. This suggests that heavy smokers, especially women, are more likely to have an excess of BF and to accumulate BF in the abdomen compared to lighter smokers.

Background: The metabolic syndrome (MS) represents a cluster of metabolic disorders that predicts diabetes and cardiovascular disease. Several definitions exist and further descriptive and prospective data are needed to compare these definitions and their significance in different populations. Objective: We examined, in a country of the African region, i) the prevalence of MS according to three major definitions (ATP, IDF, WHO); ii) the contribution of individual MS components; and iii) the agreement between the three considered definitions. We also examined the prevalence among diabetics and non-diabetics. Methods: We conducted an examination survey in a sample representative of the general population aged 25-64 of the Seychelles (Indian Ocean, African region), attended by 1255 persons (participation rate of 80.2%). Results: The prevalence of MS was similar with either definition of MS in men (24%--25%) but differed in women (WHO: 25%, ATP: 32%; IDF: 35%). Upon exclusion of diabetic persons, the prevalence was 5-10% lower for all three MS definitions: most diabetic persons had MS although a substantial proportion of diabetic men aged 45--64 did not have MS. The following components were found most often among persons with MS: 90% had high blood pressure (HBP) and 78% had obesity (ATP); 95% had obesity and 84% had HBP (WHO), and 89% had HBP and 75% had impaired glucose regulation (IDF) - not considering impaired glucose regulation and obesity that are compulsory components of the WHO and IDF definitions, respectively. Among persons with MS based on either of the three definitions (37% of total population), less than 80% met both ATP and IDF criteria, 67% both WHO and IDF criteria, 54% both WHO and ATP criteria and only 37% met all three definitions. Conclusion: We found a fairly high prevalence of MS in an African population. However, because there was only poor agreement between the 3 MS definitions, the fairly similar proportions of MS based on ATP, IDF or WHO definitions identified, to a substantial extent, different subjects as having MS.

A gradual increase in Earth's surface temperatures marking the transition from the late Paleocene to early Eocene (55.8±0.2Ma), represents an extraordinary warming event known as Paleocene-Eocene Thermal Maximum (PETM). Both marine and continental sedimentary records during this period reveal evidences for the massive injection of isotopically light carbon. The carbon dioxide injection from multiple potential sources may have triggered the global warming. The importance of the PETM studies is due to the fact that the PETM bears some striking resemblances to the human-caused climate change unfolding today. Most notably, the culprit behind it was a massive injection of heat-trapping greenhouse gases into the atmosphere and oceans, comparable in volume to what our persistent burning of fossil fuels could deliver in coming centuries. The exact knowledge of what went on during the PETM could help us to foresee the future climate change. The response of the oceanic and continental environments to the PETM is different. Many factors might control the response of the environments to the PETM such as paleogeography, paleotopography, paleoenvironment, and paleodepth. To better understand the mechanisms triggering PETM events, two different environments were studied: 1) shallow marine to inner shelf environment (Wadi Nukhul, Sinai; and the Dababiya GSSP, Luxor, Egypt), and 2) terrestrial environments (northwestern India lignite mines) representing wetland, and fluvial environments (Esplugafreda, Spain) both highlighting the climatic changes observed in continental conditions. In the marine realm, the PETM is characterized by negative ö13Ccar and ô13Corg excursions and shifts in Ô15N to ~0%o values above the P/E boundary and persisting along the interval suggesting a bloom and high production of atmospheric N2-fixers. Decrease in carbonate contents could be due to dissolution and/or dilution by increasing detrital input. High Ti, K and Zr and decreased Si contents at the P/E boundary indicate high weathering index (CIA), which coincides with significant kaolinite input and suggests intense chemical weathering under humid conditions at the beginning of the PETM. Two anoxic intervals are observed along the PETM. The lower one may be linked to methane released from the continental shelf with no change in the redox proxies, where the upper anoxic to euxinic conditions are revealed by increasing U, Mo, V, Fe and the presence of small size pyrite framboids (2-5fim). Productivity sensitive elements (Cu, Ni, and Cd) show their maximum concentrated within the upper anoxic interval suggesting high productivity in surface water. The obtained data highlight that intense weathering and subsequent nutrient inputs are crucial parameters in the chain of the PETM events, triggering productivity during the recovery phase. In the terrestrial environments, the establishment of wetland conditions and consequence continental climatic shift towards more humid conditions led to migration of modern mammals northward following the extension of the tropical belts. Relative ages of this mammal event based on bio-chemo- and paleomagnetic stratigraphy support a migration path originating from Asia into Europe and North America, followed by later migration from Asia into India and suggests a barrier to migration that is likely linked to the timing of the India-Asia collision. In contrast, at Esplugafereda, northeastern Spain, the terrestrial environment reacted differently. Two significant S13C shifts with the lower one linked to the PETM and the upper corresponding to the Early Eocene Thermal Maximum (ETM2); 180/160 paleothermometry performed on two different soil carbonate nodule reveal a temperature increase of around 8°C during the PETM. The prominent increase in kaolinite content within the PETM is linked to increased runoff and/or weathering of adjacent and coeval soils. These results demonstrate that the PETM coincides globally with extreme climatic fluctuations and that terrestrial environments are very likely to record such climatic changes. - La transition Paléocène-Eocène (55,8±0,2 Ma) est marquée par un réchauffement extraordinaire communément appelé « Paleocene-Eocene Thermal Maximum » (PETM). Les données géochimiques caractérisant les sédiments marins et continentaux de cette période indiquent que ce réchauffement a été déclenché par une augmentation massive de CO2 lié à la déstabilisation des hydrates de méthane stockés le long des marges océaniques. L'étude des événements PETM constitue donc un bon analogue avec le réchauffement actuel. Le volume de CO2 émis durant le PETM est comparable avec le CO2 lié à l'activité actuelle humaine. La compréhension des causes du réchauffement du PETM peut être cruciale pour prévoir et évaluer les conséquences du réchauffement anthropogénique, en particulier les répercussions d'un tel réchauffement sur les domaines continentaux et océaniques. De nombreux facteurs entrent en ligne de compte dans le cas du PETM, tels que la paléogéographie, la paléotopographie et les paléoenvironnement. Pour mieux comprendre les réponses environnementales aux événements du PETM, 2 types d'environnements ont été choisis : (1) le domaine marin ouvert mais relativement peu profond (Wadi Nukhul. Sinai, Dababiya, Luxor, Egypte), (2) le milieu continental marécageux humide (mines de lignite, Inde) et fluviatile, semi-aride (Esplugafreda, Pyrénées espagnoles). Dans le domaine marin, le PETM est caractérisé par des excursions négatives du ô13Ccar et ô13Corg et un shift persistant des valeurs de 815N à ~ 0 %o indiquant une forte activité des organismes (bactéries) fixant l'azote. La diminution des carbonates observée durant le PETM peut-être due à des phénomènes de dissolution ou une augmentation des apports terrigènes. Des taux élevés en Ti, K et Zr et une diminution des montants de Si, reflétés par des valeurs des indices d'altération (CIA) qui coïncident avec une augmentation significative des apports de kaolinite impliquent une altération chimique accrue, du fait de conditions plus humides au début du PETM. Deux événements anoxiques globaux ont été mis en évidence durant le PETM. Le premier, situé dans la partie inférieur du PETM, serait lié à la libération des hydrates de méthane stockés le long des talus continentaux et ne correspond pas à des variations significatives des éléments sensibles aux changements de conditions redox. Le second est caractérisé par une augmentation des éléments U, Mo, V et Fe et la présence de petit framboids de pyrite dont la taille varie entre 2 et 5pm. Le second épisode anoxique est caractérisé par une forte augmentation des éléments sensibles aux changements de la productivité (Cu, Ni et Co), indiquant une augmentation de la productivité dans les eaux de surface. Les données obtenues mettent en évidence le rôle crucial joué par l'altération et les apports en nutriments qui en découlent. Ces paramètres sont cruciaux pour la succession des événements qui ont conduit au PETM, et plus particulièrement l'augmentation de la productivité dans la phase de récupération. Durant le PETM, le milieu continental est caractérisé par l'établissement de conditions humides qui ont facilité voir provoqué la migration des mammifères modernes qui ont suivi le déplacement de ces ceintures climatiques. L'âge de cette migration est basé sur des arguments chimiostratigraphiques (isotopes stables), biostratigraphiques et paléomagnétiques. Les données bibliographiques ainsi que celles que nous avons récoltées en Inde, montrent que les mammifères modernes ont d'abord migré depuis l'Asie vers l'Europe, puis dans le continent Nord américain. Ces derniers ne sont arrivés en Inde que plus tardivement, suggérant que le temps de leur migration est lié à la collision Inde-Asie. Dans le Nord-Est de l'Espagne (Esplugafreda), la réponse du milieu continental aux événements PETM est assez différente. Comme en Inde, deux excursions signicatives en ô13C ont été observées. La première correspond au PETM et la seconde est corrélée avec l'optimum thermique de l'Eocène précoce (ETM2). Les isotopes stables de l'oxygène mesurés 2 différents types de nodules calcaires provenant de paléosols suggère une augmentation de 10°C pendant le PETM. Une augmentation simultanée des taux de kaolinite indique une intensification de l'altération chimique et/ou de l'érosion de sols adjacents. Ces résultats démontrent que le PETM coïncide globalement avec des variations climatiques extrêmes qui sont très aisément reconnaissables dans les dépôts continentaux.

RATIONALE AND OBJECTIVES: Dose reduction may compromise patients because of a decrease of image quality. Therefore, the amount of dose savings in new dose-reduction techniques needs to be thoroughly assessed. To avoid repeated studies in one patient, chest computed tomography (CT) scans with different dose levels were performed in corpses comparing model-based iterative reconstruction (MBIR) as a tool to enhance image quality with current standard full-dose imaging. MATERIALS AND METHODS: Twenty-five human cadavers were scanned (CT HD750) after contrast medium injection at different, decreasing dose levels D0-D5 and respectively reconstructed with MBIR. The data at full-dose level, D0, have been additionally reconstructed with standard adaptive statistical iterative reconstruction (ASIR), which represented the full-dose baseline reference (FDBR). Two radiologists independently compared image quality (IQ) in 3-mm multiplanar reformations for soft-tissue evaluation of D0-D5 to FDBR (-2, diagnostically inferior; -1, inferior; 0, equal; +1, superior; and +2, diagnostically superior). For statistical analysis, the intraclass correlation coefficient (ICC) and the Wilcoxon test were used. RESULTS: Mean CT dose index values (mGy) were as follows: D0/FDBR = 10.1 ± 1.7, D1 = 6.2 ± 2.8, D2 = 5.7 ± 2.7, D3 = 3.5 ± 1.9, D4 = 1.8 ± 1.0, and D5 = 0.9 ± 0.5. Mean IQ ratings were as follows: D0 = +1.8 ± 0.2, D1 = +1.5 ± 0.3, D2 = +1.1 ± 0.3, D3 = +0.7 ± 0.5, D4 = +0.1 ± 0.5, and D5 = -1.2 ± 0.5. All values demonstrated a significant difference to baseline (P < .05), except mean IQ for D4 (P = .61). ICC was 0.91. CONCLUSIONS: Compared to ASIR, MBIR allowed for a significant dose reduction of 82% without impairment of IQ. This resulted in a calculated mean effective dose below 1 mSv.

L'embolie gazeuse représente une pathologie rare, potentiellement létale, rencontrée le plus souvent comme complication iatrogène d'un geste invasif chirurgical ou médical (insertion de voie veineuse centrale), mais également dans d'autres situations (accidents de plongée, traumatismes, ventilation non invasive) ou même intentionnelle suicidaire. Nous rapportons le cas d'une patiente de 31 ans connue pour des troubles de la personnalité, avec de multiples antécédents de tentamens médicamenteux, par ingestion de débris de verre ou de solution désinfectante pour les mains (Sterilium®), ayant nécessité plus d'une centaine d'hospitalisations dans le milieu psychiatrique. Cette patiente est admise aux urgences pour un nouvel abus médicamenteux par 20 comprimés de Détensor® (chlorhydrate de diphénhydramine et 8-chlor-théophylline), médicament sédatif et hypnotique en vente libre. Environ 16 heures après l'admission, la patiente s'injecte par le cathéter veineux du pli du coude gauche une quantité inconnue d'air à l'aide d'une seringue de 10 ml dérobée dans le service. L'examen clinique révèle une patiente normotendue, normocarde, avec une saturation de 95% à l'air ambiant et un status sans particularité. La gazométrie montre une insuffisance respiratoire partielle avec légère hypoxémie (pression artérielle d'oxygène (PaO2) à 73,1 mm Hg; borne inférieure prédite pour l'âge à 80,2 mm Hg). L'électrocardiogramme est sans particularité et la radiographie du thorax ne montre pas d'anomalie décelable, en l'occurrence pas d'air dans les troncs pulmonaires. La patiente est mise immédiatement sous oxygénothérapie à haute concentration de 100% et gardée en position couchée et monitorée. L'adhérence au traitement est limitée, de seulement 20 minutes. Nous n'avons pas recours à la manoeuvre de Durant (décubitus latéral gauche). La voie veineuse périphérique est rapidement enlevée. L'évolution est favorable, la gazométrie se normalisant après 4 heures (PaO2 à 94 mm Hg à l'air ambiant). La patiente est transférée en milieu psychiatrique pour suite de prise en charge de sa pathologie psychiatrique. Conclusions: Ce cas clinique illustre une pathologie rare, un tentamen par embolie gazeuse dans un contexte hospitalier et nous a déterminé à revoir la littérature sur l'épidémiologie, la présentation clinique, l'évolution, les tests diagnostiques, les complications, le traitement et le pronostic de l'embolie gazeuse qu'elle soit iatrogène, accidentelle ou auto-infligée.

Objective: We assessed the 15-year trends in the distribution of body mass index (BMI) categories in the Seychelles (Indian Ocean, African Region) and the relationship with sex, age and socio-economic status (SES). Methods: We conducted three population-based examination surveys in 1989 (n=1,081; participation rate: 86.4%), in 1994 (n=1,067; 87.0%), and in 2004 (n=1,255; 80.2%). Occupation was categorized as "laborer", "intermediate" or "professional". Results are adjusted to the population of 2002. Results: Between 1989 and 2004, mean BMI increased markedly in all sex and age categories (overall: ∼0.15 kg/m2/calendar year). The prevalence of overweight and obesity combined ("excess weight", BMI ≥25 kg/m2) increased from 29% to 52% in men and from 50% to 67% in women. The prevalence of obesity (BMI ≥30 kg/m2) increased from 4% to 15% in men and from 23% to 34% in women. Mean BMI - respectively the prevalence of excess weight- was lower in laborers than professionals in men but higher in laborers that professionals in women and this pattern was similar in the three surveys. Odds ratios for excess weight in professionals vs. laborers were 2.10 (95% CI: 1.94-2.17) in men and 0.51 (0.48-0.53) in women, adjusting for calendar year and participants' age and smoking habits. Conclusion: The prevalence of overweight/obesity increased markedly during a 15- year period. Similar increase of BMI over time in all age and sex categories suggests common environment obesogenic factors. The association between SES and excess weight was in opposite directions in men and women. The study emphasizes the need for prevention measures in all sex, age and SES groups, and suggests that they should be tailored according to sex and SES categories.

Introduction générale : D'après une étude réalisée en Suisse en 2004, les entreprises de famille représentent 88,14% des entreprises, dont 80,2% sont constitués en sociétés anonymes. Les chiffres parlent d'eux-mêmes : les sociétés anonymes de famille occupent une place considérable dans le paysage des entreprises suisses. Les sociétés anonymes de famille correspondent donc à une réalité pratique. Juridiquement, la notion de société de famille n'apparaît pas dans le Code des obligations ; les sociétés anonymes de famille revêtent la forme juridique de la société anonyme, qui représente l'entreprise commerciale la plus courante en pratique. Le Code des obligations, à ses art. 620 ss, se limite à donner un cadre général de réglementation, ce qui a notamment pour conséquence que la forme juridique de la société anonyme s'adapte à des entités très variées, dans toutes sortes de secteurs d'activité, que ce soient des petites et moyennes entreprises ou de grandes multinationales, des sociétés capitalistes et impersonnelles ou des sociétés purement privées. Selon la conception générale de la forme juridique de la société anonyme, celle-ci revêt en principe un caractère capitaliste. L'intérêt de l'actionnaire pour la société anonyme est normalement de nature financière. Le fait que la qualité d'actionnaire soit matérialisée dans un titre, l'action, implique tant une certaine liquidité de l'actionnariat qu'une dépersonnalisation des rapports entre les membres qui composent la société anonyme. A l'opposé, la famille repose sur des liens personnels particuliers, étroits, avec notamment des dimensions psychologiques, affectives, émotives. Au premier abord, société anonyme et famille semblent donc antinomiques. Cette dichotomie présente un intérêt dogmatique. Elle correspond en outre à l'un des principaux enjeux : comment tenir compte des intérêts d'une entité fortement personnalisée - la famille - dans une structure impersonnelle et de type capitaliste - la société anonyme ? Le fait que le Code des obligations se limite à donner un cadre général de réglementation prend alors ici toute son importance ; la marge de manoeuvre et la liberté d'aménagement que le législateur accorde aux sociétés anonymes r vont permettre - ou alors empêcher - d'adapter la forme juridique de la société anonyme aux besoins d'une entité personnalisée comme la famille. Cette liberté n'est donc pas sans limites et les membres de la famille devront peut-être aussi assumer les conséquences du choix de cette forme de société. Partant, le but de notre travail est d'étudier les raisons d'être, l'organisation et la pérennité des sociétés anonymes de famille, spécifiquement sous l'angle du maintien du caractère familial de la société. Nous nous concentrerons sur la détention du capital, mais aussi sur sa structure, son maintien et son optimisation ; nous aborderons ainsi notamment les questions relatives à la transmissibilité des actions. Au regard de l'ampleur du sujet, nous avons dû procéder à certains choix, parfois arbitraires, notamment en raison des implications presque infinies des règles avec d'autres domaines. Nous nous limiterons ainsi, dans la première partie, à exposer les notions de base employées dans la suite de notre travail et nous focaliserons sur l'élaboration des définitions d'entreprise, société et société anonyme de famille, prémisses non seulement essentielles sous l'angle théorique, mais aussi fondamentales pour nos développements ultérieurs. S'agissant ensuite de l'analyse des possibilités d'aménagement d'une société anonyme dans le cadre du maintien du caractère familial de la société, nous nous concentrerons sur les règles relatives à la société anonyme et étudierons les limites qu'elles imposent et la liberté qu'elles offrent aux actionnaires familiaux. Nous laisserons en revanche de côté les problématiques particulières de la protection des actionnaires minoritaires et des organes. Enfin, si nous traitons toutes les notions théoriques nécessaires à la compréhension de chaque thématique présentée, seules celles primordiales et déterminantes sous l'angle de la conservation de l'hégémonie familiale seront approfondies. Nous avons structuré notre étude en quatre titres. Dans un premier titre, nous développerons les notions et principes élémentaires de notre sujet. Nous rappellerons ainsi la définition et les particularités de la société anonyme en général, y compris les sources et les modifications législatives, et les conditions de la cotation en bourse. Au stade des notions introductives, nous devrons également définir la société anonyme de famille, en particulier en établissant les éléments de la définition. Qu'entend-on par famille ? Quels critères permettent de qualifier une société anonyme de « société anonyme de famille » ? La définition de la société anonyme de famille devra être à la fois suffisamment précise, afin que cette notion puisse être appréhendée de manière adéquate pour la suite de notre travail, et suffisamment large, pour qu'elle englobe toute la variété des sociétés anonymes de famille. Nous présenterons aussi les raisons du choix de la forme juridique de la société anonyme pour une société de famille. Nous terminerons nos développements introductifs par un exposé relatif à la notion d'action et à son transfert en sa qualité de papier-valeur, préalables nécessaires à nos développements sur la transmissibilité des actions. Nous mettrons ainsi en évidence les conditions de transfert des actions, en tenant compte de la tendance à la dématérialisation des titres. Une fois ces éléments mis en place, qui nous donneront une première idée de la structure du capital d'une société anonyme de famille, nous devrons préciser la manière dont le capital doit être structuré. Nous chercherons comment il peut être maintenu en mains de la famille et si d'autres moyens n'ayant pas directement trait au capital peuvent être mis en oeuvre. Ainsi, dans un deuxième titre, nous analyserons les dispositions statutaires relatives à la structure du capital et à son maintien en mains familiales, en particulier les restrictions au transfert des actions nominatives. Les dispositions statutaires constituent-elles un moyen adéquat pour maintenir le caractère familial de la société ? Quelles sont les conditions pour limiter le transfert des actions ? Le caractère familial de la société peut-il être utilisé afin de restreindre le transfert des actions ? Les solutions sont-elles différentes si les actions sont, en tout ou en partie, cotées en bourse ? Nous traiterons aussi, dans ce même titre, les modalités du droit de vote et déterminerons si des dispositions statutaires peuvent être aménagées afin de donner plus de voix aux actions des membres de la famille et ainsi d'optimiser la détention du capital. Nous examinerons, dans notre troisième titre, un acte qui a trait à la fois au droit des contrats et au droit de la société anonyme, la convention d'actionnaires. En quoi consistent ces contrats ? Quels engagements les actionnaires familiaux peuvent-ils et doivent-ils prendre ? Quelle est l'utilité de ces contrats dans les sociétés anonymes de famille ? Quelles en sont les limites ? Les clauses conventionnelles peuvent-elles être intégrées dans les statuts ? Comment combiner les différentes clauses de la convention entre elles ? Dans ce même titre, nous étudierons également la concrétisation et la mise en application des dispositions statutaires et des clauses conventionnelles, afin de déterminer si, combinées, elles constituent des moyens adéquats pour assurer la structure, le maintien et l'optimisation de la détention du capital. Enfin, dans le quatrième et dernier titre, qui est davantage conçu comme un excursus, nous nous éloignerons du domaine strict du droit des sociétés (et des contrats) pour envisager certains aspects matrimoniaux et d'ordre successoral. En effet, puisque la famille est à la base de la société, il convient de relever l'importance des règles matrimoniales et successorales pour les sociétés anonymes de famille et leur incidence sur la détention des actions et le maintien du caractère familial de la société. Nous examinerons en particulier comment ces instruments doivent être utilisés pour qu'ils n'annihilent pas les efforts entrepris pour conserver la société en mains familiales. Notre travail a pour but et pour innovation de présenter une analyse transversale aussi complète que possible du droit de la société anonyme et des instruments connexes en étudiant les moyens à disposition des actionnaires d'une société anonyme de type personnel, la société anonyme de famille. Il tentera ainsi d'apporter une approche théorique nouvelle de ces questions, de présenter certains aspects de manière pragmatique, d'analyser la mise en oeuvre des différents moyens étudiés et de discuter leur opportunité.

BACKGROUND: We assessed the prevalence of risk factors for cardiovascular disease (CVD) in a middle-income country in rapid epidemiological transition and estimated direct costs for treating all individuals at increased cardiovascular risk, i.e. following the so-called "high risk strategy". METHODS: Survey of risk factors using an age- and sex-stratified random sample of the population of Seychelles aged 25-64 in 2004. Assessment of CVD risk and treatment modalities were in line with international guidelines. Costs are expressed as USD per capita per year. RESULTS: 1255 persons took part in the survey (participation rate of 80.2%). Prevalence of main risk factors was: 39.6% for high blood pressure (> or =140/90 mmHg or treatment) of which 59% were under treatment; 24.2% for high cholesterol (> or =6.2 mmol/l); 20.8% for low HDL-cholesterol (<1.0 mmol/l); 9.3% for diabetes (fasting glucose > or =7.0 mmol/l); 17.5% for smoking; 25.1% for obesity (body mass index > or =30 kg/m2) and 22.1% for the metabolic syndrome. Overall, 43% had HBP, high cholesterol or diabetes and substantially increased CVD risk. The cost for medications needed to treat all high-risk individuals amounted to USD 45.6, i.e. 11.2 dollars for high blood pressure, 3.8 dollars for diabetes, and 30.6 dollars for dyslipidemia (using generic drugs except for hypercholesterolemia). Cost for minimal follow-up medical care and laboratory tests amounted to 22.6 dollars. CONCLUSION: High prevalence of major risk factors was found in a rapidly developing country and costs for treatment needed to reduce risk factors in all high-risk individuals exceeded resources generally available in low or middle income countries. Our findings emphasize the need for affordable cost-effective treatment strategies and the critical importance of population strategies aimed at reducing risk factors in the entire population.

A nationwide survey was conducted in Switzerland to assess the quality level of osteoporosis management in patients aged 50 years or older presenting with a fragility fracture to the emergency ward of the participating hospitals. Eight centres recruited 4966 consecutive patients who presented with one or more fractures between 2004 and 2006. Of these, 3667 (2797 women, 73.8 years old and 870 men, 73.0 years old in average) were considered as having a fragility fracture and included in the survey. Included patients presented with a fracture of the upper limbs (30.7%), lower limbs (26.4%), axial skeleton (19.5%) or another localisation, including malleolar fractures (23.4%). Thirty-two percent reported one or more previous fractures during adulthood. Of the 2941 (80.2%) hospitalised women and men, only half returned home after discharge. During diagnostic workup, dual x-ray absorptiometry (DXA) measurement was performed in 31.4% of the patients only. Of those 46.0% had a T-score < or =-2.5 SD and 81.1% < or =-1.0 SD. Osteoporosis treatment rate increased from 26.3% before fracture to 46.9% after fracture in women and from 13.0% to 30.3% in men. However, only 24.0% of the women and 13.8% of the men were finally adequately treated with a bone active substance, generally an oral bisphosphonate, with or without calcium / vitamin D supplements. A positive history of previous fracture vs none increased the likelihood of getting treatment with a bone active substance (36.6 vs 17.9%, ? 18.7%, 95% CI 15.1 to 22.3, and 22.6 vs 9.9%, ? 12.7%, CI 7.3 to 18.5, in women and men, respectively). In Switzerland, osteoporosis remains underdiagnosed and undertreated in patients aged 50 years and older presenting with a fragility fracture.

Despite clear evidence of correlations between financial and medical statuses and decisions, most models treat financial and health-related choices separately. This article bridges this gap by proposing a tractable dynamic framework for the joint determination of optimal consumption, portfolio holdings, health investment, and health insurance. We solve for the optimal rules in closed form and capitalize on this tractability to gain a better understanding of the conditions under which separation between financial and health-related decisions is sensible, and of the pathways through which wealth and health determine allocations, welfare and other variables of interest such as expected longevity or the value of health. Furthermore we show that the model is consistent with the observed patterns of individual allocations and provide realistic estimates of the parameters that confirm the relevance of all the main characteristics of the model.

Background and objective: Patients in the ICU often get many intravenous (iv) drugs at the same time. Even with three-lumen central venous catheters, the administration of more than one drug in the same iv line (IVL) is frequently necessary. The objective of this study was to observe how nurses managed to administer these many medications and to evaluate the proportion of two-drugs associations (TDA) that are compatible or not, based on known compatibility data. Design: Observational prospective study over 4 consecutive months. All patients receiving simultaneously more than one drugs in the same IVL (Y-site injection or mixed in the same container) were included. For each patient, all iv drugs were recorded, as well as concentration, infusion solution, location on the IVL system, time, rate and duration of administration. For each association of two or more drugs, compatibility of each drug was checked with each other. Compatibilities between these pairs of drugs were assessed using published data (mainly Trissel LA. Handbook on Injectable Drugs and Trissel's Tables of Physical Compatibility) and visual tests performed in our quality control laboratory. Setting: 34 beds university hospital adult ICU. Main outcome measures: Percentage of compatibilities and incompatibilities between drugs administered in the same IVL. Results: We observed 1,913 associations of drugs administered together in the same IVL, 783 implying only two drugs. The average number of drugs per IVL was 3.1 ± 0.8 (range: 2-9). 83.2% of the drugs were given by continuous infusion, 14.3% by intermittent infusion and 2.5% in bolus. The associations observed allowed to form 8,421 pairs of drugs (71.7% drug-drug and 28.3% drug-solute). According to literature data, 80.2% of the association were considered as compatible and 4.4% incompatible. 15.4% were not interpretable because of different conditions between local practices and those described in the literature (drug concentration, solute, etc.) or because of a lack of data. After laboratory tests performed on the most used drugs (furosemide, KH2PO4, morphine HCl, etc.), the proportion of compatible TDA raised to 85.7%, the incompatible stayed at 4.6% and only 9.7% remain unknown or not interpretable. Conclusions: Nurses managed the administration of iv medications quite well, as only less than 5% of observed TDA were considered as incompatible. But the 10% of TDA with unavailable compatibility data should have been avoided too, since the consequences of their concomitant administration cannot be predictable. For practical reasons, drugs were analysed only by pairs, which constitutes the main limit of this work. The average number of drugs in the same association being three, laboratory tests are currently performed to evaluate some of the most observed three-drugs associations.

BACKGROUND: Although smokers tend to have a lower body-mass index (BMI) than non-smokers, smoking may affect body fat (BF) distribution. Some studies have assessed the association between smoking, BMI and waist circumference (WC), but, to our knowledge, no population-based studies assessed the relation between smoking and BF composition. We assessed the association between amount of cigarette smoking, BMI, WC and BF composition. METHODS: Data was analysed from a cross-sectional population-based study including 6187 Caucasians aged 32-76 and living in Switzerland. Height, weight and WC were measured. BF, expressed in percent of total body weight, was measured by electrical bioimpedance. Obesity was defined as a BMI>=30 kg/m2 and normal weight as a BMI<25 kg/m2. Abdominal obesity was defined as a WC>=102 cm for men and >=88 cm for women and normal WC as <94 cm for men and <80 cm for women. In men, excess BF was defined as %BF >=28.1, 28.7, 30.6 and 32.6 for age groups 32-44, 45-54, 55-64 and 65-76, respectively; the corresponding values for women were 35.9, 36.5, 40.5 and 44.4. Cigarette smoking was assessed using a self-reported questionnaire. RESULTS: 29.3% of men and 25.0% of women were smokers. Prevalence of obesity, abdominal obesity, and excess of BF was 16.9% and 26.6% and 14.2% in men and 15.0%, 33.0% and 27.5% in women, respectively. Smokers had lower age-adjusted mean BMI, WC and percent of BF compared to non-smokers. However, among smokers,mean age-adjusted BMI,WC and BF increased with the number of cigarettes smoked per day: among light (1-10 cig/day), moderate (11-20) and heavy smokers (>20), mean +/-SE %BF was 22.4 +/−0.3, 23.1+/−0.3 and 23.5+/−0.4 for men, and 31.9+/−0.3, 32.6+/−0.3 and 32.9+/−0.4 for women, respectively. Mean WC was 92.9+/−0.6, 94.0+/−0.5 and 96.0+/−0.6 cm for men, and 80.2+/−0.5, 81.3+/−0.5 and 83.3+/−0.7 for women, respectively. Mean BMI was 25.7+/−0.2, 26.0+/−0.2, and 26.1+/−0.2 kg/m2 for men; and 23.6+/−0.2, 24.0+/−0.2 and 24.1+/−0.3 for women, respectively. Compared with light smokers, the age-adjusted odds ratio (95% Confidence Interval) for excess of BF was 1.04 (0.58 to 1.85) formoderatesmokers and 1.06 (0.57 to 1.99) for heavy smokers in men (p-trend = 0.9), and 1.35 (0.92 to 1.99) and 2.26 (1.38 to 3.72), respectively, in women (p-trend = 0.04). Odds ratio for abdominal obesity vs. normal WC was 1.32 (0.81 to 2.15) for moderate smokers and 1.95 (1.16 to 3.27) for heavy smokers in men (p-trend < 0.01), and 1.15 (0.79 to 1.69) and 2.36 (1.41 to 3.93) in women (p-trend = 0.03). Odds ratio for obesity vs. normal weight was 1.35 (0.76 to 2.41) for moderate smokers and 1.33 (0.71 to 2.49) for heavy smokers in men (p-trend = 0.9) and 0.78 (0.45 to 1.35) and 1.44 (0.73 to 2.85), in women (p-trend = 0.08). CONCLUSIONS: WC and BF were positively and dose-dependently associated with the number of cigarettes smoked per day in women, whereas onlyWC was dose dependently and significantly associated with the amount of cigarettes smoked per day in men. This suggests that heavy smokers, especially women, are more likely to have an excess of BF and to accumulate BF in the abdomen compared to lighter smokers.
