The present work contains a general overview of the sentences of the Inter-American Court of Human Rights (IACtHR), which have recognised that crimes against humanity are pre-existing in customary law, and do not prescribe, nor can they be subject to amnesty or pardon. Specific attention is paid to the consequent restrictions and opportunities offered by said verdicts to countries such as Argentina, Chile, Uruguay and Peru, which find themselves in postconflict transition processes and where peace has been negotiated with certain groups and state structures that are responsible for carrying out crimes against humanity. In doing so, special attention is paid to the impact of the recognition of the nature of crimes against humanity on the notion of the principle of legality, stricto sensu; on the development and evolution of the doctrine and the practice of international human rights law in the inter-American context; and finally on the aforementioned processes of transitional justice.

This research primarily analyses relevant climate bargaining dynamics that have been informed by a North-South impasse. This working paper argues that the first stage of negotiations for a climate convention indeed witnessed a North-South divide which became institutionalized in the Framework Convention on Climate Change. However, in subsequent negotiation rounds the key loci of bargaining struggles was centered between developed countries, in which relevant North-South cooperation dynamics were also present. Finally, this paper assesses the unfinished post-Kyoto bargaining process in which two trends are already being observed: both the emergence of a new geopolitics between the United States and major developing countries, and a fragmentation process within the South, in which the Copenhagen Accord itself has begun to institutionalize such fragmentation.

Relatoria del seminario internacional “Polarización y conflictos en América Latina. Retos para la transformación de conflictos y la seguridad humana”, celebrado en Barcelona en mayo de 2011 y organizado por el Instituto Catalán Internacional para la Paz (ICIP). El seminario tuvo como objeto profundizar en el análisis de las causas de la polarización política y social en América Latina al ser éstas causas frecuentes de inestabilidad, obstáculos al desarrollo y dificultades para el asentamiento de la paz y el sistema democrático. Además el seminario fue el inicio de una línea de investigación y de elaboración de propuestas para el estudio de la polarización y la nueva conflictividad en América Latina.

The goal of this project was the historical study of Patagonia, the southernmost human settled area of the world. Our aim has been the anlysis of those societies to understand how they maintained their socioeconomic system, that is to say, how social reproduction allowed resolving the basic contradiction between production and reproduction, which is characteristic of all hunter-gatherer societies. New computational technologies have allowed a bettwer integration of the big amount and diversity of data needed. We have analyzed the historical evolution of inter-group and intra-group social relationships among nomad patagonian societies. We have compared different social answers in front of the radical change of their immediate reality produced by european colonization. We have exhaustively analyzed the results of archaeological excavations from diferent regions. We have also integrated information from anthropology, ethnohistory and geography. We are developing computing programs to integrate geographical actual data with paleoenvironmental data about the dynamic nature of soil formation, vegetation, hidrography, etc., with information about the history of productive action and how products were distributed among different human groups.

En septiembre del año 2010, el Movimiento Nacional Campesino Indígena celebraba su Primer Congreso. Bajo el lema “Somos tierra para alimentar a los pueblos” compartieron y debatieron durante tres días. De este modo, reafirmaron su lucha por la Reforma Agraria Integral y la Soberanía Alimentaria. Se manifestaron por las calles de Buenos Aires para hacer visible “el otro campo”: el de los marginados, ocultados, los pobres, los excluidos del imaginario social, nacional, y también del acceso a los bienes necesarios para el desarrollo una vida digna

Esta investigación representa una contribución a la literatura sobre el análisis retrospectivo de las fusiones. Su principal objetivo es la evaluación del impacto de la fusión entre Acer y Gateway, concretada a mediados de octubre de 2007 y que permitió a estas dos firmas convertirse en el tercer proveedor mundial de ordenadores personales. En particular, se examinan los efectos que durante el período previo e inmediatamente posterior a la fusión se produjeron sobre los precios de los productos. Para ello, se aplica el método de diferencias-endiferencias, utilizando como grupo de control el conjunto de mercados americanos con mayor volumen de ventas en los previamente las empresas fusionadas no competían. Los resultados obtenidos apuntan a la existencia de un comportamiento anticompetitivo que se habría manifestado en Norteamérica antes de que la fusión se completara. Durant diverses dècades les relacions entre la Unió Europea (UE) i Amèrica Llatina es caracteritzaven pel model tradicional de "ajuda sense comerç" fins els anys 1995, que amb acords de quarta generació impulsar el començament del nou instrument. Els acords d'associació (AdA) introdueixen com una novetat tres pilars (diàleg polític, de cooperació i comercial) i centren l'atenció en les relacions comercials, liberalitzen el comerç i estableixen un nou model d'associació biregional. Aquest treball de recerca analitza els AdA de la UE amb països o grups de països llatinoamericans i el seu impacte en les relacions comercials entre la UE i Amèrica Llatina.

Las relaciones que América Latina pueda establecer con la Unión Europea tienen ,de hecho, carácter estratégico. Ello afecta tanto al acceso a los mercados y a la diversificación de los vínculos externos, políticos y económicos, como a los modelos y las visiones ideológicas que compiten en la economía política global. Hay que subrayar que en América Latina la Unión Europea sigue siendo una importante referencia como modelo social y político, en la medida que aún presente alguna diferencia respecto del “Consenso de Washington” de inspiración neoliberal que impregna el proyecto del ALCA,45 sus evidentes pretensiones hegemónicas, y el unilateralismo que en ocasiones preside la política estadounidense hacia la región, por ejemplo en lo referido al espinoso asunto de las drogas ilegales. En relación a este hecho, a título de ejemplo, cabe destacar las propuestas del Presidente de México, Vicente Fox, sobre la necesidad de ir más allá del ALCAN y constituir una “Comunidad de América del Norte” que aborde cuestiones como la libre circulación de trabajadores y una posible “política de cohesión”, y las referencias al “modelo europeo” presentes en las propuestas de Luis Inácio “Lula” da Silva, presidente electo de Brasil para la revitalización de Mercosur con un parlamento, una moneda y una política exterior común. Esta cuestión puede tener importantes implicaciones para las relaciones entre ambas regiones. Ante las dificultades que plantea la agenda del libre comercio, a nivel multilateral y bilateral, las iniciativas para fortalecer los procesos de integración regional, y en especial Mercosur, podrían convertirse en uno de los asuntos centrales de la cooperación de la Unión Europea y América Latina.

The genetic characterization of Native Mexicans is important to understand multiethnic based features influencing the medical genetics of present Mexican populations, as well as to the reconstruct the peopling of the Americas. We describe the Y-chromosome genetic diversity of 197 Native Mexicans from 11 populations and 1,044 individuals from 44 Native American populations after combining with publicly available data. We found extensive heterogeneity among Native Mexican populations and ample segregation of Q-M242* (46%) and Q-M3 (54%) haplogroups within Mexico. The northernmost sampled populations falling outside Mesoamerica (Pima and Tarahumara) showed a clear differentiation with respect to the other populations, which is in agreement with previous results from mtDNA lineages. However, our results point toward a complex genetic makeup of Native Mexicans whose maternal and paternal lineages reveal different narratives of their population history, with sex-biased continental contributions and different admixture proportions. At a continental scale, we found that Arctic populations and the northernmost groups from North America cluster together, but we did not find a clear differentiation within Mesoamerica and the rest of the continent, which coupled with the fact that the majority of individuals from Central and South American samples are restricted to the Q-M3 branch, supports the notion that most Native Americans from Mesoamerica southwards are descendants from a single wave of migration. This observation is compatible with the idea that present day Mexico might have constituted an area of transition in the diversification of paternal lineages during the colonization of the Americas.

In light of the existing theories about institutional change, this paper seeks to advance a common framework to understand the unfolding of decentralization and federalization in three countries: Brazil, Spain, and South Africa. Although in different continents, these three countries witnessed processes after their respective transitions to democracy that transferred administrative and fiscal authority to their regions (decentralization) and vertically distributed political and institutional capacity (federalization). This paper attempts to explain how institutional changes prompted a shift of power and authority towards regional governments by looking at internal sources of change within the intergovernmental arena in the three countries. This analysis is organized around two propositions: that once countries transit to democracy under all-encompassing constitutions there are high incentives for institutional change, and that under a bargained intergovernmental interaction among political actors subnational political elites are able to advance their interests incrementally. In short, through a common framework this paper will explain the evolving dynamics of intergovernmental dynamics in three countries.

Este artículo presenta nuevas series de distribución factorial del ingreso entre 1950 y 2000 para 14 países de América Latina a partir de un proceso de armonización de los datos de compensación de los trabajadores recogidos en las cuentas nacionales. Además, se presentan estimaciones de la remuneración a los trabajadores autónomos, discutiéndose las diferentes metodologías de estimación posibles, y las limitaciones de datos que afectan a las mismas. El análisis de estas estimaciones coherentes nos permite llegar a algunas conclusionespreliminares. En primer lugar, las estimaciones presentan variaciones importantes entre los países. Segundo, a nivel regional, muestran variaciones tanto coyunturales como de largo plazo que apoyanlos estudios que cuestionan la estabilidad de la distribución factorial del ingreso en el largo plazo.Tercero, nuestras estimaciones de la remuneración del factor trabajo, una vez corregidas para incluir una estimación del trabajo no asalariado, siguen siendo sensiblemente inferiores a las de lospaíses desarrollados, cuestionando así los estudios que señalan que dichas variaciones desaparecen al aplicárseles esta corrección.

In this paper we analyse the reasons behind the evolution of the gender gap and wage inequality in South and East Asian and Latin American countries. Health human capital improvements, the exposure to free market openness and equal treatment enforcement laws seem to be the main exogenous variables affecting women s economic condition. During the second globalization era (in the years 1975-2000) different combinations of these variables in South East Asian and Latin American countries have had as a result the diminution of the gender gap. The main exception to this rule according to our data is China where economic reforms have been simultaneous to the increase of gender differences and inequality between men and women.This result has further normative consequences for the measure of economic inequality. Theimprovement of women s condition has as a result the diminution of the dispersion of wages.Therefore in most of the countries analysed the consequence of the diminution of the gender gapduring the second global era is the decrease of wage inequality both measured with Gini and Theil indexes.

This paper presents a case study of a well-informed investor in the South Sea bubble. We argue that Hoare's Bank, a fledgling West End London banker, knew that a bubble was in progress and nonetheless invested in the stock; it was profitable to "ride the bubble." Using a unique dataset on daily trades, we show that this sophisticated investor was not constrained by institutional factors such as restrictions on short sales or agency problems. Instead, this study demonstrates that predictable investor sentiment can prevent attacks on a bubble; rational investors may only attack when some coordinating event promotes joint action.

In a world where poor countries provide weak protection for intellectual propertyrights, market integration shifts technical change in favor of rich nations. Throughthis channel, free trade may amplify international income differences. At the sametime, integration with countries where intellectual property rights are weakly protectedcan slow down the world growth rate. A crucial implication of these results is thatprotection of intellectual property is most beneficial in open countries. This prediction,which is novel in the literature, finds support in the data on a panel of 53 countriesobserved in the years 1965-1990.

We postulate a two-region world, comprised of North (calibrated after the US) and South(calibrated after China). Our optimization results show the compatibility of the following threedesiderata:(1) Global CO2 emissions follow a conservative path that leads to the stabilizationof concentrations at 450 ppm.(2) North and South converge to a path of sustained growth at 1% per year (28.2%per generation) in 2075.(3) During the transition to the steady state, North also grows at 1% per year whileSouth s rates of growth are markedly higher.The transition paths require a drastic reduction of the share of emissions allocated to North,large investments in knowledge, both in North and South, as well as very large investments ineducation in South. Surprisingly, in order to sustain North s utility growth rate, some output mustbe transferred from South to North during the transition.Although undoubtedly subject to many caveats, our results support a degree of optimism byproviding prima facie evidence of the possibility of tackling climate change in a way that is fairboth across generations and across regions while allowing for positive rates of humandevelopment.
