On a mobile ad-hoc network environment, where the resources are scarce, the knowledge about the network's link state is essential to optimize the routing procedures. This paper presents a study about different pheromone evaluation models and how they react to possible changes in traffic rate. Observing how the pheromone value on a link changes, it could be possible to identify certain patterns which can indicate the path status. For this study, the behavior of the Ant System evaluation model was compared with a Temporal Active Pheromone model (a biological approach) and a Progressive Pheromone Reduction model with and without a maximum pheromone limit.

RESUMO - Planeamento da Alta: Impacto nos Indicadores de Desempenho Hospitalar O problema do presente trabalho reside na percentagem de hospitais do SNS que não tem um processo de planeamento de alta standartizado. Norteada pela questão de investigação: Qual o impacto do Planeamento das Altas nos indicadores de desempenho dos hospitais do SNS?; pelas hipóteses de que os hospitais com um processo de Planeamento da Alta standartizado têm uma Taxa de Reinternamento e uma Demora Média menor; e pelo objetivo geral: Conhecer o impacto do planeamento da alta standartizado nos indicadores de desempenho dos hospitais do SNS, enveredou-se pelo paradigma quantitativo e foi realizada uma análise comparativa dos indicadores de desempenho de dois grupos hospitalares. Estudou-se uma amostra da população acessível, constituída por 57 estabelecimentos hospitalares do SNS e destes foram criados dois grupos de hospitais, que diferiam no facto de ter um processo de planeamento de alta standartizado. No final obteve-se uma amostra, não probabilística, de 12 hospitais, seis que possuíam um processo standartizado e os outros seis não. A recolha de dados foi efetuada através dos sítios da ACSS, DGS e das entidades hospitalares. Os dados foram tratados através da estatística descritiva e indutiva, com recurso a programas informáticos. Da análise emergiram como principais resultados: A existência de um processo de planeamento de alta hospitalar standartizado não tem um impacto significativo nos indicadores de desempenho hospitalar, nomeadamente na redução das Taxas de Reinternamento e da Demora Média hospitalar.

Classificação da ocupação do solo através da segmentação de uma imagem de satélite de alta resolução

Este caso de estudo tem como objetivo demonstrar a utilidade da utilização de imagens de satélite de alta resolução para a produção de cartografia temática em áreas urbanas, bem como, experimentar a extracção de elementos de uma imagem de alta resolução a partir de protocolos de segmentação, aplicando uma abordagem orientada por regiões, e recorrendo a dados de uma cena do satélite WorldView2 com as suas novas 4 bandas adicionais. Definiu-se uma nomenclatura de ocupação de solo com base na fotointerpretação da imagem, criou-se uma legenda hierarquizada por 3 níveis de desagregação. No primeiro nível incluiu-se sete classes, no segundo nível as classes foram classificadas pelo nome dos objetos identificados na fotointerpretação, e o terceiro nível foram classificados pelas características dos objetos definidos no nível anterior. Foram criados segmentos de treino através do algoritmo da segmentação, que tem como função criar segmentos vetoriais com base na similaridade espectral e no valor espectral dos conjuntos dos pixéis vizinhos, testou-se varios parâmetros de segmentação de modo a obter o nível de segmentação que visivelmente na imagem se aproximasse mais aos objetos reconhecidos, para assim se gerar as assinaturas espectrais dos objetos representados pela segmentação, procedendo-se à classificação de ocupação de solo baseada nos segmentos.

In the present thesis, we examine the approach to the so-called “informal conversations”, especially between a suspect or defendant and criminal police authorities. Our goal is to understand if criminal police authorities are allowed to testify about the content of these conversations, revealing facts that the suspect or defendant may have shared with them, as well as about evidence that they may have acquired through these statements. Firstly, we briefly present the notion of “informal conversations” and the great variety of situations they may encompass: intra or extra-procedural; prior or subsequent to someone acquires the status of defendant. Secondly, we analyse some of the principles and rules that are involved in this controversial issue: principles concerning the procedural structure, organization and dynamic; principles concerning the production and assessment of evidence in the trial hearing; principles concerning the prosecution and the powers of criminal police authorities; the procedural status of the defendant; the rules concerning the reading of statements in the trial hearing; the rules concerning hearsay testimonies. Thirdly, we go through the great amount of case law on the so-called “informal conversations” and related matters, analysing the most relevant cases and the arguments that sustain them, as well as the legal literature. Our goal is to understand the evolution, throughout the last two decades, of the different opinions regarding the approach to the various situations in which “informal conversations” may occur and in which the admissibility of a testimony by criminal police authorities is questioned. Finally, we defend a different approach for testimonies by criminal police authorities prior and subsequent to someone acquiring the status of defendant. We see the moment when someone acquires the status of defendant as a border area in the admissibility of “informal conversations”, because from then on the statements have to be collected and assessed according to the law, so all the other conversations (or any other evidence) collected informally are irrelevant. As to the specific case of the testimony about the re-enactment of the crime, given the high degree of difficulty in separating the defendant’s contributions that may be considered essential and those that may be considered less useful, but still relevant, we support the qualification of the defendant’s contributions as inseparable from the re-enactment, allowing it to be replicated and assessed in the trial hearing with no restrictions.

The object of this dissertation is focused on the study of the home banking service and how the allocation of losses due to computer fraud is processed in the scope of this service. When considering the questions raised by the allocation of losses associated with fraudulent operations, it is important to consider, mainly, the behaviour of the user of the home banking service. In our opinion, courts have been too demanding towards the user when judging his action in the use of this service. In this study, we have concluded that, when the user “falls” into a computer fraud scheme, he should not be liable for gross negligent behaviour, even if, due to the fraud, the user revealed all his access codes to a hacker on a page similar to that of his bank. In general, such facts will not be sufficient to qualify the user’s action as grossly negligent. Therefore, the user, under the terms of the Payment Services’ System, must bear the loss up to a maximum of €150, and the bank will face the remainder of the losses. However, if the user, victim of a fraudulent technique, ignored the safety warnings issued by the bank, one must consider, given the specific case, that he contributed to gross negligence in unauthorised payment transactions. Thus, the user must bear all the losses up to the moment when he notifies the bank about the unauthorised transactions. It is the bank’s responsibility to, given the specific case, adduce evidence of the client’s contribution to the identified losses.

This case study – and accompanying teaching note – briefly describes the history of the Espírito Santo family, a banking dynasty who led one of Portugal’s leading economic and financial groups, along with its “crown jewel”, Banco Espírito Santo. It chronicles how the corporate governance issues at BES allowed the family to exploit the bank, its shareholders and its customers, so as to support its unprofitable non-financial businesses. This left the bank in a poor financial situation, which deteriorated beyond control, leaving regulators – whose actions are also analysed here – with no alternative, amidst a severe liquidity crisis, but to apply a resolution measure, pinning large losses on junior bondholders and shareholders before recapitalising the bank.

This case study focuses on the BPI’s recapitalization plan, its causes and the reasons for the early reimbursement of CoCos in June 2014. The need for a capital intervention and the subsequent subscription agreement with the Portuguese Government of €1 500 million Core Tier 1 instruments were the result of a temporary capital buffer for sovereign debt exposures imposed by the European Banking Authority. The capital increase, the positive earnings in 2012 and 2013, the improvements in the sovereign debt crisis, the implementation of Basel III, in addition to the public exchange offer and the conversion of deferred tax assets into tax credits are the main factors for concluding the entire recapitalization operation three years before the deadline.

In these days, Internet and social media represent a big advance in communication. Using the internet brings people a lot of benefits and facilities, but with them comes risks and problems that are turning the line between public and private life smaller. The frequent use of internet and the unbridled use of it we see nowadays on its utilization brings problems related to people privacy, and the dividing line between private and public life is becoming more blurred and admitting the employer intromission on employee’s private life. So, it assumes the largest importance understand in which way this employee’s on exposure on social media brings problems and risks to employment relationship and establish some criteria in order to decide what needs legal protection. But should we affirm that protection when the employee’s publications on social media brings problems to the employer or the company? We think, in these cases, and considering some facts, employee’s private life should cede before the employer’s rights.
