Cumprimento de ordens, obediência hierárquica e disciplina militar versus perpetração (in)voluntária de crimes

Following orders, hierarchical obedience and military discipline are essential values for the survival of the armed forces. Without them, it is not possible to conceive the armed forces as an essential pillar of a democratic state of law and a guarantor of national independence. As issuing orders as well as receiving and following them are inextricably linked to military discipline, and as such injunctions entail the workings of a particular obedience regime within the specific kind of organized power framework which is the Armed Forces, only by analysing the importance of such orders within this microcosm – with its strict hierarchical structure – will it be possible to understand which criminal judicial qualification to ascribe to the individual at the rear by reference to the role of the front line individual (i.e. the one who issues an order vs the one who executes it). That is, of course, when we are faced with the practice of unlawful acts, keeping in mind the organizational framework and its influence over the will of the executor. One thing we take as read, if the orders can be described as unlawful, the boundary line of the duty of obedience, which cannot be overstepped, both because of a legal as well as a constitutional imperative, will have been crossed. And the military have sworn an oath of obedience to the fundamental law. The topic of hierarchical obedience cannot be separated from the analysis of current legislation which pertains to the topic within military institutions. With that in mind, it appeared relevant to address the major norms which regulate the matter within the Portuguese military legal system, and, whenever necessary and required by the reality under analysis, to relate that to civilian law or legal doctrine.

A relação entre a motivação laboral e os valores dos indivíduos – o caso da Simoldes Plásticos

A motivação laboral tem vindo a assumir cada vez mais relevância. O sucesso de uma organização depende da existência de colaboradores motivados. É fundamental que o colaborador consiga ver no trabalho uma forma de atingir os seus objetivos pessoais. Assim, uma empresa deve possuir um sistema de recompensas eficaz e que se adeque aos valores e objetivos defendidos pelos colaboradores. Partindo do pressuposto que as estratégias de motivação laboral são mais eficazes quando correspondem aos valores dos indivíduos, esta dissertação assenta, assim, em compreender a importância dos valores dos indivíduos na motivação laboral. Neste contexto, foi aplicado o inquérito de valores pessoais de Schwartz aos colaboradores da empresa Simoldes Plásticos com o objetivo de conhecer o seu perfil motivacional e perceber se este se adequa ao sistema de recompensas existente na empresa.

Os manuais do ensino primário e elementar e a inculcação dos valores do Estado Novo

Esta dissertação versa a inculcação dos valores do Estado Novo através dos manuais únicos do Ensino Primário Elementar. Pretende-se compreender que factos justificam a idolatria de livros concebidos por um regime político autoritário e que vigoraram, ininterrupta e simultaneamente para o ensino oficial e particular, durante quase três décadas. Partimos, inicialmente, de três hipóteses: 1) A adoração saudosista pelos manuais únicos prende-se com alguns dos valores que os mesmos pretendem veicular; 2) A conceção dos manuais (conteúdo e forma) desempenha um papel preponderante na adesão do leitor; 3) O livro de leitura tem um papel relevante durante o regime salazarista como promotor da socialização e da mobilidade social ascendente. Para confirmação ou refutação das hipóteses, e tendo em conta a imparcialidade e o distanciamento que se exige a um trabalho científico, recorre-se, essencialmente, ao método da análise de conteúdo que consistiu na:  observação do corpus textual constituído pelos textos de leitura dos três manuais do ensino primário obrigatório;  elaboração de grelhas categoriais;  comparação entre os resultados obtidos;  confrontação com outros elementos passíveis de análise como a imagem. Após uma breve introdução, sucede-se um enquadramento teórico e metodológico do tema e uma contextualização histórica. Apresenta-se o estudo de cada um dos manuais com base no método de análise de conteúdo. Passa-se a explanar atitudes e valores preconizados através dos mesmos e o modo como são veiculados no corpus. Por fim, relacionam-se os dados obtidos com os valores defendidos pela ideologia do regime e conclui-se pela confirmação das três hipóteses.
