O Tratado Constitucional e o Futuro da UE

Com entrada de dez novos países, em Maio de 2004, e a aprovação do Tratado Constitucional pelo Conselho Europeu no mês seguinte, a União Europeia entrou numa nova e importante fase da sua construção. Mas existe uma contradição entre este facto e a aparente indiferença dos povos, manifestada pelos elevados índices de abstenção nas eleições para o Parlamento Europeu. Por isto, se a Constituição representa um passo importante para o aprofundamento do processo de integração europeia, ela traz novos desafios e novos problemas que exigem uma maior participação das populações, além de uma acção mais efectiva dos governos e dos parlamentos nacionais. A estes últimos –governos e parlamentos – cabem importantes tarefas para a criação de uma consciência e de uma vontade europeístas, assim como aos partidos europeus que deverão tornar-se mais do que meras federações de partidos nacionais.

A intervenção do tribunal judicial no processo de constituição do tribunal arbitral e o princípio do contraditório

Under specific circumstances, the arbitral tribunal constitution procedure may come to an impasse, due to divergences between the parties or to the mere innaction of one of them or even of a third party. Such is the case when one of the parties or a third party does not appoint the arbitrator it should appoint according to the law or to the arbitration agreement. In order to overcome these types of situations, the Voluntary Arbitration Law provides for the intervention of the President of the Tribunal da Relação in the arbitral tribunal constitution procedure, granting him the power to, by appplication of one of the parties, name or choose the arbitrator the appointment of which has been ommited by the other party or the third party. This paper adresses the question of whether the procedure aimed at the decision of the President of the Tribunal da Relação must incorporate the defendant’s right to contradictory. The answer to this question is based, mainly, on the determination of which is the procedural form applicable to the intervention of the President of the Tribunal da Relação and on analysis of both the structure and effects of the arbitration agreement and the arbitrator´s contract.

A europeização do Direito Constitucional português em matéria de direitos fundamentais – o caso do direito à identidade genética

This article aims to show the Europeanization of the Portuguese Constitutional Right in the matter of the right to one’s genetic identity. The formal recognition of this Right, in the Constitution, was influenced by the actions of the European Council regarding Biomedical Rights and dates back to 1997’s Revision of the Constitution. Not only did the conclusions of the European Council in this matter influenced the Portuguese Constitution but they also affected other documents of international and regional nature like the Charter of Fundamental Rights of the European Union. The latter also managed to find its way into our national legislation. Thus, this flow of influences in the matter of the right to one’s genetic identity and the constitutionally of some dispositions of national legislation about medically assisted procreation are the subject of our analysis.

O recurso constitucional de Amparo

Vivemos, em Portugal, na Europa, como no resto do Mundo, momentos de alguma sobrevalorização de soluções imediatas em prejuízo dos Direitos, Liberdades e Garantias dos Cidadãos. Constituem-se e transmitem-se bases de dados de ADN, com dados dos cidadãos, registam-se, organizam-se e transmitem-se ficheiros com o registo das comunicações efectuadas pelos cidadãos, são detidos cidadãos por mera suspeita da sua eventual associação a uma associação terrorista, “pensa-se”, melhor, decide-se restaurar actos atentatórios de Direitos, Liberdade e Garantias dos Cidadãos. Tal é um risco e, diria mesmo que a sua mera equação, um retrocesso centenário.
