In this paper we will essentially consider the relations between the State punitive claim as well as the pursuit of material truth of facts on the one hand, and on the other hand, the admissibility of evidence collected on the body of the accused in criminal investigations. Aware of the multiple and different refractions that this matter involves, especially considering the potential interference of the principle nemo tenetur se ipsum accusare (or privilege against self-incrimination), this approach is illustrated by the critical appreciation of the ECHR decision in the case Bogumil vs. Portugal, trying to reach some propositions (necessarily poor) regarding the specifics of evidence-related body interventions in cases of arrest and detention.

The exercise of disciplinary action, for the practice of misconduct by a lawyer or trainee lawyer, is the sole responsibility of the O.A., as professional body representative of their peers. The disciplinary procedure prescribed in the statute of the O.A., presents a framework for an integrated accusatory principle of research. The participation of the rapporteur of the disciplinary proceedings in the voting of the resolution imposing a disciplinary sanction is substantively unconstitutional for violating paragraph 5 of article 32nd of the Portuguese Constitution. The requirement to comply with this legislation stems, ultimately, from the similar nature of the fundamental rights of the accused lawyer or trainee lawyer to the rights, freedoms and guarantees protected in criminal proceedings.

This article aims to show the Europeanization of the Portuguese Constitutional Right in the matter of the right to one’s genetic identity. The formal recognition of this Right, in the Constitution, was influenced by the actions of the European Council regarding Biomedical Rights and dates back to 1997’s Revision of the Constitution. Not only did the conclusions of the European Council in this matter influenced the Portuguese Constitution but they also affected other documents of international and regional nature like the Charter of Fundamental Rights of the European Union. The latter also managed to find its way into our national legislation. Thus, this flow of influences in the matter of the right to one’s genetic identity and the constitutionally of some dispositions of national legislation about medically assisted procreation are the subject of our analysis.

O sol, como se sabe, é um símbolo universal e polissémico. Politicamente é o símbolo da soberania, outrora identificada com o monarca e até com a divindade. Símbolo imperial, mas de imperium, não de imperador. Assim, como é evidente, começa-se pelo princípio primeiro (como, na China, no sonho fecundador solar da mãe do imperador Wu, dos Han; a Bíblia assimila metaforicamente a divindade, o sol e o escudo que é defesa e soberania): o princípio que dá vida, que dá ser a Timor-Leste independente.
