Recensão do livro Abuso de Informação, Manipulação do Mercado § Responsabilidade Penal das Pessoas Colectivas, 4ª Edição Revista e Ampliada, 2015

Os crimes de abuso de informação privilegiada e manipulação do mercado estão em relação com a responsabilidade penal das pessoas colectivas como os bancos e com a chamada globalização. § The crimes of insider trading and market manipulation abuse are in relation to the criminal liability of legal persons such as banks and so-called globalization.

Anotação, numa perspectiva de Direito Penal Constitucional, de Criminologia e de Política Criminal, de alguns dos aspectos do Acórdão do Tribunal Constitucional (português) n.º 353/2012, de 5 de Julho de 2012 - o problema da legítima defesa de bens jurídicos individuais e bens jurídicos colectivos, bens jurídicos supra-individuais e/ou bens jurídicos comunitários no meio do Estado de Direito e do Estado Social

o Acórdão do Tribunal Constitucional português n.º 353/2012, de 5 de Julho de 2012, ao declarar a respectiva inconstitucionalidade com força obrigatória geral, colocou em evidência a existência de bens jurídicos individuais e bens jurídicos colectivos, bens jurídicos supra-individuais, bens jurídicos comunitários. Bens jurídicos estes que devem e têm que ser tutelados e protegidos. A legítima defesa pode existir quer em relação à agressão actual e ilícita de bens jurídicos individuais, quer em relação à agressão actual e ilícita de bens jurídicos colectivos, bens jurídicos supra-individuais e/ou bens jurídicos comunitários? Parte muito substancial e importante da Doutrina indica que sim. Mas, então, como reagir, no contexto da hipotética legítima defesa, face à eventual agressão actual e ilícita dos bens jurídicos tutelados, agora com valor reforçado, pelo próprio Tribunal Constitucional? E qual o papel do direito constitucional de resistência? Este artigo pretende fornecer um muito breve contributo para a solução das correspondentes questões. Não é mentira se dissermos que temos entre os melhores Magistrados do mundo, entre os melhores Advogados e Solicitadores do mundo, entre os melhores Funcionários Judiciais, Conservadores, Notários e outros Auxiliares de Justiça, entre os melhores polícias e investigadores do mundo. Bem hajas, Portugal, pois és capaz de muito mais e melhor. § There is the fact there are lies and there are statistics. PRECARIEDADE DOS PROFESSORES UNIVERSITÁRIOS

São tantos os estudos que demonstram que é pela qualidade da educação das pessoas que depende o grau de desenvolvimento dum dado país, que não caberia aqui citá-los um a um. Os estudos nacionais e internacionais são unânimes: investir na educação é investir no futuro honesto da Humanidade. É investir num desenvolvimento sustentável. É investir no ser humano e numa justiça verdadeira, concreta e sensível. E se investir na saúde é prioritário em absoluto, investir na educação também. § There are so many studies that show that it is the quality of education of the people who depend on the degree of development of a given country, that would not fit here quote them one by one. National and international studies are unanimous: investing in education is investing in the future of honest humanity. It is investing in sustainable development. Palavras para os presos e desprezados

Lembremo-nos de vez em quando dos presos, que não se podem manifestar, nem têm sindicato relevante em termos de Estado de Direito social, democrático, livre e verdadeiro. Presos pelas mais diversas razões: desde o crime de roubo sem feridos nem mortos, até aos crimes mais bárbaros. Agora que se fala em perdão por outras razões das quais não queremos falar hoje aqui, logo nos lembramos que o perdão não tem sentido se não houver arrependimento. E logo nos lembramos dos presos também. Somente em Portugal, são milhares. E estão presos neste momento em que escrevemos. Certo que também não nos podemos esquecer das vítimas. Sempre tivemos uma preocupação profunda por estas. § Let us remember from time to time the prisoners, who can not speak or have a relevant union in terms of rule of law social, democratic, free and true. Cuidado com bicos-de-pé em face da Constituição

Nas palavras de Canotilho/Moreira, o regime político português é um Estado-de-partidos, os quais foram elevados à Constituição formal. São expressão da vontade popular (10º/2). São um direito fundamental constitucional. Participar ou fundar um partido é um direito, liberdade e garantia (art. 51º). Participam nos órgãos com base no sufrágio universal e directo. Mas são mediadores pois o poder político é do Povo (art. 108º)! São os partidos que formam a vontade de órgãos como o Governo! Os partidos têm direito a apresentar candidatos aos órgãos; e têm o direito de obter mandatos de acordo com os resultados eleitorais e o método proporcional (art. 113º/5 e 152º/1)… E às Forças Armadas incumbe a defesa militar da República: art. 275º/1 CRP… § In the words of Canotilho / Moreira, the Portuguese political system is a state-parties, which were elevated to the formal Constitution.
