The object of this doctoral thesis is the analysis of the political and administrative purpose that is given to the reform process of a vital sector of State powers within the framework of delegate democracy, such as the administration of Justice. The object is also to analyze if State reform in a diminished or non-liberal surrounding increase or improve conditions of democracy in a given situation, based on the constitutional “what should be”, or if what occurs is a process of “seizure” of the functions of State, which becomes an institutional risk. Finally, we will examine the real and effective existence of a horizontal accountability process through the use of institutional resources, which would evidence the existence of an incomplete model of democracy. This analysis implies the relationship between two institutions within public administration: State Reform, as an act of change in State structure in order to improve qualitatively the outcomes and outputs of public policies, and in sum, to make the system work better. This, as it will be examined later, is the case of Latin America as a response of the State to three processes in crisis: fiscal, as in government intervention or in the form of bureaucratic administration. In that scheme of things, this thesis examines the present state of the art in public administration science of this process to prove that in delegate democracy, this type of instruments disregard the constitutive elements of democracy and serve, especially in critical areas of the administration, allowing for Power to dismiss Law. This research seeks to contribute towards an area seldom analyzed regarding public administration doctrine under the light of the theory of law, which is the connection between previous conditions or principal inputs of an execution process of a democracy and, on the other hand, regarding the effects of introducing a reform within models of a changing democracy and new concepts of the rule of law. While reviewing writings regarding State reform, it is clear that no approximations have been previously made in reference to prior conditions of the political system in order to begin operating a reform which respects fundamental rights as an object of this procedure. This thesis studies the rural collective action processes between 1920 and 1965 in Ecuador with a social history and political sociology approach. An approximation is carried out towards the conflicts, mobilizations and protests where indigenous and not indigenous peasants participated. Because of this, they are considered two periods, the first one that last from 1931 to 1947, sealed by the political instability and a constant change of governments; and the second one between 1948 and 1965, in a phase of successive constitutionally governments that ruled between 1948 and 1960. The conflicts and rural mobilizations reached a major visibility since 1958, deeply affecting the public opinion. The importance and magnitude of the rural mobilizations between 1959 and 1963 generated a controversy on their political effects in the agrarian change. Certainly, the rural mobilizations influenced in the outcome that took the political crisis, which concluded in the implantation of a military government in 1963. This government issued an Agrarian Reform Law in 1964, which modified partially the working relations and the land ownership. And, in addition, it defined a new type of military intervention in the policies that combined repression with reforms. The existence of a landowner social segment that backed a reform in the rural highland (sierra) society has been generally identified by Galo Plaza's figure. In his government (1948-1952), transformations were accentuated in the State intervention, mainly orientated towards the economic and political modernization. This was a new moment of coastal agro-exportation development with the leadership of the banana production. There were stimulated measures of promotion of the production and exportation of bananas. So, the road infrastructure was intensively spread and connected the producing zones with the export ports...

From 1995 to 2015, Ecuador experienced one of its longest periods of deep political, social and economic crisis. During this interval, three democratically elected governments (Bucaram, 1997; Mahuad, 2000 and Gutiérrez, 2005) were overthrown and a critical juncture arose in 2006 as a result. Since 2007, and as a consequence of these chaotic circumstances, new populist strongmen ascended and, amid the biggest bonanza of oil revenues in Ecuadorian history, established a defective democracy. The gradual escalation of authoritarian tendencies during the three consecutive terms in which Rafael Correa has acted as President, have resulted in the severe weakening of the country’s democratic institutions, since Correa’s has strived to perpetuate himself in power through continual re-election into office, instead of building an institutional quality-democracy. This study aims to clarify the historical foundations of the recurrence of caudillistas, populist and authoritarian governments in Ecuador, revealing the basis of the specific path dependence of Ecuadorian politics. We also explore the Jungian theory, specifically the “pseudo-hero myth”, as the political narrative which Correa’s regime successfully employed to establish its hegemony. Additionally, we perform a psychological-political case analysis by examining the social psychology components underlying the Ecuadorian path dependence towards authoritarian and populist caudillos: Specifically, our case study is framed within historical institutionalism, which focuses on methodological individualism to attend various political science and psychological-political theories...

The paper explores the trade competitiveness of seven major shrimp exporting countries, namely Vietnam, China, Thailand, Ecuador, India, Indonesia and Mexico, to the USA. Specifically, we investigate whether the United States (US) antidumping petitions impact upon the bilateral revealed comparative advantage (RCA) indexes for each of the seven shrimp exporting countries with the USA. Monthly data from January 2003 to December 2014 and the panel data model are used to examine the determinants of the RCA for the shrimp exporting countries. The empirical results show the shrimp exporting countries have superior competitiveness against the shrimp market in the USA. Moreover, the RCA indexes are significantly negatively influenced by shrimp prices, and are positively affected by US income per capita. However, the EMS (Early Mortality Syndrome) shrimp disease, domestic US shrimp quantity, exchange rate, and US antidumping laws are found to have no significant impacts on the RCA indexes. In terms of policy implications, the USA should try to reduce production costs of shrimp in the US market instead of imposing antidumping petitions, and the shrimp exporting countries should maintain their comparative advantage and diversify into new markets.
