Thirty-three skipjack tuna (Katsuwonus pelamis) (53−73 cm fork length) were caught and released with implanted archival tags in the eastern equatorial Pacific Ocean during April 2004. Six skipjack tuna were recap-tured, and 9.3 to 10.1 days of depth and temperature data were down-loaded from five recovered tags. The vertical habitat-use distributions indicated that skipjack tuna not associated with floating objects spent 98.6% of their time above the thermocline (depth=44 m) during the night, but spent 37.7% of their time below the thermocline during the day. When not associated with floating objects, skipjack tuna displayed repetitive bounce-diving behavior to depths between 50 and 300 m during the day. The deepest dive recorded was 596 m, where the ambient temperature was 7.7°C. One dive was particularly remarkable because the fish contin-uously swam for 2 hours below the thermocline to a maximum depth of 330 m. During that dive, the ambient temperature reached a low of 10.5°C, and the peritoneal cavity temperature reached a low of 15.9°C. The vertical movements and habitat use of skipjack tuna, revealed in this study, provide a much greater understanding of their ecological niche and catchability by purse-seine fisheries.

The recent development of the pop-up satellite archival tag (PSAT) has allowed the collection of information on a tagged animal, such as geolocation, pressure (depth), and ambient water temperature. The success of early studies, where PSATs were used on pelagic fishes, has spurred increasing interest in the use of these tags on a large variety of species and age groups. However, some species and age groups may not be suitable candidates for carrying a PSAT because of the relatively large size of the tag and the consequent energy cost to the study animal. We examined potential energetic costs to carrying a tag for the cownose ray (Rhinoptera bonasus). Two forces act on an animal tagged with a PSAT: lift from the PSATs buoyancy and drag as the tag is moved through the water column. In a freshwater flume, a spring scale measured the total force exerted by a PSAT at flume velocities from 0.00 to 0.60 m/s. By measuring the angle of deflection of the PSAT at each velocity, we separated total force into its constituent forces — lift and drag. The power required to carry a PSAT horizontally through the water was then calculated from the drag force and velocity. Using published metabolic rates, we calculated the power for a ray of a given size to swim at a specified velocity (i.e., its swimming power). For each velocity, the power required to carry a PSAT was compared to the swimming power expressed as a percentage, %TAX (Tag Altered eXertion). A %TAX greater than 5% was felt to be energetically significant. Our analysis indicated that a ray larger than 14.8 kg can carry a PSAT without exceeding this criterion. This method of estimating swimming power can be applied to other species and would allow a researcher to decide the suitability of a given study animal for tagging with a PSAT.

Short-duration (5- or 10-day) deployments of pop-up satellite archival tags were used to estimate survival of white marlin (Tetrapturus albidus) released from the western North Atlantic recreational fishery. Forty-one tags, each recording temperature, pressure, and light level readings approximately every two minutes for 5-day tags (n= 5) or four minutes for 10-day tags (n= 36), were attached to white marlin caught with dead baits rigged on straight-shank (“J”) hooks (n =21) or circle hooks (n=20) in offshore waters of the U.S. Mid-Atlantic region, the Dominican Republic, Mexico, and Venezuela. Forty tags (97.8%) transmitted data to the satellites of the Argos system, and 33 tags (82.5%) transmitted data consistent with survival of tagged animals over the deployment duration. Approximately 61% (range: 19−95%) of all archived data were successfully recovered from each tag. Survival was significantly (P<0.01) higher for white marlin caught on circle hooks (100%) than for those caught on straight-shank (“J”) hooks (65%). Time-to-death ranged from 10 minutes to 64 hours following release for the seven documented mortalities, and five animals died within the first six hours after release. The United States has managed and analyzed its marine fisheries since 1871, and since 1970 via NOAA’s National Marine Fisheries Service (NMFS). As the primary directive moved from aiding fishermen in expanding their operations emphasizing conservation, the government over time recognized that management involves influencing people not fish, and has hired social scientists to complement the biologists who assess fish populations. This change has not always been smooth. We use archival documents and oral histories to trace the development of sociocultural analytic capabilities within NMFS and describe future plans for growing the program. Four points are made. First, NMFS has created the best developed social science program in NOAA. Second, established institutions change slowly; achieving the social science presence in NMFS has taken over 25 years. Third, change needs visionaries and champions with both tenacity and opportunity. Fourth, social science data collection and research helps in making fishery management decisions, but they have also been useful in evaluating the impact and helping with the recovery from Hurricane Katrina. Good work finds other uses.

Recent years have seen a dramatic increase in litigation against the National Marine Fisheries Service, NOAA. Litigation may affect personnel throughout the agency, including scientists, whose work is often directly or indirectly influenced by complex legal requirements, but who may not be in a position to comment or engage in public dialogue. It may be helpful for scientists and other agency personnel to join the ongoing discussion in the legal community regarding the interface of science and law. This paper provides a starting point with a selected introduction to relevant legal literature in this area. It uses the phrase “forensic fisheries science” to describe the application of science to legal requirements in the fishery management context. It concludes with suggestions for future research that could assist NMFS scientists as they grapple with the challenge of using science to help the agency meet its complex legal requirements. The Northeast Fisheries Science Center of NOAA's National Marine Fisheries Service has a long history of research on benthic invertebrates and habitats in support of the management of living marine resources. These studies began in the 1870's under Spencer F. Baird's guidance as part of an effort to characterize the Nation's fisheries and living marine resources and their ecological interactions. This century and a quarter of research has included many benthic invertebrate studies, including community characterizations, shellfish biology and culture, pathology, ecosystem energy budget modeling, habitat evaluations, assessments of human impacts, toxic chemical bioaccumulation in demersal food webs, habitat or endangered species management, benthic autecology, systematics (to define new species and species population boundaries), and other benthic studies. Here we review the scope of past and current studies as a background for strategic research planning and suggest areas for further research to support NOAA's goals of sustainable fisheries management, healthy coastal ecosystems, and protected species populations.
