The present fishing effort regulation for bottom trawls in the North Sea (EU 40/2008) reduces the fishing effort with larger co-dend mesh sizes (> 100 mm mesh opening) to 86 fishing days per year. The aim of this technical measure is the protection of the weak cod stock usually harvested with this mesh opening. By combining the results of our selectivity investigations on plaice during a commercial fishing trip and the samples taken within the frame of the EU data collection regulation (DCR) we could draw conclusions on commercial and non-commercial fish species. When using codend meshes with larger mesh opening the discard was reduced remarkably. In the reference codend with 80 mm mesh opening the undersized bycatch was 47 % of the total catch of plaice, in the experimental codends with 120 mm mesh opening it was only 7 % and with 130 mm mesh opening just 3 %. On the other hand however, the applied mesh openings in the experimental codends let escape marketable plaice to some extent. The loss of catch was assessed on the basis of fish numbers per length class using a length-weight conversion rate from the DCR. The loss by weight of marketable fish with 120 mm codend mesh opening was 18 %, and 28 % with 130 mm codend mesh opening. To assure the protection of young round and flatfish with one general mesh size, a new regulation should prescribe a minimum mesh opening of 120 mm, accompanied by an expansion of the fishing effort.

Since 2002 Germany is obliged to collect fishery data to support the European Common Fishery Policy. Sampling of the com-mercial fishery under German flag is one duty within the EU fisheries data collection programme. During the past 6 years, 148 fishing trips were sampled by scientific observers onboard commercial fishing vessels to collect data on catch composi-tions with special emphasis on the proportions of landed and discarded fish. The results show that the proportion of discard is depending on the fishery. Highest discard rates were observed on beam trawl fishing trips. At the level of individual fishing trips, discard rates varied extremely within a fishery segment. Highest variations were found in the beam and bottom otter trawl fishery. In contrast, the discard rates in high-seas fisheries were low.

The reliability of the international minimum landing size of 25 cm for the flounder stock of ICES Sub-divisions 24 and 25 as well as national bans on landing female flounder during the spawning time is investigated on German samples taken in Sub-division 24. The results of the analyses of growth, sex ratio, the proportion of mature flounder, and yield curves show that 25 cm is a convenient regulation measure but it would be reliable to have an international ban on landing female as well as male flounder during spawning time.

The implementation of the precautionary approach in the mid-1990s required commercial fish stocks to be classified into different categories. These are based on the degree to which stocks have been exploited or are threatened by fishing activities. According to current ICES terminology, stocks are classified as being either “within” or “outside safe biological limits”, or as being “harvested outside safe biological limits”. Between 1996 and 2002, the relative share of stocks in these three categories remained relatively stable (at about 20 %, 30 % and 15 %, respectively). Over the same time span, the number of stocks were insufficient data is available to quantify and thus to appropriately classify the state of the spawning stock biomass (“status unknown”) has increased. Neglecting potential impacts of fishing pressure, the combined average proportion of all stocks with sufficiently high spawning stock biomass is at about one third, while only one fifth of the stocks assessed have been managed sustainably. For some important fish stocks in the ICES environment – specifically demersal ones –, science recently had to call for rebuilding plans or even a closure of the fishery to allow recovery, in spite of the management’s agreement to manage the resources according to the precautionary approach. This obvious difference between approach and implementation has a number of potential causes: erroneous or imprecise input data (landings, discard and sampling information), insufficient assessment models, problems in the understanding of the scientific advice, and implementation errors. The latter could be either a difference between advised and implemented total allowable catches (TACs), or an excess of legal TACs. During the fifteen years covered by this analysis (1987 to 2002), the average deviation between the implemented TACs for a specific stock and that recommended by ICES for the same stock was more than 30 %. The overall average deviation (summed over all stocks) for the entire period was 34 %, excluding, however, four extreme outliers in the data, representing cases in which scientific recommendations were exceeded by as much as 1000 to 2500 %. If these were included, the overall average would be as high as 45 %. The annual deviation has substantially increased in recent years (from roughly 20 % in earlier years of the surveyed period). This recently observed high deviation also matches ICES’s estimate that the fishing mortality in the ICES convention area in the 1990s was well above recommended sustainable levels in the pelagic and demersal fishery. The worldwide aquaculture production amounts to about one third of the world fishery catch. While the world fishery catch in the last years is stagnating and an increase is not to be expected, the aquaculture rose by about 10 % annually. This rate of growth is also predicted for the next years. Fish meal and oil forms a key position for the further development of aquaculture, specially for carnivorous fish species, of which the salmonids will gain an increasing economic importance, not only on the European, but also on the Japanese and American markets. Without an adequate supply of fish meal and oil for the production of these fish species, the expected product quality cannot be realized under economic conditions. Fish meal and oil are commonly produced from small pelagic fish species, which, at present and in the near future, have no importance for direct human consumption. Since December2000 the use of fish meal and oil in Germany is only allowed for use in aquaculture and petfood. However, conclusive arguments for a ban on the utilization for other animal feeds do not exist so far. The European Union continues to allows feeding of other animals – except ruminants – with fish meal under certain control measures.

Shrimping in the waddensea is frequently considered to significantly reduce the numbers of juvenile plaice . This investigation aims to reveal the seasonal and regional differences regarding discards in the German waddensea and sets the results in relation to the bycatch projects with German participation. Furthermore, methodological aspects are evaluated to find possible effects on the estimation of the netted numbers. The bycatch problem exists predominantly throughout the summer season, but high catches of juvenile plaice can occur occasionally in autumn. The discard issue seems to be most important in the East Frisian region, while the Elbe and Schleswig-Holstein areas are of lesser importance. Considering the distribution of the fish in the environment is as indispensable as sampling of the shrimp fleet with optimum representativity. There are indices that the contribution of the Dutch shrimp fleet to the discard mortality of juvenile plaice was underestimated in the recent past. A combination of time and area closures as restrictions in combination with the extensive application of selective gears could possibly gain the best protection for the affected species.

The introduction of a long-term management plan for the cod socks by the International Baltic Sea Fishery Commission (IBSFC) to ensure stable and high yields and to conserve the fish stocks of the Baltic demands certain conservation measures. One is the use of the Total Allowable Catches (TACs) based on precautionary approches. In addition the exploitation pattern and the selectivy of trawls shall be improved to increase the spawning stock biomass and to reduce the presently high discard rates. The contributation demonstrates by means of model calculations for the cod stock of the ICES Sub-divisions 22 to 24 ( Western Baltic ) the short- and long-term effects of an improvement of the trawl selectivity on stock size, yields and profit.

Trials for the determination of the magnitude of bycatch reduction by sorting grids used in the commercial brown shrimp fishery were carried out from September to December 1997. Trawls with 9 m beam length were used on different fishing grounds in the estuary of the Elbe River near Cuxhaven. The sorting grids tested were made of stainless steel bars spaced at 18, 20, 22, 26 and 30 mm, built into a cylindrical stainless steel frame with a diameter of 65 cm at an angle of attack of 45 degrees. This frame was positioned between the forenet and codend. Simultaneous hauls were made with a trawl of equal construction but without a sorting grid, and the weighed catch components (fish, discard shrimps and commercial size shrimps) separated by means of a riddle were compared. The composition of the sorted out part of the catch of the sorting grid net could be calculated by comparise the corresponding catch components in both the standard trawl and the sorting grid trawl. According to this the total catch of the beam trawl with the sorting grid is reduced by 18 to 38 % depending on the space between the bars. 7 to 31 % of the sorted out part of the catch consists of fish. The use of the sorting grid, however, also leads to losses of 4 to 12 % in Oktober. Per hour of towing this means a loss of 10,3 % commerical size shrimps with a sorting grid of 18 mm space between the bars and of 12,4 % for a 26 mm grid.

In 1998 the longtime series of the standardized bottom trawl surveys conducted in the western Baltic (ICES Sub-division (SD) 22 and 24 since 1978) during spring and autumn and also in the eastern Baltic (ICES Sub-division since 1993) during spring were continued. The results of the surveys as well as those of a sampling programme carried out on board of commercial cutters (mainly financed by an EU study project) and on the market, the investigation of the survival rate of the discards, and the landing statistics are the basis of the analysis of the German and international cod fishery in 1998. The German cod fishery was concentrated on the ICES SD 22 and 24 (total landings 9722 t). The total landings from the fishing grounds east off Bornholm, the traditional German fishing ground, amounted only to about 1270 t. The German cod quota was utilized at 64 %. The fishery in the ICES SD 22 and 24 was characterized by a discard rate of undersized cod of 13 %. That corresponds to about 7.3 million specimens of 0-group, one- and two-years-old youngfish, respectively. The total international cod landings of the Baltic amounted to 101 500 t. In comparison with 1997 (total landings 129 600 t) the landing decreased by 23 %. The percentage utilization of the cod TAC (1998: 140 000 t) amounted to 74 % in 1998.

Trials for the determination of the magnitude of bycatch reduction by the sievenets used in the commercial brown shrimp fishery were carried out from September to December 1997. Trawls with 9 m beam length were the subjected to the investigation. They were used on different fishing grounds in the estuary of the Elbe near Cuxhaven. Sievenets with 50, 60 and 80 mm mesh opening were tested in 29 hauls and 31.6 h total duration. A trawl of equal construction without sievenets fished synchronously was used for comparison. The proportional catch composition in the codend was determined by weighing the catch components (fish, discard shrimps and commercial size shrimps) as separated by means of a riddle. The composition of the sorted out part of the catch could be calculated by comparison of the corresponding catch components both in standard trawl and sievenettrawl. According to this the total catch of a beam trawl with sievenet is diminished by 9 to 34 % depending on the mesh opening of the sievenet. 32 to 58 % of the sorted out part of the catch consists of fish. Use of a sievenet, however, also leads to a loss of 6 to 15 % of commercial size shrimps. Per hour of towing this means a loss of 8.7 kg commercial size shrimps with a sievenet of 60 mm mesh opening and of 1.8 kg for a mesh size of 80 mm.

Fishing gears and methods that target the Clupeids are atalla lift net, light attraction, midwater trawl and dala (Clupeid beach seine).Dala fisheries have been the most lucrative fishing gear on Clupeids within the recent past. However, it has been declared as 100% illegal gear having a mesh size of 0.1 mm, because it catches indiscriminately undersized (juveniles/larvae) commercial fish. The ban on the gear was therefore mounted through promulgation and implementation of special fisheries laws for Kainji Lake (Nigeria). Although, the use of Dala fishing gear and method has decreased due to this management approach, its use is currently increased again. It is therefore suggested that the ban on the use of Dala may not be the answer to indiscriminate fisheries, but modification of the gear and methods for harvesting Clupeids should be the main objective

The impact of acute exposure of Gammalin 20 (an organochlorine pesticide) was investigated in a static bioassay test over a 96-(4-day) period on the fingerlings of Chrysichthys nigrodigitatus (lacepede). The 96-hLC sub(50) of Gammalin 20 was determined as 2.31 Ug/l with lower and upper limits of toxicities as 2.10 and 4.44 Ug/l respectively. At higher concentrations, the colour of the exposed fish became darker, opercular movement slowed down while pigmentation pattern increased and respiratory distress was observed, erratic swimming, tonic convulsion and no response to gentle prodding, and finally death. The implications of these results were discussed with a suggestion of the total ban on the use of Gammalin 20 in capture fisheries due to its harmful and persistence nature in the aquatic environment

Due to the increasing environmental awareness of the public, marine environmental protection became a general interest. Since fishery is one of the strongest direct influences of man on the marine ecosystem, it became criticised, especially because of the discarding of unused fish, which is considered as a waste of the resource. In the different types of fisheries the calculation of the amounts of discards in relationship to the landings vary strongly. One of the reasons is, however, the different use of the terms 'bycatch' and 'discard'. Thus it is important to work with equal terms and definitions, so that fishermen, protectionists and ecologists talk the same language. This contribution tries to define the following terms achieving a generally acceptable terminology which is also explained by the attached diagram.

Since 1993, annual frame surveys have been conducted by the Nigerian-German Kainji Lake Fisheries Promotion Project to determine the distribution and number of fishing localities, fishing canoes and fishing gears around Kainji Lake, Nigeria. The total number of fishing localities has increased from 221 in 1993 to 286 in 1996. The fishing localities included 245 permanent fishing villages, 29 permanent fishing camps, 8 temporary fishing camps (with fishermen from Kainji Lake) and 4 temporary fishing camps (with fishermen from outside Kainji Lake area). There was an increase in the total number of fishing entrepreneurs, fishing assistants and fishing canoes over the years. A total number of 5,499 fishing entrepreneurs, 12,449 fishing assistants and 9,278 fishing canoes were recorded during the 1996 frame survey. From 1995 there was a decrease in the number of shoreline fisherfolk and a decrease in the number of transport canoes, the number of engines remained the same. During the 1996 survey, a total number of 18,655 gill nets, 1,560 drift nets, 753 beach seines, 5,548 cast nets, 7,400 longlines and 36,979 traps were recorded. The concentration of the gears (number per km shoreline) was highest in substrata 06 and 08. The total number of gill nets increased from 17,680 in 1995 to 18,655 in 1996. For the remaining 5 gear types a decrease in number was observed. Despite increasing numbers of gears on the lake, of concern is the decline recorded in all the fishing methods of the number of gears owned by individual entrepreneurs. This was most notable in the gill net and longline fisheries. These two fisheries have the lowest daily catch values and coupled with the problem of gear theft on the lake, ownership in future, may be expected to fall further. The number of larger fishing units also declined as did the number of gears new entrants enter the fishery with. The decline is particularly worrying for the beach seine fishery where diversification into other fishing methods would be beneficial in light of the present ban on seines. The group of not active fishing entrepreneurs (those who do not themselves participate in fishing activities) had the highest ownership of gears whilst the new entrants into the fishery had the lowest.
