Regulatory action to protect California’s coastal water quality from degradation by copper from recreational boats’ antifouling paints interacts with efforts to prevent transport of invasive, hull-fouling species. A copper regulatory program is in place for a major yacht basin in northern San Diego Bay and in process for other major, California boat basins. “Companion” fouling control strategies are used with copper-based antifouling paints, as some invasive species have developed resistance to the copper biocide. Such strategies are critical for boats with less toxic or nontoxic hull coatings. Boat traffic along over 3,000 miles of coastline in California and Baja California increases invasive species transport risks. For example, 80% of boats in Baja California marinas are from the United States, especially California. Policy makers, boating businesses and boat owners need information on costs and supply-side capacity for effective fouling control measures to co-manage water quality and invasive species concerns. The foundation of Habermas's argument, a leading critical theorist, lies in the unequal distribution of wealth across society. He states that in an advanced capitalist society, the possibility of a crisis has shifted from the economic and political spheres to the legitimation system. Legitimation crises increase the more government intervenes into the economy (market) and the "simultaneous political enfranchisement of almost the entire adult population" (Holub, 1991, p. 88). The reason for this increase is because policymakers in advanced capitalist democracies are caught between conflicting imperatives: they are expected to serve the interests of their nation as a whole, but they must prop up an economic system that benefits the wealthy at the expense of most workers and the environment. Habermas argues that the driving force in history is an expectation, built into the nature of language, that norms, laws, and institutions will serve the interests of the entire population and not just those of a special group. In his view, policy makers in capitalist societies are having to fend off this expectation by simultaneously correcting some of the inequities of the market, denying that they have control over people's economic circumstances, and defending the market as an equitable allocator of income. (deHaven-Smith, 1988, p. 14). Critical theory suggests that this contradiction will be reflected in Everglades policy by communicative narratives that suppress and conceal tensions between environmental and economic priorities. Habermas’ Legitimation Crisis states that political actors use various symbols, ideologies, narratives, and language to engage the public and avoid a legitimation crisis. These influences not only manipulate the general population into desiring what has been manufactured for them, but also leave them feeling unfulfilled and alienated. Also known as false reconciliation, the public's view of society as rational, and "conductive to human freedom and happiness" is altered to become deeply irrational and an obstacle to the desired freedom and happiness (Finlayson, 2005, p. 5). These obstacles and irrationalities give rise to potential crises in the society. Government's increasing involvement in Everglades under advanced capitalism leads to Habermas's four crises: economic/environmental, rationality, legitimation, and motivation. These crises are occurring simultaneously, work in conjunction with each other, and arise when a principle of organization is challenged by increased production needs (deHaven-Smith, 1988). Habermas states that governments use narratives in an attempt to rationalize, legitimize, obscure, and conceal its actions under advanced capitalism. Although there have been many narratives told throughout the history of the Everglades (such as the Everglades was a wilderness that was valued as a wasteland in its natural state), the most recent narrative, “Everglades Restoration”, is the focus of this paper.(PDF contains 4 pages)

Historical definitions of what determines whether one lives in a coastal area or not have varied over time. According to Culliton (1998), a “coastal county” is defined as a county with at least 15% of its total land area located within a nation’s coastal watershed. This emphasizes the land areas within which water flows into the ocean or Great Lakes, but may be better suited for ecosystems or water quality research (Crowell et al. 2007). Some Federal Emergency Management Agency (FEMA) documents suggest that “coastal” includes shoreline-adjacent coastal counties, and perhaps even counties impacted by flooding from coastal storms. An accurate definition of “coastal” is critical in this regard since FEMA uses such definitions to revise and modernize their Flood Insurance Rate Maps (Crowell et al. 2007). A recent map published by the National Oceanic and Atmospheric Administration’s (NOAA) Coastal Services Center for the Coastal Change Analysis Program shows that the “coastal” boundary covers the entire state of New York and Michigan, while nearly all of South Carolina is considered “coastal.” The definition of “coastal” one chooses can have major implications, including a simple count of coastal population and the influence of local or state coastal policies. There is, however, one aspect of defining what is “coastal” that has often been overlooked; using atmospheric long-term climate variables to define the inland extent of the coastal zone. This definition, which incorporates temperature, precipitation, wind speed, and relative humidity, is furthermore scalable and globally applicable - even in the face of shifting shorelines. A robust definition using common climate variables should condense the large broad definition often associated with “coastal” such that completely landlocked locations would no longer be considered “coastal.” Moreover, the resulting definition, “coastal climate” or “climatology of the coast”, will help coastal resource managers make better-informed decisions on a wide range of climatologically-influenced issues. In January 2006 the Maumee Remedial Action Plan (RAP) Committee submitted a State II Watershed Restoration Plan for the Maumee River Great Lakes Area of Concern (AOC) area located in NW Ohio to the State of Ohio for review and endorsement (MRAC, 2006). The plan was created in order to fulfill the requirements, needs and/or use of five water quality programs including: Ohio Department of Natural Resources (DNR) Watershed Coordinator Program; Ohio EPA Great Lakes RAP Program; Ohio DNR Coastal Non-point Source Pollution Control Program; Ohio EPA Total Maximum Daily Load Program; and US Fish & Wildlife Service Natural Resources Damage Program. The plan is intended to serve as a comprehensive regional management approach for all jurisdictions, agencies, organizations, and individuals who are working to restore the watershed, waterways and associated coastal zone. The plan includes: background information and mapping regarding hydrology, geology, ecoregions, and land use, and identifies key causes and sources for water quality concerns within the six 11-digit hydrological units (HUCs), and one large river unit that comprise the Maumee AOC. Tables were also prepared that contains detailed project lists for each major watershed and was organized to facilitate the prioritization of research and planning efforts. Also key to the plan and project tables is a reference to the Ohio DNR Coastal Management Measures that may benefit from the implementation of an identified project. This paper will examine the development of the measures and their importance for coastal management and watershed planning in the Maumee AOC. (PDF contains 4 pages)

Coastal storms, and the strong winds, heavy rains, and high seas that accompany them pose a serious threat to the lives and livelihoods of the peoples of the Pacific basin, from the tropics to the high latitudes. To reduce their vulnerability to the economic, social, and environmental risks associated with these phenomena (and correspondingly enhance their resiliency), decision-makers in coastal communities require timely access to accurate information that affords them an opportunity to plan and respond accordingly. This includes information about the potential for coastal flooding, inundation and erosion at time scales ranging from hours to years, as well as the longterm climatological context of this information. The Pacific Storms Climatology Project (PSCP) was formed in 2006 with the intent of improving scientific understanding of patterns and trends of storm frequency and intensity - “storminess”- and related impacts of these extreme events. The project is currently developing a suite of integrated information products that can be used by emergency managers, mitigation planners, government agencies and decision-makers in key sectors, including: water and natural resource management, agriculture and fisheries, transportation and communication, and recreation and tourism. The PSCP is exploring how the climate-related processes that govern extreme storm events are expressed within and between three primary thematic areas: heavy rains, strong winds, and high seas. To address these thematic areas, PSCP has focused on developing analyses of historical climate records collected throughout the Pacific region, and the integration of these climatological analyses with near-real time observations to put recent weather and climate events into a longer-term perspective.(PDF contains 4 pages)

Storm force flooding continues to be a major concern in the hurricane season and causes considerable loss to the coastal communities. National Flood Insurance Program (NFIP) provides recovery resources for the flood disaster and dissuades uneconomic uses from locating in flood hazard area. In order to motivate flood insurance purchase and promote increased flood hazard mitigation, the Community Rating System (CRS) that is a part of NFIP, credits 18 community floodplain management activities. However, CRS has been marked by a lack of active participation since its inception limiting its potential effectiveness. As of January 2008, 1080 communities, representing only 5% of all the NFIP communities have enrolled in CRS. Little empirical evidence exists to shed light on what factors influence the establishment of local hazard mitigation projects. To fill this gap, we propose to analyze flood hazard mitigation projects in 37 North Carolina coastal counties between 2002 and 2008. Specifically, we will examine the influence of physical, risk, and socioeconomic factors on coastal community hazard mitigation decisions as reflected in the CRS score. The goal of the Puget Sound Nearshore Ecosystem Restoration Project (PSNERP) is to improve system-wide functionality of nearshorei ecosystem processes. To achieve that goal, PSNERP plans to strategically restore nearshore sites throughout Puget Sound. PSNERP scientists are assessing changes to the nearshore, and will recommend an environmentally strategic restoration portfolio. Yet, PSNERP also needs stakeholder input to design a socially strategic portfolio. This research investigates the values and preferences of stakeholders in the Whidbey Sub-Basin of Puget Sound to help PSNERP be both socially and environmentally strategic. This investigation may be repeated in the six other Puget Sound Sub-Basins. The results will guide restoration portfolio design and future stakeholder involvement activities. This study examines four areas of stakeholder values and preferences: 1) beliefs about the causes, solutions, and severity of nearshore problems; 2) priorities for nearshore features, shoreforms, developments, and restoration objectives; 3) thoughts about ecosystem servicesiii and trade-offs among them; and 4) visions of a future, restored Puget Sound nearshore and the role of science in attaining this vision. The study is framed by two hypotheses from the Advocacy Coalition Framework (ACF), which suggests that groups of policy advocates form around shared “policy core beliefs” which can transcend traditional categories of stakeholders.(PDF contains 3 pages)

The health of the oceans and people are inextricably linked. For many years we focused research and policy on anthropogenic impacts to oceans and coasts. Recently we have started to think about how the health of the oceans affects us. In response to the Oceans and Human Health Act of 2004, a NOAA initiative was created to explore the “One Health” of the oceans and coasts. The Center of Excellence in Oceans and Human Health at Hollings Marine Laboratory (HML) is one of three Centers dedicated to understanding the connections and forecasting changes in ocean and coastal health and human health. The Center at HML is developing new tools and approaches, including sentinel habitats and sentinel species, to evaluate linkages between ecological process and human health and wellbeing. The results provide environmental and public health managers, policy-makers and communities forecasts and assessments to improve ecosystem-based management that protects health and mitigates risks for the oceans, coasts and people.(PDF contains 4 pages)

With arguably the world’s most decentralized coastal governance regime, the Philippines has implemented integrated coastal management (ICM) for over 30 years as one of the most successful frameworks for coastal resource management in the country. Anthropogenic drivers continue to threaten the food security and livelihood of coastal residents; contributing to the destruction of critical marine habitats, which are heavily relied upon for the goods and services they provide. ICM initiatives in the Philippines have utilized a variety of tools, particularly marine protected areas (MPAs), to promote poverty alleviation through food security and sustainable forms of development. From the time marine reserves were first shown to effectively address habitat degradation and decline in reef fishery production (Alcala et al., 2001) over 1,100 locally managed MPAs have been established in the Philippines; yet only 10-20% of these are effectively managed (White et al., 2006; PhilReefs, 2008). In order to increase management effectiveness, biophysical, legal, institutional and social linkages need to be strengthened and “scaled up” to accommodate a more holistic systems approach (Lowry et al., 2009). This summary paper incorporates the preliminary results of five independently conducted studies. Subject areas covered are the social and institutional elements of MPA networks, ecosystem-based management applicability, financial sustainability and the social vulnerability of coastal residents to climate change in the Central Philippines. Each section will provide insight into these focal areas and suggest how management strategies may be adapted to holistically address these contemporary issues. (PDF contains 4 pages)

This panel will discuss the research being conducted, and the models being used in three current coastal EPA studies being conducted on ecosystem services in Tampa Bay, the Chesapeake Bay and the Coastal Carolinas. These studies are intended to provide a broader and more comprehensive approach to policy and decision-making affecting coastal ecosystems as well as provide an account of valued services that have heretofore been largely unrecognized. Interim research products, including updated and integrated spatial data, models and model frameworks, and interactive decision support systems will be demonstrated to engage potential users and to elicit feedback. It is anticipated that the near-term impact of the projects will be to increase the awareness by coastal communities and coastal managers of the implications of their actions and to foster partnerships for ecosystem services research and applications. As the impacts and potential of climate change are realized at the governance level, states are moving towards adaptation strategies that include greater regulatory restrictions on development within coastal zones. The purpose of this paper is to outline the impacts of existing and planned regulatory mechanisms on the Fifth Amendment to the United States Constitution, which prevents the government taking of private property for public use without just compensation. A short history of regulatory takings is explained, and the potential legal issues surrounding mitigation and adaptation measures for coastal communities are discussed. The goal is to gain an understanding of the legal issues that must be resolved by governments to effectively deal with regulatory takings claims as coastal mitigation and adaptation plans are implemented. Congress established a legal imperative to restore the quality of our surface waters when it enacted the Clean Water Act in 1972. The act requires that existing uses of coastal waters such as swimming and shellfishing be protected and restored. Enforcement of this mandate is frequently measured in terms of the ability to swim and harvest shellfish in tidal creeks, rivers, sounds, bays, and ocean beaches. Public-health agencies carry out comprehensive water-quality sampling programs to check for bacteria contamination in coastal areas where swimming and shellfishing occur. Advisories that restrict swimming and shellfishing are issued when sampling indicates that bacteria concentrations exceed federal health standards. These actions place these coastal waters on the U.S. Environmental Protection Agencies’ (EPA) list of impaired waters, an action that triggers a federal mandate to prepare a Total Maximum Daily Load (TMDL) analysis that should result in management plans that will restore degraded waters to their designated uses. When coastal waters become polluted, most people think that improper sewage treatment is to blame. Water-quality studies conducted over the past several decades have shown that improper sewage treatment is a relatively minor source of this impairment. In states like North Carolina, it is estimated that about 80 percent of the pollution flowing into coastal waters is carried there by contaminated surface runoff. Studies show this runoff is the result of significant hydrologic modifications of the natural coastal landscape. There was virtually no surface runoff occurring when the coastal landscape was natural in places such as North Carolina. Most rainfall soaked into the ground, evaporated, or was used by vegetation. Surface runoff is largely an artificial condition that is created when land uses harden and drain the landscape surfaces. Roofs, parking lots, roads, fields, and even yards all result in dramatic changes in the natural hydrology of these coastal lands, and generate huge amounts of runoff that flow over the land’s surface into nearby waterways. In Washington State, the Department of Natural Resources (WA DNR) is responsible for managing state-owned aquatic lands. Aquatic reserves are one of many Marine Protected Area (MPA) designations in WA State that aim to protect sensitive aquatic and ecological habitat. We analyzed the designation and early planning processes of WA State aquatic reserves, identified gaps in the processes, and recommend action to improve the WA State aquatic reserve early planning approach. Approximately two-thirds of coastal and Great Lakes states have some type of shoreline construction setback or construction control line requiring development to be a certain distance from the shoreline or other coastal feature (OCRM, 2008). Nineteen of 30 coastal states currently use erosion rates for new construction close to the shoreline. Seven states established setback distances based on expected years from the shoreline: the remainder specify a fixed setback distance (Heinz Report, 2000). Following public hearings by the County of Kauai Planning Commission and Kauai County Council, the ‘Shoreline Setback and Coastal Protection Ordinance’ was signed by the Mayor of Kauai on January 25, 2008. After a year of experience implementing this progressive, balanced shoreline setback ordinance several amendments were recently incorporated into the Ordinance (#887; Bill #2319 Draft 3). The Kauai Planning Department is presently drafting several more amendments to improve the effectiveness of the Ordinance. The intent of shoreline setbacks is to establish a buffer zone to protect shorefront development from loss due to coastal erosion - for a period of time; to provide protection from storm waves; to allow the natural dynamic cycles of erosion and accretion of beaches and dunes to occur; to maintain beach and dune habitat; and, to maintain lateral beach access and open space for the enjoyment of the natural shoreline environment. In addition, a primary goal of the Kauai setback ordinance is to avoid armoring or hardening of the shore which along eroding coasts has been documented to ultimately eliminate the fronting beach. As coastal destinations continue to grow, due to tourism and residential expansion, the demand for public beach access and related amenities will also increase. As a resultagencies that provide beach access and related amenities face challenges when considering both residents and visitors use beaches and likely possess different needs, as well as different preferences for management decisions. Being a resident of a coastal county provides more opportunity to use local beaches, but coastal tourism is an important and growing economic engine in coastal communities (Kriesel, Landry, & Keeler, 2005; Pogue & Lee, 1999). Therefore, providing agencies with a comprehensive assessment of the differences between these two groups will increase the likelihood of effective management programs and policies for the provision of public beach access and related amenities. The purpose of this paper was to use a stated preference choice method (SPCM) to identify the extent of both residents’ and visitors’ preferences for public beach management options.
