Making use of sea, as a place for dumping of wastes and other materials from human activities wasn’t forbidden before creation of the convention on the prevention of marine pollution by dumping of wastes and other matters (London Convention). Therefore, industrial countries, without any specific consideration, were dumping their wastes into the world’s seas. Many years and before the beginning of rapid development of industry, the great self- purification of seas were preventing some of discharging problems. But gradually, the increase of industrial development activities, exceeded the production of wastes and other matters, and this led to the misuse of world’s seas and oceans as a dump site. One of the most important consequences of 1972 Stockholm World Conference was to focusing world attention on threats have jeopardized marine environment balance. World countries` leaders committed in Stockholm to begin protecting the environment. Finally, this movement at marine environment section led to the creation of London Convention in the same year. London Convention was concluded for cooperating between countries at December 29, 1972 to promote effective control of all marine environment polluting resources and to prevent marine pollution by dumping wastes and other matters. Then it was opened for signature to other countries. At last, after 15 states signature, this convention was entered in to force at August 30.1975. Ratification and execution of London Convention resulted in coordinated performance of countries in marine waste management. Common actions with supports and cooperation of different international, regional, governmental and non-governmental organizations and agencies prevent marine pollution by dumping of wastes and other matters. Due to the importance of wastes in our marine and coastal areas, investigation of the performance of London Convention can identify the lack of regulations and lack of regulation supports about marine pollution prevention by dumping of wastes and other matters in Iran. Considering this issue, proper protection of seas will be achieved. London Convention has been studied here to achieve intended purposes. In first chapter, generalities about marine environment, including the importance and necessity of marine environment protection, with the focus on some internal and international resources of environmental law accompanying with marine pollution and its recourses, and finally, due to the study theme, dumping of wastes and other matters at seas with its impacts have been investigated .In the section of international measures, a brief history of marine pollution and marine environment international law with international law framework, exclusively for controlling of wastes and other material discharge at seas and oceans has been reviewed. In second chapter, obligations, amendments, and annexes of London Convention have been investigated and classified. The obligations have been categorized in to legal obligations and technical and organizational obligations. In former section, subject ,purpose, territory, exceptions, rights and duties of parties, convention amendments,… and in latter, special requirements for wastes assessment, determination of pollutants` permissible limit, site selection and type of discharge selection, design principles for marine environment quality monitoring program, and discharge license issuance mechanism have been studied. In third chapter, due to the examination of convention performance in Iran, the internal law system for marine environment conservation and its pollution has been mentioned in detail. Considering this, two issues have been compared .firstly, convention obligations with regional treaties that Iran as a party to them and secondly, Iranian internal law there of .Finally, common and different aspects of these issues have been determined. At last, recommendations and strategies for convention enforcement and conformity of its obligations with internal regulations have been presented. Furthermore, translation of convention English text has been reviewed and its protocol has been translated.

Das am 16. November 1994 in Kraft getretene Seerechtsübereinkommen der Vereinten Nationen (United Nations Convention on the Law of the Sea) regelt völkerrechtlich alle Nutzungsarten der Meere. Die dort erlassenen Vorschriften beschränken sich auf allgemeine Rechtsgrundsätze, seerechtliche Kompetenzregelungen und Staatenverpflichtungen zum Erlaß internationaler und nationaler Regelungen. Das Vertragswerk bezieht den marinen Umweltschutz, einen Kernbereich globaler Umweltpolitik, ausdrücklich mit ein. Wesentlich konkreter in der Umsetzung umweltpolitischer Ziele sind die internationalen Übereinkommen zum Schutz der Meeresumwelt. Für den in Abbildung 1 gezeigten Teil des Nordostatlantiks einschließlich der Nordsee existieren derartige Übereinkommen bereits seit 1972 durch das OSLO und PARIS Übereinkommen und für die gesamte Ostsee seit 1974 durch das HELSINKI Übereinkommen. Im Lichte des heutigen Umweltverständnisses und unter Berücksichtigung des weiterentwickelten Seerechts wurden beide Übereinkommen 1992 neu gefaßt. Die politischen Veränderungen haben insbesondere im Ostseeraum auch zu geographischen Erweiterungen geführt. Die mit der Novellierung der jeweiligen Übereinkommen verbundene Neuorganisation ist weiterhin selbstverständlich von den Erfahrungen aus der zwanzigjährigen Überwachungstätigkeit und dem in dieser Zeit durch die Meeresforschung gewachsenen Wissen geprägt.

In Bangladesh, only 6% of the daily food intake is animal food of which fish accounts for 50%. Rice is the mainstay, making up 60% of the daily food intake. However, many nutrients such as vitamins A and C, iron, calcium, zinc and iodine are not found in rice and have to be obtained from other sources. Small indigenous fish are a vital contribution to the diet of the rural poor in Bangladesh, where more than 30,000 children go blind every year from vitamin A deficiency and 70% of women and children are iron-deficient. Small fish, which are less than 10 cm in length and usually eaten whole with the organs and bones, contain large amount of calcium and possibly iron and zinc. The largest fish promoted in aquaculture do not contribute significantly to calcium intake. Some species also contain large amount of vitamin A. Much of the small indigenous fish (SIS) of Bangladesh are caught in floodplains and natural waterbodies. Small fish are eaten frequently in small amounts and are more equally distributed among family members than big fish of which men get the larger share. Unfortunately, overfishing and the deterioration of natural habitats have resulted in a decline in SIS. When measures are taken to improve food and nutrition security, there should be a focus on production of small fish so that greater quantities are accessible for consumption by the rural poor.

For more than 25 years all sea turtle products have been prohibited from international commerce by the 170-member nations of the Convention on International Trade in Endangered Species (CITES). Sea turtles continue to be threatened by direct take (including poaching) and illegal trade despite multi-national protection efforts. Although take may contribute significantly to sea turtle decline, illegal take is difficult to measure since there are few quantified records associated with legal fisheries and fewer still for illegal take (poaching). We can, however, quantify one portion of the illegal sea turtle trade by determining how many illegal products were seized at United States ports of entry over a recent 10-year period. The United States Fish and Wildlife Service (USFWS) oversees the import and export of wildlife and wildlife products, ensuring that wildlife trade complies with United States laws and international treaties. Additionally, the USFWS has legal authority to target suspected illegal wildlife activity through undercover and field investigations. In an effort to assess the scale of illegal sea turtle take and trade, we have conducted a 10-year (1994 – 2003) review of the law enforcement database maintained by the USFWS. This database tracks the number and type of wildlife cases, the quantity of seized products, and the penalties assessed against violators. These data are minimum estimates of the sea turtle products passing through the United States borders, as smuggled wildlife is oftentimes not detected.

The 22nd Annual Symposium on Sea Turtle Biology and Conservation was held April 4-7, 2002 in Miami, Florida and hosted by the U.S. Fish and Wildlife Service. The 22nd symposium was the most globally diverse ever with 839 individuals from 73 countries attending the symposium and associated regional meetings. One third of the attendees were from outside the United States. This diverse attendance was made possible in large part because of substantial donations from The Packard Foundation, National Fish and Wildlife Foundation, National Marine Fisheries Service, U.S. Fish and Wildlife Service, Convention on Migratory Species, Oceanic Research Foundation, and International Sea Turtle Society which supported travel grants for 170 international travelers. This paper includes information about the Pribilof Islands since their discovery by Russia in 1786 and the population of northern fur seals, Cailorhinus ursinus, that return there each summer to bear young and to breed. Russia exterminated the native population of sea Oilers, Enhydra lulris, here and nearly subjected the northern fur seal to the same fate before providing proper protection. The northern fur seal was twice more exposed to extinction following the purchase of Alaska and the Pribilof Islands by the United States in 1867. Excessive harvesting was stopped as a result of strict management by the United States of the animals while on land and a treaty between Japan, Russia, Great Britain (for Canada), and the United States that provided needed protection at sea. In 1941, Japan abrogated this treaty which was replaced by a provisional agreement between Canada and the United States that protected the fur seals in the eastern North Pacific Ocean. Japan, the U.S.S.R., Canada, and the United States again insured the survival of these animals with ratification in 1957 of the "Interim Convention on the Conservation of North Pacific Fur Seals," which is still in force. Under the auspices of this Convention, the United States launched an unprecedented manipulation of the resource through controlled removal during 1956-68 of over 300,000 females considered surplus. The biological rationale for the reduction was that production of fewer pups would result in a higher pregnancy rate and increased survival, which would, in turn, produce a sustained annual harvest of 55,000-60,000 males and 10,000-30,000 females. Predicted results did not occur. The herd reduction program instead coincided with the beginning of a decline in the number of males available for harvest. Suspected but unproven causes were changes in the toll normally accounted for by predation, disease, adverse weather, and hookworms. Depletion of the animals' food supply by foreign fishing Heets and the entanglement of fur seals in trawl webbing and other debris discarded at sea became a prime suspect in altering the average annual harvest of males on the Pribilof Islands from 71,500 (1940-56) to 40,000 (1957-59) to 36,000 (1960) to 82,000 (1961) and to 27,347 (1972-81). Thus was born the concept of a research control area for fur seals, which was agreed upon by members of the Convention in 1973 and instituted by the United States on St. George Island beginning in 1974. All commercial harvesting of fur seals was stopped on St. George Island and intensive behavioral studies were begun on the now unharvested population as it responds to the moratorium and attempts to reach its natural ceiling. The results of these and other studies here and on St. Paul Island are expected to eventually permit a comparison between the dynamics of unharvested and harvested populations, which should in turn permit more precise management of fur seals as nations continue to exploit the marine resources of the North Pacific Ocean and Bering Sea. In accordance with the recommendations of the Committee on Fisheries (COFI), FAO prepared the first draft of the technical guidelines in relation to Fishing Operations, which were submitted to the Technical Consultation on the Code of Conduct for Responsible Fishing, Rome, 26 September to 5 October 1994. The draft was prepared taking into account the Declaration of Cancún, Agenda 21 of United Nations Conference on Environment and Development (UNCED) and the Report of the Expert Consultation on Responsible Fishing Operations, Sidney, British Colombia, Canada, 6 -11 June 1994. Thereafter, the draft was revised taking into account, the negotiations at the UN Conference on Straddling Fish Stocks and Highly Migratory Fish Stocks, the elaboration of the Code as well as developments at the International Maritime Organization (IMO) with regard to the Protocol to the Torremolinos International Convention on Fishing Vessel Safety and the new International Convention on Training, Certification and Watchkeeping for Fishing Vessel Personnel, 1995. Technical Guidelines are given in support of the implementation of the Code in relation to fishing operations. These are addressed to States, international organizations, fisheries management bodies, owners, managers and charterers of fishing vessels as well as fishers and their organizations. On the basis of the ”Gdansk Convention on Preservation of Living Resources of the Baltic Sea” the International Baltic Sea Fishery Commission (IBSFC) has been regulating catches of most important fish species in the area since 1974. This article reviews, in a first step for Baltic Sea cod, the development of stocks and fishery since 1970 in the light of respective catch regulations of IBSFC. TACs have been fixed by IBSFC by species for the whole Baltic Sea and resulting quotas have been split according to national and/or international fishery zones from 1975 up to now. The Baltic Sea cod is on biological background treated in scientific stock assessment as two separate stocks. Both stocks, in the western and eastern Baltic Sea, show clearly different developments over the period since 1970. After a short living peak in stock size of the eastern compartment about 20 years ago this stock has been on a very low level since the late 1980’s. During that period with increasing effort big cod catches have been landed.. The level of fishing effort is more or less the same still with much lower catches nowadays. A detailed description of development of stock sizes and recruitment is given. The conclusion is that with the present regime of regulation on the basis of one TAC for the total Baltic Sea and with high fishing capacity available for cod it will be impossible to meet the aim of good and stable yields.

EXECUTIVE SUMMARY: At present, the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) criteria used to assess whether a population qualifies for inclusion in the CITES Appendices relate to (A) size of the population, (B) area of distribution of the population, and (C) declines in the size of the population. Numeric guidelines are provided as indicators of a small population (less than 5,000 individuals), a small subpopulation (less than 500 individuals), a restricted area of distribution for a population (less than 10,000 km2), a restricted area of distribution for a subpopula-tion (less than 500 km2), a high rate of decline (a decrease of 50% or more in total within 5 years or two generations whichever is longer or, for a small wild population, a decline of 20% or more in total within ten years or three generations whichever is longer), large fluctuations (population size or area of distribution varies widely, rapidly and frequently, with a variation greater than one order of magnitude), and a short-term fluctuation (one of two years or less). The Working Group discussed several broad issues of relevance to the CITES criteria and guidelines. These included the importance of the historical extent of decline versus the recent rate of decline; the utility and validity of incorporating relative population productivity into decline criteria; the utility of absolute numbers for defining small populations or small areas; the appropriateness of generation times as time frames for examining declines; the importance of the magnitude and frequency of fluctuations as factors affecting risk of extinction; and the overall utility of numeric thresh-olds or guidelines.

The Lower Mekong Basin has extensive wetlands and these are being threatened by numerous problems. Most of these problems are interdependent and interact with one another. The lack of an appropriate definition of wetlands applicable to the region, pervasive inefficiencies and chronic lack of funds among riparian governments, and the poor appreciation of the true economic importance of wetlands and its resources are among the most prominent. The current definition, based on the Convention on Wetlands (Ramsar, Iran, 1971), is too broad when compared to the understanding of wetlands as being swamps, marshes and the like, and was developed specifically for wetlands with international importance as waterfowl habitats. Furthermore, wetlands are composed of different types of resources, which require different modes of management. Often, institutional competition, overlapping mandates and sometimes jealousies occur between government departments when they try to assert their authority on a particular wetland resource and use, and put forward their development plans without considering how these may conflict with other wetlands uses. Finally, effective wetland management requires reliable statistics or information on rate of harvest of natural resources such as fish and others, fishing/harvesting methods over time in order to determine the level of exploitation, and the status of the natural resources. This information is needed to identify opportunities for expansion, to establish historical trends, and to determine when management interventions are necessary to protect the resources from being overused by other developments. In order to address these issues, ICLARM - The World Fish Center has launched a project, the aim of objectives of which are described in this paper.

In November 1993, Professor Alexei Yablokov, who at the time was the Science Advisor to Russian President Boris Yeltsin, stood on a podium in Galveston, Tex., and delivered a speech to the Society for Marine Mammalogy’s biennial conference, the premier international event in the field of marine mammal science. Addressing the 1,500 scientists present, he made what amounted to a national confession: that, beginning in 1948, the U.S.S.R. had begun a huge campaign of illegal whaling. This brochure summarizes a series of case studies done in nine countries—Brazil, India, Indonesia, Mexico, Senegal, South Africa, Spain,Tanzania and Thailand—on the role of communities in the planning and implementation of marine protected areas (MPAs). The studies demonstrate that communities can be powerful allies in efforts for conservation and management of coastal and marine resources. They also underline the need for systematic attention, capacity building, funding and other resources for effective implementation of Programme Element 2 on governance, participation, equity, and benefit sharing of the Programme of Work on Protected Areas (PoWPA) of the Convention on Biological Diversity (CBD).

The lacunae in fishing-community engagement in the management and governance of marine and coastal protected areas (MCPAs) were discussed in the 2009 Chennai Workshop organized by the International Collective in Support of Fishworkers (ICSF). To continue the discussion, a second, two-day workshop to review existing legal and institutional mechanisms for implemention and monitoring of MCPAs, titled ‘Fishery-dependent Livelihoods, Conservation and Sustainable Use of Biodiversity: The Case of Marine and Coastal Protected Areas in India’, was held in New Delhi during 1-2 March 2012. The objective was to understand the impact of MCPAs on fishing communities, from an environmental-justice and human-rights perspective, and make specific proposals for better conservation while securing the livelihoods of small-scale fishers. The workshop also served to underscore these issues in light of the upcoming Conference of the Parties (COP) to the Convention on Biological Diversity (CBD), to be held at Hyderabad in October 2012. This publication contains the prospectus of the workshop and a report of the proceedings. It will be useful for fishworkers, non-governmental organizations, policymakers, trade unions, researchers and others interested in natural resource management and coastal and fishing communities.
