Relativity in legal writing

In this article, we discuss the linguistic variation in the coding of relativity in the Portuguese language. The theory of Variation and Change (Labov, 1972) provided the basis for this study. We analyzed 40 texts of legal writing, which contained between 5 and 15 pages, selected by the following criteria: type of activity, age and gender of the lawyers. We obtained 64 pieces of information, of which 34.4% refers to the occurrence of non-standard relative clauses and 65.6% to the forms prescribed by the normative grammar. As aspects of linguistic basis, we controlled the syntactic function of the relative clause, its position in the sentence as well as the presence or absence of intervening material in the sentence. We noted that although the forms considered standard still remain in monitored writing, it is now possible to notice a significant frequency of forms that go against grammatical textbooks, what can point to a linguistic change in progress.

Neste artigo, tratamos da variação linguística na codificação da relativização em Português. Elegemos como variável dependente as relativas em variação x forma padrão [preposição + relativo]. Consideramos como formas em variação tanto a relativa com pronome cópia, a cortadora e os usos de onde com valores diferentes do prescrito na gramática normativa, qual seja, locativo espacial. Deu suporte teórico ao estudo a Teoria da Variação e da Mudança (LABOV, 1972). Analisamos 40 textos da escrita jurídica, os quais tinham entre 5 e 15 páginas, selecionados pelos seguintes critérios: tipo de ação, idade e sexo dos(as) advogados(as). Dos textos, obtivemos 64 dados, dos quais 34,4% referem-se à ocorrência de orações relativas não padrão e 65,6% às formas prescritas pela gramática normativa. Como fatores de natureza linguística, controlamos a função sintática da oração relativa, sua posição no período, bem como a presença ou a ausência de material interveniente na sentença. Constatamos que, embora as formas ditas padrão ainda predominem na escrita monitorada, já se verifica uma frequência significativa de registros que contrariam os compêndios gramaticais, o que pode apontar para uma mudança linguística em processo.
