The city of Marion has applied to the Illinois EPA for Section 401 water quality certification to construct a 1,172 surface acre, raw water impoundment reservoir on Sugar Creek, southeast of Creal Springs, Williamson County, Illinois. This proposal and the impacts are described in the Final EIS, DSI, and DSII. The proposed project will involve the construction of a reservoir on Sugar Creek and the mitigation for affected wetlands and jurisdictional waters of the United States. ... "Under Section 401 of the Clean Water Act, the Illinois EPA must determine whether the activities as demonstrated in the federal permit application would meet state water quality standards. The applicant obtains this certification or denial by requesting that the Illinois EPA conduct a review of the permit application to ensure compliance with Illinois water quality rules and regulations. The overall purpose of Section 401 is to assure that permits issued by the U.S. ACOE do not result in a violation of the water quality requirements of the State of Illinois."--p. 4.
